In compliance with the above-dated Invitation to Bid and Instructions to Bidders, the undersigned hereby proposes to perform all work for in strict accordance with the following: 1. JPL Firm Fixed-Price Construction Subcontract format (JPL 1689). 2. The Specimen Subcontract including all Exhibits and Specifications. 3. Bid Form Schedule of Bids.

Receipt of Amendments: The undersigned acknowledges receipt of the following amendments of the Invitation to Bid and Instructions to Bidders, drawings, and/or specifications, etc. (give number and date of each):

The undersigned agrees that, upon JPL’s written acceptance of this Bid (via Notice of Award), mailed or otherwise furnished, within calendar days after the date of opening of Bids the Subcontractor will within calendar days (unless a longer period is allowed) execute a Construction Subcontract (JPL Firm Fixed-Price Construction Subcontract, form JPL 1689), and give performance and payment bonds, if such Subcontract exceeds $150,000, on JPL-supplied forms with good and sufficient surety.

The undersigned agrees, if awarded the Subcontract, to commence the work within five calendar days after the date of receipt of written Notice to Proceed and to complete the work within calendar days after the date of receipt of written Notice to Proceed.

Note: The base Bids and any alternate Bids shall be lump sum amounts, include all costs, including all elements of cost, insurance bonds and taxes. The Bid shall not include exceptions or advance understandings of any nature. Failure to adhere to this requirement may render your bid nonresponsive.

The lowest bidder shall be the bidder offering the lowest amount (price) for the Highest Priority Bid which is within the available funds internally identified/earmarked by JPL prior to issuance of the ITB. If no bid is within the available funds identified/earmarked by JPL prior to issuance of the ITB, the lowest bidder shall be the bidder offering the lowest bid for the Lowest Priority Bid (i.e., the Base Bid). JPL reserves the right to make no award.

JPL may award a subcontract to the lowest bidder, provided it is determined to be responsive and responsible and funds are available at time of award. The subcontract may cover work for any Priority Category Bid which is within the available funding at time of award (which may be more or less than the available funds internally earmarked/identified by JPL prior to issuance of the ITB), provided the bidder is also lowest for that Category awarded.

Bidders are required to complete and submit the “Experience Modification Rate and Recordable Incident Rate/Lost-Time Incident Rate” Form 2899-A33 (Attachment A-33) as part of their bid. This data will be reviewed by the JPL Occuptational Safety Program Office (OSPO) for acceptability. JPL strives to ensure that all Subcontractors have a current workers’ compensation EMR of 1.0 or lower. A Subcontractor, on an exception basis, may be eligible to perform work at JPL with an EMR greater than 1.0; however, JPL may require additional documentation, which includes, but is not limited to, a written plan of action to address the Subcontractor’s unfavorable EMR as well as a detailed hazard assessment relative to the proposed scope of work. All requests for an exception will be at the discretion of JPL’s OSPO, which will provide a technical review of all deliverables relative to safety and health. Should JPL find the EMR to be unacceptable, the Subcontractor’s bid will not be accepted.
