SWANCREEK TOWNSHIP BOARD OF TRUSTEES Regular Meeting Minutes Monday, November 2, 2015

Call to Order 7:00 p.m. Prayer Pledge Board members present: Ron Holdeman, Chairman, Rick Kazmierczak, Vice Chairman, Pamela Moore, Trustee. Employees: Chris Lauch, Administrative Assistant Excused - Matt Stout, Maintenance Supervisor Fiscal Officer: Dawn Wheatley, absent Guest: Chief Floyd, Providence Township Fire 175-15 Trustee Moore motioned to approve the 10-19-15 Regular Meeting Minutes, 2nd by Trustee Kazmierczak. Roll Call: Trustee Holdeman-Abstain, Trustee Kazmierczak-Yea, Trustee Moore-Yea 176-15 Trustee Moore motioned to approve the expenditures in the amount of $28,417.16, 2nd by Trustee Kazmierczak. Roll Call: Trustee Holdeman-Abstain, Trustee Kazmierczak-Yea, Trustee Moore-Yea Guest: Chief Floyd, Providence Township Looking into contracting with Springfield Township for dispatching. There is a cost associated with this contract. Discussed cost breakdown. He asked the Trustees if they would like to pick up the cost or have it included in the Township’s contract with Providence. He does not expect any changes in the contract, except this cost. The Trustees will review. Discussed coverage area and call laps, due to cell phones directed to cell towers. Calls go to Lucas County and then redirected to Fulton County entities when the calls are close to the county lines. Discussed coverage and territory of Co. Rd. D and Swanton Fire Department. The Trustees will keep him posted of any boundary change. Public Forum None Employee Reports * Chris Lauch, Administrative Assistant Report: Discussed intermittent noise complaints. Trustees instructed her to email Sheriff Roy Miller to inquire about referring calls to the Township and invite someone from his of- fice to the next meeting. * Matt Stout, Maintenance Supervisor Report: Excused Trustee Moore said he checked on costs for tile for Co. Rd. EF. He received a quote for $5500.00 Trustee Holdeman will get back to Matt about purchasing it and getting the tile put in. Administrative/Fiscal Officer * Trustees reviewed reports. * Trustee Kazmierczak reviewed the year to date fund account summary. Old Business * Trustee Moore discussed the Ohio Public Works update: Co. Rd. EF is done and Co. Rd FG is done. There is a concern of a drop off on the north side of Co. Rd. EF. Matt Stout will put dirt there. Trustee Holdeman explained the processes of burming, which should help. Trustee Kazmierczak discussed the road only having a course coat on it and voids where water will sit and freeze. Discussed doing a top coat and sealing. The County Engineer’s office suggests waiting two to three years. Discussed cost of doing a topcoat at the time of the project. The Trustees will talk about it further. * Maintenance Building: Have not heard anything from Brad Hammond, Walters Building yet. Discussed building a lean-to on the salt building temporarily. The salt building is not in good shape. Trustee Kazmierczak talked to Mike Rudey, Chief Building Official, who said that the Township will need cer- tified architect designs, planning approval and inspection during construction. Need permits. * Land owner/Pipeline meeting (Update): Emens and Wolpers, LLC are holding a public meeting on Novem- ber 11, 2015 at 6:30 p.m. at the Swanton American Legion. Trustee Kazmierczak will get their agenda so that the Township can let people know. * Newsletter: Take off agenda * Road FG: Cannot get the roller kit cost. Take off the agenda. * Naming Chief Myers as permanent Fire Marshal: Move to Fire/Rescue on agenda. York Township Fiscal Officer will let Chris know when Brett Hite has officially resigned. * Annexation discussion: Take off agenda. Trustee Kazmierczak voiced concern about campaign material. Swanton and Swancreek Township have no annexation contract, nor any discussion whatsoever. The annexation discussion was only regarding what Brad Pebbles, Village of Delta, brought to the Trustees re- garding Nature Fresh. Brad Peebles is in discussions with York Township and will be coming to Swancreek Township Trustees thereafter. Discussed the process of annexation. There are land owners that have requested to be annexed into the Village of Swanton on Airport Highway. • Update on small excavator: Trustee Kazmierczak talked to Brad Short who extended a previous sale price until November 21, 2015. Their lead times on orders are behind, so even if it was ordered it would not be delivered until possibly after April or May. Matt Stout is getting a quote from the Terrex dealer, also. Trustee Holdeman voiced his concern about funds and storage for purchasing another new piece of equip- ment. He feels the back hoe has always done the work that needs done. • Training Chris as Assistant Fiscal Officer/Server Information: Dawn is on vacation. Keep on agenda • Office open on on-widely observed holidays: Trustee Kazmierczak is taking a look at the calculations of Chris’s last wage increase, due to sick and holiday pay being taken away. Dawn gave him Chris’s last three years annual pay. • Handbook Amendments & Interview Criteria/Evaluation/Application Forms: Hold off until next meet- ing until the forms are updated according to the legal opinion that was received; the township cannot require a person to be a registered voter or a resident of the township for employment. The Trustees have always tried to hire within the township, however, cannot require it. An applicant for the Board of Zoning Appeals or Zoning Commission has to be a resident of the township to serve, per Ohio Revised Code. Chris will give the Trustees a final draft of the Application, as well as the Interview Criteria and Evaluation forms for them to adopt at their next meeting. New Business • Steve Fuzinski’s resignation from the Water District and Board of Zoning Appeals: Discussed time limit of appointment to open seats. Dale Brunner voiced his concern about appoint a new board member during the new project. The Trustees will hold off on appointment at this time for the Water District. Dale Brunner will look into Water District Bylaws, and talk to the Water Board and Tina Whalen. Chris is to email Sue Whitaker to ask her if she would like to take Mr. Fuzinski’s seat on the Board of Zon- ing Appeals. If she is not interested, when the new application is approved, an ad will be placed in the newspaper. • Swanton Township’s letter regarding Co. Rd. 1: Discussed Chris is to type a letter of response stating that the Trustees have received their letter and any further communication is to go to Scott Hasel- man, Fulton County Prosecutor and carbon copy him. Zoning • Employee report: Trustees received report. * Discussed signs in the right of ways. Chris is to continue to send letters at election time to all candidates and place a few ads to let residents know the township’s policy of signs not to be place in road right of ways. If signs are obstructing view, they are to be moved back. Fire/Rescue • Providence Township Fire/EMS contract: The contract renews net month. The Trustees will have Howard Myers, Swanton Fire Chief and Fulton County Sheriff Roy Miller at their next meeting to discuss Co. Rd. D boundary change/dispatch lag issue. Also, possibility, talk to Lucas County Sheriff, if needed. Cemetery * Deed signed: Dorothy Goldsmith, Shiloh Cemetery; Section B, Lot 42, Grave #1 * Fence (Cost/Cooperative Purchasing Update): No update. Dawn sent the Trustees the state cooperative purchasing information. Leave on agenda * Columbarium/pavers: Keep on agenda. Trustee Reports * Trustee Moore: None * Trustee Holdeman: Has upcoming Fulton County Regional Planning meeting, will find out about the grant money. * Trustee Kazmierczak: Discussed concerns about election material issues. Suggested the township host a debate with a fact checker for upcoming elections if there is not a ‘meet the candidate’ being held. He ex- plained the Supreme Court ruling that a candidate can put anything in campaign material. New resident voiced her concern regarding the same issue. Spoke with Jerry Kmotorka about pipelines inquiry.
