February 2, 2012

1. CALL MEETING TO ORDER

Mayor Mary Jo Dylla called the regular city council meeting to order at 7:30 pm. The Mayor welcomed everyone and thanked them for coming.

2. ROLL CALL AND ESTABLISH A QUORUM

Roll call was taken. Members present were Councilman Walter Wyrwich, Councilman Justin Jones, Councilman Frank Arevalo, Councilman Dwayne Padalecki, and Councilwoman Susann Baker. A quorum was established. Barbara Pawelek presided as City Secretary.

3. EXECUTIVE SESSION in accordance with the Texas Local Government Code 551.071, Seek advice of the city’s attorney on pending litigation and matters subject to the confidentiality provisions of the Texas Disciplinary Rules of Professional Conduct, to wit: City of St. Hedwig, Texas v. D.R. Barr, Individually and d/b/a Silver Saddle Arena and Party House, and Robby Vosburg, as well as related legal issues involving the use of property at 291 FM 1518, St. Hedwig, Texas.

The city council meeting was adjourned at 7:31 pm to go into executive session.

The city council meeting was called back to order at 8:06 pm.

4. READING AND APPROVAL OF MINUTES

Council read over the minutes of the January 5, 2012 city council meeting.

Councilwoman Susann Baker moved to accept the minutes as written. Councilman Frank Arevalo seconded the motion. All were in favor; the minutes were approved.

5. APPROVAL OF FINANCIAL SUMMARY

The financial statement was balanced and for council’s approval for December. January is informational until the bank statements come in. The Mayor said she forgot to change the

1 beginning and ending balance dates which she will correct, however the balances are correct, just the dates. The Mayor asked if there were any questions. There were none. Councilman Frank Arevalo moved to accept the December financial summary with the date changes. Councilwoman Susann Baker seconded the motion. All were in favor; the December financial summary was approved.

6. REPORT FROM VFD

The report will be tabled until next month.

7. REPORT FROM PLANNING AND ZONING

Kathy Palmer reported for the Planning and Zoning Commission. The Planning and Zoning met on January 19th to discuss the Junked Vehicle Ordinance. The Commission voted to recommend to council not to proceed with the ordinance for several reasons. We were exploring alternative options to enter into an interlocal agreement with Bexar County but unfortunately Bexar County lost 3 people in their compliance department and will not have the manpower to work with us at this time. We have not received any other formal complaints about any junked vehicles in the year and a half that we have been working on it, and besides the fact that we have no way to enforce the ordinance, the commission decided to recommend tabling the junked vehicle ordinance until we have the means to enforce the ordinance or until Bexar County can do an interlocal agreement with us. The next planning and zoning meeting will be in April.

8. REPORT FROM CODE COMPLIANCE

Kathy Palmer reported for Code Compliance. We issued one building permit for a home on LaVernia Road this month.

Most calls are regarding the building permit process.

One call was to Richard Hammond regarding the water diversion on LaVernia Road that the Mayor has been working on with SARA and TECQ and he had questions on acreage size and paperwork and process of installation of electricity with CPS Energy.

She had a question regarding animal control in St. Hedwig and a question on the certificate of occupancy for the new owners at Jalapeño Grill.

Kathy Palmer brought up that our ordinance for trash service states that it is mandatory that every citizen participate in the trash service program. She needs council’s direction. It should not state ‘mandatory’ that citizens have trash service. Our ordinance wording needs to be corrected to change the verbage and make a recommendation next month. Kathy will highlight and make notes and will give council a copy to look over and discuss.

There were no citizens to be heard.

10. OLD BUSINESS

A. ROADS

Councilman Justin Jones reported for the Roads. Charles Seiler installed the tree trimming apparatus on the city tractor. He will start trimming the week of February 6th. Roads he will be trimming are lower Felix, Adkins/Elmendorf, St. Hedwig, upper Felix, LaVernia and Churchview. More roads will be added to the list once these have been completed. He asked if council or anyone has any other roads needing attention to visit with him after the meeting.

Spraying will begin the week of March 19th.

Texas Road Repairs has been doing crack fill and pothole repairs during the month of January on the following roads: Miller Road, Kajec, Oz Way, Lupon, Mergele, and East Lupon.

Councilman Jones spoke with Mr. Payne on the project of the culverts on Miller Road and St. Hedwig Road. The pipes were put in yesterday and will be staging the forms today and tomorrow. The guard rail work on Miller Road will begin next week. Councilman Wyrwich added that they poured the cement at both locations today.

The Mayor had a list of signs from Mr. Adams on Mergele Road that were missing or knocked down. She gave it to Councilman Jones who said he will look into.

B. CITY PARK

Councilman Dwayne Padalecki announced that Kenneth Mihalski, our maintenance man, installed the city park tables and trash cans. He said he received a lot of compliments and thanked Mr. Mihalski for installing them.

Councilman Padalecki received bids from St. Hedwig Fence Co. for the fence that the back neighbor requested we put up. It is for 682 feet of 5 foot, 9 gauge fence, which is stronger than what we have up front. Again he reminded council that the neighbor is going to put up an electric fence in front of ours so the livestock won’t mess it up. The bid is for $7,023. The next bid is for 514 feet of 5 foot fence which will be the side area of the park and it is for $5,090. The final bid is for the gate and 50 feet of fencing to complete the front. That bid is for $873.

Councilman Susann Baker moved to construct the 682 feet of chained linked fencing on the northern boundary of the city and install 50 feet of fencing with a double gate on the front

3 part of the property. Councilman Frank Arevalo seconded the motion. All were in favor, the motion was approved.

The Mayor had a question regarding the water flow on the well. Councilman Padalecki said the casing has been dropped but the pump has not been installed yet. The company that drilled our well had four wells to dig in St. Hedwig and is doing them all at one time. Next week he should be installing the pump and then we will know more.

C. SPRING CLEANUP DAY WITH MD SYSTEMS

MD Systems will sponsor the Spring Cleanup Day, which will be held on March 10th from 9 till 3. They will be sending out a flyer.

11. NEW BUSINESS

None.

 If anyone is interested in running for city council, sign up starts on Monday, Feb. 4th through March 5th. The 3 open spots are the Mayor, Councilwoman Susann Baker, and Councilman Justin Jones. You can sign up on Mondays and Thursday’s from 5:00pm till 7:00pm or call city hall for appt or our election judge at (210)667-1480.  Blood Drive at the Annunciation Catholic Church on February 19th from 7:45am - 1:00pm  Casino Night at the American Legion Hall on March 3rd  Happy Valentine’s Day!

Councilman Padalecki moved to adjourn the meeting. Councilwoman Susann Baker seconded the motion. All were in favor; the meeting was adjourned at 8:35 pm.
