In accordance with the California Penal Code 243.5 P.C. and 415.5 P.C. And The California Education Code 48900 (a) and 48900 (k)

Creekside High School and the Murrieta Police Department will take an aggressive approach to inform students in conflict with each other the about the severity of fighting on a school campus. This will be done by informing each student of the violations and consequences of the California Penal Code and the California Education Code. This will assist in ensuring a safe campus for all students.

243.5 P.C. “Assault or Battery on school property; arrest without warrant”  When a person commits an assault of battery on a school property during hours when school activities are being conducted, a peace officer may, without a warrant, arrest the person who commits the assault and battery.

415.5 P.C. “Disturbance of peace of school…”  Any person who (1) unlawfully fights within any building or upon the grounds of any school; (2) Maliciously and willfully disturbs another person within any of these buildings or upon the ground by loud and unreasonable noise or (3) Uses offensive words within any of these buildings or upon the grounds which are likely to provoke an immediate violent reaction is guilty of a misdemeanor punishable by a fine not to exceed $400.00 or by imprisonment in the county jail for a period of not more than 90 days or both.

48900 E.C. A pupil shall not be suspended from school or recommended for expulsion unless the superintendent or the principal of the school in which the pupil is enrolled determines that the pupil has:  (a) Caused, attempted to cause or threatened to cause physical injury to another person.  (k) Disrupted school activities or otherwise willfully defied the valid authority of supervisors, teachers, administrators, school officials or other school personnel engaged in the performance of their duties. I am aware of the serious consequences that can occur if an assault or battery occurs. I am also aware that in order to avoid and assault or battery, I can contact school officials to assist in resolving the problem. This will prevent criminal and education code violations and the possibility of being suspended, expelled or arrested.
