P R E C A R I U M

concluded between

1. the Roman-Catholic parish …...... hereinafter briefly referred to as Grantor, on the one hand and

2. …...... hereinafter briefly referred to as Grantee, on the other hand, as follows:

1.2 The Grantee is a person seeking asylum / person entitled to subsidiary protection / recognised refugee / ………………………………..

1.3 The object of this contract are the premises outlined in the attached plan (appendix ./A) …..... in the aforementioned building with a size of …...... m², hereinafter briefly referred to as Granted Object.

The Grantee is familiar with the Granted Object after having inspected it.

Page 1 Only the interior of the Granted Object shall constitute the object of this contract.

It is noted that the furnishings specified in the attached inventory (appendix ./B) shall be made available for use as well.

1.4 The Granted Object may only be used for residential purposes. Any change of the intended use shall require the express consent of the Grantor.

II.

The grant relationship shall commence on …...... and may be revoked at any time without stating reasons.

The Grantee expressly acknowledges that no security of tenure and/or guarantee for a certain duration of the use shall be linked to the Granted Object provided on loan, subject to revocation at any time.

Upon termination of the grant relationship, the Grantee must return the Granted Object to the Grantor in a condition as received, taking into account wear and tear resulting from normal and careful use, cleaned and cleared of non-granted movables, with all keys.

III.

The Granted Object shall be made available for use free of charge.

The Grantee shall bear the share of operating and heating costs allotted to the Granted Object as well as operating costs such as electricity, gas, telephone, cable TV and the like incurred by the Grantee. For the pro-rata share of operating and heating costs as well as electricity and gas, a monthly flat rate of € …...... shall be set, payment of which shall be due to the Grantor on the fifth day of each month.

IV.

The Grantee shall be obliged to treat the Granted Object with care and ensure greatest possible protection of the structure, and to use the Granted Object without disturbing anyone with undue noise.

Animal keeping in the Granted Object shall be admissible only for species-appropriate keeping of a normal number of harmless household pets and small animals usually kept in apartments.

Page 2 The Grantee shall not be allowed to install equipment of any kind that does not comply with the safety provisions applicable at the relevant time; in particular electricity and gas equipment that does not comply with Austrian safety standards must not be installed.

Compliance with the house rules shall be mandatory.

The Grantor as well as people commissioned by the same shall be entitled to inspect the Granted Object upon timely advance announcement. In case of imminent danger, no advance announcement shall be necessary.

Without the Grantor's express consent, the Grantee shall not be entitled to transfer the Granted Object to third parties for use, whether in part or in full, for valuable consideration or gratuitously.

V.

Amendments to the Granted Object desired by the Grantee shall require the express consent of the Grantor.

VI.

The Grantee shall be liable for all damage incurred as a result of improper treatment or treatment of the Granted Object otherwise contrary to the agreement through her/his own fault and/or any fault of a person to whom she/he had granted or allowed access to the Granted Object.

VII.

No oral side-agreements have been concluded apart from this agreement.

To be valid, this agreement shall require approval by the archiepiscopal ordinariate.

Three copies of this agreement shall be produced, so that accordingly each contracting party as well as the Legal and Property Affairs Office of the Archdiocese of Vienna shall receive one copy.
