Michiana Village Council Date: September 14, 2012

CALL TO ORDER - 1:00p.m.(EST) ROLL CALL: President Beverly Bruesch, President Pro-Tem Timothy Iverson, Council Members; Linda Stein, Phil Bonello. Anne Heywood/Clerk, Jan Lausch-Zilke /Treasurer, Police Chief Lyn Papke and Superintendant, Rick Reitz and 5 townspeople present. Absent: Hillary Herbst

Motion by Tim Iverson to approve meeting minutes from August 10,, 2012, second by Phil Bonello; motion passed unanimously.

ADDITIONS/DELETIONS –Beverly Bruesch would like the Zoning minutes added to the October agenda. Old business; Resolution Subdivision No.5.

CORRESPONDENCE - NO REPORTS:

1. Police Commission Report - George Hermelink posted a poster in the police department office with reminders on what is expected of our Officers. Tim Iverson also told George his position on the police commission expires in November and would like to know if George would like to remain on the commission. Tim asked George to put a letter together for the November meeting if he would like to remain the commissioner.

2. Building Inspector Report –Bill Lambert provided a monthly inspection report showing the progress of the permits. Bill also stated that he has been getting more phone calls. He feels like construction is picking up a little. Tim Iverson asked if he knew what was going on at a home Ponchartrain as they had a dumpster in front. Bill was going to check into it. He was unaware.

3. Treasurer’s Report - Jan Lausch-Zilke had no report will get them out in the next couple of weeks. Taxes were due today and she has been busy keeping up with them. Council asked when the auditors were coming, Jan said in October.

4. Tree Inspector Report - Kris Wulff issued 3 permits for taking down trees. 5. Fire Chief Report – Chief James Imes read the report for Michiana Shores Volunteer Fire Department. (Report provided). Chief also reminded everyone about the pancake breakfast which would be October 28 from 7am – noon cost is $6.50. Council asked Jan if she could be put on the website.

6. Finance Committee Report - Rich Shepherd not present.

7. Water Authority Commission Report - Carol Shepherd not present. Tim Iverson mention that they would like to sit down and talk with Jan about the hydrant rental fee to make sure the charge is not too low or high.

8. Police Report - Chief Lyn Papke submitted his monthly report. Had no complaints. Council asked what LCSD stood for on his report. The Chief said it was short for LaPorte County Sheriff’s Department.

9. Public Works/Water Authority Report by Superintendant Rick Reitz reported; paving was completed and Rick was pleased with the job, started phase 2 of replacing stop signs in the Village, and received a price of $250 to drill holes for the posts at 41 to install the fence and still waiting on the DEQ for permits to fix the washout at stop 43. Council asked Rick to remove the handmade parking signs. Council would like to Rick to notify Bernie if you had the ordinance regarding fees for homeowners illegally turning on water on the village property. If this ordinance is misplaced Tim Iverson said a new one will need to be drafted for the next meeting. Rick mention that the new truck will be in soon and would like to take the truck home. Bev would check the charter to see if there is anything in there about taking home vehicles. Anne is to call Sara Bell and check on insurance coverage.

10. Clerk Report by Anne Heywood - Approval of Check Register for $80,031.55 Tim Iverson wanted it noted that at the last meeting they approved $2,500 for the police garage doors and the final bill came in at an additional $105 which was for additional openers. Motion by Tim Iverson for approval of the Check Register as submitted, Linda Stein second; motion passed unanimously.

OLD BUSINESS:

1. Office Manager – 3rd reading of Ordinance 2012-01 (Village Manager) by title only, Beverly Bruesch made a motion to approve the third reading of ordinance

2 2012-01 there was some discussion that this position should be advertized with a job description attached and the budget needs to be amended if a person is hired this year or wait until next year’s budget. Roll call vote was taken; 4 ayes, motion passed unanimously. 2. Village Rules – Beverly Bruesch passed out a hand out to the council members that she and Hillary Herbst had worked on. Beverly would like everyone to review and will talk about it at the October meeting.

3. Tree Replacement – Kris Wulff has priced out 4 oak trees at $150.00 each plus delivery and installation need to be added on. These trees are the replacement trees for the four trees that were taken down by a homeowner without Village or DEQ permission. Bev is working with Kris on where these trees should be placed in the Village. Per Sara Bell, Village Attorney: when the nursery sends the invoice this should go directly to the homeowner and the homeowner should pay the nursery directly. 4. Zoning Board of Appeals Verdict – the home at 3886 Ponchartrain was approved. Beverly stated that the new construction will cover less property. 5. Sub-Division No.5 – Resolution 2012-003 making the following roads public in sub-division #5. Motion by Tim Iverson to except the Resolution 2012-003 per the recommendation of Village Attorney, Sara Bell, second by Phil Bonello; Roll call vote was taken 4 ayes; motion passes unanimously. NEW BUSINESS:

1. Resolution 2012-002 – Tim Iverson made a motion that the Village will maintain ownership of the purchased parcel #11-41-4940-0039-00-7 that if be used for open land and recreational purpose, Linda seconded the motion. Roll call vote was taken; 4 ayes; motion passes unanimously. Closing on property is September 18, 2012. A split rail or chain link fence will follow where the extending fence is to mark the Village property. Beverly stated that the property goes even through the creek over to Creek Drive. Tim asked that a thank you go on the website. 2. Police Base Radio & Laptops for police cars - Tim Iverson asked the Chief to work with Officer Ryan to write down needs for the Base Radio; the purpose and the justification for the laptops; what programs, licensing, training cost and how many will be needed? Then Tim Iverson will write the grant for these needs which will make our police department more efficient and updated. Tabled until October.

3. Ellie Laser purchasing Village property – Is interested in buying the Village property next to her property. Tim Iverson wanted to go on record stating that Village owned land be kept open. He would like this policy to continue. The council was not in favor of selling. Phil Bonello said he would contact Mrs. Laser to let her know the outcome of the meeting. Public Comments:

3 Rick asked to meet with two council members for some help in running his department. Tim Iverson and Phil Bonello said they would sit down with him after the meeting.

Beverly Bruesch mentioned the passing of Gertrude Peterson who worked many years ago for the Village Hall.

There was mention about a cell tower going up in Grand Beach; Tim Iverson said the idea is still being explored.

Phil Bonello asked about a mobile home parked over on Lake Shore Drive, if this was allowed. Chief Papke said as long as it is plated and current they are fine.

Mick Wulff brought to the council’s attention that there are two dead trees one by Seminole/Mohawk and one on Ponchartrain that need to come down. Rick will check. The council then went over the “TO DO LIST” - Rick to put signs at the beach stops to remove all items off the beach by October 15, 2012. Next council meeting to be held on Friday, October 12, 2012 at 1:00 p.m. (EST).
