23-1-1799-4 Petition of sundry Inhabitants of Hawkins County
To Major William hoard at Noxvell this with Care
House of Representatives, Sept. 25, 1799, Read & referred to the Committee of Propositions & Grievances, Ed Scott, Secty. In Senate 25 September 1799, Read & referred, John Kennedy, Clk ------page 130-131 Petition of Citizens of Anderson County 19-2-1801-1a To the general Assembly of the State of Tenessee [sic] the Memorial of the Citizens of Anderson County humbly represents That Micajah Cross, Robert Pollack and Edward Williams respectable Citizens of your County of Anderson, are or by all probability will be sufferers as Securities for a certain Jesse Van Noy who was bound some time since to appear personally at the superior Court held at Knoxville in March (19-2-1801-1b) 1803 for Hamilton District; but for the want of honor or fear of justice, made his elopement so that after the most accurate researches and the utmost efforts deserted from Court to Court until the present term the said Cross, Pollock and Williams were unable to procure the appearance of the above Jesse Van Noy at the afore said Court then and there by his default were compelled to suffer judgement to be entered against them to the enormous amount of 1000 dollars.
Your memorialists humbly conceive, it being well acquainted with the said Cross, Pollocks and Williams pecuniary circumstances that the above forfeited recognizance will not only divest them of all their real and personal property, but will also be an insufficient satisfaction of being of being releasest from the debt in the aforesaid manner contracted (19-2-1801-1c) your memorialists further humbly represent that the Damage to the state would be greater if good Citizens in the care of rising families are deprived by the afore said measures of their support of their families sustenance, than the non punishment of no capital Crime. The said Cross, Pollack and Williams will lay before your honorable body with this memorial a declaration made upon Oath, that a stroke of the almighty, put it beyond their powers for ever to procure the said Jesse Van Noys appearance at the afore said Court –
Your memorialists therefore humbly, pray, that you will release the said Micajah Cross, Robert Pollack and Edward Williams from the afore said forfeiture… To your wisdom, to your patrotism, we commit this sacred pak deposit with the unlimited confidence, that you will do justice and provide against the destruction of faithfull and good Citizens.
For which we as your humble petitioners pray and for ever shall pray &c.
