ENNIS CITY COMMISSION MEETING MINUTES REGULAR MEETING TUESDAY, MAY 2, 2017 6:00 P.M.

CALL TO ORDER

Mayor Juenemann called a regular meeting of the Ennis City Commission to order on Tuesday, May 2, 2017 at 6:00 P.M. in the City Commission Chambers of Ennis City Hall, 115 W. Brown Street, Ennis Texas 75119.

INVOCATION AND PLEDGE OF ALLEGIANCE

Assistant Police Chief David Anthony offered the Invocation. Mayor Juenemann led the Pledge of Allegiance

ROLL CALL

PRESENTATIONS

Mayor Juenemann read a Proclamation declaring May 2017 as Motorcycle Awareness Month in the City of Ennis and presented the Proclamation to members of the ‘Guardians of the Children’ motorcycle club.

City Manager Scott Dixon recognized four new Public Works employees.

City Manager Dixon presented the Quarterly Financial Report for the period January 1, 2017 – March 30, 2017, highlighting general fund revenues for the fiscal year are at 75%; economic development revenues are at 94%; and water/sewer and sanitation revenues are slightly down. Expenditures were reviewed as well stating that general fund expenditures are below the 50% mark; non-departmental expenditures are higher; and revenues are higher than expenditures at quarter end.

COMMISSIONER UPDATES

Commissioner Searcy thanked everyone for the turnout at the Candidate Forum held by the Chamber of Commerce.

CONSENT AGENDA

1. Approval of the April 16, 2017 City Commission Regular Meeting Minutes.

2. Accept the Quarterly Financial Report for January 1, 2017 – March 31, 2017.

3. Approval of a Public Facilities Use Application submitted by the Rotary Club of Ennis for the Ennis Polka Fest Run on May 27, 2017 from 5 AM to 11 AM.

4. Approval of a Public Facilities Use Application submitted by the Damascus Road Fellowship for an event to be held on Sunday, May 7, 2017 from 8 AM to 1 PM at 116 W. Ennis Avenue. Mayor Juenemann read the Consent Agenda item. Commissioner Hejny made a motion, seconded by Commissioner Hernandez, to approve the consent agenda. A vote was cast, 7 in favor, 0 against. Motion passed.

PUBLIC HEARING

5. Conduct a public hearing and a second reading of an Ordinance approving Project Demolition II, an Economic Development Corporation project whose purpose is to provide funding to partially demolish 201 NW Main and completely demolish 108 W. Milam; amend the EEDC FY17 budget to provide $175,000 to fund the project and authorize the EDC President to execute any and all documents necessary to complete the action. Mayor Juenemann read the item and opened the Public Hearing. No one spoke and the Public Hearing was closed.

6. Conduct a public hearing to consider amending the Zoning Ordinance of the City of Ennis, Texas from “R-7” Single Family District to “D” Dwelling District (Duplex and Townhouse) for III Cardinals, L.P. at 2907, 2905, 2903, and 1300 Cardinal Dr. Mayor Juenemann read the item and opened the Public Hearing. No one spoke and the Public Hearing was closed.

INDIVIDUAL ITEMS FOR CONSIDERATION

7. Discuss and consider an Ordinance approving a Type B Economic Development project (Project Demolition II), and amending the Ennis EDC FY17 Budget to provide $175,000 to fund the project. Mayor Juenemann read the item. Mayor Pro Tem Walker made a motion, seconded by Commissioner Pruitt, to approve the Ordinance as read. A vote was cast, 7 in favor, 0 against. Motion passed.

8. 9. Discuss and consider an Ordinance authorizing and approving a comprehensive policy for administering Chapter 380 agreements. Mayor Juenemann read the item. City Attorney McDonald stated that the presented Ordinance should be amended to include in the caption, ‘providing for the dedication and contribution of land as a possible incentive’. Mayor Pro Tem Walker made a motion, seconded by Commissioner Hejny, approve the Ordinance with the recommended amendment to the caption ‘providing for the dedication and contribution of land as a possible incentive.’ A vote was cast, 7 in favor, 0 against. Motion passed.

EXECUTIVE SESSION

14. Ennis City Commission shall convene into closed Executive Session pursuant to:

a. Texas Government Code, Section 551.071; consultation with the City Attorney on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act regarding:  Separation Agreement with Human Resources Director  Annexation b. Texas Government Code, Section 551.072; deliberations regarding Real Property:  Land Acquisition for Fire Department  Disposition of City Owned Property c. Texas Government Code, Section 551.074; to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee:  Human Resources Director

Mayor Juenemann recessed the Commission into Executive Session at 6:36 P.M.

Mayor Juenemann reconvened the Commission into Open Session at 7:26 P.M.

Possible action as a result of the Executive Session. No action taken

ADJOURNMENT With no other business before the Commission, Mayor Juenemann declared the meeting adjourned at 7:27 P.M.
