216. PLANNING APPLICATIONS FOR DECISION

RESOLVED that the list of planning applications to be determined under Items 5 to 21 of the Agenda be noted.

217. PLANNING APPLICATION 07/01997/F – BRACKENWOOD, HEATH DRIVE, WALTON ON THE HILL

The Committee considered a report on an application for the erection of ten two bedroom apartments at the above location and it was noted that this item had been deferred from the previous meeting to enable a site visit to be held (Minute No. 202). An objector to the proposal, a representative of the Residents Association also objecting to the proposal and a representative of the applicant addressed the Committee.

RESOLVED that subject to the inclusion of reference to the failure to follow PPS3 and Ho9A requirements that new development should not compromise the character of the area, then planning permission be REFUSED for the following reason: 224 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

1. The proposed development, by reason of its size, proximity to boundaries, and discordant design, would become more visually apparent with the loss of a well-established wall and hedging along the Heath Drive boundary, and would not be in keeping with or preserve or enhance the existing character of the Conservation Area and Residential Area Of Special Character in which the site is situated. The development would thereby conflict with policies SE4 and SE5 of the Surrey Structure Plan 2004 and policies Pc13, Ho9, Ho13, Ho15 and Ho16 of the Reigate and Banstead Borough Local Plan 2005 and PPG 15 : Planning and the Historic Environment.

218. PLANNING APPLICATION 07/02219/F – 1 DOODS PARK ROAD, REIGATE

Consideration was given to a report on an application for the erection of five three bedroom houses at the above location. It was noted that this application had been deferred from the previous meeting to enable a site visit to be held (Minute 196). RESOLVED that planning permission be REFUSED for the following reasons:

1. By reason of the cramped layout of the dwellings on a constrained site, and the proximity to the railway line, the development would result in a poor standard of living for future occupiers of the development contrary to Reigate & Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. 2. The proposed residential development would, by reason of the number of proposed dwellings, their bulk and scale in an elevated position above street level, result in an overly dominant, incongruous and overbearing addition to the Doods Park Road that would be harmful to the character and amenity of the surrounding area and street scene. The proposal would thereby be contrary to Reigate & Banstead Borough Local Plan 2005 policies Ho9, Ho13 and Ho16 and Surrey Structure Plan 2004 policy SE4.

219. PLANNING APPLICATION 07/02190/F – REDSTONE HALL, 10 REDSTONE HILL, REDHILL

The Committee considered a report on an application for the conversion and 225 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

extension of a building to provide eleven two-bedroom apartments with associated parking at the above location. This application had been deferred from the previous meeting to enable a site visit to be held (Minute No. 194).

RESOLVED that subject to the conclusion of negotiations regarding a contribution to future road safety initiatives in the vicinity should the Highway Authority deem them necessary, authority be delegated to the Head of Building and Development Services in consultation with the Chairman and Ward Member to GRANT permission subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004. 2. Until the completion of the development hereby permitted, no site or building works (including demolition, excavation, construction of the development hereby permitted) shall be carried on outside the hours of 0800-1800 Mondays to Fridays inclusive; 0800-1300 hours on Saturdays and not at all on Sundays and Public Holidays. There shall be no deliveries taken at or despatched from the site outside these hours. Reason: To ensure that the construction of the development hereby permitted does not unreasonably affect the amenities enjoyed by the residential properties in the vicinity, with regard to the Surrey Structure Plan 2004 policy SE1. For the avoidance of doubt “Public Holidays” includes New Year’s Day, Good Friday, Easter Monday, May Day, all Bank Holidays, Christmas Day, and Boxing Day. 3. Before the development hereby permitted is commenced the developer shall obtain the Local Planning Authority’s written approval of the details of the existing and proposed ground levels. Reason: In order that the Local Planning Authority may be satisfied as to the details of the proposal and its relationship with adjoining development with regard to Reigate and Banstead Borough Local Plan 2005 policies Ho9 & Pc13 and policy SE4 of the Surrey Structure Plan 2004. 4. No new development shall take place until the new access road, including its junction with Redstone Hill (A25), and the associated highway works on the A25 to include the widening of the carriageway and centreline hatching, has been designed and constructed in 226 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority, but broadly in line with the design as shown in drawing number TSP/HPH/P1383/01D. No development shall begin before that junction and 10 metres of the new road have been completed and the visibility zones included in the design shall be part of the new road and shall not be included in any plot or other sub- division of the site. Reason: The development should not prejudice highway safety, nor cause inconvenience to other highway users with regard to Planning Policy Guidance Note 13 “Transport” and policies DN2 & DN3 of the Surrey Structure Plan 2004. 5. No new development shall be occupied until space has been laid out within the site in accordance with the approved plans for 13 cars to be parked and for vehicles to turn so that they may enter and leave the site in forward gear. The parking/turning area shall be retained exclusively for its designated purpose. Reason: The development should not prejudice highway safety, nor cause inconvenience to other highway users with regard to Planning Policy Guidance Note 13 “Transport” and policies DN2 & DN3 of the Surrey Structure Plan 2004. 6. No development shall start until a Method of Construction Statement, to include details of: (a) Parking for vehicles of site personnel, operatives and visitors; (b) Loading and unloading of plant and materials; (c) Storage of plant and materials; (d) A programme of works (including measures for traffic management); and (e) Provision of boundary hoarding behind any visibility zones has been submitted to and approved in writing by the Local Planning Authority. Only the approved details shall be implemented during the construction period. Reason: The development should not prejudice highway safety, nor cause inconvenience to other highway users with regard to Planning Policy Guidance Note 13 “Transport” and policies DN2 & DN3 of the Surrey Structure Plan 2004. 7. No new development shall be occupied until space has been laid out within the site in accordance with a scheme to be submitted to and 227 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

approved in writing by the Local Planning Authority to provide secure cycle parking to the satisfaction of the Local Planning Authority and shall thereafter be permanently maintained. Reason: The development should not prejudice highway safety, nor cause inconvenience to other highway users with regard to Planning Policy Guidance Note 13 “Transport” and policies DN2 & DN3 of the Surrey Structure Plan 2004. 8. No development shall commence on site until a scheme for the landscaping and replacement tree planting of the site, including, if applicable, a replacement of appropriate size and species for the mature sycamore to be removed from the Redstone Hill frontage, has been submitted and approved in writing by the local planning authority. Landscaping schemes shall include details of hard landscaping, planting plans, written specifications (including cultivation and other operations associated with tree, shrub, hedge or grass establishment), schedules of plants, noting species, plant sizes and proposed numbers/densities and an implementation programme. Reason: To ensure good arboricultural and landscape practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Pc12, Ho9 and Ho13 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE9 of the Surrey Structure Plan 2004. 9. All hard and soft landscaping work shall be completed in full accordance with the approved scheme, prior to completion of the development hereby approved, or in accordance with a programme agreed with the local planning authority. All trees shrubs, hedges and plants supplied shall comply with the requirements of British Standard 3936, specification for nursery stock and British Standard 4043:1989 Transplanting root-balled trees. All pre planting site preparation, planting and post-planting maintenance work shall be carried out in accordance with the requirements of British Standard 4428 (1989) “Code of Practice for general landscape operations” (excluding hard surfaces). All new tree planting shall be positioned in accordance with guidelines and advice contained in the current British Standard 5837. Trees in relation to construction. Any trees shrubs or plants planted in accordance with this condition which are removed, die or become severely damaged or become severely diseased within five years of planting shall be replaced within the next planting season by trees, and shrubs of the same size and species. 228 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

Reason: To ensure good arboricultural and landscape practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Pc12, Ho9 and Ho13 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE9 of the Surrey Structure Plan 2004. 10. Prior to the commencement of any development works, including demolition ground works and construction activities all related arboricultural matters, including arboricultural supervision, monitoring, tree protection measures, specialist surfacing, pruning or removal of trees shall be undertaken in strict accordance with the approved details contained in the arboricultural report compiled by ACS consulting dated 21 January 2008. Reason: To ensure good arboricultural and landscape practice in the interests of the maintenance of the character and appearance of the area and to comply with policies Pc4, Pc12, Ho9 and Ho13 of the Reigate and Banstead Borough Local Plan 2005 and policies SE4 and SE9 of the Surrey Structure Plan 2004. 11. Development shall not begin until drainage works, including surface water attenuation facilities, have been carried out in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the site is satisfactorily drained prior to the commencement of development with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 12. All tiles shall be handmade sand faced plain clay tiles unless otherwise agreed in writing by the Local Planning Authority. All windows shall be of white painted timber, with casements in each opening and corniced heads, with glazing bars of traditional proportions (or lead cames dependent on the outcome of discussions). All timber framing shall be of black stained and pegged timber. Before the building is occupied, the existing Venner porch shall be retained and restored with the coats of arms retained and the dated newel posts from the rear elevation incorporated within the design. Details showing the chimneystack reinstated to its original height and the stringcourse and pots reinstated shall be submitted to and approved in writing by the Local Planning Authority before works commence and be restored according to these approved details before 229 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

the building is occupied. All drives and paths shall be of fixed gravel. Reason: To preserve and enhance the character and appearance of the Redstone Hill Conservation Area with regard to the Reigate and Banstead Borough Local Plan 2005 policies Ho9 and Pc13. 13. The development shall not be occupied until a plan indicating the positions, design, materials and type of boundary treatment to be erected has been submitted to and approved in writing by the Local Planning Authority. The boundary treatment shall be completed before the occupation of the development hereby permitted. Reason: To preserve the visual amenity of the area and protect neighbouring residential amenities with regard to the Reigate and Banstead Borough Local Plan 2005 policies Ho9 and Pc4. Informatives: 1. Your attention is drawn to the safety benefits of installing sprinkler systems as an integral part of new development. Further information is available at www.firesprinklers.info. 2. The applicant is advised that prior to the initial occupation of any individual dwelling hereby permitted, a 140 litre wheeled bin conforming to British Standard RG723/2 and a 60-litre recycling box should be provided for the exclusive use of the occupants of that dwelling. Prior to the initial occupation of any communal dwellings or flats, wheeled refuse bins conforming to British Standard RG723/2, separate recycling bins for paper/card and mixed cans, and storage facilities for the bins should be installed by the developer prior to the initial occupation of any dwelling hereby permitted. Further details on the required number and specification of wheeled bins and recycling boxes is available from the Council’s Neighbourhood Services on 01737 276224, or on the Council’s website at www.reigate- banstead.gov.uk. Bins and boxes meeting the specification may be purchased from any appropriate source, including the Council’s Neighbourhood Services Unit on 01737 276608. 3. The use of landscape/arboricultural consultant is considered essential to provide acceptable submissions in respect of the above relevant conditions. Replacement planting of trees and shrubs should reflect the species lost through development and shall be in keeping with the character and appearance of the locality. There is an opportunity to incorporate substantial sized trees into the scheme to provide for future amenity and long term continued tree cover in this area. It is expected that replacement trees shall be of substantial size to make

provision for long term tree cover in the area. If the sycamore numbered T3 is removed its replacement should be of semi-mature size with initial planting height of not less than 6m, with girth measurement at 1m above ground level of not less than 30/35cm. 4. The use of a suitably qualified arboricultural consultant is considered essential to provide acceptable supervision and monitoring in respect of the arboricultural issues in respect of the above condition. All works shall be in compliance with the recommendations contained within British Standard 5837:2005 and British Standard 3998:1989 Tree Works. 5. The permission hereby granted shall not be construed as authority to carry out works on the highway. The applicant is advised that a Section 278 Agreement must be entered into with the Highway Authority before any works are carried out on any footway, footpath, carriageway, verge or other land forming part of the highway. Details of this can be requested from Transportation Development Control, Surrey County Council. 6. The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or damage the highway from uncleaned wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. (Highways Act 1980 Sections 131, 148, 149). 7. The applicant is aware that the design of the refuse area, located at the rear of the site, does not accord with the design requirements set out by the Neighbourhood Services division of the Council. Private arrangements for refuse collection will therefore likely need to be arranged. 8. The applicant is advised that certain birds and mammals are protected in law under the Wildlife and Countryside Act and all reasonable precautions must be taken to avoid killing or injuring them and in the cases of birds, damaging or destroying their eggs. The applicant is advised that search procedures should be carried out by a licensed consultant to determine whether there are protected birds or mammals resident on the site or in buildings, and to consult English Nature in the event that existence of such species is confirmed.

220. PLANNING APPLICATION 07/02369/OUT – LAND TO THE REAR OF 1 AND 2 GROVE COTTAGES, MERROWDOWN & HAWTHORNS, SANDLANDS GROVE, WALTON-ON-THE-HILL

Consideration was given to a report on an application for the construction of two dwellings, one four bedroom two-storey with detached double garage, 231 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

one three bedroom single-storey dwelling with attached garage at the above location.

Consideration of this item had been deferred at the previous meeting of the Committee to enable a site visit to be held as Members were minded to refuse the application (Minute No. 203).

RESOLVED that planning permission be REFUSED for the following reason:

1. The proposed development by virtue of the layout and siting of the dwelling on plot one would result in a scale of built form that would fail to respect the transition from the urban area to the Metropolitan Green Belt and would therefore erode the character of the surrounding area, contrary to policy Ho9 of the Reigate and Banstead Borough Local Plan 2005 and policy SE4 of the Surrey Structure Plan 2004.

221. PLANNING APPLICATION 07/01915/OUT – HIGH BANK, WATERHOUSE LANE, KINGSWOOD

The Committee considered a report on an application for the demolition of the existing dwelling and the construction of a new two-storey building containing eight one-bedroom apartments including parking area and associated works at the above location. It was noted that this application had been deferred from the previous meeting as no formal decision had been reached (Minute No. 195).

RESOLVED that planning permission be REFUSED for the following reason:

1. The proposed development, by reason of its scale, bulk and increase in density, would result in an overdevelopment of the site which would be harmful to the character and appearance of the surrounding area, and would fail to make an appropriate transition to the Metropolitan Green Belt, contrary to Surrey Structure Plan policy SE4 and Reigate & Banstead Borough Local Plan policies Ho9, Ho9A and Ho13.

222. PLANNING APPLICATION 07/02084/OUT – HORLEY DEVELOPMENT NORTH EAST SECTOR, HORLEY

The Chairman, Councillor M.J. Miller vacated the Chair and in the absence of the Vice-Chairman it was

RESOLVED that Councillor D.J. Pay be elected as Chairman of the Committee during consideration of this item.

The Committee considered a report on an application for the demolition of disused former kennels, and residential development for 110 dwellings, formation of part riverside green chain, provision of LAP, LEAP, MUGA and kick-about area and associated infrastructure and works at the above location. It was noted that a site visit had been held in connection with this application.

RESOLVED that subject to the prior completion (within six months of the date of this resolution or such longer period as may be agreed by the Head of Building and Development Services) of all documentation required to create a planning obligation under Section 106 of the Town and Country Planning Act 1990 (as amended) to secure:-

(i) Highway Works: contributions of £42,013 towards site-specific traffic calming and junction improvements, and contribution to off-site junction improvements;

(ii) Public Transport: contributions towards infrastructure improvements and operating costs to provide the Fastway bus service linking NES to Horley town centre, and Crawley/Gatwick. Contributions to other public transport improvements in the area including Horley Station;

(iii) Cycle and Pedestrian Network: an on-site cycle and pedestrian network, contributions towards a comprehensive cycle and pedestrian network linking the development to Horley town centre, key services such as Oakwood School and neighbouring areas including Redhill and Gatwick;

(iv) Affordable housing: not less than 25% of new dwellings with a mixture of tenures and housing types to meet the needs of the Borough;

(v) Education: contributions towards primary, secondary and post-16 education within Horley to meet the demand generated by development;

(vi) A contribution towards a Library, Community Information Centre and Youth Facility within Horley;

(vii) A contribution towards Day Centre provision within Horley;

(viii) Leisure Centre: a contribution of towards capital and maintenance costs of future Leisure Centre provision in Horley;

(ix) Town Park: a contribution towards the acquisition, fitting out and maintenance of the Town Park, which is to include three football pitches, a cricket pitch, changing facilities, landscaping and play areas;

(x) Riverside Green Chain and spine path: layout of land adjacent to site plus a maintenance contribution.

(xi) Play Space - Local Area for Play, Local Equipped Area for Play, a Multi-Use Games Area, a kickabout area plus a maintenance contribution;

(xii) Allotments: a contribution towards the provision and maintenance of allotments in Horley;

(xiii) Public Art: appropriate public art within the site plus a maintenance contribution;

(xiv) Recycling: an on-site recycling point if required; and

(xv) Payment of the Council’s costs in preparing the agreement.

then outline planning permission be GRANTED subject to the following conditions:

1. Approval of details of the access, layout, scale, appearance and landscaping of the site (hereinafter called the “reserved matters”) shall be obtained from the Local Planning Authority in writing before any development is commenced and carried out as approved. Plans and particulars of the reserved matters referred to above shall be submitted in writing to the Local Planning Authority before the expiration of three years from the date of this permission. The development hereby permitted shall be begun either before the expiration of five years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later. Reason: To comply with Article 3 of the Town and Country Planning (General Development Procedure) Order 1995 (or any order revoking and re- enacting that Order) and Section 92(2) of the Town and Country Planning Act 1990 as amended by Section 51(2) of the Planning and Compulsory Purchase Act 2004. 2. Until the completion of the development hereby permitted, no site or building works (including demolition, excavation, construction of the development hereby permitted) shall be carried on outside the hours of 0800-1800 Mondays to Fridays inclusive; 0800-1300 hours on 234 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

Saturdays and not at all on Sundays and Public Holidays. There shall be no deliveries taken at or despatched from the site outside these hours. Reason: To ensure that the construction of the development hereby permitted does not unreasonably affect the amenities enjoyed by the residential properties in the vicinity, with regard to the Surrey Structure Plan 2004 policy SE1. For the avoidance of doubt “Public Holidays” includes New Year’s Day, Good Friday, Easter Monday, May Day, all Bank Holidays, Christmas Day, and Boxing Day. 3. No development shall take place until the applicant has secured the implementation of a programme of archaeological work in accordance with a Written Scheme of Investigation which has been submitted by the applicant and approved by the Planning Authority. Reason: The site covers an area in which it is considered necessary to preserve for future reference any archaeological information before it is destroyed by the development with regard to Reigate and Banstead Borough Local Plan 2005 policy Pc8 and Surrey Structure Plan 2004 policy SE5. 4. The development hereby permitted shall not begin until a management plan for the Riverside Green Chain within the development hereby permitted has been submitted to and approved by the Local Planning Authority. The plan shall be implemented as approved. Reason: To ensure the preservation of a range of natural habitats in accordance with Reigate & Banstead Borough Local Plan 2005 policy Hr38. 5. No development approved by this planning permission shall be commenced until: (a) A site investigation has been designed for the site using the information obtained from the desk top study and any diagrammatical representations (Conceptual Model). This shall be submitted in writing to, and approved in writing by, the Local Planning Authority prior to that investigation being carried out on the site. The investigation must be comprehensive enough to enable: a human health risk assessment to be undertaken relating to soil, groundwater and surface waters associated on and off the site that may be affected; refinement of the Conceptual Model; and the development of a Method Statement detailing the remediation requirements. 235 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

(b) A written Method Statement detailing any remediation requirements, including measures to minimise the impact on ground and surface waters and post remediation monitoring, using the information obtained from the Site Investigation has been submitted to, and approved by, the Local Planning Authority Reason: To ensure that the proposed development and any site investigations and remediation will not cause harm to human health or pollution of controlled waters in accordance with national planning guidance in PPS23. 6. Prior to occupation: (a) The development of the site shall be carried out in accordance with the approved Remediation Method Statement, and any addenda submitted by the developer and agreed in writing by the Local Planning Authority. Any post remediation monitoring identified in the Method statement and agreed by the Local Planning Authority, shall be installed by the developer within the timescales identified in the Method Statement and maintained an operated for as long as identified by the Method Statement. (b) If during development, contamination not previously identified, is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, a written addendum to the Method Statement. This addendum to the Method Statement must detail how this unsuspected contamination shall be dealt with. (c) Upon completion of the remediation detailed in the Method Statement a report shall be submitted to the Local Planning Authority that provides verification that the required works regarding contamination have been carried out in accordance with the approved Method Statement and any addenda thereto. Post remediation sampling and monitoring results shall be included in the report to demonstrate that the required remediation has been fully met. Future monitoring proposals and reporting shall also be detailed in the report. Reason: To ensure that the proposed development and any site investigations and remediation will not cause harm to human health or pollution of controlled waters in accordance with national planning guidance in

PPS23. 7. There will be no more than 110 dwellings unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the site is not overdeveloped, to safeguard the character and appearance of the scheme and wider area with regard to Reigate and Banstead Borough Local Plan 2005 policy Hr16. 8. Not less than 28 of the dwellings hereby permitted shall be of one or two bedrooms in size. Reason: In the interests of securing an appropriate mix of units sizes on the site, and meeting local housing needs for smaller units in accordance with Reigate and Banstead Local Plan 2005 policy Hr16. 9. Prior to commencement of development, a bird hazard management plan shall be submitted to and approved in writing by the Local Planning Authority and the plan shall be implemented as approved. No subsequent alterations to the plan are to take place unless first submitted to and approved in writing by the Local Planning Authority. Reason: To minimise the attractiveness of the development to large birds that could endanger the safe movement of aircraft and the operation of Gatwick Airport with regard to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. Note: The management plan shall comply with BAA Advice Note 8 “Potential Bird Hazards from Building Design” available at www.caa.co.uk/srg/aerodrome. 10. No building or structure associated with the development hereby permitted shall exceed the limitation on height of 104.290 metres AOD, (Above Ordnance Datum), set by the Gatwick Airport Obstacle Limitation Surface as defined by the Civil Aviation Authority. Reason: To avoid endangering aircraft movements and the safe operation of the aerodrome, including the operation of communication and navigational aids and surveillance equipment with regard to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. 11. No development shall take place until full details of soft and water landscaping works have been submitted to and approved in writing by the Local Planning Authority, and the plan shall be implemented as approved. No subsequent alterations to the plan are to take place unless first submitted to an approved in writing by the Local Planning Authority. Reason: To avoid endangering the safe movement of aircraft and the operation of Gatwick Airport through the attraction of birds and an increase in the bird hazard risk of the application site with regard to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. Note: Details must comply with Advice Note 3 “Potential Bird Hazards from Amenity Landscaping & Building Design” available at www.caa.co.uk/srg/aerodrome. 12. Development shall not commence until a drainage strategy detailing any on and off site drainage works has been submitted to and approved in writing by the Local Planning Authority in consultation with the sewerage undertaker. No discharge of foul or surface water from the site shall be accepted into the public system until the drainage works referred to in the strategy have been completed. Reason: The development may lead to sewage flooding; to ensure that sufficient capacity is made available to cope with the new development; and in order to avoid adverse environmental impact upon the community, in accordance with Reigate & Banstead Borough Local Plan 2004 policy Ut3. 13. No development shall take place until details been submitted to and approved, in writing by the Local Authority, showing details of predicted energy use of all buildings, the generation of on site renewable energy, and how the development will achieve at least a 10% reduction in energy requirements through the use of renewable energy sources and/or energy conservation measures within the development hereby permitted. Such renewable energy sources and/or energy conservation measures shall be incorporated in the development as approved and maintained hereafter. Reason: To ensure the use of renewable energy and/or energy conservation as part of the development, in accordance with Structure Plan policy SE2. 14. No development shall take place until details of the means of access to the site via the spine road between phases 2 and 3 have been submitted

to and approved in writing by the Local Planning Authority. This access shall be designed and constructed in accordance with these details and shall all be permanently maintained to a specification to be agreed in writing with the Local Planning Authority. All vehicular access to the application site shall be from the Spine road for phases one and two, and there shall be no access other than footway or cycleway onto Langshott from this site. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users, with regard to Surrey Structure Plan 2004 policy DN2, and in recognition of Planning Policy Guidance Note 13 - Transport. 15. No development shall start until a Method of Construction Statement, to include details of: (a) Parking for vehicles of site personnel, operatives and visitors; (b) Loading and unloading of plant and materials; (c) Storage of plant and materials; (d) A programme of works (including measures for traffic management); and (e) Provision of boundary hoarding behind any visibility zones has been submitted to and approved in writing by the Local Planning Authority. Only the approved details shall be implemented during the construction period. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users, with regard to Surrey Structure Plan 2004 policy DN2, and in recognition of Planning Policy Guidance Note 13 - Transport. 16. Prior to the commencement of any development works, including ground preparation and demolition a detailed TPP (tree protection plan) shall be submitted to and approved in writing by the Local Planning Authority. The TPP shall contain details of the specification and location of tree protection (barriers and/or ground protection) and any construction activity that may take place within the protected root areas of trees shown on the TPP and the supervision and monitoring of these activities. Tree protection shall be erected prior to demolition, ground preparation and will remain in place for the duration of all construction works, including hard landscaping. The protection barriers shall only be removed on the completion of all construction activity and with the written agreement of the Council. be carried out in strict accord with the approved details. Reason: To ensure good arboricultural practice in the interests of the maintenance of the character and appearance of the area and to comply with policy Pc4 of the Reigate and Banstead Borough Local Plan 2005 and policy SE9 of the Surrey Structure Plan 2004 and the recommendations within British Standard 5837. 17. Prior to the commencement of the development hereby approved, a detailed scheme explaining how the surface water run-off generated from the site will be controlled and disposed of in a sustainable manner shall be submitted to and approved in writing by the Local Planning Authority. The construction of the scheme shall then be carried out in accordance with the approved details. Reason: To reduce the impact of the development on flood risk elsewhere and improve water quality, with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 18. All site clearance works and tree felling shall be undertaken outside of the bird breeding/nesting season. This is from March to September. Reason: In the interests of the protection of on site biodiversity with regard to Surrey Structure Plan 2004 policy SE6. 19. Prior to the occupation of the first unit, details of a lighting design strategy shall be submitted to and approved in writing by the Local Planning Authority, and the development shall be carried out in accordance with the approved plans. Reason: To protect the visual amenity of the area and neighbouring residential amenities, and in the interests of foraging bats, with regard to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan SE6. 20. Prior to the commencement of development, details of an assessment to be carried out as to the connectivity between this application site and the identified Great Crested Newt ponds to the west in phases one & two, including any ponds that may have been used by Great Crested Newts since the last surveys carried out prior to this permission, shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the protection of on site biodiversity with regard to Surrey Structure Plan 2004 policy SE6. 21. No development, other than that considered to be essential

infrastructure, shall be located in the area at risk from flooding during a 1% annual probability flood event with an allowance for climate change. Reason: To protect the more flood risk vulnerable parts of the development from the risks associated with flooding and to help reduce the impact of the development on flood risk elsewhere with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 22. The finished floor levels of the new dwellings shall be set at least 500mm above the 1% annual probability flood water level including an allowance for climate change. Reason: To protect the properties and their contents from the damage associated with flooding with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 23. There shall be no storage of spoil or materials on that part of the site liable to flood during a 1% annual probability flood event including an allowance for climate change. Reason: To reduce the impact of the development on flood risk elsewhere with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 24. Prior to the commencement of the development hereby approved, a detailed scheme of flood plain compensation for all development proposed in the area at risk from flooding (during a 1% annual probability flood event with an allowance for climate change) shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall then be carried out in accordance with the approved details. Reason: To reduce the impact of the development on flood risk elsewhere with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 25. Other than in accordance with the details already approved by the grant of planning permission or discharge of other planning conditions, there shall be no raising of existing ground levels. Reason: To reduce the impact of the development on flood risk elsewhere with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 26. Prior to the commencement of any development hereby approved,

details of how any boundary treatments located in the area at risk from flooding (during a 1% annual probability flood event with an allowance for climate change) will be made permeable to the flow of floodwater shall be submitted to and approved in writing by the Local Planning Authority. The construction of the boundary treatment will be carried out in accordance with the approved details. Reason: To reduce the impact of the development on flood risk elsewhere with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. 27. There shall be no development, including areas of hardstanding and fences within a buffer zone eight metres wide alongside the (i) main river the Silverlea Ditch, or within a buffer zone five metres wide alongside any (ii) ordinary watercourses present on site. There shall also be no storage of materials, fires, dumping or tracking of machinery within these respective buffer zones, which should be suitably marked and protected during development. Reason: To maintain the character of the watercourse, reduce the risk of pollution and provide undisturbed refuges for wildlife using the river corridors with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy SE3. Note: (i) Main rivers are usually larger streams and rivers. However, they do include smaller watercourses of local significance. A main river is a watercourse marked as such on a main river map. This is an official document. Defra decides which are the main rivers. A main river can include any structure or appliance that controls or regulates the flow of water in, into, or out of, the main river. (ii) An ordinary watercourse is every river, stream, ditch, drain, cut, dyke, sluice, sewer (other than a public sewer) and passage through which water flows and which does not form part of a main river. 28. Prior to the commencement of any development hereby approved, details of any watercourse crossings shall be submitted to and approved in writing by the Local Planning Authority. The construction of the crossings shall be carried out in accordance with the approved details. Reason: To reduce the impact of the development on flood risk elsewhere and provide undisturbed refuges for wildlife using the river corridors with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 242 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

and Surrey Structure Plan 2004 policy SE3. 29. In the event that the neighbourhood centre recycling facilities approved as part of Phase 2 are not completed and ready for use prior to the construction of Phase 3, the subject of this application, no more than 25 dwellings in Phase 3 shall be occupied until a temporary recycling facility has been provided in phase 3 of the development, hereby approved. Details of the design and location of this facility shall be submitted to and approved in writing by the Local Planning Authority prior to it's construction. The facility shall only be removed on completion of a permanent recycling facility in phase 2 of the development to the Local Planning Authority's satisfaction. Reason: To ensure adequate facilities in the interests of future occupiers in accordance with policy Hr1 of the Reigate and Banstead Borough Local Plan 2005. Informatives: 1. The applicant is advised that prior to the initial occupation of any individual dwelling hereby permitted, a 140 litre wheeled bin conforming to British Standard RG723/2 and a 60-litre recycling box should be provided for the exclusive use of the occupants of that dwelling. Prior to the initial occupation of any communal dwellings or flats, wheeled refuse bins conforming to British Standard RG723/2, separate recycling bins for paper/card and mixed cans, and storage facilities for the bins should be installed by the developer prior to the initial occupation of any dwelling hereby permitted. Further details on the required number and specification of wheeled bins and recycling boxes is available from the Council’s Neighbourhood Services on 01737 276224, or on the Council’s website at www.reigate- banstead.gov.uk. Bins and boxes meeting the specification may be purchased from any appropriate source, including the Council’s Neighbourhood Services Unit on 01737 276608. 2. The submission of the bird hazard management plan pursuant to condition 9 shall include details of: (a) Management of any flat/shallow pitched/green roofs on buildings within the site which may be attractive to nesting, roosting and ‘loafing’ birds. The bird management plan must ensure that flat/shallow pitched roofs to be constructed to allow access to all areas by foot using permanent fixed access stairs, ladders or similar. The owner/occupier must not allow gulls to nest, roost or ‘loaf’ on the building. Checks must be made weekly or sooner if bird activity dictates, during breeding season. Outside of the

breeding season gull activity must be monitored and the roof checked regularly to ensure that gulls do not utilise the roof. Any gulls found nesting, roosting or ‘loafing’ must be dispersed by the owner/occupier when detected or when requested by BAA Airfield Operations Staff. In some instances it may be necessary to contact BAA Airfield Operations Staff before bird dispersal takes place. The owner/occupier must remove any nests or eggs found on the roof. The breeding season for gulls typically runs from March to June. The owner/occupier must obtain the appropriate licence from Natural England before the removal of nests and eggs. (b) Management of the SUDS attenuation basins to ensure that no starling roosts are formed. If more than 100 starlings are spotted on each the SUDS basins then the birds must be dispersed. This could be incorporated into the landscape management plan for the site. 3. The submission of soft and water landscaping details pursuant to condition 11 shall include details of: (a) Grassed areas; (b) Species, number and spacing of trees and shrubs; and (c) Details of any water features. 4. The submission of hard and soft landscaping details pursuant to condition 1, shall have regard to the advice in the Civil Aviation Authority’s Advice Note 3 “Potential Bird Hazards from Amenity Landscaping and Building Design” available at www.caa.co.uk/srg/aerodrome. 5. Attention is drawn to the British Standard Code of Practice for the safe use of cranes and the Civil Aviation Authority’s Advice Note 4 “Cranes and other Construction Issues” available at www.caa.co.uk/srg/aerodrome. 6. Attention is drawn to the need to comply with the requirements of the Environmental Protection legislation during construction and in this respect you are advised to contact the Council’s Environmental Health Service Unit. 7. For further advice and information on any issues identified as potential crime risks it is recommended that you contact the Architectural Liaison officer, Surrey Constabulary, Horley Police Station, Massetts Road, Horley, Surrey, RH6 7DQ. 8. The applicant is advised that all bats found in Britain are fully protected under schedule 8 of the Wildlife and Countryside Act 1981. It is an offence to kill or injure them when roosting, to destroy roosts,

or to block entrances to roosts. It is recommended that an investigation is carried out by a licensed bat worker prior to any works of demolition. If evidence of the presence of bats is found English Nature must be informed immediately. For information on licensed bat workers the applicant should contact Charlotte Evans, Surrey Bat Group, c/o Surrey Wildlife Trust, School Lane, Pirbright, Woking Surrey GU24 0JN 901483 488055). 9. Your attention is drawn to the safety benefits of installing sprinkler systems as an integral part of new development. Further information is available at www.firesprinklers.info. 10. The applicant is advised that the Borough Council is the street naming and numbering Authority and you are requested to contact the NPLG Officer, Chief Executive’s Department, Town Hall, Reigate, Surrey, RH2 0SH, when construction is about to commence enclosing a site layout plan, in order that official street naming and numbering can be allocated as appropriate. 11. Under the terms of the Water Resources Act 1991, the prior consent of the Environment Agency is currently required for any discharge of sewage or trade effluent onto or into the ground and for surface run off into ground water. Such consent may be withheld. If there is existing discharge consent the applicant should ensure that any increase in volume is permitted under the present conditions. Contact the EA Authorisations Officer on 01276 454333 for further details. 12. Any building work, alteration to ground levels, erection of fences, walls or other means of enclosure, removal or planting of trees within nine metres of a watercourse requires the consent of Reigate & Banstead Borough Council under the Land Drainage Byelaws 2001. You are therefore advised of the need to seek separate consent under the above byelaws. Application forms should be obtained from the Borough Council’s Drainage Engineer at the Earlswood Depot, Horley Road, Redhill, RH1 6PN. 13. The proposed access road will cut across public footpath 575, the applicant is advised that good sight lines are provided and maintained at the point together with dropped kerbs on both side or the road and traffic calming measures to slow traffic at the crossing point. Applicants are also advised to contact the County Council Countryside Access Officer, Mrs Jenman, on 01737 737332, to discuss the potential for improved surfacing to this footpath in light of the likely increase in use, and the future maintenance of trees along this path. 14. The applicant is advised that on the advice of the County Council Countryside Access Officer, Mrs Jenman, the dedication of footpaths around the periphery of the site is welcomed. However you are advised to contact the officer to obtain agreement regarding surfacing,

status and structures on all paths intended to become definitive routes, including the spine path. 15. The applicant is reminded that this grant of permission does not authorise the obstruction of or interference with a public right of way. All public rights of way must be kept open at all times, allowing the public safe unhindered access. Nothing is to be stored/parked on or near to a public right of way so as to restrict the available width or endanger the public. 16. The applicant is advised to ensure when erecting fencing, temporary or permanent, that they do not obstruct any public rights of way. Should you require confirmation of exact routes on the ground you are advised to contact the County Council Countryside Access Officer, Mrs Jenman, on 01737 737332. 17. The Highway Authority has no objection to the proposed development, subject to the above conditions but, if it is the applicant’s intention to offer any of the roadworks included in the application for adoption as maintainable highways, permission under the Town and Country Planning Act should not be construed as approval to the highway engineering details necessary for inclusion in an Agreement under Section 38 of the Highways Act 1980. 18. The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or damage the highway from uncleaned wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. (Highways Act 1980 Sections 131, 148, 149). 19. The permission hereby granted shall not be construed as authority to obstruct the public highway by the erection of scaffolding, hoarding or any other device or apparatus for which a license must be sought from the Highway Authority. 20. Design standards for the layout and construction of access roads and junctions, including the provision of visibility zones, shall be in accordance with the requirements of the County Highway Authority. 21. In respect of condition 14 above, land outside the application site but shown as under the applicants control will be affected. 22. The applicant should note that in relation to condition 15 regarding submission of a method of construction statement, access for construction traffic to the site shall not be from the east but from the A23/Cross Oak Lane.

23. The use of a suitably qualified arboricultural consultant or competent person is essential to provide acceptable submissions in respect of the above relevant condition. These submissions should be compliant with the recommendations contained in British Standard 5837:2005 (Trees in Relation to Construction) recommendations. 24. Should evidence be found at any stage of construction works of dormice on site, the applicant is advised that all works should cease and advice be sought from Natural England. They can be contacted on 01273 476595. 25. If any works are to be undertaken within 30 metres of any entrance to an active badger sett, a licence will be required from Natural England. The applicant is advised that the badger sett initially surveyed in the northeast corner of the site must be resurveyed prior to commencement of any development adjacent to this set, the results of which should be forwarded to Surrey Wildlife Trust at School Lane, Pirbright, Woking, Surrey, GU24 0JN. 26. The applicant is advised to adhere to good practices during construction including the covering of trenches overnight in the interests of wildlife. 27. The applicant is advised that in line with the Environmental Statement Vol.2 (para 3.7.2), ash and poplar trees, and the ruined cottage on site should be subject to a further detailed inspection for bats prior to demolition. These inspections should be carried out by a licensed bat worker. If evidence of bats is found all work must cease and advice should be sought from Natural England. It is recommended that a dusk and dawn survey is undertaken on the day prior to works as bats can colonise and roost within a short period of time. In addition to the bat boxes proposed in trees around the edge of the site, the incorporation of bat tubes/bricks or boxes into the design of at least 30% of new dwellings is advised. 28. The reptile population of the site should be translocated to a receptor site. The applicant is advised to provide further information regarding the location and suitability of such a site to Natural England and Surrey Wildlife Trust for comment and advice. The applicant is advised that all wood should remain on site to create habitats for invertebrates and reptiles, in the form of for example log piles, hibernacula and loggaries. These hibernacula and loggeries should be created in the open space areas in the north east of the site. 29. All shrubs to be planted should be indigenous and of local provenance. 30. The applicant is advised that two areas to be specified and given over to grassland should be cleared and reseeded with a wildflower mix. A

five-metre buffer zone is recommended on either side of the hedgerows. 31. The applicant is advised to incorporate nesting boxes for house sparrows and open fronted boxes for song thrush be incorporated on houses in tree lines, around public spaces and throughout the Riverside Green Chain. Nest boxes for barn owls are also advised throughout the Riverside Green Chain. 32. Any slow worms found during construction or clearance works should be placed in a previously prepared enclosure consisting of a long grass habitat. The applicant is advised to contact Surrey Wildlife Trust for advice on the design of any such enclosure. Following completion of development the Slow Worms should then be re-introduced back into open space. 33. The applicant is advised that it would be beneficial to produce an information pack for future occupiers of the site with regard to the wildlife value and enhancements on site, and advice on future maintenance. The applicant should contact Surrey Wildlife Trust who will work with them to develop the information. 34. The applicant is advised to take note of the advice and issues agreed at the meeting with Surrey Wildlife Trust on 23 January 2008, and that this should be taken into account when designing the detailed stages of the development. 35. In connection with condition 17, a proposal to use underground storage tanks would be contrary to the Horley Flood Risk Development Brief. The Environment Agency also consider the use of such techniques in a site’s drainage system as unsustainable as they do not offer any benefits for the site’s amenity or help to improve the quality of water being discharged from the site. The lifetime cost of underground tanks (i.e. installation and maintenance) is also greater than those of alternative, sustainable surface water drainage solutions. 36. In connection with condition 28, wherever possible, any crossing of the watercourses on site (both existing and proposed) should be with an open span bridge including a suitable area between the top of the bank of the watercourse and any supporting structures rather than with a culvert. This will ensure the creation of continuous wildlife corridors along the water features present on site and ensure that there are no restrictions to the flow of flood water during a flood event. 37. All storm flows are to be attenuated or regulated into the receiving public network through on or off site storage. At the stage of connection to a public sewer, site drainage should be separate and combined at the final manhole nearest the boundary. Connections are not permitted for the removal of Ground Water. Where it is proposed to discharge to a public sewer, prior approval is required from Thames 248 26th March 2008 PLANNING COMMITTEE - Continued 26th March 2008

Water Developer Services. They can be contacted on 0845 850 2777. 38. The applicant is advised that to comply with condition 13 regarding renewable energy, they are expected to submit details to show that the development will in fact achieve a significantly greater reduction in the energy requirements than 10%, which as indicated in the condition is a minimum target. 39. The applicant is advised that the retention and incorporation of existing landscape features such as trees and hedgerows into the new development is considered to be an important objective of the Development Framework. The Authority considers that all trees and hedgerows should be retained unless or until agreed, as part of the reserved landscaping matters, to be removed.

223. PLANNING APPLICATION 07/02175/F – LAND ADJACENT TO THE GRANGE, 40 BONEHURST ROAD, HORLEY

Consideration was given to a report on an application for the erection of a detached apartment block containing ten units at the above location.

RESOLVED that:

(i) subject to the prior completion (within six months of the date of this resolution or such longer period as may be agreed by the Head of Building and Development Services) of all documentation required to create a planning obligation under Section 106 of the Town and Country Planning Act 1990 (as amended) to secure the payment of infrastructure contributions of £130,580 and the payment of the Council’s costs for checking the obligation then planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004. 2. Before the development is occupied the proposed modified vehicular accesses to Bonehurst Road shall be constructed and provided with visibility zones of 2.4m 'x' distance by 120m 'y' distance in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority, all to be permanently maintained to a specification to be agreed in writing with the Local Planning Authority and the visibility zones shall be kept permanently clear of any obstruction. Reason: In order that the development should not prejudice highway safety nor cause inconvenience to other highway users with regard to Reigate and Banstead Borough Local Plan 2005 policy Mo6 and Surrey Structure Plan 2004 policy DN2. 5. No new development shall be occupied until space has been laid out within the site in accordance with the approved plans for cars and cycles to be parked and for the loading and unloading of vehicles and for vehicles to turn so that they may enter and leave the site in forward gear. The parking and turning area shall be retained exclusively for its designated purpose. No development shall commence on site until a scheme for the landscaping and replacement tree planting of the site has been submitted and approved in writing by the local planning authority. Landscaping schemes shall include details of hard landscaping, planting plans, written specifications (including cultivation and other operations associated with tree, shrub, hedge or grass establishment), schedules of plants, noting species, plant sizes and proposed numbers/densities and an implementation programme. Reason: To ensure good landscape practice in the interests of the enhancement and maintenance of the character and appearance of the area, with regard to policy Pc4 of the Reigate and Banstead Borough Local Plan 2005, and policy SE9 of the Surrey Structure Plan 2004. 9. development hereby approved, or in accordance with a programme agreed with the Local Planning Authority. All trees shrubs, hedges and plants supplied shall comply with the requirements of British Standard 3936, specification for nursery stock and British Standard 4043:1989 Transplanting root-balled trees. All pre-planting site preparation, planting and post-planting maintenance work shall be carried out in accordance with the requirements of British Standard 4428 (1989) Code of Practice for general landscape operations (excluding hard surfaces). All new tree planting shall be positioned in accordance with guidelines and advice contained in the current British Standard 5837: Trees in Relation to Construction. Any trees shrubs or plants planted in accordance with this condition which are removed, die or become severely damaged or become severely diseased within five years of planting shall be replaced within the next planting season by trees, and shrubs of the same size and species. Reason: To ensure good landscape practice in the interests of the enhancement and maintenance of the character and appearance of the area, with regard to policy Pc4 of the Reigate and Banstead Borough Local Plan 2005, and policy SE9 of the Surrey Structure Plan 2004. 10. Prior to the commencement of any development works, including demolition groundworks and construction activities all related arboricultural matters, including arboricultural supervision, monitoring, tree protection measures, specialist surfacing, pruning or removal of trees shall be undertaken in strict accordance with the approved details contained in the arboricultural report compiled by Simon Jones Associates Ltd dated November 2007 and Tree Protection Plan drawing number SJA TPP 01. Reason: To ensure that good arboricultural and landscape practice is followed, and to preserve and enhance the character and appearance of the area with regard to Reigate and Banstead Borough Local Plan 2005 policies Ho9, Pc4 and Surrey Structure Plan 2004 policy SE9. 11. The finished floor levels of the development are to be 450mm above the 1 in 100 year + 20% flood levels for the site. No other raising of ground levels shall occur on the site without the prior written approval of the Local Planning Authority. Reason: To provide appropriate flood protection measures with regard to

There are a few items which are required town-wide but are not justified by the additional dwellings alone, such as a Leisure Centre. Only a proportion of the costs attributable to the 2600 additional dwellings would therefore be sought. The proportion is 29%, being equivalent to the addition to Horley's dwelling stock at 2001 (8809) of the 2,600 dwellings.

The Contribution per dwelling includes an allowance of 7% for non- collection to ensure that sufficient contributions will be forthcoming to meet all the obligations. If all the 2,600 additional dwellings fully contribute, credits may be payable.

The estimated cost of each obligation will be updated using an appropriate index until the date of payment, such as ATCO, BCIS, DTI, PUBSEC, RPI, and LMO1.

On commencement of development, notice should be sent to the Planning Authority in writing or email to [email protected] advising that works have started. The sum described above is payable within a period of 28 days from commencement of development. Failure to pay the infrastructure contribution may result in legal action being taken against the developer and/or owner of the land. 6. The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or damage the highway from uncleaned wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. The use of a suitably qualified arboricultural consultant is considered essential to provide acceptable supervision and monitoring in respect of the arboricultural issues in respect of the above condition. All works shall be in compliance with the recommendations contained within British Standard 5837:2005 and British Standard 3998:1989 Tree Works. 9. The permission hereby granted shall not be construed as authority to carry out works on the highway. The applicant is advised that a licence must be obtained from the Highway Authority Local Transportation Service before any works are carried out on any footway, footpath, carriageway, verge or other land forming part of the highway.

(ii) in the event that a satisfactorily completed unilateral obligation is not received by 27th March 2008 or such longer period as may be agreed, the Head of Building and Development Services be authorised to REFUSE permission for the following reason:

1. The proposal fails to provide an agreed contribution towards the provision and improvement of local infrastructure and facilities in Horley and is therefore contrary to Policy DN1 of the Approved Surrey Structure Plan 2004, and Policy Hr3 of the adopted Reigate and Banstead Borough Local Plan 2005.

224. PLANNING APPLICATION 08/00175/OUT – 28 DOWNS WAY, TADWORTH

The Committee considered a report on an application for the demolition of the existing house and garage and the erection of a detached building comprising six two-bedroom apartments and underground garaging for six vehicles at the above location.

RESOLVED that planning permission be REFUSED for the following reasons:

1. The proposed layout of the individual units would result in habitable rooms with inadequate window provision. This would result in a claustrophobic effect with no acceptable outlook, resulting in an unsatisfactory living environment for future residents of the proposed dwellings, contrary to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. 2. The proposal by virtue of the positioning of the underground parking and the number of vehicles using this facility in conjunction with the proposed development would create additional noise and disturbance detrimental to the amenities of the neighbouring property contrary to Reigate and Banstead Borough Local Plan 2005 policy Ho9 and Surrey Structure Plan 2004 policy SE4. 3. The proposal fails to provide an agreed contribution toward infrastructure contributions required to fund the improvement of local infrastructure and facilities in Reigate and Banstead and is therefore contrary to policy DN1 of the Surrey Structure Plan 2004. 4. The proposal would result in a development which would be out of character with the locality by reason of increased activity associated with the increased number of units on this plot compared to the original single family unit contrary to Reigate & Banstead Borough Local Plan 2005 policies Ho9 and H013 and the Surrey Structure Plan 2004 policy SE4.

The developer is reminded that it is an offence to allow materials to be carried from the site and deposited on or damage the highway from uncleaned wheels or badly loaded vehicles. The Highway Authority will seek, wherever possible, to recover any expenses incurred in clearing, cleaning or repairing highway surfaces and prosecutes persistent offenders. (Highways Act 1980 Sections 131, 148, 149). 5. The applicant is advised that the Borough Council is the street naming and numbering Authority and you are requested to contact the NPLG Officer, Chief Executive’s Department, Town Hall, Reigate, Surrey, RH2 0SH, when construction is about to commence enclosing a site layout plan, in order that official street naming and numbering can be allocated as appropriate. 6. You are advised that a charge relating to infrastructure contributions has been secured through a planning obligation associated with the permission for the amount of £36,340.56. On commencement of development, notice should be sent to the Planning Authority in writing or email to [email protected] advising that works have started. The sum described above is payable within a period of 28 days from commencement of development. Failure to pay the infrastructure contribution may result in legal action being taken against the developer and/or owner of the land.

(ii) in the event that a satisfactorily completed unilateral obligation is not received by 8th April 2008 or such longer period as may be agreed, the Head

of Building and Development Services be authorised to REFUSE permission for the following reason:

1. The proposal fails to provide an agreed contribution toward infrastructure contributions required to fund the improvement of local infrastructure and facilities in Reigate and Banstead and is therefore contrary to Policy DN1 of the Surrey Structure Plan 2004.

227. PLANNING APPLICATIONS 07/02410/F AND 08/00342/F – 14 – 18 YEW TREE BOTTOM ROAD, EPSOM DOWNS

The Committee considered a report on an application for a residential development comprising the demolition of 14 Yew Tree Bottom Road and the erection of 4 dwellings with a new access at the above location. It was noted that an appeal had subsequently been lodged against the non-determination of application 07/02410/F and consequently the Committee considered the decision that would have been taken had an appeal not been submitted in respect of that application.

During the discussion reference was made to the difficulty of considering certain applications without professional advice being available at the meeting from Highway Authority officers, and it was suggested that the Leader of the Council should be asked to take this aspect up with the County Highway Authority.

RESOLVED that:

(i) with reference to application 08/00342/F, authority be delegated to the Head of Building and Development Services in consultation with the Chairman and Ward Member to REFUSE the application subject to the following reasons and subject to (a) an additional reference to Ho9A and PPS3 in the first reason; and (b) consideration of an additional reason relating to the non-achievement of 90m splay as per Surrey Design Technical Appendix to be explored with the Highway Authority:-

1. The proposal, by virtue of the size, design and siting of the new dwellings would be out of keeping with the character and appearance of the area. The development therefore is contrary to policies Ho9, Ho13, Ho14 and Ho16 of the Reigate and Banstead Borough Local Plan 2005, policy SE4 of the Surrey Structure 2004 and the provisions of the Council’s Local Distinctiveness Design Guide

2. The proposal, by virtue of the size and location of the dwellings in relation to the site boundaries and the location of windows in the dwellings would result in an overbearing impact upon neighbouring properties and a loss of privacy to those properties. The development is therefore contrary to policy Ho9 of the Reigate and Banstead Borough Local Plan 2005 3. The proposal fails to provide an agreed contribution toward infrastructure contributions required to fund the improvement of local infrastructure and facilities in Reigate and Banstead and is therefore contrary to policy DN1 of the Surrey Structure Plan 2004.

(ii) with reference to application 07/02410/F, had an appeal against non- determination not been submitted the Council would have delegated authority to the Head of Building and Development Services in consultation with the Chairman and Ward Member to REFUSE the application for the following reasons and subject to (a) an additional reference to Ho9A and PPS3 in the first reason; and (b) consideration of an additional reason relating to the non-achievement of 90m splay as per Surrey Design Technical Appendix to be explored with the Highway Authority:-

RESOLVED that in the absence of the Chairman and Vice-Chairman, Councillor D.J. Pay be elected as Chairman of the Committee during consideration of this item.

The Committee considered a report on an application for the renewal of planning permission 07/00440/F for the retention of a portable office building for a further temporary period of 12 months at the above location.

RESOLVED that planning permission be GRANTED subject to the following condition:

1. This permission shall be for a limited period expiring on 18th April 2009 when the building hereby permitted shall be removed and the land restored to its former condition. Reason: To enable the Local Planning Authority to ensure that the long-term visual appearance of the site is maintained with regard to Surrey Structure Plan 2004 policy SE4.
