RESOLVED that the list of planning applications to be determined under items 5 to 16 of the Agenda be noted.

114. PLANNING APPLICATION 07/01100/F - 34 - 40 RUDEN WAY, EPSOM DOWNS

The Committee considered a report on an application to demolish 36 Ruden Way and erect two two-bedroom apartments, ten three-bedroom houses and one four-bedroom house with associated parking and access at the above location.

An objector to the proposal, a representative of the Residents’ Association also objecting to the proposal and a representative of the applicant addressed the Committee. It was noted that a site visit had previously been held relating to this site.

RESOLVED that planning permission be REFUSED for the following reason:

surfacing limiting the scope for soft landscaping, and loss of trees within the site and the highway verge, tree litter and pressure for removal, would collectively harm the character and appearance of the area, in conflict with policy SE4 of the Surrey Structure Plan 2004 and policies Pc4, Ho9, Ho13 and Ho14 of the Reigate and Banstead Borough Local Plan 2005.

115. PLANNING APPLICATION 07/01733/F - 27 HOLMETHORPE AVENUE, REDHILL

Consideration was given to a report on an application for roof alterations including side, front and rear dormers at the above location.

RESOLVED that the planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004. 2. The materials to be used in the construction of the external surfaces of the extension hereby permitted shall match those used in the existing building. Reason: To ensure that the development hereby permitted is only constructed using the appropriate external facing materials or suitable alternatives in the interest of the visual amenities of the area with regard to Reigate and Banstead Borough Local Plan 2005 policies Ho9 and Ho13.

(NOTE: Councillor S.S. Banwait declared a personal and prejudicial interest in the above application and withdrew from the meeting during consideration thereof.)

116. PLANNING APPLICATION 07/01462/F - REAR OF 4-12 MILL LANE AND 179-187 NUTFIELD ROAD, MERSTHAM

The Committee considered a report on an application for the erection of two detached four-bedroom family homes with integral garages and associated 31st October 2007 PLANNING COMMITTEE - Continued 31st October 2007

landscaping at the above location, and it was noted that this application had been deferred from the previous meeting to enable a site visit to take place (Minute No.103).

RESOLVED that planning permission be REFUSED for the following reasons:

1. The proposal would constitute a cramped form of development, which by virtue of its bulk, scale, massing and obtrusiveness would adversely affect the character of the locality. It would therefore fail to comply with policy SE4 of the Surrey Structure Plan 2004 and policies Ho9, Ho13 and Ho14 of the Reigate and Banstead Borough Local Plan 2005 and the provisions of the Reigate and Banstead Local Distinctiveness Design Guide. 2. The proposal, by virtue of its size and massing, would have an overbearing effect on adjoining residential properties, harmful to the amenities thereof and contrary to policy SE4 of the Surrey Structure Plan 2004 and policies Ho9, Ho13 and Ho14 of the Reigate and Banstead Borough Local Plan 2005 and the provisions of the Reigate and Banstead Local Distinctiveness Design Guide.

117. PLANNING APPLICATION 07/01620/F - ORCHARDS, 8 THE AVENUE, TADWORTH

The Committee considered a report on an application for the erection of 24 x two-bedroom apartments following demolition of the existing house at the above location.

RESOLVED that consideration of this application be DEFERRED to the next meeting of the Committee to enable a site visit to be held on a suitable date and time to be agreed in consultation with the Chairman.

118. PLANNING APPLICATION 07/00109/F - ASDA STORES LIMITED, REIGATE ROAD, BURGH HEATH

Consideration was given to a report on an application for the reconfiguration of the existing car park and alteration to existing vehicular access to Reigate Road at the above location.

RESOLVED that subject to an amendment to condition 4 below to require larger trees to be planted, then planning permission be GRANTED subject to the following conditions: 31st October 2007 PLANNING COMMITTEE - Continued 31st October 2007

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004. 2. Prior to the commencement of any development works, including ground preparation or demolition, a detailed arboricultural method statement (AMS) shall be submitted to and approved in writing by the Local Planning Authority. This shall relate directly to the tree protection plan [TPP] approved. All works shall be carried out in strict accordance with these details when approved or as otherwise agreed in writing by the Local Planning Authority. These submissions shall be in accordance with British Standard 5837:2005 (Trees in Relation to Construction). Reason: To ensure good arboricultural practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Ho9, Ho13 and Ho15 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE9 of the Surrey Structure Plan 2004. 3. No pruning, removal or other works to the retained trees and hedges, located both within and overhanging the site, shall take place during construction, or for one year after completion except with the prior written approval of the Local Planning Authority. Any tree work already approved as part of this consent and any other work undertaken should be done in accordance with British Standard 3998:1989 ‘Recommendations for Tree Work’. If any of the retained trees or hedges within the site, controlled by this condition, are removed, dies, or become significantly damaged or diseased within one year of completion, it shall be replaced before the expiry of one calendar year by tree/s or hedge/s, to a planting specification agreed in writing by the Local Planning Authority. Reason: To ensure good arboricultural and landscape practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Ho9, and Ho13 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE9 of the Surrey Structure Plan 2004. 4. No development shall take place until full details of soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. Any trees, shrubs or plants planted in accordance with this condition 31st October 2007 PLANNING COMMITTEE - Continued 31st October 2007

which are removed, die or become damaged or become diseased within five years of planting shall be replaced within the next planting season by trees, shrubs of the same size and species. Reason: To preserve and enhance the visual amenities of the locality with regard to Reigate and Banstead Borough Local Plan 2005 policies Ho9 and Pc4. 5. The new proposed traffic signalised junction with the Reigate Road (A240) and associated highway works, to include the narrowing of the access to the south of the site, shall be designed/constructed in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority, but broadly in line with the design as shown in drawing number 2005-052/SK-06. The works shall be phased in accordance with drawing number 2005-052/SK-08 Rev A, where phase 1 shall be completed before phase 2 is commenced. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to Reigate & Banstead Borough Local Plan 2005 policy Mo5 and Surrey Structure Plan 2004 policy DN2. 6. Before completion of the signalised junction, space shall be laid out within the site in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority for cars and cycles to park. The car and cycle parking areas shall be used and retained for its designated purpose. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to Reigate & Banstead Borough Local Plan 2005 policy Mo5 and Surrey Structure Plan 2004 policy DN2. 7. No development shall take place until a Method of Construction Statement, to include details of the programme of works, to include measures for traffic management and interim access and entry arrangements, has been submitted to and approved in writing by the Local Planning Authority. Only the approved details shall be implemented during the construction period. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to Reigate & Banstead Borough Local Plan 2005 policy Mo5 and Surrey Structure Plan 2004 policy DN2. Informatives: 1. The use of a suitably qualified arboricultural consultant or competent person is considered essential to provide acceptable submissions in 31st October 2007 PLANNING COMMITTEE - Continued 31st October 2007

respect of the relevant tree related conditions above. The submissions should be compliant with the recommendations contained in British Standard 5837:2005 (Trees in Relation to Construction) in particular those found in sections 7 and 9 of the above British Standard. They should also provide a supervisory regime for their implementation and monitoring. They shall include and apply to all retained trees and hedges within the site and any significant trees overhanging the site 2. Those details submitted with the application do not include a specific programme of tree work including those for ‘access facilitation’ and these with a schedule of tree/vegetation removal and retention are required as part of the landscaping details required by condition 4. 3. The permission hereby granted shall not be construed as authority to carry out works on the highway. The applicant is advised that a Section 278 Agreement must be entered into with the Highway Authority before any works are carried out on any footway, footpath, carriageway, verge or other land forming part of the highway. Details of this can be requested from Transportation Development Control, Surrey County Council. 4. The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or damage the highway from unclean wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. 5. The proposed design of the scheme is acceptable to the Highway Authority. The proposed traffic signalised junction would have to be connected to the County Council SCOOT system. This can be designed as part of the details, and agreed through the Section 278 Agreement with the Highways Authority. 6. The proposed signalised junction should be redesigned to include facilities for a Toucan crossing. This will include minor adjustments such as widening the crossing points and widening the pedestrian refuge island, this again can be addressed through the detailed design through the Section 278 Agreement. 7. The signal specification for the proposed junction would require Surrey County Council approval. The County Council are willing to design the specification for the applicant, as this would reduce the time and cost. The applicant should request a quote from Surrey County Council if this design is required.

119. PLANNING APPLICATION 07/01765/CU – 51A HIGH STREET, REIGATE

Consideration was given to a report on an application for the change of use from Class A1 (retail) to mixed A1/A3 (coffee shop) at the above location.

RESOLVED that subject to the prior advertisement of the application as a departure from the provisions of the Development Plan and subject to consideration of any further representations, then the Head of Building and Development Services in consultation with the Chairman and Ward Member, be authorised to GRANT planning permission subject to the following conditions:

1. The premises shall not be used other than as a coffee bar serving coffee, other hot and cold drinks, sandwiches and similar light refreshments for consumption on or off the premises, and for associated retail sales. Reason: The change of use has further reduced the proportion of A1 retail use within frontage B to below 80% and this is only acceptable in view of the contribution the user may make to the vitality and viability of the centre, with regard to Reigate and Banstead Borough Local Plan 2005 policy Sh7 and Supplementary Planning Guidance on Retail Changes of Use within Town Centres. 2. No primary cooking of unprepared food shall be carried on within the premises. Only reheated or cold food that has been prepared elsewhere shall be served within the premises. Reason: For the avoidance of doubt, having regard to the nature of the coffee shop use which specifically excludes sale of hot food for consumption on or off the premises. Accordingly, the development makes no provision for ventilation or extraction equipment which otherwise might have had an unacceptable impact on the character or appearance of the Reigate Town Centre Conservation Area, contrary to policies Pc13 and Rg1 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE5 of the Surrey Structure Plan 2004. 120. PLANNING APPLICATION 07/01388/ADV – 51A HIGH STREET, REIGATE 31st October 2007 PLANNING COMMITTEE - Continued 31st October 2007

Consideration was given to a report on an application for a fascia and projecting sign at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. No advertisement is to be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission. Reason: To comply with Regulation 2(1) and Schedule 2 of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007. 2. No advertisement shall be sited or displayed so as to: (a) endanger persons using any highway, railway, waterway, dock, harbour, or aerodrome (civil or military); (b) obscure, or hinder the ready interpretation of, any traffic sign, railway signal or aid to navigation by water or air; or (c) hinder the operation of any device used for the purpose of security or surveillance of for measuring the speed of any vehicle. Reason: To comply with Regulation 2(1) and Schedule 2 of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007. 3. Any advertisement displayed, and any site used for the display of advertisements, shall be maintained in a condition that does not impair the visual amenity of the site. Reason: To comply with Regulation 2(1) and Schedule 2 of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007. 4. Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a condition that does not endanger the public. Reason: To comply with Regulation 2(1) and Schedule 2 of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007. 5. Where an advertisement is required under the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 to be removed, the site shall be left in a condition that does not endanger the public or impair visual amenity. To comply with Regulation 2(1) and Schedule 2 of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007. 6. The externally illuminated fascia and projecting sign hereby granted shall not be illuminated when the premises are closed. Reason: In order to limit the impact of the external illumination on the character and appearance of the Reigate Town Centre Conservation Area in line with policy SE5 of the Surrey Structure Plan 2004 and policies Pc12, Pc13 and Sh2 of the Reigate & Banstead Borough Local Plan 2005. Informative: 1. This permission does not purport to grant consent for the internal ‘Starbucks’ logo located within one metre of the shop window, which is unauthorised and must be removed.

121. PLANNING APPLICATION 07/01791/F – LAND TO THE REAR OF ROOKLEIGH, ALCOCKS LANE, KINGSWOOD

The Committee considered a report on an application for the proposed construction of two five-bedroomed houses with garages and car parking at the above location.

RESOLVED that as the Officer recommendation for approval of this application subject to conditions was not approved, consideration of the application be DEFERRED to the next meeting of the Committee to enable a site visit to take place on a suitable date and time to be agreed in consultation with the Chairman.

122. PLANNING APPLICATION 07/01601/F – LAND TO REAR OF 79 AND 81 KINGSWOOD ROAD, TADWORTH

The Committee considered a report on an application for two detached dwellings at the above location.

123. PLANNING APPLICATION 07/01777/F – CONNICK TREE CARE, NEW POND FARM, WOODHATCH ROAD, REIGATE

Consideration was given to a report on an application for the widening of the entrance to New Pond Farm onto Woodhatch Road at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004. 2. The proposed modified vehicular access and access road from New Pond Farm to Woodhatch Road shall be widened in accordance with the approved plans, all to be permanently maintained to a specification to be agreed with the Local Planning Authority. Reason: The above condition is required in order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to the Surrey Structure Plan 2004 policy DN2. Informatives: 1. The permission hereby granted shall not be construed as authority to carry out works on the highway. The applicant is advised that a licence must be obtained from the Highway Authority Local Transportation Service before any works are carried out on any footway, footpath, carriageway, verge or other land forming part of the highway.

2. The applicant is advised that planning permission is required to erect signage on the Council owned access to New Pond Farm.

Consideration was given to a report on an application for the erection of a rear conservatory at the above location.
