REDEPLOYMENT AND REDUNDANCY POLICY STATEMENT

This policy statement outlines the ACT Public Service’s policy with respect to the redeployment and management of excess officers, providing specific advice on changes to the minimum redeployment period for an actually excess officer.

APPLICATION

1. This advice applies to all ACT Public Service (ACTPS) directorates and any permanent officer deemed to be excess (potential or actual).

REDEPLOYMENT AND REDUNDANCY PROCESS 2. The ACT Government has committed to no forced redundancies. 3. In keeping with this commitment, the ACTPS recognises the important role of redeployment initiatives in managing its workforce. 4. In accordance with the Enterprise Agreement and this Policy, directorates are required to: 4.1 consult with unions as to any proposed changes that would lead to a potentially excess officer(s) prior to any individual employee(s) being identified; 4.2 make every effort to redeploy excess officers (potential or actual) at level within the directorate and across Government, including by providing officers deemed to be excess the opportunity to seek redeployment; 4.3 only make an offer of voluntary redundancy to an actually excess officer where there is documentary evidence that: 4.3.1 management has discussed redeployment options and recommended the officer seek financial advice; 4.3.2 the officer understands the effect of accepting a redundancy; and 4.3.3 the officer and the directorate genuinely agree to proceed to redundancy without further pursuing redeployment options. 5. Redeployment and/or the redundancy process, including consultation and provision of information to employees, must be undertaken in accordance with Section K of the Enterprise Agreement.

An officer to whom an offer of redundancy is made must be provided with the minimum consideration periods stipulated in sub clause K5.3. A lesser consideration period can only apply if conditions within sub clause K5.4 are met.

Redeployment timeframes 7. Where the directorate declares an officer actually excess, an offer of voluntary redundancy may be made to that officer with no minimum redeployment period if that officer does not want to be redeployed, or the officer has specialist skills and redeployment to another part of the ACTPS is not possible. 8. REVIEW

9. This advice will be reviewed in twelve months to reflect arrangements following the review of the Public Sector Management Act 1994.
