Minutes
Call to Order: 7:07 pm by Mayor Dan Spencer
Present: Mayor Spencer, Jarad Brinkerhoff, Deon Baird, Karen Williams, Ellen Lamb, Kade Iverson, Chris Schmitz, Pam Schmitz, Judge Steven Wallace, and Lora Lee Cox. Mayor noted all council members were present.
It was determined not necessary to review Budget Work Meeting held previous to the Board Meeting. A Public Hearing to adopt the Budget for Fiscal Year 2016 was scheduled for Thursday June 18, 2015 at 6:30 pm
Minutes: Minutes of: Public Hearing TOBBACO FREE PARKS, Public Hearing DOG ORDINANCE, Public Hearing LAW ENFORCEMENT CONTRACT and the Minutes from Regular Town Board Meeting held on April 16, 2015 were reviewed. A MOTION was made by Deon Baird and seconded by Donald Davis to approve all the minutes. All voted yes. Motion PASSED.
Bills: The bills were presented for payment and reviewed. Jarad Brinkerhoff made a MOTION to pay the bills. Karen Williams seconded. All voted yes. Motion PASSED.
Business:
4th of July plans in brief: Mayor Spencer gave an informational comment on the 4th plans to date, including an estimate of costs for the dinner etc.
Dog Ordinance: Question: to continue with existing Glendale Town Dog Ordinance, do away with the existing ordinance or adopt Utah State Law: Title 18. Jarad had questions regarding the need to have a Public Hearing to change, get rid of or add to the existing ordinance. Deon pointed out that is what the April 16, 2015 Public Hearing was for. Karen expressed her concerns. Karen wants the option of going back to or replacing the ordinance under discussion, at a later date, should the need arise. Discussion followed on dog ordinance enforcement, picture taking, and citizens role in dog enforcement. Lolly Cox gave a brief history of dog enforcement in Glendale Town. Jarad Brinkerhoff and Karen Williams discussed the sheriff’s role in enforcing this ordinance. Karen reviewed the original KCSO law enforcement contract and new KCSO contract section on animal control. State Law Title 18 was reviewed. The Mayor stated Title 18 is basic liability. The existing ordinance requires licensing, animal control, and a dog pound. Karen Williams shared her concerns. She does not want to abandon the ideal of not doing anything else. She is concerned about people shooting in towns. She does not want people shooting in town. She clearly stated she does not think that is responsible behavior. Lolly Cox expressed her opinion. Lolly said she is NOT in favor of the town having a law for everything. Kade Iverson asked for clarification on shooting in town. Discussion followed. Karen restated that she wants people to take responsibility for their dogs. The Mayor stated the no ordinance status in Orderville seemed to be working. Karen said that there are dogs at large in Orderville that are viscous. It was brought up that with or without a dog ordinance, if a person or animal are attacked by a dog State Title 18 is in place and the sheriff will respond. Karen said Sheriff Glover stated previously that he does not like to respond to dog attacks. However, it is a state law to report animal attacks so the sheriff has to respond. Deon Baird made a MOTION to rescind the existing Glendale Town Dog Ordinance and revert/ adopt Utah Code Title 18. Motion seconded by Donald Davis. Roll Call Vote: Donald Davis, YES, Jarad Brinkerhoff, YES, Deon Baird, YES, Karen Williams, Yes, Dan Spencer, YES. Motion PASSED. Karen stated that she was never in favor of not rescinding the existing ordinance. She reminded the Board that she has researched this issue extensively and doesn’t understand why no one will take that into consideration. Discussion followed.
Fire Department: Council Member Donald Davis introduced Chris Schmitz, a member of the Orderville Fire Department. Chris lives in Mount Carmel and is an active volunteer fire man. He has lots of training and is willing to be the Glendale Chief. There is no local or state statute preventing Chris from serving in Glendale.
Mayor Dan recommended Chris Schmitz for the position of Fire Chief of the Glendale Fire Department. Jarad Brinkerhoff asked Chris some questions and led a discussion on the appointment. Chris will continue in his position in Orderville. Mr. Schmitz will be the Chief on a trial basis. Chris stated that the fire department is lacking many things. Don Davis and Chris agreed they need to recruit more volunteers. Jarad Brinkerhoff nominated Chris Schmitz as Glendale Fire Chief. Motion seconded by Deon Baird. All in- favor. The Mayor abstained from vote because he recommended him. PASSED.
Planning & Zoning Committee openings: Mayor Spencer: There are 2 openings on the P & Z Committee. Mayor Spencer recommended Kade Iverson and Lloyd Robinson to be appointed members of the P & Z Committee. Current members and outgoing members were discussed. Meetings are the 2nd Wednesday each month. It is a 5 member committee. Deon Baird is the Town Board representative and Mike Chamberlain attends meetings because he is the Building Inspector. Jarad Brinkerhoff made a motion to appoint Kade Iverson and Lloyd Robinson to the planning and zoning committee. Motion seconded by Deon Baird. All voted yes. Motion PASSED. Law Enforcement Contract: Mayor Spencer reviewed the history of the law enforcement contract. The Mayor is still waiting to see what Orderville Town does about the contract. Dan would like to negotionate directly with the Kane County Commissioners, not Orderville and not the KCSO. The Commissioners in reality are the responsible party. Mayor Spencer will set up a meeting with the commissioners. The Mayor next expressed his concern over the intimidation used at the public hearing. This tactic is in violation of Utah Code: Title 76-8-104. It is a crime to intimidate, coerce or harm. Dan is going to bring that up to Sheriff Glover. He felt the intimidation might actually have been seen as a disadvantage to the KCSO. Mayor Spencer stated, according to Utah Code: Title 10, Glendale Town, because of its low population base, is NOT required to engage in a law enforcement contract. Opinions were expressed and a discussion followed. Lolly Cox felt the comments made after the meeting were also intended to intimidate, double taxation was also discussed. The prior meeting was discussed at length. Many folks who did not attend the Public Hearing have come forth and expressed concerns and opinions to the board members. Many towns’ people are NOT in favor of the cost and burden of the Law enforcement Contract. Item TABLED. Agenda Item next meeting.
FEMA: Pratt Engineering involvement: Mayor Spencer reviewed his conversations with Pratt Engineering. Gerold Pratt has started the tedious process with FEMA. Dan stated that all homes in Glendale are classed in the highest flood rating. What the town hopes to accomplish is at least some reclassification. The bid from Pratt is $10, 000 and the board will have to wait and see how much this money can accomplish. The survey has to be completed. Mrs. Cox expressed appreciation that the town is acting on this action. Dan reminded everyone that it is a slow process.
Orderville Justice Court: Mayor Dan Spencer reviewed the history of the Justice Court contract. Law enforcement and the Justice Court are enter-twined. The original agreement established the court and a law enforcement agency at the same time. This contract expired in 1999. The Mayor asked Judge Wallace, “What do we (Glendale) get out of it?” The Judge responded free court services. Judge Wallace gave a brief statistical analysis of tickets. The Judge said court case load average is approximately 40-43 percent of cases annually are in Glendale Jurisdiction, which is from the dump north. Judge Wallace suggested that Mayor Dan and Mayor Merlin Esplin review the court revenue and expenses together. The Judge said Orderville Town does keep the court revenue, but the operating costs are substantial. Court expenses include: prosecutor fee (salary), court operating costs, judge Salary, state surcharge fee, and employee (clerk) wages, in addition to the facility costs. The Judge again said Glendale basically gets Court participation for free.
Mayor Spencer asked Judge Wallace, “What would you like to do with the court? What is the advantage of keeping the court?” The Mayor then stipulated he would like to do what is best for taxpayers. Judge Wallace reminded everyone the Justice Court does not cost Glendale anything. Judge Wallace said he does not think it is worth pursuing a share of the revenue. It was mentioned that Judge Wallace does accept small claims actions, but they are not frequent. The court is a good thing for the citizens of Glendale. It provides a convenience for the folks of Glendale. Ticket costs and revenue were discussed. JUDGE Wallace suggested that both Mayors and Clerks sit together and review revenues and costs. The Mayor stated that because Judge Wallace was recently retained for 3 years by a ballot issue, s Glendale will not actively pursue the issue until the end of Judge Wallace’s tenure. Judge Wallace will retire in 3 years. Deon Baird does not think Glendale should complain.
Again, Judge Wallace said he thinks the court is a good thing, he recommended leaving the court alone. Dan Spencer said the existing contract has expired and he will renegotiate a court contract with Orderville. Jarad requested that Ellen and the Orderville clerk work together to compile audit figures to prepare new contract. TABLED: Agenda: June.
General Plan: Karen Williams: The current General Plan was compiled in 2002. Karen would like to set goals and work toward them. This is not being done. She wants to see the board take a proactive role. What do we want the town to do? What is our vision? The Board should be working on a vision for the town. Deon Baird said Planning and Zoning is supposed to review the general plan every 5 years. Deon proposed that the board review a section of the General Plan every month during Board meeting. Review General Plan: 1st section: VISION STATEMENT: JUNE AGENDA.
Cell phone for Mike: Discussion on cell phone possibilities for Mike. Everyone agreed it is a good idea. Suggested carrier: ATT/ or Verizon. Sewer and irrigation will chip in on cost. Suggested the town buy an industrial phone. Radio option and approval was discussed. Dan Spencer made a motion to purchase an ATT cell phone for Mike Chamberlain, maintenance. Motion seconded by Deon Baird. All voted YES. Motion PASSED.
Summer Help: Mayor Dan Spencer recommended Glendale Town hire Matt Roundy at $12.00 per hour up to 29 hours per week. Jarad Brinkerhoff moved Glendale Town hire Matt Roundy for summer help. Deon Baird seconded the motion: all voted YES. Motion PASSED. Eric Brinkerhoff will train Matt Roundy.
Social Hall Walls: Jarad Brinkerhoff: TABLED, Jarad is still working on it.
4th Train: Mayor Dan Spencer/ New Tires—TABLED/ Also discussed storing train in shed at ball park. Mayor Dan will check that out.
Departments: WATER: Jarad Brinkerhoff: Frost free faucet at park needs to be replaced. Mike has been replacing some meters.
FIRE DEPARTMENT: Don Davis: Don is HAPPY!
BALL PARK: Mayor Spencer: The fence is down, as soon as we get good dry weather Dan will spear head putting fence in. The Flood control at the park is working. Mayor Spencer said he still needs to meet with Harry Barber to discuss the illegal ball park road. Jarad will set the meeting up. Dan Spencer also wants to talk to the BLM about a trail head for the Effie Trail. Also the Bat cave was discussed. Mayor Spencer said there are Indian burials in the cave.
FLOOD CONTROL: Mayor Spencer: Flood Control at Kade Iverson corner was discussed. Mayor Different ideas were discussed/ Dan will get bids. Also Dan would like to speak to Darwin Lamb, Lamb Ex about this project.
STREETS & ROADS: History and discussion on quit claim process involving Cox Road. Judge Wallace stated that there has been a water leak on the 200 E (between Mack Roundy’s and Maxwell Shop) for 7 years. The leak runs from Lacorti property to the corner. The Mayor and other board members were not aware it is actually a town street. Gravel and Chip sealing options were discussed.
Bauer Bridge: Dan Spencer: The Mayor needs to fix the bridge deck. Glendale owns the bridge. He wants to do it this year. The state offers a community participation loan, the town match (contribution) is 6.75%. The bridge deck is condemned and it needs to be fixed now. Clerk was advised to publish an invitation to bid. Jarad gave guidelines for bidding. A discussion followed.
July 4th FIREWORKS: The town would like to provide fireworks for the 4th celebration. Mayor Spencer will take charge of this. Liability and insurance coverage were discussed. Clerk will check insurance with ULGT.
PARKS & CEMETERIES: Deon Baird: nothing more to discuss. Karen Williams asked about spraying the apple trees at the park. Discussion followed.
BUDGET: Karen Williams: Budget Hearing scheduled June 18 at 6:30. Apple Festival: no report
MAINTENANCE: Mike was absent
Clerk: Ellen would like to have a credit card machine to process utility payments. Discussion followed, the board expressed favor in using a credit card machine. Russell Rogers would like to buy the carpet pieces. Discussion followed. The board left carpet up to the clerk’s discretion.
Veteran’s Monument: Discussion on placque.
