Ms. Karlsson Called the Roll

The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, August 18, 2014, at 8:10pm.

Mayor Labrosse called the meeting to order and the City Clerk Deborah Karlsson announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall.

Ms. Karlsson called the roll:

Present – Mayor John P. Labrosse, Jr., Deputy Mayor Canestrino, Councilman Battaglia, Councilman David Sims, and Councilwoman Greenman were present. Interim City Manager Art Koster and City Attorney Thomas P. Scrivo were both present.

A motion was made by Councilman Sims and seconded by Deputy Mayor Canestrino to accept the Meeting Minutes for May 20, 2014 and June 19, 2014 Council of the Whole and the Regular Meeting.

Children from the Kids Safety Awareness Program were in attendance. Each child asked a question about the governmental process with the Mayor and Council responding.

City Manager’s Report – Art Koster

I took a ride with Councilman Sims to Carver Park, we will be working with the DPW and Recreation Department to do a facelift, we will be making some improvements. Please remember that August 23, 2014 is Cabaret Night at the Cultural Arts Center. August 19 th at the Boys & Girls Club between 12:30 and 3:00 pm is Multicultural Day. The Summit Avenue curb pavement problem will be taken care of by putting a new catch basin for drainage there by the County and the City will take care of the curb. Update on 210, 214 Main and 210 Moore Streets there is a pre application meeting to be held on September 2, 2014. The Towing ordinance is in its final stages and hopefully we will have it ready for the next meeting. The Dupree’s will be performing tomorrow night on the Green.

RESOLUTION NO. 279-14

FINAL ADOPTION OF ORDINANCE NO. 25-2014, BOND ORDINANCE PROVIDING FOR ATLANTIC STREET PARK IMPROVEMENTS, BY AND IN THE CITY OF HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY; APPROPRIATING $650,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $617,500 BONDS OR NOTES OF THE CITY TO FINANCE PART OF THE COST THEREOF

This ordinance has been advertised pursuant to law and now calls for a public hearing. Will someone so move?”

Motion offered by Deputy Mayor Canestrino and seconded by Councilman Sims that there be a public hearing.

PUBLIC HEARING –

1 8/18/14 Seymour Chase, 1 Atlantic Street – I feel this is an ill-conceived plan although better than the one prior. Most owners of the properties on both sides of the street are attorneys. On May 8, 2014 a litigation hold letter was sent to the city because of opposition to the plan. We have enough litigation in Hackensack. We are in objection to this as there won’t be enough parking for all those who will be using this park and the other businesses in the area. We are already with insufficient parking this will just make the problem worse. I urge you all to think again if it is necessary at this time to generate this money.

Victor Sassoon – Euclid Avenue – I find it shameful that lawyers are putting their own punitive interest before the city. There is plenty of parking at the old Record Building only a block away from your office. For you to threaten litigation, you should be interested in the good of the city.

Hackensack Riverkeeper Program Director– We have stressed that you need to go back to your towns and help make them aware of the parks and wetlands. Please pass this ordinance.

Steven Gelber, Clinton Place – In theory I believe in open space but I’m not sure that this is the space for a park. This is a commercial zone and if we cannot be accommodating to the commercial establishments then we may drive them out of the area. This does need to be a very well thought out decision. Both Mr. Sassoon and Mr. Chase have valid points. The council has a very difficult decision to make here. You have to weigh both sides of the argument very carefully.

Kathleen Salvo, Hudson Street – I do believe with everything that all have said before me but it has to be weighed on our priorities. I was very surprised that this came up again, I thought we would be giving it about a year. I am not against the park, just not now. Think about losing revenue for grass. We have a park a block away. Let’s wait until all the other redevelopment is on its way.

Richard Gelber, Clinton Place – You are going into this project, knowing that we are going to have litigation, that matching grant is going to be eaten up by legal fees. It is crazy.

Brothers Carpet owner – I would suggest you all act bravely. I think it is crucial to have Green Space. Property around parks goes up in value.

Christopher Coli, Prospect Avenue – You need to rethink the parking. You are going to be building more buildings and not have enough parking. You will be taking the parking away for the park. There are plenty of parks that are empty, you need to vote this down. Once the record building is sold you lose the parking there.

Larry Isen, Maple Avenue – The Council is right we are desperately short of park space. This is an ideal place for a park. Right across from the park is the Atlantic Parking Garage, so now they will have to pay to park. You shouldn’t be intimidated by threats of litigation. I endorse the plan to go ahead with the park.

Jerry Lombardo – Chairman of Upper Main Alliance – For eleven years we have been working on the downtown. Green Space is very valuable for development of downtown areas. There is no loss of spaces. 44 spaces are to be removed and 43 spaces will be put back. We have to move downtown forward. Now is not the time for the council to be weak. We brought in the experts and we know this is right. We support the park, this is open space which is necessary. The town is broke we need to build rateables. We have 3 new projects in the works. Parking will be built with all of these. Let’s get this done, we have a grant for this and the Upper Main Alliance will continue to support you.

Jason Somes, Prospect Avenue – I want to see Hackensack grow and this is best for the city.

Steve Mandero, Co-owner of Brothers Carpet – We know there are issues with parking all over. We all work around it. We support this project and Open Space. Business owners will enjoy this space as well, you need to move this forward. Laura Kirsch, Colonial Terrace – I live and work in Hackensack. I sit on the board of the Upper Main Alliance and we have been working on this for twelve years. We need to have commercial and residential space. The successful areas are both commercial and residential with open space. It has been proven that these areas thrive. We need to move forward with this and approve this plan. We will be providing for cultural activities not only open space. Please approve this park.

Director of New Jersey School of Architecture – I am here to speak in favor of this bond issue, in support of the park and I sent a letter to the Mayor and Council on June 4, 2014 regarding this issue. We held two meetings in the spring of 2012 with the residents. The proposed plan shows mixed residential and commercial uses and open space. This will be a green beltway to Hackensack. Mr. Chase asked for answers, I feel the answers can be found in the DMR Plan. To miss this opportunity I feel will set the community back.

Ed Lippiner – 9 Coles Avenue - I am in support of this initiative. This is not a brand new idea, the concept was developed several years ago. The park clearly is a critical piece of the puzzle to development of the downtown area.

Ruth Neustadter – 279 Hamilton Place – I have lived here for 40 years, Main Street was two ways and there was no charge to park when I moved here. I find it hard to shop on Main Street due to the parking. What will be charged for the parking? No one is talking about this. If you go ahead with this project you really need to look at the parking issues. You need to think of convenience and turning Main Street around.

RESOLUTION NO. 280-14

INTRODUCTION OF ORDINANCE NO. 26-2014, AN ORDINANCE AMENDING CHAPTER 175 OF THE CITY OF HACKENSACK MUNICIPAL CODE ENTITLED ”ZONING” TO ADD NEW SECTION 175-6.10, ENTITLED “TRANSIT VILLAGE”

WHEREAS, it is necessary to supersede an existing inter-local services cooperative agreement for the County and its people to benefit from this program; and

WHEREAS, an agreement has been proposed under which the City of Hackensack and the County of Bergen in cooperation with other municipalities, will modify an Interlocal Services Program pursuant to N.J.S.A. 40:8A-1 et.seq.; and

WHEREAS, it is in the best interest of the City of Hackensack to enter into such an agreement,

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the City of Hackensack that the agreement entitled “Three Year Cooperative Agreement”: An Agreement Superseding the Cooperative Agreement dated July 1, 2000 – June 30, 2003, to clarify the planning and implementation procedures, and to enable the Municipality to make a Three Year irrevocable commitment to participate in the Community Development Program, the HOME Investment Partnership Act Program and the Emergency Solutions Grant program for the Program Years: 2015, 2016, 2017 (July 1, 2015 – June 30, 2018) to be executed by the Mayor and Municipal Clerk in accordance with the provisions of law; and

BE IT FURTHER RESOLVED, that this resolution shall take effect immediately in accordance with law.

7 8/18/14 RESOLUTION AUTHORIZING THE CITY OF HACKENSACK TO ENTER INTO AN AGREEMENT WITH THE HACKENSACK PUBLIC SCHOOL DISTRICT REGARDING THE PROVISION OF A SCHOOL RESOURCE OFFICER

WHEREAS, the City of Hackensack (“City”) desires to enter into an agreement (“Agreement”) with the Hackensack Public School District (“District”) for the City to provide police officers from the City of Hackensack’s Police Department to the District for utilization as the school resource officer (“SRO”) for the 2014-2015 through 2018-2019 school years; and WHEREAS, the City has agreed to provide the SRO to the District for the 2014-2015 through 2018-2019 school years upon the terms and conditions set forth in the Agreement; and WHEREAS, the City and the District are authorized to enter into this Shared Services Agreement pursuant to the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1, et seq.; and WHEREAS, the Council finds it in the best interest of the City to enter this Agreement; and NOW, THEREFORE, LET IT BE RESOLVED, by the Council of the City of Hackensack, that the Mayor be and is hereby authorized and directed to enter into an Agreement with the appropriate authority of the Hackensack Public School District for the utilization of police officers from the Hackensack Police Department by the District for the 2014-2015 through 2018-2019 school years in the form of a school resource officer. WHEREAS, N.J.A.C. 5:30-15 established rules that govern how local government units manage and finance compensation for accumulated absence time for their respective employees, and WHEREAS, accumulated absence includes any sick days, vacation days, personal days, compensatory time or any other absence time authorized as part of an employer agreement, which is not used by the employee during the allowed period and which is permitted to accumulate over time to the benefit of the employee, and WHEREAS, the Chief Financial Officer has certified that the funds and authority exists to pay Lambert Duffus for owed vacation days and sick days, and WHEREAS, Acting City Manager Art Koster has authorized the payment of $33,630.46 to Lambert Duffus for said days. NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of Hackensack hereby approves payment to Lambert Duffus in the amount of $33,630.46 for his accrued time payout in accordance with the rules and regulations established by the Local Finance Board for such payments.

– MARC CUNICO WHEREAS, N.J.A.C. 5:30-15 established rules that govern how local government units manage and finance compensation for accumulated absence time for their respective employees, and WHEREAS, accumulated absence includes any sick days, vacation days, personal days, compensatory time or any other absence time authorized as part of an employer agreement, which is not used by the employee during the allowed period and which is permitted to accumulate over time to the benefit of the employee, and WHEREAS, the Chief Financial Officer has certified that the funds and authority exists to pay Marc Cunico for owed vacation days, sick days and compensatory time, and WHEREAS, Acting City Manager Art Koster has authorized the payment of $38,865.32 to Marc Cunico for said days, and WHEREAS, the governing has previously adopted Resolution #267-14 on August 4, 2014 and now wishes to revise the dollar amount. NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the City of Hackensack hereby approves payment to Marc Cunico in the amount of $38,865.32 for his accrued time payout in accordance with the rules and regulations established by the Local Finance Board for such payments.

ACCUMULATED ABSENCES LIABILITY TRUST FUND WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonably accurate estimates in advance; and WHEREAS, N.J.A.C. 5:30-15 provides for receipt of funds by the municipality to provide for the operating costs to administer this act; and WHEREAS, N.J.S.A. 40A:4-39 provides the dedicated revenues anticipated from the Accumulated Absences Trust Fund are hereby anticipated as revenue and are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack as follows:

The Governing Body does hereby request permission of the Director of the Division of Local Government Services to pay expenditures of the Accumulated Absences Liability Trust Fund (N.J.A.C. 5:30-15). 2. WHEREAS, the City of Hackensack strives to make its practices consistent with the State of New Jersey Department of Community Affairs’ (“DCA”) Best Practices; and WHEREAS, the DCA included the following on its Best Practices Worksheet CY 2013/SFY2014: “Does your municipality exclude from healthcare coverage part-time elected and appointed officials (less than 35 hours per week)?”; and

WHEREAS, the City of Hackensack strives to exceed the minimum percentage of the DCA’s Best Practices checklist items required in order for all or part of the City’s State Aid payment to be released; and

WHEREAS, City representatives appeared before the Local Finance Board (LFB) of the Division of Local Government Services of the DCA on Wednesday, August 13, 2014, concerning the City’s application to issue bonds related to the funding of tax appeal judgments and settlements; and

WHEREAS, the LFB noted that elected City officials receiving health insurance benefits is not consistent with DCA Best Practices; and

WHEREAS, the Mayor and Council of the City of Hackensack have determined that it is in the City’s best interest to eliminate health insurance benefits for part-time City employees and elected City officials.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Hackensack that elected City officials and part-time City employees are prohibited from receiving City-funded health insurance benefits, effective November 1, 2014; and

Chris Coli – I went on the city website and I could not find the meetings listed, it says this page cannot be found. Can Mr. Dib please correct this problem? The Mayor stated that with certain mobile devices you can’t get on the website. Mr. Dib is in the process of updating the website. When will certain Councilmembers cease the spying on employees at the parks? The parks are open to all the residents. I think there is someone running a tennis business at the tennis courts. It looks like these councilmembers are making the city employees do things they don’t want to do. Does the employee listen to the councilmember or his foreman?

Daniel Corolla – I like the website. I have a question – what is the process for a nixel message? Mr. Koster answered it goes through John Niland in the Fire Department/OEM and Albert Dib. Even though I don’t agree with everything you do, I don’t think you are out to do harm. The Economic Development position, you are not going to fill this position at this time is that correct Mayor? Mayor stated not at this time. If it such an important position why not fill it? You can all say you didn’t bring in the proper person for the position. Why not just admit that you created the job or fill the position to help the city?

Earl Warden – I have been coming to these meetings for a long time, chapter 1 is now closed and we are ready for chapter 2. Mayor I would like to speak to Mr. Sims directly. Do you run the Hackensack Basketball and it is a 501C3. It is legal to pay. Your payments should be documented. I can’t find it. On your Financial Disclosure Form you left Hackensack Basketball off. I was at the Rec for 16 years, I have never seen any councilperson come down to get permits, pay for permits, etc except for you guys. All others have removed themselves from the sports except to watch the games. I am unemployed and I feel it is not right that you are using your political ties to enhance your programs. Give something back to the city, give to the Hackensack Recreation programs.

Jason Nunnermacker – I proudly accepted your Bucket Challenge last week and yes I did it along with my Board of Education colleagues, we raised about $2,000.00. It is a good cause. Last meeting I spoke about Mr. Catania. Resolution 287-13 appointing Mr. Catania at the pleasure of the City Council. No RFQ was received. Ordinance 14-9 shows that he is a part time city employee. I sent in an OPRA request for his RFQ submission. I did not receive anything for Mr. Catania but I did receive two for Mr. Gray. Mr. Catania got health benefits but Mr. Gray wasn’t even offered benefits. I am not questioning Mr. Gray’s appointment and he is good at what he does. Why are they being treated differently? Who is Mr. Catania friends with that Mr. Gray isn’t. Mayor stated – I wasn’t aware that the Public Defender was an employee. Mr. Scrivo stated that the prosecutor serves at the pleasure of the council and the Public Defender serves a one year term.

Richard Salkin – The State statue trumps the ordinance. Has Mr. Catania been reappointed? Is there a lawsuit? You are willing to look past an expungement. It is on the New Jersey Courts website. A charge is pending. I didn’t support you so I didn’t expect anything from you. Mr. Battaglia what are we doing about the money and your wife? I want to know before I go to prosecutor’s office. Mayor stated this is a personnel matter and the council can not speak on this. Her rate has been reduced but she has been paid Mr. Salkin stated. Mr. Scrivo stated he will do a memo with a legal opinion. Since this is a personnel matter is should be discussed in executive session. Mr. Salkin stated you must protect the city money. All of this is public record.

19 8/18/14 Steven Gelber – Clinton Place – On a good note, I think it was a great thing for the city to come together on this issue, the bucket challenge. If you are a Comet you have been nominated for the challenge. Health insurance thank you for that. No one is being grandfathered in correct? Mayor stated yes. I think an ethics violation should be disclosed to you. I hope at the next meeting we have a new prosecutor. I know a memo has gone out in the past about our form of government and your duties as council members. We got a second round of lawsuits. Let the City Manager do his job. Ms. Heck’s lawsuit – Ms. Greenman I really wish I could be a fly on the wall when you are disposed.

Jared Wexler – Byrne Street – Ms. Greenman I know you weren’t born in this country but I have nothing but respect for those that came here and live the American Dream. You have sworn an oath to defend the constitution. The 1st amendment gives us the right to stand up and speak. That is part of being a councilperson, if you don’t like it maybe you should resign.

Stephen Neustadter 279 Hamilton Place – This doesn’t belong in a council meeting and it doesn’t belong in the public sector. Personal and derogatory claims should not be said here in this chamber and the mayor and council should say this.

Deborah Keeling Geddis – Hamilton Place – I am a concerned and scared home owner regarding the tax appeals. This large bill is left over from the previous council. 8.6 million dollars for the first year will cost tax payers $65-70 dollars, the second bond will be about 10 million which will be a substantial hit to the residents and a third bond in the amount again of about 10 million dollars. No one here is anti-police, they have been nothing but professional, but with this looming tax appeal pending how can you pay them 22%? If you can find a way to give them this raise without affecting our taxes give it to them, but I feel this was a reckless decision. How are you going to explain this to the senior citizens of the city? All the other contracts that are coming up will expect the same. I supported you on your strong stance on transparency, what happened? You are being dishonest about how much things are going to cost us.

Mayor explained the steps in the contract, you cannot include the steps in the raise, and it was 1- 1/2%. All the teachers, fireman and police go through a step process. It is only 22% if you count the steps.

Ms. Haverty – Berry Street – I wanted to speak about the 22% raise. Hackensack is under dire circumstances and I just want to make sure that the taxpayers understand that their taxes are going to be inflated. The Governor gave the tools for municipalities to keep taxes down. Everyone has to sacrifice for the good of the city. This is my feeling. I think going above the 2% cap is reckless. That is my opinion and I am entitled to it.

Emil Canestrino – I was a paid police officers for over 35 years and you are mis-informed about the police contract. It takes six steps to get to the top step and top pay, this has been in existence for years. The new contract has extended the steps to nine (9). Those in the step process do not get the 1-1/2% until they reach the top step and beyond. You are wrong with saying that they are getting more than the 1-1/2%.

Regina DiPasqua – Parker Avenue – It has been an interesting couple of weeks. There has been a lot of negative attention. A councilperson has filed police reports against me. You might want to look this up 2C:28-4A. I can go where I want to go and say what I want to say. You are flip flopping on the bond issue. I can’t understand why you went to the local finance board, you tried to make the city look bad. You voted against the police contract, stating irregularities, but at the next meeting you stated that you never saw the contract. Going to the local finance board along with some residents was just wrong especially bringing up the police contract, this was not in the best interest of the city. Without the Local Finance Board’s approval the citizens of Hackensack will be looking at tough nut to crack. It was irresponsible of you to throw mud on the city. Please stop the negative attention to the city Ms. Greenman.

Richard Gelber – Ms. Greenman went to the Bergen County Police and left paper on me there. It is outrageous that this group went to Trenton. Police Officers with families making $33,000.00, this contract was a win win for the city. It’s a disgrace that this sat on the previous city manger’s desk. The patching on the Central Avenue project is terrible. Great City spirit on the ALS challenge. Homeless shelter has turned around, thank you for going there. Is the accounting complete on the monies that Mr. Rottino owes the city? It is being looked into stated the Mayor. I have attended another municipalities meeting and their Municipal Attorney had a laptop, maybe we can see if this is possible for our City Attorney so he has everything he needs at his fingertips.

Kathleen Salvo – Hudson Street – I visited the Health Department today, they are short staffed. I don’t see a big city like Hackensack sharing services. There is a lot of paperwork within this department. We are short inspectors and office staff. Building Department needs help also. As per interim City Manager we have a part time person coming in for a one year contract.

A motion was offered by Deputy Mayor Canestrino and seconded by Councilman Sims to close meeting to the public.

Mayor asked the CFO Mangin to comment on the police contracts. CFO Mangin commented on the police contracts and explained the step increases.

Council Comments:

Councilman Battaglia – I started the team for my sons to be able to play. Everyone has a key that gets a permit. Yes it is true that I go around and check the fields, it is only for the benefit of the kids

Deputy Mayor Canestrino- We have a few board openings, we will be advertising them on the web site as well. We need a resident of the housing authority, we have an opening on the recreation board and an alternate on the planning board. This is a great positive way to be involved in the city. The best way to overcome some of our problems is to bring in rateables and the best way to get them is redevelopment. It is critical to market what we have in a positive way. We have to think out of the box, get out of our comfort zone, we have to encourage the city to grow. Please continue to support this growth. We will have a full evaluation on the parking expectations of the city with it redevelopment. I know that Mr. Reiner has made changes to the plan to put more parking in the park area. I respect Mr. Chase, but all you will have to do is walk across the street, it is a covered garage. Change in difficult but we have to open our eyes and be willing to change if we are going to grow. Political cronyism, so if someone contributes to our campaign and they are the most qualified person for the job, you cannot use that as a weapon to say that they are not allowed to work for the city. We have kept the position of economic director open because it is an important position. Right now we are looking for a qualified city manager and we will discuss this with the manager when he is on board as to whether to fill the position. The contract, we cannot speak about this as it is in litigation. They are complex contracts. I don’t want anyone to be frightened by things that were said tonight. I spoke about our many accomplishments that we made this year to the local finance board. We will always make decisions in the best interest of the city’s residents. I think it went well, I feel it was a positive meeting. We have a lot to be thankful and al lot to be hopeful for.

Councilman Sims –I want to thank everyone for coming out tonight. Last Friday was last day of summer camp and this week we start sign up for the fall camps.

Councilwoman Greenman – I think the most telling thing was that the CFO was not allowed to speak during at any of the public hearing directly to the residents. He was in Trenton, it is clear that the police are getting over 20%. The residents went on their own. I commend them for their love of the city and they were applauded.

Mayor Labrosse – The park, we have been going over this for such a long time, it is part of a plan. Just think if we buckled we would never move forward. This park is necessary, green space is necessary. This is the only way to move the city forward. You will be able to use the parking garage across the street and it is covered. The Finance Board, reckless was the word that was used, if the board made a decision to decline that bond, it would be catastrophic to the residents of the city. I think it is sad that people from the city went down there with a separated

21 8/18/14 agenda. Tomorrow is the Dupree’s, hope that the weather will cooperate. Thank you all for coming out.
