MINUTES OF A MEETING OF THE BOARD OF ASSESSMENT APPEALS TUESDAY, MARCH 12, 2013

The meeting was called to order at 6:00pm. Present at the meeting were : Charles Agli, Joseph Tria and Gerard Weatherby.

Approval of Minutes: The minutes of the September 27, 2012 meeting were reviewed. Upon a motion by Gerard Weatherby, seconded by Joseph Tria, the minutes were approved. The motion was approved unanimously. (Agli-yes, Tria-yes, Weatherby-yes)

Report on 2013-2014Budget: Charles Agli reported to the Board that he had attended a February 6, 2013 budget hearing of the Board of Finance on behalf of the Board of Assessment Appeals. The Board requested a budget that was the same as this year's budget except for a $50 increase in the supplies budget in anticipation of more appeals and postage due to the revaluation next year. There were no questions from the Board of Finance.

Hearing of Appeals: Anthony Scarfo: Personal Propety Appeal for October 1, 2011 grand list. Anthony Scarfo explained that he had never received a 2011 personal property declaration from the Assessor. He had never received the notices that the Assessor sent. He feels he never had the opportunity to get a correct value. He discussed that he had address problems on his mail from the Assessor and the Tax Collector. It took some time and effort on his part on more than one occasion to get it resolved. For the 2012 declaration in October 2012 he responded immediately. He presented pictorial evidence to the Board that he had very limited personal property in Windsor Locks.

Anthony Scarfo: Real Estate Appeal for 498 Elm Street. Anthony Scarfo stated that he had a bank appraisal for his house at 498 Elm Street. The appraisal was dated as of December 10, 2012. The appraisal concluded the value of this property was $184,000.

KLTM Enterprises Candy Machine Vending: Personal Property Appeal. Keith White explained that in October 2012 KLTM had only one vending machine left. He presented to the Board a picture from an internet listing which showed the type of machine that KLTM had. It was a small, stand type, vending machine with three containers that dispensed gumball type candy. He explained that the candy machine vending business had not worked out. They had disposed of their small number of machines over the last couple of years. And as of this December 2012, this last machine had been destroyed and they were no longer in this business. In recent years they had donated all proceeds to Lupus Awareness and Research. Their last income tax return was in 2008 or 2009. Meeting of the Board of Assessment Appeals on March 12, 2013 – page 2

Crown Park, LLC: Real Estate Appeal for 317 Ella Grasso Turnpike. Joseph DeMaio and Attorney Paul Smith made the appeal. They stated the Federal Reserve Bank of Boston had been the lessee of this property for years. The lease ended in 2012. Attempts to secure another lessee have not yet been successful. Now the building is essentially a shell with some raised computer floors and other special purpose installations still remaining which may not be suited to a new tenant. They supplied an analysis which compared the subject assessment to surrounding similar buildings. The analysis showed the Town's appraisal of the subject to be about $65.80 per square foot and the surrounding properties were more in the range of $45 per square foot.

Shailesh Patel Trustee of Manisha Realty Trust: Real Estate Appeal for 5 Ella Grasso Turnpike. Shailesh Patel and Eric Moody explained that since they purchased the property the economy is down and airport business is down. In 2011 they had stopped paying the mortgage and the bank chose get out of the mortgage of $5,000,000 for $2,400,000. Ramada Inn is pulling the franchise from the property because of the condition of the property. They hope to secure another franchise, make improvements, and make a come back.

Decisions: The Board noted that the following appeals had been withdrawn before this meeting: AFP Forty-Eight Corp.: Real Estate Appeal for 12 Ella Grasso Turnpike. Anna DeLeo, dba Ads Pizzeria: Personal Property Appeal.

The Board was in receipt of a request from Mike Russo of ALLNICC LLC to reschedule the hearings for the two appeals they filed to the week of March 18th. Upon a motion by Joseph Tria, seconded by Charles Agli, the Board voted unanimously to reschedule those hearings for Tuesday, March 19, 2013 at 6:00pm. (Agli-yes, Tria-yes, Weatherby-yes)

Anthony Scarfo: Personal Propety Appeal for October 1, 2011 grand list. Upon a motion by Joseph Tria, seconded by Gerard Weatherby, the appeal was dismissed because the Board of Assessment Appeals does not have statutory authority to change the 2011 grand list at this time. The motion was approved unanimously. (Agli-yes, Tria-yes, Weatherby-yes) Anthony Scarfo: Real Estate Appeal for 498 Elm Street. Upon a motion by Joseph Tria, seconded by Gerard Weatherby, the assessment appeal for 498 Elm Street was denied. The motion was approved unanimously. (Agli-yes, Tria-yes, Weatherby-yes) KLTM Enterprises Candy Machine Vending: Personal Property: Upon a motion by Joseph Tria, seconded by Gerard Weatherby, the personal property assessment was changed to 2,100. Shailesh D. Patel Trustee of Manisha Realty Trust: Real Estate Appeal for 5 Ella Grasso Turnpike. Upon a motion by Gerard Weatherby, seconded by Joseph Tria, the appeal was denied. The motion was approved unanimously. (Agli-yes, Tria-yes, Weatherby-yes)
