Graves Labrador Retrievers General Health Guarantee & Bill of Sale Contract

This general health guarantee & sales contract is made this day ___ of ______20__ between Genia Graves 24439 N 195th Ave, Surprise, Arizona 85387 Cell: 623-810-9765 Party of the first part, and hereinafter termed The Seller,

The seller agrees to sell, and herby does sell, and has this day delivered to the buyer, a Labrador Retriever breed of Color & Sex, whelped 0?/30/2012 sired by Sire Name, and out of Dam name is in sound body and good health, and free from communicable disease as far as appears to the eye.

The consideration for sale is the sum of ______, as the purchase price, plus also the conditions to be performed by the buyer as hereinafter set forth, and the information furnished by the buyer as hereinafter set forth, which information is given by the buyer as true and correct, and by which information the seller has been induced to make this contract. Deposits are non-refundable.

General Health Guarantee

The puppy/dog must be taken to a licensed veterinarian with in seventy-two (72) hours (excluding weekends or holidays) of purchase. Failure to have the puppy examined within 3 business days constitutes acceptance of the puppy as-is. The seller guarantees this puppy/dog to be free of Parvo, Distemper, Corona Virus, Parainfuenxa and Adeno Virus Type II for a period of 3 weeks from the puppies last vaccination date and for a period of thirty (30) days if and only if the purchaser keeps the puppy/dog up to date on vaccinations as recommended by his or her veterinarian. If a health problem is diagnosed that qualifies Buyer to exercise their option to return the puppy to Seller for another puppy, and Buyer elects to refuse the this option and keep the puppy, Seller is NOT RESPONSIBLE for any future veterinary expenses that the puppy may incur.

Buyer understands and agrees that, while Seller has made every effort to only produce puppies from healthy and sound parents with no known genetic defects, there is no way to guarantee, regardless of the genetic health of the parents, that ANY living thing will be free of genetic defects. Therefore, there is no guarantee against genetic defects.

Buyer understands and agrees that, because they have chosen to purchase a young puppy and not a mature adult dog, that it is impossible to guarantee the exact characteristics of this puppy at maturity. Therefore, no guarantee is made as to future temperament, conformation (including bite and ear carriage), size, or suitability for showing and/or breeding (including descent of testicles on male puppies). Buyer understands agrees to follow Seller’s advice about careful and gentle handling of a Large breed puppy, and the risk of injury (including broken bones and/or joint damage, both of which may cause permanent disability) if the puppy is roughly handled, dropped, or permitted to jump on/off furniture, trucks and other raised surfaces. Any injuries incurred after this puppy has left Seller’s premises, and any consequences from said injuries, are not covered by the health guarantee. (The seller reserves the right to postpone the replacement of the puppy/dog for any reason.)

* Buyer understands and agrees to follow Seller's recommendations about feeding, training, and appropriate veterinary care for this puppy.

The puppy/dog must be returned within seventy-two (72) hours of purchase (excluding weekends or holidays if shipping is required) and must be accompanied by all paperwork supplied by the seller at the time of sale, and a written statement from the licensed veterinarian clearly stating defect or illness. Sick puppies/dogs may not be returned to the seller’s home! It is the responsibility of the purchaser to contact the seller to arrange another place to meet. (This is to prevent healthy puppies/dogs from becoming ill.) The seller would never knowingly sell a sick puppy/dog and the purchaser agrees that the seller could not have been aware of any illness or defect unable to detect by a licensed veterinarian. If a puppy/dog is found to have a health problem at its initial veterinarian visit and the purchaser opts to treat this puppy/dog instead of exchanging it for another puppy/dog, the seller is not responsible for any expenses incurred or for the death of the puppy/dog, and no replacements will be made.

* Buyer understands that, while Breeder has made every effort to only produce offspring from healthy and sound parents, that it is impossible to guarantee, regardless of the genetic health of the parents, that ANY living thing will be free of genetic defects.

* Seller is not responsible if this puppy contracts a communicable disease after leaving Seller's premises. Parasites and Mange (internal or external) are not covered by this guarantee.

Hip Guarantee; This hip guarantee applies only to those puppies/dogs breed by Genia Graves – Graves Labrador Retrievers (unless otherwise specified in writing at the time of purchase) and only to the original purchaser.

**The seller’s health, hip and genetic guarantee does not apply to any injury, illness, disease or fatality develops as a direct result of the dog being overweight or malnourished, including but not limited to; C-sections, inertia, loss of dam in whelp, mastitis, eclampsia, any sexually transmitted disease, etc… Breading a dog is a risk and should be carefully considered. If breeding is undergone, then the purchaser does so at his/her own risk and does not hold the seller responsible for any expense, disease, injury or fatality of the dog.

** The Seller’s health, hip and genetic guarantee does not apply to any injury, illness, disease or fatality develops as a direct result of the dog being over overweight or malnourished, including but not limited to hip dysphasia (see hip guarantee), heart disease, joint problems, etc…

Sellers do herby guarantee this puppy/dog to have acceptable hip joint conformation as determined by the OFA. If this puppy’s/dog’s hips are rejected for OFA certification between two (2) and two and a half (2 ½) years of age, seller will replace this puppy/dog with another puppy of comparable value from our next available litter. (OFA results that are considered rejections are: Mild, Moderate or Server CHD.) Replacement puppy will be of the same breed, sex and color as the original puppy/dog unless otherwise agreed to by both parties. Replacement puppy will be provided between six (6) and sixteen (16) weeks of age. Seller is bound by this agreement if and only if the following conditions are met: 1. Seller must be notified of OFA rejection within thirty (30) days of its postmark. 2. OfA rejection and a written statement from a licensed veterinarian who took the x-rays must accompany the request. 3. Original puppy/dog must be spayed or neutered by the purchaser, and a written statement from a licensed veterinarian indicating that this has been done must be provided to the seller. 4. Original puppy/dog must not ever have been hit by a vehicle or suffered any other physical trauma capable of causing lameness of any type, for any duration. Any such trauma will render this guarantee null and void. Any condition of obesity or malnourishment for any duration will render this guarantee null and void. Females that have been bred before the x- rays for hip evaluation were taken renders the hip guarantee void. 5. Any returned animal must be accompanied by any and all paperwork supplied by the seller at the time of the sale, as well as a written statement from a licensed veterinarian indication the following: a. All shots are and have been kept current. b. Puppy/dog appears to be healthy and well cared for. c. Purchaser must not be in violation of the “Basic Maintenance Agreement” signed at time of purchase of original puppy/dog and must sign a new Basic Maintenance Agreement on any replacement puppy provided. In case of a question, it will be the responsibility of the purchaser to provide documentation showing shot records and other applicable veterinarian attention and receipts.  Any replacement puppy will not have both the same parents as the original. **The seller’s health, hip and genetic guarantee does not apply to any injury, disease or fatality incurred as a direct result of breeding, including but not limited to C-sections, inertia, loss of dam in whelp mastitis, eclampsia, any sexually transmitted disease, etc… Breeding a dog is a risk and should be carefully considered. EIC Guarantee; This EIC guarantee applies only to those puppies/dogs breed by Genia Graves – Graves Labrador Retrievers (unless otherwise specified in writing at the time of purchase) and only to the original purchaser.

*** This EIC guarantees that your (dog/puppy) is not EIC Affected (Affected: A dog that has two copies of the mutated EIC gene.)

*** How to have your dog tested The Veterinary Diagnostic Laboratory can test a blood, semen, dew claw, or cheek swab sample from your dog. They will be able to provide you with a result for your dog. www.vdl.umn.edu/vdl/ourservices/canineneuromuscular.

CNM Guarantee; This EIC guarantee applies only to those puppies/dogs breed by Genia Graves – Graves Labrador Retrievers (unless otherwise specified in writing at the time of purchase) and only to the original purchaser.

****This CNM guarantees that your (dog/puppy) is not CNM Affected (CNM Affected: A dog that has two copies of the mutated CNM gene.)

**** How to have your dog tested The CNM DNA test, available at www.labradorcnm.com, It is inexpensive and involves a non-painful collection of cells from the inside of the canine’s cheek. The owner can easily do the test themselves, or can choose to go to a veterinarian. The CNM Project provides kits and e-forms with very specific easy directions.

The buyer is aware that hypoglycemia and coccidiosis is stress related and is not covered by this contract.

The buyer is fully aware that all care, training, registration and medical cost of below described animal are their full responsibility.

Buyer agrees that this puppy will NEVER be sold or given to a pet shop, commercial dog dealer/broker, puppy mill, or their agent(s). It will also NEVER be surrendered to an animal shelter or rescue organization.

If, at any point in this puppy’s life, Buyer is unable or unwilling to keep it AND is unable or unwilling to find it an appropriate home, Buyer agrees to return it, with its registration papers, to Seller. This will be on a surrender basis only and no compensation will be given.

This guarantee applies to this puppy as purchased by this buyer ONLY and is not transferable.

Buyer has read, understands and agrees to the terms and conditions contained herein. It is further understood and agreed that no warranties or representation of any nature or sort have been made with respect to this puppy, except those contained in this Agreement. Buyer acknowledges receipt of a signed copy of this document.
