Case Synopsis: Nikki Beatty was pulled over for crossing over the fog line and having an abnormally loud muffler. Officer Tyler noticed that Beatty was overstating her arm movements and swaying abnormally as she was talking to him. While in the Patrol vehicle Beatty admitted that she had a history of drug use and that she had completed a drug court program. While talking about drugs Beatty’s tone of voice changed and she started to fidget nervously. Beatty consented to allow Officer Tyler that search her vehicle. While conducting the search Officer Tyler found several items containing burnt marijuana residue and methamphetamine residue.
Sentencing Synopsis: On the charge of Possession of a Controlled Substance, the Court sentenced Nikki Beatty to a suspended five years sentence to the South Dakota State Penitentiary and ordered to serve sixty (60) days in the Union County Jail with the balance of the time suspended if the Defendant gets accepted into inpatient treatment program when they have a bed available. On the charge of failure to have proof of Financial Responsibility, the Court ordered Beatty to pay an additional $266 in fines and court fees in addition to the financial obligations Ordered on the felony charge. Additionally, Beatty’s license was suspended for thirty (30) days.
Criminal History: This is Nikki Beatty’s second career felony conviction.
