Exhibition Waiver and Warranty for Artists

The Artist will: Provide all works ready for hanging, including secure framing as necessary Deliver the works to the venue and assist with installation if necessary Assist with the dismantling of the exhibition and remove the works Not include in the exhibit, artwork featuring frontal nudity Warrant that he/she created and possesses unencumbered title to the artwork Be solely responsible for insuring his/her artwork if insurance is desired. Furnish all signage as deemed suitable Act as their own agent in the sale of all art work
Liability and Risk: Artist agrees that, except in the case of gross negligence, the City of Westerville shall not be liable for damage to or loss of artwork from any cause whatsoever, including but not limited to weather, flood, earthquake or earth movement, mold, water damage from any source, Acts of God, theft or vandalism. ARTIST WAIVES ANY AND ALL RIGHT OF CLAIM AGAINST THE CITY FOR DAMAGE TO OR LOSS OF THE ARTWORK FROM ANY CAUSE WHATSOEVER, EXCEPTING GROSS NEGLIGENCE OF THE CITY.
Use of Photographs: Artist grants the City of Westerville the right to photograph the artworks and use the photographs with or without the Artist’s name for any and all purposes including but not limited to, private or public presentations, advertising, publicity and promotion. Artist warrants that Artist has the right to authorize photographic uses and agrees to hold the City of Westerville harmless from any and all liability of whatever nature, arising from such uses.
