The Board of Directors shall have such powers for the conduct of the affairs of the Association as are granted by law and the Governing Documents including the following:

WHEREAS, Section 13 Part C Article IV of the By-Laws of the Association grants power to the Board of Directors to conduct Association business, “To adopt and publish Rules and Regulations governing the use of the Common Area, and the personal conduct of the Members and their guests thereon, and to establish penalties for the infraction thereof.”

The following Rules and Regulations shall govern the use and operation of the Property known as Oakhill Townhome and the use of the Common Area, for the enjoyment of all safety and welfare of the Owners, but also to protect the owners’ privacy, property and the quality of your investment. These rules shall apply to all present and future owners, mortgagees, lessees, and occupants of the homes and of the Common Area, their agents, employees and guests.

A. General Rules

1. Common walkways in front of all units providing ingress to or egress from Units shall not be obstructed or used for any purpose other than pedestrian traffic.

2 Toys or personal articles shall not be allowed to stand unattended on any part of the Common Area. NOTE: Items found standing unattended on the Common Area for periods in excess of twenty-four (24) hours will be removed. Items posing a threat to the health and safety of the residents will be removed immediately.

3. Each Unit Owner shall keep his or her front steps and or porch and back area deck in a good state of preservation and cleanliness. May not be used as a “Storage Area” or in any manner, which may detract from the overall appearance of the Unit.

4. The Owners’ maintenance responsibilities shall include painting, and repair of the exterior of his/her townhouse. 5. NO CLOTHES LINE or household fabrics shall be hung, dried or aired on the exterior of the unit.

6. The Association will provide trash removal. All garbage and trash must be placed in trash bins not outside of trash bin area. NO FURNITURE and or APPLIANCES in or around the trash bins.

7. Any damage to any portion of the Common Ground including that damage which may be caused by the moving or carrying of any article into or out of a Unit, shall be the financial responsibility of the Unit Owner causing said damage. Any damage to any portion of the Common Ground caused by the Unit Owner occupants, or guests of the Unit Owner will be repaired at the expense of said Unit Owner.

8. Unit Owners shall not use or permit to be brought into any Unit or placed on the Common Ground, a flammable oil or fluid such as gasoline, kerosene, naphtha, or explosives, fireworks, or other articles deemed hazardous to life.

9. Residents shall not make or permit any disturbing noises and or acts in or around any Unit, which will interfere with the rights, comforts or conveniences of other residents. Residents shall not cause or permit any objectionable noises or odors to be produced or emanate from their unit or on Common Grounds.

10. Dumping of trash on Common Ground is strictly prohibited.

11. The removal of trees on Common Ground is prohibited, unless approved by the Board of Directors.

12. NO EXTERIOR ADDITION, CHANGE OR ALTERATION TO THE ORIGINAL CONSTRUCTION OF THE UNIT SHALL BE MADE TO ANY LOT OR DWELLING UNIT UNTIL THE PLANS AND SPECIFICATIONS HAVE BEEN SUBMITTED AND APPROVED BY THE ASSOCIATION.

13. If a Unit Owner leases a Unit, the Unit Owner must provide the Manager/Boar of Directors with the lessee’s name and duration of the lease and affirm that lessee has read and has in his/her possession a copy of the Rules and Regulations of Oakhill Townhome. The Unit Owner shall be responsible for any and all FINES levied against the tenant for violations of the Rules and Regulations.

14. No type of playground equipment, lawn furniture or other objects may be placed on the lawn of the Common Grounds, which will interfere with the lawn maintenance. Grass area shall be kept clear of all objects.

15. Lawn mowing of all grass in front and the side of each Unit area shall be provided by the Association Landscaping of the common area shall be provided by the Association. The Unit owner is responsible for maintaining his/her backyard and any fenced in area.

16. ALL ASSOCIATION ASSESSMENTS ARE MANDATORY AND DUE ON THE FIRST OF THE MONTH. Those dues and assessments not received within fifteen (15) days of due date will result in a $10 late fee payable by owner with that month’s dues. Owners who do not pay dues and assessments within thirty (30) days of due date will have water service disconnected and interest shall bear from due date at the rate of 2% per annum. The Association governs the water service to each unit.

17. Checks returned to the Association for any reason shall be subject to a $25 handling fee. This fee will be assessed against the owner’s accumulative account.

18. The playing of street football, basketball or any other sports games and or temporary sporting equipment is prohibited within the parking areas and streets of Oakhill Circle.

19. Unit Owners must obtain homeowner insurance policy that covers exterior structure of their unit. 20. ALL OFFICERS and BOARD MEMBERS of the Association MUST BE AN OWNER.

21. Young people, like all Residents, are to stay out of flowerbeds and the climbing trees in the Common Area.

22. There is to be no congregating or loitering in the vicinity of the mailboxes, dumpster area and common grounds. (electric meter boxes, parking area, front and side of buildings)

23. The standard fencing for the Oakhill Townhome Community is privacy fence Dog-eared Wood Fencing (6 feet tall) the color of the fencing will be either (white or stained). No other fencing will be acceptable.

24 A REFUNDABLE security deposit of $250.00 (two hundred fifty dollars) is required for all units that are rented. Pro-rata refunds will be based upon complaints received/violations incurred during the lease. No more than 10 (ten) units at Oakhill Townhome will be available for rent simultaneously, to conform with guidelines established by FHA and other mortgage/lending institutions, where mandated owner vs. rental ratios must be 85%: 15%. Selection of designated authorized rental units will be determined by a lottery, administered by the Board, to be held at the OTA Annual Meetings

25. Within all parts of the common area, including streets on Oakhill Townhome property, ALL persons UNDER THE AGE of 16 YEARS OLD, unless accompanied by a parent or legal guardian, MUST OBSERVE CURFEW (WEEKDAYS 9:00 pm to 6:00 am - WEEKENDS 10:00 pm to 6:00 am) B. PARKING RULES

1. Each Unit is entitled to two (2) parking spaces, which shall be assigned by the Association.

2. All motor vehicles shall be parked in established parking areas only. Vehicles such as motorcycles, mopeds, etc. may not be stored on the porch or deck of any Unit.

3. All vehicles parked within the property MUST display the OAKHILL TOWNHOME PARKING PERMIT with current vehicle tags and inspection sticker and MUST be in an operable condition, or will be removed at the owner’s expense and is hereby deemed a nuisance. (AMENDED: July 1, 2001)

4. Any vehicle which appears to be incapable of operation due to flat tires, broken windows, broken headlights and tail lights, missing body parts, or similar, and remains parked in the Oakhill community in excess of ten days, shall be deemed a nuisance and subject to be towed.

5. NO LARGE COMMERCIAL type vehicles (tractor trailer or truck cabs, dump trucks, cement trucks, oil or gas trucks - delivery trucks or any other vehicular equipment mobile or otherwise, deemed to be a nuisance by the Board), shall be parked anywhere in or on the property.

6. NO BOATS, CAMPERS, MOTOR HOMES, TRAILERS, OR RECREATIONAL VEHICLES SHALL BE PARKED WITHIN THE PROPERTY ON A TEMPORARY OR PERMANENT BASIS.

7. NO MAJOR VEHICLE REPAIRS PERMITTED. Repairs to motor vehicles shall be limited to minor repairs only, repairs which can be accomplished in six hours or less. No vehicle shall be left jacked up and unattended.

8. A repair which may damage any portion of the Common Grounds (draining radiators or leaking oil) is strictly prohibited. Any damage to Common Grounds resulting from the repair of motor vehicles becomes the financial liability of the vehicle owner and Unit Owner.

9. All Unit Owners, members of their families, their employees, visitors, guests, tenants and agents will obey all traffic regulations (10 mph speed limit) as may be promulgated by the Board of Directors for the health, safety, comfort and convenience of Oakhill Townhome Residents.

10. No vehicle belonging to Unit Owner, members of their families, their employees, visitors, guests, tenants or agents shall be parked on the grass or on the storm drainage, which will impede or prevent the maintaining of the lawn. C. PET RULES

1. ALL PETS SHALL BE ON A LEASH BEING HELD BY A PERSON CAPABLE OF CONTROLLING THE ANIMAL WHEN OUTSIDE THE UNIT. NO DOGS OR PET SHALL BE TIED OUTSIDE ON A LEASH UNATTENDED.

2. Should any animal belonging to an Owner or tenant be found unattended out of the Unit and not being held on a leash, such animal may be removed by the Association to an animal shelter.

3. Pets shall be limited to cats, dogs, birds, and fish. No unit owner/tenant may keep more than two (2) pets, excluding fish. All pets shall have the appropriate license and rabies shots.

4. If any animal becomes obnoxious to other unit owners/residents, the owner shall correct the problem or, upon written notice by the Board of Directors, will be required removing the animal, or taking such action as the Board may direct.

5. Pets shall not be allowed to defecate / urinate within fifteen (15) feet of any building, on flowerbeds, shrubs, sidewalks or parking areas.

6. PETS’ FECES ANYWHERE ON THE COMMON GROUNDS MUST BE REMOVED IMMEDIATELY BY THE PET OWNER.
