Cleveland Elementary Silent Auction Fundraiser

Auction Item Catalog March 11 – 15, 2013 Welcome Letter

The Auction committee welcomes you to the Cleveland’s Annual Silent Auction. The proceeds raised will fund art and music programs, facility improvements, and overall support for Cleveland.

This catalog is full of many wonderful items, including a subscription to Ancestry.com, an autographed Golden State Warriors jersey, two professional photography sessions, tickets to events & shows, gift certificates to restaurants & spas and much, much more.

Please review the catalog with your family, friends, and associates. If you cannot attend, you can make arrangements with another Cleveland parent who is in attendance to bid for you. Cleveland parents can also bid for their friends, co-workers and relatives but any Cleveland parent or relative must use a Cleveland parent’s name when bidding. Neither Cleveland nor the PTA is responsible or liable for any arrangements with other bidders.

Your support of this auction provides our unique and wonderful school with the vital resources it needs to fulfill its mission. Thank you for your support and we hope to see you there!

1. Silent Auction opens Monday, March 11th, 2013 at 8 AM and closes Friday, March 15th, 2013 at 5:00 PM. Once an item is closed, no further bids will be honored.

2. Minimum bids and increases shown on the bid sheets must be observed for bid to be valid. Bid sheets are not to be altered other than by the auction chairs and confirmed by their signatures.

3. To place a bid, print your name, and the amount of your bid in legible form on the available line on the bid sheet. Doing so constitutes a legal contract to purchase that silent auction item at the price you stated if your bid is the winning bid. The last (highest) valid bid entered prior to the section closing will be the winning bid.

4. An auction committee member will certify winning bids and make the information available.

5. The auction committee reserves the right to withdraw any item at any time without notice before the actual sale. In the event of a dispute, the Auction Committee shall act as final authority in determining the winning bid. Auction Rules - Condition of Sale

1. All Sales are Final. No exchanges or refunds on items are permitted except where specified. 2. All items are sold “as is”. 3. All items must be paid for in full before the buyer may take them. Payments can be made by check or via PayPay which can be accessed on the Cleveland website (http://ousdes1.ousd.k12.ca.us/cleveland). Checks must be made out to Cleveland Elementary. We cannot bill your account nor do we accept credit cards. All items must be paid for no later than Friday, March 22th, 2013. 4. It is the buyer’s responsibility to arrange for delivery or pick up, if required. 5. Unless otherwise indicated, all items and services must be used one year from the auction date. Specific dates and times are to be arranged at the mutual convenience of the donor and the buyer. 6. Please call restaurants for reservations. Tax, gratuity, or alcoholic beverages are not included unless otherwise stated on the gift certificate or donor form. 7. Monetary values indicated on donation forms have been established by donors, or are only estimates, and are not warranted by Cleveland Elementary for tax purposes or for general use. 8. Cleveland Elementary makes no warranties or representations of any kind with respect to any item or service sold. 9. The buyer waives any claim for liability against Cleveland Elementary of items or service for any personal injury or damage resulting from the use of the item or service sold. 10. Neither Cleveland Elementary nor the Auction Committee is responsible for the correct description or authenticity of any item sold. 11. In determining tax deductibility of items purchased at the auction, Revenue Ruling No. 67246 issued August 4, 1988, reminds buyers that no deduction is allowable except to the extent that the taxpayer can show that the payment exceeds the fair market value of the item or services received. Winning bidders should consult with their own tax advisors regarding applicable tax laws.
