Ohio Association Family, Career & Community Leaders of America CONSTITUTION AND BYLAWS

Article I Name - Sponsor - Mission - Purpose - Definitions

Section A. Name: The name of this organization shall be the “Ohio Association of Family, Career & Community Leaders of America” (FCCLA). Members of the Association are Family, Career & Community Leaders of America chapters affiliating with the state FCCLA and national FCCLA organization. Members of these chapters are hereinafter referred to as FCCLA. The letters FCCLA will be officially used to designate the organization, its sections or members thereof. Section B. Sponsor: The sponsor of the organization shall be the Family and Consumer Sciences Division, Ohio Department of Education. The state headquarters shall be located in the Family and Consumer Sciences Division, Office of Career-Technical Education, Ohio Department of Education. Section C. Mission: The mission of the Ohio Association of FCCLA and National Family, Career and Community Leaders of America is to promote personal growth and leadership development through Family and Consumer Sciences education. Focusing on the multiple roles of family member, wage earner and community leader, members develop skills for life through:  Character Development  Creative and Critical Thinking  Interpersonal Communication  Practical Knowledge  Career Preparation Section D. - Purposes: Organized instruction relating to the mission is a part of the FCS education program in the school. The purposes of the organization shall be: 1. To provide opportunities for personal development and preparation for adult life. 2. To strengthen the function of the family as a basic unit of society. 3. To encourage democracy through cooperative action in the home and community. 4. To encourage individual and group involvement in helping achieve global cooperation and harmony. 5. To promote greater understanding between youth and adults. 6. To provide opportunities for making decisions and for assuming responsibilities. 7. To prepare for the multiple roles of men and women in today’s society. 8. To promote Family and Consumer Sciences and related occupations.

Section E. Definitions: 1. State Executive Council (SEC) - students elected as state officers to represent FCCLA at the state level. 2. Regional Executive Council (REC) - students elected as regional officers to represent FCCLA at the regional level.

Page 1 6/2/2018 3. District Executive Council (DEC) - students elected as district officers to represent FCCLA at the district level. 4. Local Executive Council (LEC) - students elected as local officers to represent FCCLA at the local level. 5. Officer(s) - student(s) elected to serve at the state, regional, district and local level of FCCLA. 6. Ohio Department of Education (ODE) 7. Family and Consumer Sciences (FCS) - subject matter licensed teacher 8. Workforce Development (WFD) - workforce development career fields related to FCS 9. Adviser(s) - licensed educator in FCS or related WFD career field 10. State Adviser(s) - licensed educator in FCS employed and appointed by the Ohio Department of Education to serve as official designee to FCCLA. 11. State Executive Council Adviser(s) (SECA) - licensed educator in FCS or related WFD career field in the school from which the state student officer elected and shall serve as members of the state executive council advisers. 12. Regional Executive Council Adviser(s) (RECA) - licensed educator in FCS or related WFD career field in the school from which the regional student officer elected and shall serve as members of the regional executive council advisers. 13. District Adviser(s) - licensed educator in FCS or related WFD career field in the school from which the district student officer elected and shall serve as members of the district executive council advisers. 14. Local Adviser(s) - licensed educator in FCS or related WFD career field in the school from which the local student officer elected and shall serve as members of the local executive council advisers. 15. Board of Directors (BOD) - One (1) Culinary Teacher, One (1) Early Childhood Education Teacher, One (1) Lodging Teacher, Ten (10) FCS Teachers (1 from each region), Three (3) State Officers, One (1) Past State Officer, One (1) Endowment Chairperson, One (1) Representative from the Alumni and Associates, State Parent(s), One (1) FCS Supervisor, One (1) FCCLA State Adviser, One (1) ODE FCS Consultant, One (1) ODE Assistant Director Pathways, Programs and Services 16. Voting delegates shall be active members authorized by the chapter which they represent to cast its official vote on any issues. a. Each chapter may be entitled to voting delegate(s) on the following FCCLA membership: i. 20 or less members - 1 delegate ii. 21-40 members - 2 delegates iii. 41-60 members - 3 delegates iv. 61-80 members - 4 delegates v. 81-100 members - 5 delegates b. Middle School Dues - Chapters shall be counted for voting delegate purposes as 50 members entitled to three voting delegates. c. Urban Chapter Affiliations shall be accounted for up to ten (10) voting delegates. d. High School Dues - Chapters shall be counted for voting delegates purposes as to 50 members entitled to three (3) voting delegates.

Article II - Organization Page 2 6/2/2018 The Ohio Association of FCCLA is a chartered State Association of the national organization of FCCLA. Ohio FCCLA shall be composed of chartered local chapters within the state. 1. Active chapters of the Ohio Association FCCLA shall be chartered in schools where FCS instruction is offered. This shall include related career technical and non-career technical programs. 2. New chapters wishing to organize shall send to the appointed State Adviser(s) for information and material, adopt a constitution not in conflict with the state constitution and national Bylaws, elect officers, set up a program, and send dues and application to Ohio FCCLA Headquarters. 3. There shall be two types of chapters: a) FCCLA chapters that emphasize Family and Consumer Sciences, b) FCCLA WFD chapters that emphasize career tech career fields.

Article III - Membership

Types of membership in this organization shall be as follows: 1. Active Membership: Any student who is taking or has taken a course in FCS and/or related WFD through grade 12 shall be eligible for active membership in an organized chapter within the school. Active members shall be eligible to hold office, to make motions and to vote. Active member to be in good standing shall: a. Attend chapter meetings with reasonable regularity b. Participate in the activities of the chapter c. Pay dues regularly 1. Honorary Membership: Honorary memberships may be awarded in the State Association and local chapters. Any adult who has rendered outstanding service to the Ohio Association of FCCLA by advancing its purposes may be selected for honorary membership in the State Association in accordance with procedures adopted by the State-SEC and State-BOD. Honorary membership shall be perpetual. Honorary members have the privilege of attending all meetings of the organization without vote. The awarding of honorary membership shall be at the discretion of the State and Local Executive Councils. 2. Alumni Membership: Former FHA, NHA (New Homemakers of America), HERO, or FCCLA Chapter members desiring to continue support of and involvement with the organization following high school graduation shall be eligible for alumni membership. Alumni members shall not be eligible to hold office, make motions or vote. 3. Associate Membership: Adults who share the goals and purposes of FCCLA and its programs and who wish to support the continuing development of FCCLA youth shall be eligible for Associate membership. Associate members shall not be eligible to hold office, make motions, or vote. 4. Post-Secondary Membership: Postsecondary members are eligible if they are enrolled in a post-secondary program (grades 13-16 in career and technical education centers, career and technical adult education centers, community colleges, and four-year colleges and universities). Members may compete at the national FCCLA leadership conference.

Page 3 6/2/2018 Article IV - Procedure for Determining Standing of Local Chapters

A chapter shall be considered in good standing annually when the following conditions are met: 1. National and state dues are paid to the Ohio Association of FCCLA on a date designated by the State BOD. 2. Local constitution is in accordance with the National and State Constitutions and Bylaws. 3. In order to participate in STAR Events at Regional, State or National level, dues are to be paid no later than March 1. 4. Chapters must affiliate by December 1 in order to be eligible for Outstanding Chapter Award. The names of officer candidates, STAR Event participants, State Degree candidates, and Power of One candidates must be listed as having paid their dues.

Article V - Finances

Section A. - National & State: Annual membership dues in the State Association shall be fixed by the State BOD, upon recommendation of the State SEC and is subject to approval by a majority vote of the delegates. Both state and national dues must be paid to be an active member. Membership dues shall be sent to the Ohio office on the date determined by the State BOD. Section B. - Chapter Dues: The dues of any chapter shall be fixed by the LEC subject to a majority vote of the membership of that chapter. Section C. - Fiscal Year: The fiscal year for FCCLA shall be July 1 through June 30. Section D. - Financial Review: The financial statement of all income and expenditures prepared by the State Adviser shall be reviewed annually.

Article VI - State Executive Council (SEC)

Section A - The designated super regions for officer elections will be determined by the State BOD. These regions will be composed of districts. The districts will be designated as CTPD’s and will consist of local affiliated FCCLA chapters. Each local school district may submit two state officer candidates. 1. State SEC will be comprised of ten (10) FCS state officers and three (3) WFD state officers 2. The ten (10) FCS state officers will be made up of five (5) officers from super regions and five (5) officers at-large Section B - Qualifications 1. SEC members shall have the following qualifications: a. Currently an active member in an affiliated chapter and has been an active member in good standing for at least one year b. A minimum of one year of comprehensive occupational FCS classes c. Required accumulative 3.0 GPA on a 4 point grading scale. d. Work cooperatively and easily with an unfamiliar group: and able to express themselves well orally and in writing e. Have knowledge of parliamentary procedure according to Robert’s Rules of Order Section C - Election Procedures Page 4 6/2/2018 1. Nominees for state officers should complete the state officer application, secure a copy of their official school transcript and submit to Ohio FCCLA by deadline 2. All nominees will be interviewed by State BOD guidelines 3. Elections will take place following the interview process and state FCCLA leadership conference following the guidelines established by the State BOD 4. Ten (10) officers will be elected by FCS voting delegates. Up to three (3) qualified WFD officers will be elected by WFD voting delegates. 5. Announcement and installation of state officers shall take place at state FCCLA leadership conference Section D - Responsibilities 1. State Officers will be comprised of qualified FCS candidates. One from each super region as defined by the State BOD and an additional FCS candidate up to ten (10) state officers. 2. State Executive Council (SEC) The offices of the Ohio Association of FCCLA shall be: a. President, Vice-President of State Programs, Vice-President of National Programs, Recording Secretary, Vice-President of Public Relations, Corresponding Secretary, Vice-President of Ohio FCCLA Endowment, Vice- President of Membership and any other offices deemed appropriate by the State FCCLA Adviser b. All State Officers shall represent their regions at state meetings and shall assist in direction of any regional meetings c. Three officers shall serve on the State BOD with voting privileges d. The elected State Officers shall compose the State SEC

Article VII - Regional Executive Council (REC)

Section A - The designated regions for officer elections will be determined by the State BOD. These regions will be composed of districts. The districts will be designated as CTPD’s. CTPD’s will consist of local affiliated FCCLA chapters. Each local school district may submit two candidates. a. REC will be comprised of five (5) officers b. Three (3) FCS officers and two (2) WFD career field officers - Hospitality and Tourism and Education and Training Section B - Qualifications Regional Executive Council members shall have the following qualifications: 1. Currently an active member in an affiliated chapter and has been an active member in good standing for at least one year 2. A minimum of one year of comprehensive or occupational FCS classes 3. Required accumulated 3.0 GPA or a 2.5 accumulated GPA with a 3.0 previous semester 4. Work cooperatively and easily with an unfamiliar group; and able to express themselves well orally and in writing 5. Have knowledge of parliamentary procedure according to Robert’s Rules of Order

Page 5 6/2/2018 1. Nominees for regional officers should complete the regional officer application, secure a copy of their official school transcript and submit to Ohio FCCLA by deadline 2. All nominees will be reviewed by State BOD guidelines 3. Nominees will be announced at state FCCLA leadership conference and elected in May following the guidelines established by the State BOD 4. The officers will be elected by FCS and WFD voting delegates 5. Announcement and installation of regional officers shall take place in June Section D - Responsibilities The offices of the REC shall be: 1. Regional President, Regional Vice-President of STAR Events, Regional Vice- President of Public Relations, Vice-President of Skills Events, Vice-President of Membership and any others as deemed necessary 2. Positions shall be comprised FCS and WFD officers 3. State BOD may appoint a member(s) to serve per a term in lieu of open position 4. All State SEC members shall represent their regions at state meetings and shall assist in direction of any regional meetings

Article VIII District Executive Council (DEC)

Section A - The districts will be designated as CTPD’s. CTPD’s will consist of local affiliated FCCLA chapters. Each local school district may submit two (2) candidates. Section B - Qualifications 1. District Executive Council members shall have the following qualifications: a. Currently an active member in an affiliated chapter and has been an active member in good standing for at least one year b. A minimum of one year of comprehensive or occupational FCS classes c. Good academic standing within students school district d. Work cooperatively and easily with an unfamiliar group; and able to express themselves well orally and in writing e. Have knowledge of parliamentary procedure according to Robert’s Rules of Order Section C - Offices of district organizations may be the same as those of the State Association, or consist of: a. President, Vice-President, Secretary, and any other officers deemed appropriate by the District b. District Executive Council shall be composed of the district officers Section D - Local Executive Council (LEC) The offices of the local chapter may be the same as those of the State Association or consist of: a. President, Vice-President, Secretary, and Treasurer, and any other desired offices b. The Local Executive Council shall be composed of the chapter officers and others designated in chapter Bylaws c. Local chapters may be organized in Middle, Junior, Senior, and Career Technical High Schools in which Family and Consumer Sciences or related instruction is offered d. They shall be organized under the supervision of the FCS or WFD who shall act as chapter advisers Page 6 6/2/2018 Section E - National In the event Ohio has a National Officer(s) elected, they will serve as a non-voting, ex-officio member of the State SEC. Adviser(s) shall be a FCS/WFD teacher in the school from which the National officers elected and shall serve as consultant to the State SEC.

Article VIII - State Adviser(s)

1. The State Assistant Director Pathways, Programs and Services approved by the Director of Career-Technical Education, ODE, shall give general guidance to the association and shall appoint a member(s) of the FCS Unit State Staff as the State Adviser(s), who will serve as the administrative officer of the association. 2. The official designated by the ODE to be responsible for FCS Career Technical Education, ODE, or the duly appointed designee shall be the association officer of FCCLA. 3. It shall also be the duty of State Adviser(s) to: a. Direct the work of FCCLA b. Advise the State SEC and State BOD on matters of policy c. Keep permanent records of state proceedings d. Serve as an ex-officio member of all committees e. Assist regional and district organizations and local chapters with the work of the association f. Perform other such duties as needed

Article IX - State Board of Directors

Section A - There shall be a State BOD for the State Association FCCLA which shall be composed of the following voting positions: 1. One (1) Culinary Teacher, One (1) Early Childhood Education Teacher, One (1) Lodging Teacher, Ten (10) Family and Consumer Sciences Teachers (1 from each region), State Officers, One (1) Endowment Chairperson, One (1) Representative from the Alumni and Associates, State Parent(s), One (1) FCS Supervisor 2. Also, part of the State BOD will be the following non-voting positions: One (1) State Adviser and one (1) Assistant State Director of Pathways, Programs and Services, and One (1) Family and Consumer Sciences Education Consultant 3. Three (3) members of State SEC will be appointed to State BOD as elected/appointed as per handbook 4. One past state officer that was a member of State BOD appointed by the State BOD 5. In the event Ohio has a National Officer(s) elected, they will serve as non-voting, ex- officio member of the State BOD 6. The State SEC shall present suggestions on the organization’s structure and policies to the State BOD for their consideration. The officers of the State BOD shall be a. Chairperson, Vice-Chairperson and Secretary

Article X - Relationship of the State BOD and the State SEC

Section A - The State BOD and the State SEC are interdependent in matters of program development, program implementation and public relations. The State BOD and the State SEC are recognized in these Bylaws as the two key decision-making bodies of the state Page 7 6/2/2018 organization. Appointed State SEC members shall have membership on the board and its committees as provided in these Bylaws. When needed, the State SEC and the State BOD shall meet jointly to discuss matters of common interest. Official business to be presented to delegates at the state meeting shall be discussed by the State SEC and presented to the State BOD for final approval. Section B - Authority and Powers The legal governing body of FCCLA shall be the ODE. The primary functions of the ODE shall be to set policy related to program, personnel, and fiscal matters and to be responsible for sound management. The ODE shall employ the state advisor who shall be the chief administrative officer of the organization. The ODE receives and acts upon the recommendations of the state adviser relative to the management of personnel, program, and fiscal matters.

Article XI - Meetings

Section A - The Ohio Association of FCCLA shall hold one meeting annually. The one meeting can only be cancelled in case of extreme emergency by the State BOD on the recommendation from the State Adviser. The State Adviser(s) have sole authority to reschedule meeting including time and location. Section B - Regional organizations of FCCLA may hold two meetings annually, one in fall and one in spring or otherwise deemed necessary by the REC. The time and place of these meetings may be determined by the REC. Officers of the State Association and regional organization are also voting delegates of their respective units. Section C - District organizations FCCLA may hold two meetings annually one in fall and one in spring or otherwise deemed necessary by the DEC. The time and place of these meetings may be determined by DEC. Officers of the State Association and regional organization are also voting delegates of their respective units. Section D - Local chapters shall hold regularly scheduled meetings during the school term and at such time and place as may be decided by the LEC of the local chapter. Special meetings may be called by the LEC as needed.

Article XII - Emblem and PIN

Section A - The official state emblem is designated by the Ohio Association of FCCLA. Section B - The official pin is a reproduction of the emblem of the organization. All members (active and honorary) shall be entitled to wear the official pin and designated official guards. Section C - Advisers (Chapter and State) are entitled to wear the emblem and the official “HA” guard. Section D - Chapter parents are entitled to wear the emblem and the official guard. Section E - Honorary members (Chapter and State) are entitled to wear the emblem and the official “H” guard. Section F - The name and the emblem of FCCLA, Inc. is a registered trademark in the U.S. Patent Office and its use is determined by the National Board of Directors and as stated in the organization’s publication, Policies of the Family, Career and Community Leaders of America, Inc.

Article XIII - Parliamentary Authority

Page 8 6/2/2018 The most current Robert’s Rules of Order shall govern Ohio Association of FCCLA in all cases to which they are applicable and in which they are not inconsistent with the National ByLaws.

Article XIV - Amendments

Section A - Proposed amendments to the Constitution or Bylaws of the Ohio Association of FCCLA shall be: 1. Submitted in writing to the State BOD no later than January 1 by any local chapter, appointed State Adviser(s), or State BOD 2. The State BOD shall review and assemble the proposed changes and submit them to the State Adviser(s) at ODE. 3. To be voted on by delegates from local chapters as stated above. 4. ODE will be final approval. Section B - Copies of the amendments to the State Association Constitution and Bylaws shall be submitted by the appointed State Adviser(s) to the National Executive Director.

Article XV - Dissolution or Liquidation of Assets

Upon final dissolution or liquidation of the state organization and after the discharge or satisfaction of all outstanding obligations and liabilities, the remaining assets shall be used by the State BOD in accordance with the purposes of the state organization or shall be transferred to a qualified exempt organization within the meaning of Section 501 (c) (3) of the Internal Review code of 1954.
