City of Medora Minutes of Regular Meeting June 6, 2017 (Subject to Council review and approval)

Meeting was called to order at 7:00 p.m. by Mayor Todd Corneil. Present were Councilmen Denis Joyce, John Tczap, Ben Brannum, and Kinley Slauter. City Engineer, Mike Njos and City Attorney, Sandy Kuntz were also present.

Minutes from the May 2 regular meeting were reviewed. Tczap made the motion to approve the minutes, second by Joyce. Motion passed unanimously.

City Engineer, Mike Njos, reviewed his written Engineer’s Report. Northern Improvement completed the street patching work. Njos will split the costs appropriately amongst the different entities the patching was done for—City, County, and TRMF. Cordova Construction completed the 20’ of sewer main replacement at the C-Store. Grass seeding still needs to be completed. Njos has received quotes from suppliers for slide gates and check valves and will now obtain quotes from a contractor to complete the installation. TA funding from the NDDOT has been awarded for the Medora shared use path to recreation area and campground. NDDOT needs to be notified by July 14 if the local finances needed to plan and design this project are available. Njos added that the City could get a better price if the basketball and tennis courts would be tied to this walking path. Slauter thanked Njos and Steffen for submitting the grant application and would like to see the City move forward. Njos has been in contact with Wendy Ross at TRNP. They will have a new Facilities Chief later in June, but they have started some drainage ditch cleaning and the environmental audit.

The written ambulance and police reports were reviewed. Chief Lapp added that server training is being facilitated by TRMF for the 2017. Lapp is also working on online training as an option. Lapp introduced season officer, Alex Cogdill.

Dell Beach and Brett Ostermann presented written monthly reports.

City Auditor, Carla Steffen, presented her monthly report. Slauter made the motion to transfer $40,000 from the General Fund to the Public Utilities Fund. Second by Brannum. Motion carried unanimously. Joyce made the motion to amend the Highway Tax Distribution fund (201-43100-427) by $25,000. Second by Brannum. Motion carried unanimously. Steffen and County Auditor, Marcia Lamb, have been working with the ND Cares Executive Director to line up a ND Cares Community Initiative Training in Medora. It was the consensus of the Council to have the event at the MCC on October 5, 2017. HB1245 was discussed regarding changing the city alcohol permit since a separate Sunday permit is no longer required. Brannum made the motion to accept the 1st reading of Ordinance 02-2017 which would change the Sunday opening to 11:00 a.m. and combine the current Sunday alcohol permit fee with the regular license fee. Second by Joyce. Motion passed unanimously. The 2016 Drinking Water Quality Consumer Confidence Report is complete and is available to view on the medorand.com website and at the City Auditor’s office.

Under Old Business, Attorney Kuntz stated she will have the updated cat ordinance at the July meeting. Park Planning Committee is still meeting and has no report at this time.

Brannum made the motion to approve the Site Authorization for the Fort Abraham Lincoln Foundation to conduct gaming at the Little Missouri. Second by Slauter. Motion passed unanimously.

A public fireworks display permit submitted by Cody Bridger was reviewed. The proposal is for a consumer fireworks display on July 4. Joyce stated that permit approval must take into consideration the possibility of a burn ban. Joyce made the motion to approve the fireworks display permit with the following provisions: release and indemnity agreement must be signed; burn ban restrictions would apply; wind speed at time of launch cannot be greater than 20 mph; display must be done before the TRMF fireworks show; John Tczap will be the contact person. Second by Brannum. Motion passed unanimously.

Animal Rides Permit 05-2017, a request by TRMF for horse-drawn carriage rides around town, was presented by Kinley Slauter on behalf of TRMF. The certificate of liability insurance was included with the application. Tczap made the motion to approve Animal Rides Permit 05-2017. Second by Joyce. Joyce, aye; Tczap, aye; Brannum, aye; Slauter abstained. Motion carried.

Bonnie Streitz requested permission to hold her annual craft show on the front MCC lawn June 24. Streitz stated that craft shows with 10 or less vendors don’t have to file sales tax. Kuntz will check on that. Corneil would like Streitz to file a craft show permit with the City Auditor. Joyce made the motion for Streitz to hold her craft show on the MCC lawn contingent on sales tax information from Kuntz being followed. Second by Brannum. Motion carried unanimously.

Corneil recommended Bonnie Streitz, Pool Manager, receive a 50 cent/hour raise to 17.50/hour. Admission and lesson rates will be unchanged. Tczap made the motion to raise Streitz’s pay to 17.50/hour. Second by Joyce. Motion carried unanimously.

A Transient Merchant application from Tyler & Kari Roller aka Kettle Corn Vending was reviewed. A letter from the property owner where the vendor was planning on setting up was also reviewed. Tczap made the motion to decline the application because of the property owner’s refusal. Second by Joyce. Motion carried unanimously. There was further discussion regarding raising the application fee or possibly only allowing vendors to come in when there is a special community event such as Cowboy Christmas. After further discussion, Kuntz recommended that the CVB and Chamber be contacted to bring feedback to the July meeting. Randy Hatzenbuhler with TRMF addressed the Council regarding the Foundation's desire to move the Nabor’s man camp from Williston to Medora. They are looking to acquire 340-400 rooms to replace the Bunkhouse and add additional employee housing. Randy introduced the Project Manager, Jack Markort. This is still an unsecured project. They are asking for conditional approval from the City and it still needs to be approved by the TRMF Board. Conditional approval would allow them to submit a Zoning Application for the June 20 meeting. They will also be asking for a property tax exemption. Kuntz stated the City has never taken the option of property tax exemptions to the vote of the people as is required. PILT would be another option. Kuntz will research this further. Corneil stated his concerns regarding lagoon capacity. Njos added that since the facilities study was done a few years ago, things have been repaired and improved. They are being managed well now, but he recommends that a specialist come in and look at the facility to find out the capacity. Corneil added that the project is a great idea, but he is concerned about the city infrastructure. A clear answer regarding the net increase of room capacity was not presented. There was discussion about Slauter having a conflict of interest. Kuntz stated it is a conflict for him to vote on both Council and Zoning, but he could bring discussion to the table. Council recommends this be viewed as 2 separate projects; the Bunkhouse project and the housing next to the Life Skills Center. This would require 2 separate zoning applications. Tczap made the motion to offer a vote of confidence to move forward with the TRMF lodging/housing project contingent on lagoon capacity and infrastructure needs. Second by Brannum. Discussion; Jim Bridger and Ben Brannum understand they are conflicted to vote on the Zoning Board regarding this project. Corneil added that he does not think employees of TRMF should be allowed to vote. Tczap added that if someone abstains they must state a reason. Corneil requested that Kuntz and Njos attend the June 20 Zoning Board meeting. A zoning denial can be appealed to City Council. Joyce, aye; Tczap, aye; Brannum, aye; Slauter, abstained. Motion carried.

Per NDCC 40-13-02, Slauter made the motion to confirm the bond of the City Auditor. Second by Tczap. Motion carried unanimously.

Under Misc. Business, a letter of intent to participate in the Multi Hazard Mitigation Plan from Billings County Emergency Manager Pat Rummel was reviewed. If the grant is not approved for this plan the County and City will not participate. Brannum made the motion to enter into the Multi Hazard Mitigation Plan agreement with Billings County. Second by Joyce. Motion carried unanimously. Slauter asked Kuntz where the City is with the damage that was done to the playground. Kuntz has estimates and should have a long form complaint by next week. Slauter also asked if the railroad should have given the City an official notice when they had the tracks shut down for repairs. Steffen will try to reach our regional rep. to see if there could be better protocol in the future.

Joyce made the motion to approve the financials. Second by Brannum. Motion carried unanimously.

Mayor Corneil read the announcements noting the July meeting will be held Thursday, July 6 @ 7:00 p.m. There being no other business, Brannum made the motion to adjourn. With no objection, meeting was adjourned at 9:42 p.m.
