Handbook for Trainers and Foundation Year 1 Dentists (DF1) Foreword
Dental Foundation Training (Vocational Training) is primarily aimed at the new graduate to provide the initial stage of general professional training and education. Emphasis is placed on continuing professional development throughout one's practising career. The Trainee (Foundation Year 1 dentist) is encouraged to develop and expand the clinical and personal skills learned as an undergraduate. During the Dental Foundation training year, the new graduates have the opportunity to consider their future - whether a career in general dental practice, the Salaried Dental Services, or specialisation within dental practice, the Hospital Service or the University. Introduction
This handbook is designed to explain the working of the Dental Foundation Training Scheme in General Dental Practice in the West Midlands. There are separate sections describing the role of the Foundation Year 1 Dentist (DF1), the role of the Trainer, the arrangements for the study day course, a copy of the Trainer/Trainee contract, the report form used by the practice visitors and an information section. An application form for the Trainer and Foundation Dentist is included. The DF1 application form is available online at www.westmidlands deanery.nhs.uk.
Potential trainers who wish to apply for the scheme should read the handbook carefully and either complete the relevant application form at the back of the book or complete, print and sign a downloadable copy.
If you require further information, the relevant addresses and phone numbers are included in the information section. The Postgraduate Dental Dean, Associate Dental Dean (Vocational Training) and the course organisers will be pleased to answer any queries.
General practice is a specialty, which requires the development of particular skills. Recognition of this requirement has led to the emergence of a system of vocational training centred on the general practice environment. The scheme is open to those who are looking for their first post in general practice, either as new graduates or following a period in some other branch of dentistry. On 1st October 1993 mandatory vocational training in general dental practice became a requirement for all UK graduates who wish to practise within the General Dental Services.
The introduction of the new General Dental Service (GDS) contract on 1st April 2006 made it a requirement that to be a Performer or Provider, individuals would have to be undertaking or have undertaken, Vocational Training. Other applicants are required to satisfy the local Deanery that they possess equivalent experience to Vocational Training before they can join the Primary Care Trust list as Performers.
Pilot schemes of vocational training have operated in the region since 1980, and the five schemes which are in progress offer a possible total of 60 training places. It is likely that the number of schemes will increase for an August 2010 commencement. This long experience has allowed the West Midlands considerable insight into the operation of VT Schemes. The educational input arises firstly from in-practice tutorials run by the Trainer on a weekly basis and secondly from the study day course.
1 Dental Foundation Training (DFT)
A new graduate is now required to undertake a period of supervised practice in an approved vocational training practice and for this to be certified as having been completed before they can be considered by a Primary Care Trust as a performer or provider of dental services in the GDS. Without such certification a graduate cannot work in the GDS, they are no longer able to work as Assistants in NHS general dental practice.
The certification process depends upon the completion of the Foundation Training and Learning Portfolio throughout the period of the training year. This has various elements, commencing with the agreed record of a discussion between the Trainer and Foundation Dentist at the start of the year, where they note their expectations of what is to come. There are periodic reviews of progress at intervals during the year and at the end of the year. The Foundation Dentist (FD) is also asked to complete an initial record of clinical experience and to note when certain basic proceedings have been undertaken. There is also a log to be completed, which covers various details including, teaching tutorial time, hours worked and various aspects of the week's activity. Attendance at the study day course is compulsory and is recorded.
At the end of the year these various records are considered, along with the views of the Trainer and Adviser and if all has gone well a Certificate of Completion will be issued by the Associate Postgraduate Dental Dean.
This Certificate should be retained by the FD to provide evidence to PCTs of the individual’s eligibility to become a Provider or Performer in the GDS.

Dental graduates who are entering general dental practice for the first time are invited to apply for a place on the Vocational Training Schemes within the region. They will be appointed as a FD within general practices or salaried services in the West Midlands. The length of the appointment is one year, and during this period the FD attends a study day course at one of the Postgraduate Centres within the area.
Currently five schemes run within the region. Four commence on 1st August annually, based at City Hospital, Birmingham; Stafford District General Hospital, Stafford; Walsgrave Hospital; Coventry; and Worcestershire Royal Hospital, Worcester. The fifth commences on 1st February annually at Russells Hall Hospital, Dudley. 2 new schemes are proposed for August 2010. Are you a potential Foundation Dentist? All entrants to Dental Foundation Training in General Dental Practice will need to meet the essential criterias set out in the Person Specification produced by the Conference of Postgraduate Dental Deans. See page 54.
Payments in respect of Dental Foundation training are payments to a contractor who employs a Foundation Dentist. They are intended to meet the salary costs of employing the Foundation Dentist, provide payment to the Dentist Performer who is providing the vocational training to the Foundation Dentist practitioner and to provide a payment to the contractor to cover service costs. The payments are only intended to meet the costs of providing Dental Foundation training to those graduates who are required to complete 12 months Foundation training to remain on the performers lists (apart from any “relevant period of employment” determined in accordance with Regulation 28 (3) of the National Health Service (Performers Lists) Regulations 2004). How do I apply on line?

Where will I work?
In a general practice or salaried services where one of the dentists has been appointed as a Trainer, having been judged to offer both the guidance and the environment necessary to allow a new graduate rapid and complete transition to the role of a general practitioner.
How do I get appointed?
The Deanery will be using a Centralised Recruitment Process. An on line application form must be completed as detailed on the West Midlands Deanery website. See page 55 for the Sequence of Foundation Dentist Appointment for August 2010

3 Should I accept the Placement?
If you agree to accept a position for training you are bound by the legal and ethical frameworks that exist in any recruitment procedure. Do not accept a position until you are certain. You may be asked to sign a “Letter of Intent”:- this pre-contractual agreement, signed before graduation, gives a sense of security to both parties. Do not sign more than one “Letter of Intent”.
What is special about my appointment?
You will be employed as a Performer on a salary. This will allow you to manage patients free from immediate financial pressures. This is in contrast with the previous Associate arrangements, where payment is based on the amount of work that is done. You also have the benefit of an assured income from the end of the first month in practice.
How will I be paid?
Your Trainer will arrange payment for you, via the Business Services Agency, as an employee. The salary will be approximately £2,486.00 per month from 1st April 2009. This is raised annually in the light of the pay awards in the General Dental Services. Your payments will be monthly in arrears and will be paid via your Trainer.
When is the study day course held?
This is held on Fridays during normal University terms, allowing approximately 30 whole day sessions. There may be occasional variation from this format including residential elements.
Which study day course will I attend?
This will depend on two factors. Firstly, the time of year you wish to start vocational training. If it is an August start you will be based at Birmingham, Stafford, Coventry or Worcester or one of the proposed 2 new schemes depending on your practice location. However, if it is a February start you will be based at Dudley.
Who pays for the study day course?
The courses are centrally funded and most reasonable expenses incurred by Foundation Dentists can be reclaimed from the local Primary Care Trust.
Can I have a holiday?
Yes, you are allowed 5.6 weeks leave is equivalent to 28 working days, including 8 bank holidays for an employee who works five days a week. However, this must be taken during the vacation, not during the study day course terms.
What if I fail to attend a study day session?
The study day course is part of your salaried appointment and attendance is compulsory. If you miss a session you will be asked to arrange an equivalent postgraduate training session in your own time and provide proof that you have attended.
4 What if I have problems?
Where appropriate, talk to your Trainer. Otherwise, the Course Organisers are very willing to help. In the case of sickness, you are allowed four weeks sick leave. See pages 19 & 21 for full details.

What if I want to stay in the practice at the end of the year?
If you and your Trainer decide that you wish to continue in the same practice, participation in the scheme in no way prevents this happening. You will, however, have to apply to the Primary Care Trust in your area and ask whether they are willing to fund a contract for you to continue to provide National Health dental services in this practice
Do I get anything at the end of the year?
The Postgraduate Dental Dean issues a certificate, subject to your completion of the course. If you leave the course or practice, before the end of the year you will not be eligible to work as a Performer or Provider in the National Health dental services.
Can I undertake Dental Foundation training as a part-time Foundation Dentist?
Arrangements may be made to accommodate individuals who are only able to undertake part- time appointments. If this should apply to you, please contact the local Vocational Training Adviser, whose details are given in the back of this booklet, to discuss the possibilities.
5 The Trainer’s role in Foundation Training
The West Midlands Vocational Training Schemes in General Dental Practice can accept up to 60 practices per year in which to place dental graduates new to general practice. It is anticipated that this number will increase by 24 with an additional 2 schemes commencing in August 2010.
The practitioner who wishes to become a Trainer should demonstrate awareness of the current patterns in dentistry and have taken part in continuing postgraduate education. The physical circumstances of the practice should reflect good contemporary standards of equipment and organisation. It is most important that there should be an adequate workload to ensure that sufficient experience is gained within the training year.
The training practice should be one in which the new graduate undergoes the initial stages of general professional training within the environment of general dental practice. To this end, a Trainer is appointed in each practice to be responsible for the day-to-day guidance of a FD. The Trainer Who is eligible?
A Trainer should be an experienced practitioner with high clinical and ethical standards and be in good standing with the GDC, PCT and other regulating bodies. A practitioner must have declared superannuable earnings of £20,000 within the GDS as the minimum level of commitment required to providing dental care within the GDS before being considered for appointment. They should have a minimum of four years experience in general practice/community dental service on the date of commencement of the Foundation Dentist.
What is the role of the Trainer?
The Trainer/FD relationship is the fulcrum of the scheme. It is intended that it will be closer than previous Associate/Principal relationships. The emphasis will be on developing an interchange that allows the Trainer to form an awareness of the FD’s progress on the one hand, and the FD to be able to call on the Trainer's experience and guidance on the other. Although the Trainer’s role may be shared between two practitioners, preference will normally be given to individual applicants, willing to undertake sole responsibility.
What are the responsibilities of the Trainer?
1. The Trainer is required to employ the FD under a standard national contract previously drafted by the Committee on Vocational Training. Details of the current contract are to be found later in this handbook. It is emphasised that this places on the Trainer the responsibility for any errors and omissions on the part of the FD. The FD becomes an additional performer within the practice. 2. On appointment, the Trainer will be obliged to attend a Trainer Preparation Course. This will seek to develop the skills required in the one-to-one teaching situation and generally indicate methods of preparing the practice for a FD and relating to them when in post. 3. The Trainer must be available for day-to-day guidance of the FD in the practice on a minimum of three days a week. 4. The Trainer must set aside a period of one hour each week for a formal in-practice seminar. This must be in normal practice working hours.
6 5. The Trainer must provide surgery conditions and facilities to allow the FD to work at least 28 hours per week when the study day course is running and 35 hours at other times. Unsocial hours of work should be avoided.
6. The Trainer will require the FD to attend the study day course. The course will occupy approximately 30 days per year, usually a Friday, corresponding to the University terms. Absence for reasons other than sickness will be allowed only in exceptional circumstances. Repeated unexplained absence will be interpreted as withdrawal from the scheme by the Trainer and the FD.
7. During the year, Trainers will be asked to attend meetings with the Course Organiser. These are usually held each term at the Postgraduate Centre concerned.
8. The Trainer is required to attend a minimum of 14 half-day sessions of postgraduate education during the training year. This should include attendance at sessions involved directly with the course such as the Trainer Preparation Course and meetings with the Course Organisers. Trainers are required to attend at least one study day course session each term – this will be recorded and can be considered for verifiable CPD.
9. The Trainer will be asked to assist with the general progress of the scheme. This will include completion of the interviews and assessment details contained within the Foundation Training and Learning Portfolio. The course programme will usually involve an annual conference for Trainers and FDs at which attendance is expected.
How am I appointed as a Trainer?
In this booklet is an application form and a self-assessment document for you to complete. You will also need to fill in a form on which you give a brief practice description. This description will be available to potential FDs so please ensure that it conveys a clear picture of your practice. Once these forms are returned to the NHS West Midlands Workforce Deanery, a practice visit is arranged in which the facilities within the practice are inspected by a team representing the West Midlands Deanery. A copy of the checklist used by the visiting team will be found later in the handbook (see page 27). Further discussions regarding the course can usually take place at this visit. Following the practice visit, a short formal interview by several of the members of the Deanery is conducted, after which the final offer of appointment may be made by the Postgraduate Dental Dean. References may be asked for and taken up by the Deanery. The Trainer does not take up the appointment until a FD joins the practice. The appointment runs for one year from that date.
Who chooses my Foundation Dentist?
From August 2010 the Workforce Dental Team will introduce a new selection process for Foundation Dentists applying to complete their Dental Foundation Training Year 1 in the West Midlands. The process will be chaired by John Gilmour, Associate Postgraduate Dental Dean for Vocational Training.
What is the FD told about the course?
Please consult the details given earlier in this booklet.
7 Do I get paid as a Trainer?
A Trainer's grant is payable monthly via the BSA, this will be approximately £746.00 from 1st April 2009. The FD's salary (including the employer's NI contribution) will be fully funded from the BSA, on instruction from your local PCT. The sum of £5,221.00 from (1st April 2009) per month also accrues to the training practice as the “service cost” of the work undertaken by your FD each month.
What happens if I do not find a suitable Foundation Dentist but still wish to become a Trainer?
You will be required to reapply for the next available scheme, but should discuss the situation with your local Course Organiser for clarification.
Are all graduates eligible to undertake vocational training?
Whilst all UK nationals or nationals of EEA who qualify in UK dental schools or dental schools outside the EEA must undertake Foundation training or its equivalent to become a Performer or Provider in the GDS, other individuals may not be able to become vocational dental practitioners. If in doubt, and before offering appointment, please contact the NHS West Midlands Workforce Deanery (Tel 0121 695 2588/2590) or your local Course Organiser for guidance.
What happens if there are problems with the Foundation Dentist?
The Course Organiser, in whose scheme you are based, is most willing to attempt solution of problems, and should be contacted at the earliest opportunity if problems occur.

What difference is there in employing a FD?
As an employer you are bound by law to comply with employment, health and safety and liability insurance legislation.
What further guidelines are there regarding the criteria for appointment as a Trainer and approval of the practice facilities?
The application forms (pages 39 - 53) and the Practice Visit Checklist (pages 27 - 35) should be studied to indicate the information that will be required before consideration by the interview panel for appointment as a Trainer. The following section in this booklet describes the person specification required to become a Trainer.

The role of the Trainer requires considerable commitment to the FD and the VT scheme, both of which will provide some stress and possible conflict with the Trainer's own patient care and practice organisation. It is essential that this fact is appreciated by applicants who wish to become Trainers. 11 The Practice
The characteristics and features of a practice which will be assessed during the practice visit conducted by the Associate Dental Dean (Vocational Training), or a GDP Adviser and another general practitioner representing the Deanery, are given in the Practice Visit Checklist (pages 27 - 34). This checklist should be referred to when reading this section. The property within which the practice is situated should provide sufficient accommodation to house both the current practice personnel and a new FD. It is desirable that the maintenance and decor of the practice is suitable for both the treatment of patients and the well-being of all staff. Ideally, provision of a suitable room in which practice tutorials can occur without disruption should be suggested at the time of the practice visit. The organisation of reception and appointment systems should provide a model of clarity and efficiency, which demonstrates logical and appropriate timing of patient treatment sessions. Ideally, such systems should be adaptable for the presence of a FD in the practice. Computer systems must be able to fulfil the same requirements as well-planned manual systems. The practice must provide Internet Access for all of the dental team. The patient records within the practice must be readily decipherable, attributable to a practitioner, and contain sufficient information to allow the safe and efficient treatment of patients. Ideally, such records should show evidence of the planning of patients’ treatment and the presence of regularly updated medical histories. Radiographs which form part of the patients’ records must be of a sufficient quality and type to be useful to the clinical care of that patient. The justification for taking radiographs and a report on their findings should appear in the notes.
The surgeries for both the Trainer and FD must be of a sufficient standard to allow for modern, safe and hygienic dental care of patients. It is essential that all facilities necessary to carry out such are available to the FD. Each surgery should have evidence of adherence to the prevention of cross infection policy followed by the practice. Ideally, the surgeries for Trainer and FD should be closely related to allow ready access. Application to the scheme prior to the provision of a FD’s surgery and equipment is possible, but appointment as a Trainer will not be confirmed until such a surgery has been completed and inspected. A prevention of cross infection policy must be present in the practice. The presence of autoclaves is essential and these should be of sufficient number to allow for breakdowns and maintenance. Cleaned, sterile instruments, including handpieces, must be available for each new patient. They must be present in sufficient numbers and stored on sterile trays. Methods of cross infection control which rely on other regimes will be critically examined during the practice visit. Personnel within the practice must also have available gloves, masks and spectacles for their own and their patients’ protection, together with a suitable hand washing regime. Disposal of hazardous waste, including “sharps” must be by recognised contractors. Intra-oral radiographic equipment must be readily available to the FD, though not necessarily for his or her sole usage. The set should be safe and serviceable and the regime for taking and processing film must follow displayed local rules and conform to current radiological usage guidelines. Sets must be of more than 50Kv and allow long-cone paralleling techniques to be employed and, ideally, rectangular collimation. The provision of clean, dry compressed air from a safely installed and maintained compressor is essential. Dry-line suction systems must be vented externally. Amalgam separation should be present in suction systems. Adequate arrangements should be made for laboratory support of the FD. Equipment must exist in the practice for dealing with medical emergencies and staff must be trained in its usage. It is essential that basic life-support, including oxygen-enriched forced ventilation, is possible. Where drugs are held, they must be in date and organised to allow their safe administration to patients. If sedation is carried out in the practice, appropriate monitoring and resuscitation equipment must be available. 12 There should be adequate bench reference books available in the practice.
Employment legislation requires that the practice employs its staff under written terms and conditions, that there is a current Employer’s Liability Certificate on display and that a Health and Safety Code is available. It is also a requirement that a COSHH document exists and advisable to ensure the electrical safety of appliances within the practice. All staff should be vaccinated against Hepatitis B and a record kept of their immune status.
The FD will require an experienced dental nurse preferably, but not essentially, qualified and registered. Where appropriate all support staff must be registered with the GDC. The practice should show evidence of staff management and training. The practice should also provide a wide range of care for its patients and have the necessary arrangements for handling dental emergencies outside surgery hours and an organised policy on referrals for secondary care of its patient group when required.
The workload of the practice must be sufficient to provide adequate experience for a new graduate without the pressures of an overlarge patient group. The Trainer needs to be able to show that he or she provides not only a wide range of GDS treatments, but also will have sufficient time and flexibility available to undertake the Trainer’s role.
At the time of the visit the applicant will need to indicate that s/he has an understanding of the essential difference in employing a FD and that there are significant commitments both to their own training and that of the FD within the VT Scheme. Essential aspects such as ready access to each other’s surgeries and compulsory attendance at certain scheme activities must be clearly understood. The visitors would ideally wish to hear of previous professional relationships, especially with newly qualified dentists, which have proved harmonious and long- lasting.
APPROVAL AS A TRAINER REMAINS A COMPETITIVE PROCEDURE AND DESPITE APPLICANTS MEETING THE ABOVE CRITERIA APPOINTMENT CANNOT BE GUARANTEED
Practice Visit Protocol
Normally, practices will be visited every second cycle of recruitment (i.e. Approximately every two years) Each year, at the time of application, all practices will complete a self-assessment form and return it with the application form and practice description All practices receiving a visit, will have the self-assessment document reviewed against a checklist during a practice visit.
13 Sequence of Trainer’s Appointment
1. Interested practitioner answers advertisement for Trainers circulated via PCTs & the Deanery Website. Enquiries received by the NHS West Midlands Workforce Deanery. 2. Handbook with questionnaire/application forms and practice description pro-forma sent to practitioner. 3. Completed questionnaire, self-assessment document and practice description returned to the NHS West Midlands Workforce Deanery. 4. Practice visit arranged and completed by Course Organiser(s)/practice visitors. 5. Report on practice prepared. Practitioner invited by the Associate Postgraduate Dental Dean for formal interview. 6. Following successful interview, letter offering approval of Trainer sent by Associate Postgraduate Dean to practitioner. Practitioner required to acknowledge that he accepts responsibility as a Trainer as outlined in handbook (an E Version is also available for acknowledgement purposes). Acknowledgement sent to NHS West Midlands Workforce Deanery. 7. On receipt of acknowledgement from practitioner, Associate Postgraduate Dean confirms approval subject to appointment of FD in practice. 8. Once FD appointed and Associate Postgraduate Dean has been informed, Trainer sends PCT details of FD and a copy of the letter of confirmation. 9. Three copies of the Vocational Training in the General Dental Services FD’s Contract are signed by Trainer and Foundation Dentist. One copy is retained by the Trainer, one by the FD and one is returned to the NHS West Midlands Workforce Deanery. 10. New Trainers will be expected to attend a new trainer induction evening arranged prior to practice details being placed on www.westmidlandsdeanery.nhs.uk.

Venue
Study day courses for Foundation Dentists are run from the Postgraduate Centres at City Hospital, Birmingham; Russells Hall Hospital, Dudley; Stafford District General Hospital, Stafford; Walsgrave Hospital, Coventry and Worcestershire Royal Hospital, Worcester.
Duration
The timing of the courses corresponds approximately with the University terms, occupying thirty days during the year. Sessions are normally held on a Friday from 9.30am - 4.30pm with suitable breaks for lunch and refreshments.
Format
There is a mixture of seminar presentations, workshops, "hands-on" sessions, practice visits, residential conferences and occasional trips to more distant venues requiring an overnight stay.

Topics are varied, and subject to constant review, but may typically include:

Contributors
The presenters of each session are highly regarded in their particular field of activity, whether within or without dental practice. They are, however, asked only to guide sessions and it is hoped that FDs will volunteer their own ideas, and those of their Trainers, at each session for the maximum benefit of all on the course.
Attendance
Foundation Dentists are required to attend all sessions of the study day course, unless absence is enforced by other circumstances. The long inter-term periods and the half- term break allow holiday arrangements outside term-time. Absences are discourteous to contributors and Course Organisers and reduce the worth of the Scheme to all participants. We welcome Trainers to any of the sessions and require them to attend on at least one occasion each term.
15 The Agreement
There is a national contract for use between Trainers and DF1 (Foundation Dentists). The wording is reproduced on pages 22 - 26. Some explanatory notes follow.
Vocational Training Scheme in General Dental Practice Guidance notes on the FD/Trainer contract (2008 REV)
Introduction
The contract has been approved as the national standard by the Conference of Postgraduate Dental Deans and Directors (COPDEND). It is a condition of approval as a Trainer by a selection committee that the standard contract is used when the Trainer/Foundation Dentist pairing is made. A copy of the signed contract must be deposited with the Postgraduate Dental Dean (Regional Adviser in Scotland). Any variation in the terms of the contract must be notified to the Postgraduate Dental Dean before the FD is in post.
These notes of guidance will help Trainers and FDs complete the contract properly, by explaining the terms used and the intentions behind some of the clauses. Misunderstandings can be avoided if both parties make time to think through the terms of the contract in advance. If any questions arise from the contract, advice should be sought from the Postgraduate Dental Dean or Regional/VT Adviser, who in turn may consult the British Dental Association.
The parties enter into the contract having agreed to abide by the educational agreements that they have each made with the Deanery and mindful of the purpose of vocational training, which is to introduce the FD to general dental practice in a protected environment while enhancing skills. The principles in these agreements underpin the contract.
A Trainer is an experienced practitioner who has been approved by the relevant local selection committee. The training practice will also have been approved within the training scheme. Once the FD has started work, the Trainer will be paid a grant and reimbursed the FD’s salary.
It is for the Postgraduate Dental Dean to determine what further training is required if vocational training is incomplete at the end of the contract. If, exceptionally, the training period has to be extended for any reason this should be done by entering into a new contract.
A FD is appointed by a Trainer solely at the Trainer's discretion. The FD is the Trainer's employee and works as a Performer in the National Health Service. After the training period is over, the FD may continue to work in the practice as an employee or an Associate or may move on to another practice. In the NHS, this is subject to the necessary funds being available within the Provider’s contract with the Primary Care Organisation. In extreme circumstances it is possible that approval of the Trainer may be withdrawn. If this happens, every effort will be made to find the FD a new training practice in order to complete vocational training.
A FD may have two joint Trainers or 2 Trainers and 2 FDs may be appointed at the same practice. 16 Part-time vocational training
A contract for part-time vocational training is available from postgraduate offices.
Terminology
A Postgraduate Dental Dean may also be known as the Director of Postgraduate Dental Education. In Scotland a Regional Adviser is known as a Regional General Practice Vocational Training Adviser (RGPVT Adviser). A Vocational Training Adviser (VT Adviser) is known as a General Practice Vocational Training Adviser (GPVT Adviser). References to the Postgraduate Dental Dean should be taken as referring to the RGPVT Adviser.
Completion of the contract
Preamble
The preamble places the contract in context and lays down the fundamental principles.
If the FD is to work at more than one practice location, all of these need to be specified.
Clause 2
The Trainer must inform the Postgraduate Dental Dean (or equivalent) and the PCT of the appointment of a FD and the FD’s starting date in the practice. The agreement automatically terminates after one year. However it can be terminated at any time by giving one month's written notice. If both parties agree, a shorter period of notice or pay in lieu may be given.
Clause 3
The salary is specified in the Statement of Financial Entitlements. During the currency of a training contract the salary may be altered. This is why the contract does not specify the amount of salary. It is for the Trainer and FD to agree when the salary will be paid but payment at the end of each month's work is normal in salaried employment. The FD is entitled under employment law to an itemised payslip each month.
Clause 4
This clause may be deleted if the FD opts out of the NHS Superannuation Scheme. A FD considering doing so should take appropriate professional advice.
Clause 5
Every practitioner must be protected against professional risks. Trainers should note that they may be liable for the actions and omissions of their trainees, but that their professional indemnity should cover their defence. 17 Clause 6
(6.5) exceptionally, tutorials may be provided outside normal hours, when this is appropriate - for example, a session on re-opening a surgery out-of-hours. Tutorials are expected to continue on a weekly basis throughout the twelve-month term of the contract.
(6.9) The Professional Development Portfolio is crucial to the assessment of completion of vocational training and must be maintained carefully by both FD and trainer. This includes taking part in the assessments and final appraisal.
Clause 7
(7.1) The Trainer is responsible for the fulfilment of the terms of his/her contract with the PCT and so the VDP must agree to obey the Trainer's direction; and
(7.2) the FD must work as a full, cooperative member of the practice team.
(7.3) any private fees for work done by the FD will accrue to the Trainer. As it is the NHS's vocational training scheme it is not expected that the FD will do much private work. No other fees should be paid to the FD in addition to the salary except any reimbursement of travel costs in respect of domiciliary visits.
(7.5) Hours of work must be agreed in advance. It is expected that a FD will normally work 35 hours a week, exclusive of lunch breaks, including any study day courses.
(7.6) Any employment undertaken by the FD in addition to the contract must not impinge on the FD’s commitment to vocational training nor compromise the FD’s ability to complete vocational training. (See the stipulations in Clause (7.6)).
(7.7) this clause is not intended to prohibit sharing of confidential information between Trainer and FD during and as part of weekly tutorials.
(7.10) A FD has to make a commitment to the course, just as a Trainer must undertake to attend courses under his/her contract with the Postgraduate Dental Dean. The FD will not take holidays which clash with study days, so absence from the study day course is acceptable only on grounds of illness or other unavoidable cause.
(7.13) A FD will be expected to attend additional studies, for example as a result of not being able to attend a study day because of illness.
Clause 8
If a FD agrees to work on a public holiday, he or she should be given a days leave in lieu.
Clause 9
5.6 weeks leave is equivalent to 28 working days, including 8 bank holidays for an employee who works five days a week. 18
Clause 10
A note on statutory sick pay appears at the end of these notes. In case of frequent absences the Trainer may ask for medical evidence for periods of absence of less than seven calendar days. Any leave in addition to the normal holiday entitlement and reasonable sickness can only be taken with the agreement of the Trainer and the Regional or VT Adviser. Otherwise the contract must be terminated.
Clause 11
In addition to statutory maternity leave, the FD has the right to reasonable time off with pay to receive antenatal care and to attend antenatal classes. BDA advice sheet D9 Employees' family arrangements and pay gives further information on maternity, adoption and paternity rights. Absence due to maternity/adoption/paternity should be treated like any other absence from the scheme: the period of training missed should be made up afterwards. Clause 12
This clause is to protect the Trainer's goodwill after the FD’s departure. It can only be waived by the Trainer and a FD must note that he/she is under a legal obligation to observe whatever restrictive covenants (binding out arrangements) are entered into. The reference to 'Performers' includes the FD. In other words, the FD should not accept anyone who was treated by himself/herself at the training practice.
Questions and answers What can be deleted from the contract? Amendment of the terms of this nationally agreed contract is not permitted. What can be added to the contract? In theory, anything which does not negate the other clauses. Both sides should take advice prior to the drawing up of additional clauses and should notify the Postgraduate Dental Dean of the changes they intend to make. What if there are joint Trainers? They should each enter into the contract with the FD and will be jointly and severally liable for training. The VDP must be clear who is responsible for his/her training at any one time or in any one place. What about sick leave? The FD may be entitled to statutory sick pay and the Trainer should inform the BSA Dental Services Division/Health Board/Central Services Agency of any sums received under SSP: reimbursement of the salary may, in certain circumstances, be defrayed by the amount of SSP received. See also the note at the end of this guidance. What about maternity/paternity leave? 52 weeks absence is allowed under clause 11. Maternity leave is counted separately from sick leave. The FD continues to receive her salary but if she is entitled to statutory maternity pay, the Trainer should inform the Health Board/Dental Practice Board/Central Services Agency of any sums received under SMP. Female employees have full protection against dismissal on grounds related to pregnancy. Further advice is available from the BDA. Can the contract be further extended? No, but a new contract may be entered into for educational or other reasons, as under mandatory vocational training it is important for a FD to be given every opportunity to complete vocational training. A new contract can only run for a limited period, if permission is given by the Trainer and Adviser and required by the Postgraduate Dental Dean. 19 Who is clinically responsible?
The FD is engaged on the understanding that he/she is skilled to perform certain duties and will do so with reasonable professional care. However, the Trainer as employer takes full responsibility under his/her contract with the PCO for the FD’s acts and omissions. The FD could appear before the General Dental Council as a fully registered practitioner in, for instance, a case of professional misconduct and must comply with his/her obligations under the Performers Lists regulations. How should forms be completed? Forms should be completed under the contractor's number with the FD’s suffix. The FD should sign the forms. The FD may prescribe in the same way as the Trainer, using his own stamp on the appropriate form. What about patient charges? The Trainer will be responsible for charges not collected by the FD. How does employment law relate to the FD? The standard contract complies with the Employment Rights Act 1996 (as amended) (Contracts of Employment and Redundancy Payment (Northern Ireland) Act 1965 as amended). The Trainer's general obligations as an employer will already exist with regard to practice staff. What about grievance procedures? Procedures must be established within a practice for dealing with grievances. Any serious difficulties should be referred to the Course Organiser/VT Adviser. What about insurance? The Trainer has the normal employer's liability under the Health and Safety at Work Act 1974 (Health and Safety at Work (Northern Ireland) Order 1978). What is the FD’s tax liability? The VDP is taxed on a PAYE basis, which the Trainer is responsible for deducting. What about National Insurance and superannuation? The Trainer is responsible for the employer's NI contribution and for deducting the employee's contribution from the FD’s pay. If the FD is a member of the NHS Superannuation Scheme, 6.5 per cent of the FD’s pay will be deducted at source and NI will be deducted at the lower contracted-out rate. 20 For more information

STATUTORY SICK PAY
Statutory Sick Pay (SSP) is the minimum statutory amount payable to an employee who has been absent from work through illness.
Notification
In order to be considered for SSP, an employee should notify the employer of the illness. The employer is entitled to ask for reasonable evidence of incapacity, such as self-certification, for periods of illness lasting fewer than seven days, or a doctor’s note for illnesses of seven days or longer.
Entitlement
An employee who is sick for three calendar days in a row or fewer is not covered by SSP. Under the FD contract, however, a total of four weeks’ accumulated sick leave is paid at normal salary before SSP applies. There are rules governing eligibility for and the amount of SSP payable and for how long, depending upon the amount of sick leave taken in a year and how separate periods of incapacity for work link together. Advice should be taken from the BDA in individual cases.
SSP is subject to NI and tax contributions and is paid when usual salary payments are made, for example weekly or monthly.

WHEREAS this contract of employment applies exclusively to arrangements made under dental vocational training schemes in England, to which nationally agreed terms apply
WHEREAS the purpose of the national dental vocational training scheme is to enhance clinical and administrative competence and promote high standards and to introduce the trainee to general dental practice in a protected environment while enhancing skills
WHEREAS both the Trainer and the Trainee have entered into educational agreements with the [ ] Deanery
WHEREAS the Trainer has been approved as a Trainer in General Dental Practice and the Trainee wishes to enter employment on a dental vocational training programme with the Trainer

1 The Trainer will employ the Trainee and the Trainee will serve the Trainer as an employed performer in the said practice to the best of his/her ability and will do his/her best to promote the interests of the Trainer and to serve the patients of the practice. 2.1Subject as hereinafter provided (and in particular subject to earlier termination as provided in clause 2(2) below) this agreement shall start on the ______day of ______20___ and shall automatically terminate on the ______day of ______20 ___. 22
2.2Notwithstanding clause 2.1 above this agreement may be terminated at any time by either party giving one month’s notice in writing to the other.
3. During the continuance of this employment the Trainer shall pay to the Trainee a salary at the rates laid down from time to time in the Statement of Financial Entitlements payable to General Dental Practitioners under the National Health Service. Payments will be made in arrears by monthly instalments on the ______day of each calendar month.
4. The Trainee will be subject to the NHS Superannuation Regulations and the Trainer will account to the proper authority for all contributions and other payments for which the Trainee is liable under the said Regulations.
5. during the period of the employment both parties shall at their own expense be members of an appropriate medical defence organisation.
6. During the continuance of this employment the Trainer shall:
6.1work in the same premises as the Trainee in a surgery to which the Trainee has sufficient access to allow him/her to fulfil his/her obligations under the contract, for not less than 3 days per week;
6.2be available to the Trainee for guidance in both clinical and administrative matters;
6.3provide reference material for the use of the Trainee;
6.4allow and require the Trainee to attend the appropriate study day course of approximately 30 days in the year arranged by the Regional Adviser/VT Adviser in General Dental Practice;
6.5provide weekly tutorials for the Trainee, such tutorials to take place during normal practice hours and to be of a minimum of one hour’s duration;
6.6provide the Trainee with satisfactory facilities to comply with health and safety and infection control standards as contained in the Department of Health’s guidance HTM 01-05 including an adequate supply of handpieces and instruments sufficient to allow them to be sterilised between patients;
6.7 the trainer shall provide the trainee opportunities to perform a broad range of clinical procedures under the NHS and to ensure as far as reasonably practicable that there is an adequate patient flow to fully occupy clinical time;
6.8 provide the Trainee with administrative support and full-time assistance of a suitably experienced Dental Nurse;
6.9 complete the Foundation Training Portfolio provided by the Postgraduate Dental Dean or Regional Adviser/VT Adviser in General Dental Practice; 6.10 inform the Postgraduate Dental Dean forthwith and in writing if the circumstances of either the Trainer or the Trainee change in such a way as to alter the contract of employment;
23 6.11 fulfil the obligations and responsibilities of trainers in the national Dental Vocational Training Scheme in England and Wales as contained in the Trainer’s educational agreement with the Deanery
7. During the continuance of this employment the Trainee shall:
7.1 fulfil and obey all lawful and reasonable directions and orders of the Trainer and not at any time except in the case of illness or other unavoidable cause or permitted holidays be absent from the service of the Trainer without the Trainer’s consent;
7.2 work cooperatively with colleagues in the practice, in particular with the dental nurse assigned to him/her;
7.3 keep proper accounts of all professional visits, fees paid, all patients attended, operations performed including prosthetic work and all other business done by him/her for the Trainer and of all monies received and forthwith pay all monies so received to the Trainer or as the Trainer may direct;
7.4 keep all usual and necessary dental charts and an appropriate record of the work done for all patients attended to by him/her;
7.5 devote his/her whole time to the practice of the Trainer during the hours specified in clause 8 below
7.6 unless as part of the training course, not normally attend any patient or perform any operation or prosthetic work for any person other than the Trainer nor on his/her own account either carry on or be engaged in a dental practice nor accept any part-time or full-time dental appointment whether paid or unpaid or give any dental advice either gratuitously or for reward unless it be with the prior written consent of the Trainer and notification to the Postgraduate Dental Dean;
7.7 not whether during or after his/her employment disclose any professional secrets or any confidential information with respect to the Trainer or his/her family, patients, practice, or affairs or any directions given to him/her by the Trainer; such confidential information to include patient records, details of appointments, and financial information relating to the Trainer or practice;
7.8 observe and conform to the provisions of the Dentists Act 1984 so far as they relate to the Trainee or his/her employment and observe and conform to all the laws and customs and reasonable standards of practice of the dental profession;
7.9 in relation to any patient treated by the Trainee or desiring to be treated by the Trainee under the National Health Service comply insofar as possible with the GDS/PDS contract between the provider and PCT and NHS (GDS contract); 7.10 attend such study day courses as are set out in the published programme and shall not except in case of illness or other unavoidable cause absent himself/herself from any such course without the previous consent both of the Trainer and of the Regional Adviser/VT Adviser in General Dental Practice;
7.11 attend weekly tutorials with the Trainer 24 7.12 maintain and complete the Foundation Training Portfolio provided by the Postgraduate Dental Dean or Regional Adviser/VT Adviser in General Dental Practice;
7.13 undertake such educational studies as may be reasonably advised from time to time by the Regional Adviser/VT Adviser in General Dental Practice;
7.14 inform the Postgraduate Dental Dean and Trainer of any alteration in his/her circumstances which might affect this contract of employment;
7.15 fulfil the obligations and responsibilities of trainees in the dental vocational training scheme as contained in the Trainee’s educational agreement with the Deanery 8.1 The Trainee is normally required to work during the following hours: ______

9.1 The Trainee shall be entitled to 5.6 weeks’ holiday, including bank holidays, with full pay during the period of twelve months in the practice and pro rata for shorter periods. Such holidays shall be taken at the times agreed between the parties.
9.2 Where employment ends or is terminated or if the Trainee chooses to leave the practice, a payment will be made on a pro-rata basis in respect of any accrued holiday entitlement that has arisen in the relevant leave year but has not been taken on the date of termination.
9.3 A deduction will be made from the Trainee’s final pay on a pro-rata basis for any holiday taken in excess of their entitlement in that leave year, at the date of termination.
10. If absent due to sickness the Trainee will be entitled to statutory sick pay entitlements. If the Trainee is unable to attend work, for any reason whatever, they must contact the practice at the earliest possible time on the first day of absence and not later than ______[time] to give the reason for absence and, if possible, to say when they hope to return to work. Unauthorised absence will not be paid.
11. The Trainee shall be entitled to 52 weeks’ maternity/adoption leave and 39 weeks’ maternity/adoption pay or two weeks’ paternity leave/pay as the case may be. During a period of maternity leave, the Trainee’s entitlements under paragraph 9 to paid holidays and under paragraph 10 to paid sickness leave will accrue. Subject to her entitlement to Statutory Maternity Allowance the Trainee shall be entitled to 90% of her earnings for the first 6 weeks and for the remaining 33 weeks she shall be entitled to Statutory Maternity Allowance only. * For more information see Statutory Maternity Pay and Maternity Allowance at www.direct.gov.uk .

12. Nothing herein shall entitle the Trainee to any of the rights or expose him/her to any of the liabilities of a partner or constitute in any way the relationship of partners between the Trainer and the Trainee.
13. Should you have any query, grievance or complaint regarding your employment or the terms and conditions relating to that employment, you should raise the matter initially with the Trainer or the VT Adviser. The full procedure is set out in Appendix 1.
14. The full disciplinary rules in place in this practice are set out in Appendix 2.

1. Interested FD answers advertisement in the BDJ or directly via the West Midlands Deanery website. The FD can download a copy of the Dental Foundation Training Handbook from www.westmidlandsdeanery.nhs.uk
2. Applications will be received through I:CAMS. This process must be completed online. The opening date for applications is 13th January 2010.
3. 28th January 2010. Closing date for applications.
4. 1st February 2010. Long listing of applications. This will be based on the essential criteria for the qualifications section of the person specification.
5. FD interviews will take place over 3 days at the Clarendon Suites, Birmingham on the 11th March, 17th March and 18th March. The interview will relate to the person specification (Clinical, Communication, Management and Leadership, Professionalism).
6. On attendance at interview the applicant will rank the schemes in order of preference they wish to join. No guarantee can be made as to your preference and you MUST rank all schemes. Preferences will depend on how well the FD has scored at interview.
7. The top 48 applicants will be appointed to the 4 current schemes, subject to satisfactory references. In the event that one or two further schemes are confirmed this number will increase by 12 or 24 respectively.
8. A reserve list will be drawn up in the event of a successful applicant declining an offer.
9. 23rd April. A “Meet and greet” day will take place. On this day you will be able to meet all the trainers appointed to that particular scheme on an individual basis. There will be no guarantees as to the practice you will eventually be allocated and this will be dependent on your score at the initial interview with the highest scoring applicant having the greatest choice.
