RESIDENTIAL APARTMENT LEASE AGREEMENT For ______(Street) ______(City,State, Zip)

IN CONSIDERATION of their mutual promises, ______(Lessor, or Owner), whose address is ______and ______(SS#______) (LESSEE/RESIDENT) agree as follows:

1. PREMISES, The Owner leases to the Resident, a ______bedroom apartment at: ______

2. TERM AND RENEWAL. The term of the lease will commence on ______and subject to the renewal provisions, will terminate on ______. If the Resident remains in possession of the lease property after expiration of the original terms of this agreement, such possession shall be as a month to month tenant under the same terms and conditions of this agreement, except that Owner may increase the amount of the monthly rent to be paid or change terms upon thirty (30) days prior written notice to Resident. The month to month tenancy may be terminated by either party on the last day of any month, upon thirty (30) days prior written notice.

3. RENT AND PAYMENT. The Resident will pay as rent the sum of ______Dollars and ______Cents ($______) payable in 12 consecutive equal monthly installments of ______Dollars and ______Cents ($______), due on or before the 1st day of each month (Postmark of 1st day of month or earlier will be used for this purpose).

Any rent received postmarked after the 1st calendar day of the month must be accompanied with a $50.00 late fee. In addition, if the Resident has a check returned by their bank, the Resident must redeem the check within 24 hours after notice of its return and pay $50.00 plus applicable late fees from the late charge date until acceptable payment is received by the management office. Checks will not be resubmitted. Payment received will be applied in the following order: property damages, bad check charges, late charges, delinquent rent, pet fees, and the balance to current rent, no matter what may be specified on the memo portion of the check. If rent is not received by the 5th calendar day of the month a “3 day notice to vacate premises” will be issued. If resident does not comply with the “Notice to Vacate Premises” an eviction will be filed. Tenant will be responsible for fees associated with the eviction including but not limited to Rent, Eviction Cost and Court Costs Any additional residents not listed by name in this lease are subject to an increase in rent of $75.00 per month. The owner may increase the rent during the term of the lease to reflect any increase in the common utilities, taxes and assessments paid for by the Owner.

4. SPECIAL PROVISIONS:

5. DEPOSITS. $______received as deposit at lease signing. Balance of $______received at move in date. Resident shall pay ______Dollars ($______) as a security deposit to secure the performance of all terms of this agreement. If the Resident fails to perform the terms of this agreement, Owner may deduct any amounts owed from the security deposit. Resident shall be liable for any monies owed to Owner which exceed the security deposit. Within 14 days after the termination of this agreement, subsequent agreements, month to month tenancies and vacating, and if Resident provides Owner in writing a forwarding address, the Owner will prepare a written statement of security deposit disposition in which there will be written itemization of any deductions from the security deposit (if any) and a refund to the Resident of the Balance, if any, of the security deposit. SECURITY DEPOSIT IS NOT A SUBSTITUTE FOR THE LAST MONTHS RENT. LAST MONTHS RENT MUST BE PAID IN FULL. Rent will not be pro-rated at move out.

6. APARTMENT CONDITIONS/INSPECTIONS/SECURITY. Resident has inspected the apartment and the apartment building complex and accepts them as of move in date. Resident acknowledges that the premises are in good condition at the commencement of the lease. If the Owner provides any storage area to the Resident, Resident will store non-hazardous and non-flammable materials and Resident will store items at Resident's own risk. This agreement shall in no way be construed to be or infer to be a guarantee of the Resident's security and Resident agrees to rely solely on Resident's own insurance to protect resident in this area. Basements and garages are to be considered such storage areas.

7. UTILITIES. It shall be the Resident's obligation to have non-furnished utilities (Gas & Electric) placed in his/her name prior to occupancy, and to have final readings taken upon vacating. Resident shall pay for all utilities except water. There shall be no diminution or abatement of rent or any other compensation for interruption or curtailment of any "service" or utilities which Owner agrees to provide, when such interruption

0ce2b9ba7dc781ac3ff03af5e791d6ab.doc Page 1 of 5 Initial & Date______01/09/18 or curtailment shall be due to accidents, alterations, or repairs desirable or necessary to be made, or to inability or difficulty in securing supplies or labor for maintenance of such service, or to some other cause beyond Owner's control.

8. REPAIRS. Owner will perform necessary repairs or replacements to be made at it's own expense whenever such repairs are deemed necessary by Owner due to normal wear, obsolescence, or mechanical equipment of the premises to Owner. Resident must pay for all maintenance exceeding normal wear and tear to all fixtures including toilets, disposals, sinks, tubs and drain lines when such maintenance is required due to residents or there invitees neglect including , example, resident's or invitee's flushing of foreign items (disposable diapers, sanitary napkins, grease, etc.). Resident must also pay for all damage to the property exceeding normal wear and tear. No diminution or abatement of rent or other compensation shall be claimed or allowed for inconvenience or discomfort arising from repairs or improvements made to buildings or its appliances, nor for any space taken to comply with any law, or ordinance, or order or government authority, no matter the cause.

9. USE. Resident agrees to use the premises solely as a private residence for the occupant's use and that no other person other than those on the application will occupy premises, unless there is prior written approval by the Owner.

10. PETS. No pets, except guide dogs for the handicapped, may be brought onto any part of the apartment community without Owner's prior written consent.

11. AUTO PARKING. One outdoor space in side lot is provided.

12. ALTERATIONS AND IMPROVEMENTS. The Resident shall make no alterations or improvements (for example, but without limitation painting, wallpapering, permanent shelving, floor covering, the change of locks, or addition of fastening devices to the door) to the premises without obtaining Owner's written consent. All alterations, additions, or improvements made in and to said premises shall become the property of the Owner. At the option of the Owner, all improvements shall remain.

13. OBLIGATIONS OF RESIDENT. Resident will comply with all applicable laws, rules, and regulations promulgated by any governmental authority having jurisdiction. Prosecution or conviction of drug trafficking, prostitution or other serious crimes by Residents or invitees shall be considered reasonable grounds for lessor to terminate this lease with thirty (30) days prior written notice. The Resident will observe all rules and regulations made by the Owner in effect at the execution and delivered with this lease, and any made or modified during the term of this lease and delivered to the Resident or Owner's residence. Resident agrees to: (A) Keep that part of the premises that he/she occupies and uses safe and sanitary. (B) Dispose of rubbish, garbage and other waste in a clean, safe and sanitary manner in prescribed containers provided. Resident is responsible to take their own containers to curb on the correct evening. (C) Keep all plumbing fixtures in the apartment unit or used by Resident as clean as their conditions permit. (D) Use and operate all electrical and plumbing fixtures safely and properly. (E) Comply with requirements imposed by all applicable state and local housing, health and safety codes. (F) Personally refrain, and forbid any other person who is on the premises with tenant's permission, from intentionally or negligently destroying, defacing, damaging or removing any fixtures, appliance, or other part of the premises. (G) Maintain in good working order and condition any range, refrigerator, washer, dryer, dishwasher, or other appliance or other part of premises as provided. (H) Conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighbor's peaceful enjoyment of the premises. (I) Use good judgment and thoughtfulness for others in use of his/her apartment. (J) Not to commit any waste or nuisance in or about said premises. (K) Not to in any way annoy, molest or interfere with any other Residents or occupants. (L) Not to use on a wasteful, unreasonable or hazardous manner any utilities furnished by the Owner. (M) Confine play activities of children to designated play areas. Children may not play or loiter in basements, laundry areas, stairways, hallways, doorways, parking areas or other designated areas. (N) Not to in any way be detrimental to the reputation of the apartment community. (O) n/a (P) Return all recreational facility passes, entry keys, mailbox keys to Owner at time of move-out as applicable. All keys not returned will be accesses and replacement cost of $30.00 per key. (Q) A minimum charge of $60.00 for lockouts during business hours and $70.00 between the hours of 6:00 PM and 7:00 AM and on Holidays. (R) Not to have waterbeds. (S) Smoke Alarms - Resident shall maintain any smoke detectors and fire extinguishers which have been provided in the unit and shall keep the unity fully operational and replace any old battery with a manufacturer's recommended battery as applicable. (T) To be responsible for the conduct and actions of their children, invitees or children of their invitees. (U) All light fixtures have bulbs at time of move in, it is the tenants responsibility to maintain these fixtures. Any bulbs missing at move out will be paid for out of the security deposit. (V) Do not apply any stickers or decals to appliances, walls, doors, etc. (W) Just be a generally good person, please.

14. INJURIES OR DAMAGES. Resident to provide renter’s insurance for their personal property to safeguard against personal loss. Neither the management nor the Owner of the apartment community shall be liable to the Resident for any loss or damage of Resident's effects for any reason outside of owners control. Resident, his/her family, or guests agrees to hold management and owner harmless for any damages or claims arising by reason of events outside of owners control.

15. BREACH. In the event the Resident breaches any of the terms of this lease, Owner may reclaim the apartment by any method permitted by law, including litigation. Resident remains liable for any and all damages stemming from said breach including all rents due on the balance of this agreement and repairs necessary to restore the apartment to rentable condition.

0ce2b9ba7dc781ac3ff03af5e791d6ab.doc Page 2 of 5 Initial & Date______01/09/18 16. POSSESSION. If there is a failure to deliver possession of premises at the time agreed herein, Owner shall return the deposit to Resident and Owner will not be liable for any further damages.

17. ABANDONMENT. If Resident's occupancy appears to indicate abandonment from and of the premises for five (5) consecutive days, while all or any portion of the rent is unpaid, it shall be deemed abandonment of said premises, and his residence at management's option may immediately terminate without further notice. All contents of the apartment become property of the landlord Apartment may be re-rented without any liability of Owner to Resident whatsoever.

18. TRANSFERABILITY AND COST OF COLLECTION. Resident may not sublet or assign this lease without prior written consent of Owner. In the event suit is necessary to enforce any of the provisions herein contained, or to recover possession, Resident agrees to pay all court fees, delinquent amounts, and damages.

19. OTHER COVENANTS. Resident's Application to Rent, and Community Policies, and Rules and Regulations, current and future are agreed to be part of this lease; and, the terms, conditions, and representations shall be binding upon their heirs. Any false, statement or other misrepresentations on said application may be grounds for termination of this lease at the option of the Owner.

20. RIGHT OF ENTRY. Management reserves the right to inspect all apartments with 24 hours notice and Resident agrees that management may show apartment to prospective applicants during the thirty (30) or sixty (60) day notice to vacate period at reasonable times without prior notice. Owner agrees that no employee shall enter the premises for the purpose of making repairs, alterations or inspections unless the Resident or an adult member of the Resident's household is present, or unless prior permission to enter has been granted or twenty-four hour notice has been given to Resident. In the case of emergency, Resident agrees that such prior permission shall not be required.

21. NOTICES. Any notice to be given by either party to the other shall be in writing, either delivered personally, or sent by U.S. mail, prepaid, to the Resident at the leased addresser management as applicable.

22. OWNER'S REPRESENTATIVE. Owner appoints the site manager or property manager, if applicable, as it's duly authorized agent to manage the premises and to act for the purpose of service of process and for the receiving and receiving all notices and demands. However, Resident agrees not to look to manager or property manager of any liability. Any liabilities will solely rest with the Owner.

23. SEVERABILITY. If any provision in this lease shall be deemed invalid by judgment or court order, all other provisions shall remain in full force and effect.

24. JOINT LIABILITY. "Resident" when used in this lease shall be construed to be plural of more than one person to this lease, and "Resident" shall be jointly and severally liable and obligated to perform all terms, conditions, and covenants contained in this lease.

25. WAIVER. One or more waivers of any covenants, condition, rule or regulation by Owner shall not be construed as a waiver or a further breach of the same.

26. CAPTIONS. The captions are inserted only as a matter of convenience and for reference and in no way define, limit or describe the scope of this lease nor the intent of the provisions thereof.

27. CABLE TV. The premises is completely wired for cable at this time. Any additional Cable installation or changes requires owner’s written permission and presense onsite for such installation.

28. WATERBEDS. No waterbeds are allowed on premises.

29. SMOKING. Applicable laws apply.

30. BED BUGS. Owner has fully treated this building, and at time of rental, this unit is bed bug free. Resident is being supplied with literature detailing bed bugs. If resident carries bed bugs into premises, requiring treatment of this unit, owner will conduct treatment. Resident is obligated to aid in bed bug treatment, including but not limited to, furniture removal, clothes cleaning/storage, and any means deemed necessary by extermination company of owner’s choice. Any future treatment costs incurred relating to this unit will be deducted from security deposit, as necessary.

31. ENTIRE AGREEMENT. This lease, together with any addendum attached and with the Owner's rules and regulations and any other covenants, conditions, addendum and agreements, which by reference herein are made a part of this lease, constitute the entire Agreement and there are not other agreements, oral or written, pertaining to this lease.
