BOARD OF SELECTMEN Meeting Minutes – September 13, 2017

PRESENT: Doug Ludewig – Chair, Timothy McDonald – Vice Chair, and Dianna Boisvert, Sandra Schiller, and Harold Jones – Members. ABSENT: None. ALSO PRESENT: Curtis Lunt - Town Manager, Kevin Mulherin – Police Chief, Dan Roy – Fire Chief, David Shaw – CEO, Bruce Balfour – PW Director, Herb Whittier, Donna Shaw, Leonard Bates, Ronald Daigle, and Doreen Christ – Recording Secretary.

1. Call to Order and Pledge of Allegiance. This meeting was called to order at 6:00 pm by Doug Ludewig – Chair, along with the Pledge of Allegiance.

2. Public Hearing – Proposed No Parking Zone – Phil’s Variety. This amendment will prohibit parking on US Route 202 on the south side, beginning at the intersection of Annabessacook Road, easterly a distance of 100 feet. There was a brief discussion on Section 9. Penalties, Fines as to the amount of the fine for this offense. The fines shall be $25.00. Herb Whittier commented that the other day, a tractor trailer was parked in the designated area. This was perfect parking. Traffic was flowing. The following motion was made. MOTION: by Harold Jones, seconded by Sandra Schiller, to adopt the Parking Ordinance to include Letter N. State Route 202 – On the south side, beginning at the intersection of Annabessacook Road, easterly a distance of one hundred (100) feet and to set a fine of $25.00. VOTED: 5-0 (Passed).

3. Minutes of August 30, 2017. Changes were made to Page No. 1, Item No. 4. Public Comments. On the fifth line, correct the spelling of “Coppossee Lake” to read, “Cobbossee Lake”. In the 17th sentence delete the words, “to the north” and insert the words, “to the value north of the west shore”. The following motion was made. MOTION: by Harold Jones, seconded by Dianna Boisvert, to accept the Board of Selectmen meeting minutes for August 30, 2017, as amended. VOTED: 5-0 (Passed).

4. Department Head Reports. Kevin Mulherin – Police Chief made reference to his August monthly report. There were 212 calls to service. 131 were motor vehicle stops, three (3) OAS’s, two (2) warrants, etc. Officer Wessling will be attending leadership training in Westbrook, Maine on September 28-29, 2017. David Shaw – CEO made reference to last month’s report. Compared to this time last year, there were the same amount of permits. The only difference is that the values have increased. He did two (2) new houses this week – one for a house and the other for the proposed treehouse. On Monday, the representative from “Animal Planet” will be here. They are moving right along. The footers were dug both yesterday and today. David Shaw updated the board by saying that he started a new enforcement action (Pleasant Street, south side, third house in). A Notice of Violation was sent. Dan Roy – Fire Chief said his dept. has been fairly busy. There have been 87 calls this year. There were a couple of car crashes on Route 126. There was a structure fire today in South Monmouth. It was a grease fire. Last week, his dept. responded to a cat rescue call. Gerry Robinson, a lineman from Target, rescued him. The cat had had a run-in with a porcupine. Gerry Robinson is now off to Florida for volunteer work. Teddy Dodge has passed away with cancer. He retired from the Fire Dept. in 2013. He had worked for the Fire Dept. for 35 years. Dan Roy performed the service for him. The Fire Dept. has dedicated their newly acquired Rescue Boat to him. Last evening, his dept. had joint training with the Town of Sabattus on “Smoke Conditions”. There are three (3) junior firefighters attending the Basic Fire School. This is for 100 hours of training. They will train on Wednesdays and every other Sunday. The following events are coming up: Homecoming Weekend on Friday/Saturday night, the Annual Cub Scouts meeting, Fall Harvest Sale (at Cumston Hall – fundraisers), September 30, 2017 will be the Apple Fest, and Fire Prevention Week is the second week in October 2017. His dept. will have two (2) weeks of training on the new fire trucks. Bruce Balfour – PW Director reported road grading taking place on Packard Road, Cressey Road, etc. The paving is done at the Town Office and Cumston Hall (16 spaces). The sewer manhole covers are quite deep and were dug out for inspection. His dept. has put out cones. Harold Jones commented to notify the public and place a notice on the Town’s Website regarding the manhole cover work taking place. Bruce Balfour said that Pike Industries is offering winter sand from the Town of Leeds at $3.50 per cubic yard. Curtis Lunt has signed the contract. They had budgeted $26,000 for sand. In this contract, the cost of sand is $17,500. Salt has gone down some. It is at $55 per ton. With the decrease, his dept. got to purchase more sand. The Cub Scouts are having a Popcorn Sale on October 14-15, 2017, at the Transfer Station. Bruce Balfour introduced a road distance system, which is GPS operated from a vehicle. He distributed the device at this meeting. This can go into any vehicle. Curtis Lunt – Town Manager said that Donna Hays, the Assessor’s Agent will be present at the next regularly scheduled Board of Selectmen meeting regarding the re-valuation from Vision Appraisals. Curtis Lunt reported that he had contacted the MDOT regarding reduced speed on Route 202. He has not received an answer. In regards to the sign issue on Academy Road by Norris Hill, it cannot be moved. A letter will need to be written. It is presently 30 MPH. Doug Ludewig said that this is a hazardous area. They will need a request and a study done to get it changed. It was suggested to write a letter and request to extend the speed zone further north by a couple of hundred feet after the curve. Curtis Lunt will write the letter.

5. Public Comments. Ed Phillips complimented the Public Works Dept. on road striping. He complimented on the centerline and white-lined sideline striping on Norris Hill Road. He also commented that all roads should be centerlined with any excess money. He said, “We need to do things for the safety of our residents”. David Shaw commented that if they pave Packard Road, he will pay for striping it. Leonard Bates commented on the passing zones, speed, and dangerous areas on South Main Street. It is 35 MPH. There is a daycare up there also. We need some help up there. There is a parking zone. Paradis Point should be double- lined and no passing. He wants the speed changed from 35 to 30 MPH. Ron Daigle was also present and a new resident in Monmouth and has witnessed this also. They have both seen double passing also. It is treacherous to get out of the daycare and any business in this area. This is getting progressively worse. Harold Jones commented that it seems that more aggressive enforcement would be needed instead. Curtis Lunt will write another letter to the state MDOT.

6. Adoption of General Assistance Ordinance Appendices Updates. Curtis Lunt presented this item. This is updated annually and is required by the state. The state dictates this policy. These numbers are driven by housing. He made reference to Page No. 2 Non-Metropolitan Areas under Kennebec County (Appendix A) He also referenced the 2017-2018 Food Maximums. There was a one percent (1%) minimal increase in food cost (Appendix B). Appendix C references the 2017-2018 GA Housing Maximums for both heated and unheated rents. This shows a cost adjustment. The following motion was made. MOTION: by Timothy McDonald, seconded by Harold Jones to move to approve the adoption of the General Assistance Ordinance Appendices A-D 2017-2018 Updates. VOTED: 5-0 (Passed).

7. Marijuana Referendum – Proposed Moratorium. The Town’s Attorney (David Perkins) was contacted for advice. The Town is considering adopting a six (6) month moratorium. Included in board members packets was the correspondence from the Town’s Attorney regarding the wording for a proposed November 7, 201 Warrant Article. Option 1 would have a six month moratorium beginning February 2, 2018. Harold Jones commented that he prefers the Town’s Attorney – Option 2. He prefers 180 days beyond when the State of Maine adopts a new law covering retail marijuana business activities. He said cultivation should also be included. The State moratorium expires February 2, 2018. Again, Harold Jones said that he prefers Option 2 in the Attorney’s letter. David Shaw commented that a moratorium is needed to get an Ordinance ready for the June 2018 Town meeting. The following motion was made. MOTION: by Sandra Schiller, seconded by Doug Ludewig, to accept Option 1 with the modification to the proposed November 7, 2017 Warrant Article, to include retail cultivation. VOTED: 3-1-1 (passed) (Harold Jones voted no and Dianna Boisvert Abstained).

8. Voting Credentials for MMA October 4, 2017 Business Meeting. Timothy McDonald volunteered to be the voting representative for the Town of Monmouth. The following motion was made. MOTION: by Harold Jones, seconded by Dianna Boisvert, to make Timothy McDonald the voting representative for the MMA October 4, 2017 Business Meeting. VOTED: 5-0 (Passed).

9. Warrant #6 Payroll and Payables. Curtis Lunt read a listing of items over $1,000. The following motion was made. MOTION: by Timothy McDonald, seconded by Harold Jones to move to pay Warrant #6 - Payroll – $44,159.64 and Payables – $92,933.23. VOTED: 5-0 (Passed).

10. Adjourn. The following motion was made to adjourn the meeting. MOTION: by Timothy McDonald, seconded by Harold Jones to move to adjourn the meeting at 7:22 pm. VOTED: 5-0 (Passed).
