NOTICE OF SALE

This sale is a sale in execution pursuant to a judgment obtained in the above Honourable Court on 19 March 2012 and a Writ of Execution issued thereafter, the immovable property listed hereunder will be sold in execution on 4 June 2012 at 09h00 by the Sheriff Inanda District Two, at the Sheriff's Office, 82 Trevenen Road, Lotusville, Verulam, to the highest bidder without reserve:

PROPERTY DESCRIPTION: Erf 831, La Lucia (Extension Number 3) Registration Division FU, Province of KwaZulu-Natal, in extent 1462 (One thousand four hundred and sixty two) square metres, held under Deed of Transfer Number T17611/2006

PHYSICAL ADDRESS: 3 Ellingham Drive, La Lucia, KwaZulu-Natal

IMPROVEMENTS: The following information is furnished but not guaranteed: double storey building consisting of: Lower level: Entrance hall, lounge, dining room with aircon, kitchen: bic & ELO and hob, 1 bedroom which opens onto a veranda - with bic and en-suite (wash basin, shower and toilet), Upper Level: 3 bedrooms with bic and en- suites (bath, wash basin & toilet), all 3 bedrooms have parquet floors and airconditioners, Outbuilding/s: double lock up garage, double domestic's accommodation, guard hut at gate, swimming pool. High boundary walls with automated gate (the nature, extent, condition and existence of the improvements are not guaranteed, and are sold "voetstoots").

1. The sale shall be subject to the terms and conditions of the High Court Act and the Rules made thereunder.

2. The purchaser shall pay a deposit of 10% of the purchase price, in cash and/or bank guaranteed cheque, immediately after the sale of the property, the balance against transfer to be secured by a Bank or Building Society guarantee, to be furnished to the Sheriff within FIFTEEN (15) days after the date of sale for approval by the Execution Creditor's Attorneys and the Sheriff.

3. The conditions of sale may be inspected at the office of the sheriff for Inanda District Two, at 82 Trevenen Road, Lotusville, Verulam as from the date of publication hereof, and the Rules of the auction are available 24 hours prior to the auction.

4. Registration as a buyer is a pre-requisite subject to specific conditions, inter alia:

a) In accordance with the Consumer Protection Act 68 of 2008; (http://www.info.gov.za/view/downloadfileAction?id=9961) b) FICA-legislation : in respect of proof of identity and residential address

c) Payment of a Registration deposit of R10,000-00 in cash or a bank guaranteed cheque is required

5. The office of the Sheriff Inanda District Two will conduct the sale with either one of the following auctioneers Mr R R Singh (Sheriff) and/or Mr Hashim Said (Deputy Sheriff) and/or Mr Sanjith Singh (Deputy Sheriff).

6. Advertising costs at current publication rates and sale costs according to the court rules apply.
