TERMS AND CONDITIONS

REGISTRATION: To bid in person, you will need to register in person at the sale. Please remember to bring your government issued photo ID (valid driver’s license). By registering for the sale, the Bidder acknowledges that he/she has read, understood and accepted the terms and conditions of the sale. Anyone bidding on behalf of a third party shall be a registered bidder at the auction and be personally responsible for their bidding.

INTERNET BIDDING: Pre-registration is required with a valid credit card and submission of a copy of the FFL Dealer’s License to where the firearm will be shipped to (See Exceptions Below). Higgenbotham is not responsible for interruptions or loss of internet service during the auction. Higgenbotham reserves the right to (a) utilize reasonable means to determine that a person is eligible to bid and will follow the rules of the auction and (b) deny bidding privileges to any person, to refuse acceptance of any bid presented, or to revoke any bid received at the auction, whether said bid is received live or online, all at the sole discretion of Higgenbotham and without specifying a reason. Due to the structure and speed of live Internet auctions, the final bid shown may not be the actual final bid. Bids received live on the floor may take precedence of identical internet bids. Higgenbotham reserves the right to determine who the final bidder is at its sole discretion and without explanation. Also, Higgenbotham reserves all rights to correct any incorrect Internet bids.

BUYERS PREMIUM: If bidding live at the auction, a Buyer’s Premium of 13% will be added to the successful bid price to create the total purchase price. There is a 3% discount when paying with cash or check. If Internet bidding, a Buyer’s Premium of 18% will be added to the successful bid price to create the total purchase price.

SALES TAX: All items are subject to a 7% Florida sales tax. Dealers purchasing must register their Florida tax exemption form prior to the sale or prior to registration. In the event you do not have your tax exemption form present, you will have to pay sales tax at the auction. If you provide a valid copy of your exemption certificate within 7 days after the auction, the sales tax will be refunded to you. No sales tax will be charged for out of state purchases.

Firearm Terms: ALL firearm purchasers must pass a background check. Fee for background check for Florida residents is $5.00 per person. Background check fees may vary by state. All firearms are sold subject to applicable federal state and local laws. All firearms will need to be picked up from Higgenbotham Auctioneers location, 5900 Imperial Lakes Blvd, Mulberry FL on Thursday February 11th. Rifles and shotguns can be picked up on sale day. Bidders with a current Concealed Weapon or Firearm License can pick up handguns on sale day. Any firearms that are to be shipped MUST be shipped to a licensed firearms dealer in your area for pickup.

CATALOGUE DESCRIPTIONS: All item descriptions and dimensions are provided as a courtesy only. It is the Bidders responsibility to inspect all lots prior to bidding to ensure that they are satisfied with them. The Auctioneer and Seller make no warranties or guarantees, expressed or implied, as to the genuineness, authenticity, or quality of any item. Auctioneer and Seller are not responsible for advertised discrepancies or inaccuracies. Everything is sold “as is” and “where is”, except as expressly made in writing. No warranties, expressed or implied, are made as to the merchantability of any items or their fitness for any purpose, or otherwise. The Bidder acknowledges that he has had the opportunity to examine the goods purchased and has exercised this clause. ALL SALES ARE FINAL.

PAYMENT: Items purchased will not be released until, full payment has been received, verified and approved. Payment may be made in cash, check, Visa, MasterCard, AMEX, Discover. Items are sold for immediate removal.

REMOVAL OF PURCHASES: No items may be removed during the sale unless otherwise instructed by the Auction Company. All property shall be removed from the premises by the Bidder at her/his own risk and expense by the conclusion of each sale unless special arrangements have been made or unless it is being transported by a shipper approved by the Auction Company.

SHIPPING AND PACKING: The cost for packing, shipping and insurance shall be exclusively that of the purchaser. The shipping and handling fee is $25.00 for Handguns and $40.00 for Long guns to the lower 48. There may be a discount for shipping if you purchase multiple guns. Alaska and Hawaii buyers should call for shipping rates. All shipping charges are billed to your credit card. NO overseas shipping. Bidder agrees to indemnify and hold harmless the Auction Company and Seller of any and all damages resulting from the removal of the property from the auction. Upon acceptance of the bid by the Auctioneer, the risk of loss of the property shifts to the Bidder.

AMMO PURCHASES: Must be 18 years or older to purchase rifle and shotgun ammo. Must be 21 years or older to purchase handgun ammo. In order to verify the age of bidders that we are to ship ammo to, we will require a scanned copy of a state issued ID card. Please email clear copy to [email protected]. Special Exceptions: California: Only Antique Firearms (older than 1898). No sales of any other firearms. Connecticut: Curio & Relic (C&R) handguns must go to a full Class 01 FFL dealer. No sales of semi-auto rifles except for the SKS. Illinois: No firearms sales to the cities of Chicago, Cicero, Morton Grove, Oak Grove or Cooke County. Curio & Relic (C&R) sales to C&R licensees require a copy of the FOID card. Handguns shipped only to full Class 01 FFL dealers and a copy of the State Handgun Sellers license is required. Maryland: C&R handgun sales to full Class 01 FFL dealers only. Only used handguns made prior to 1/1/85 sold. No sales of semi auto rifles with detachable magazines. Massachusetts: No sales of rifles that take detachable magazines. Only handguns on the MA approved list sold. Curio and Relic firearms to Curio and Relic license holders only with a copy of your Massachusetts FID Class A or B license. New Jersey: For a C&R license holder to purchase a C&R rifle, a signed written certificate on a form prescribed by the Superintendent of State Police, which identifies the purchaser, their address and FID or dealer number, and states that they are not disqualified from purchase. No C&R handguns to C&R license holders. No magazine sales over 15 rd. capacity. No sales of firearms which accept hi-capacity magazines New York: Handguns must be on the New York State approved list. All handguns must go to a full Class 01 dealer and a State Handgun Dealers License is required. No sales to NY City or surrounding boroughs. Washington DC: No sales of any firearms.
