Minutes of a meeting of the PLANNING & ENVIRONMENT COMMITTEE held at St. Peter’s Church Hall, Greatstone on Monday 18th May, 2009 at 7pm

Present: The Town Mayor, Cllr. D. G. Kersey, the Deputy Town Mayor Cllr. Ms. R. G. Saunders and Councillors: Revd. A. J. Davis (Chairman), Mrs. P. A. Davis, D. G. Kersey, Cllr. G. D. McKay & D. F. Watts.

Absence: Apologies for absence was received from: Cllrs. Mrs. M. R. Masters due to Illness and M. R. Reynolds due to a prior engagement.

235 APPOINTMENT OF CHAIRMAN FOR THE CURRENT COUNCIL YEAR The Town Mayor, Cllr. D. G. Kersey and the Deputy Town Mayor Cllr. Ms. R. G. Saunders waived their right to Chair this and subsequent Committee meetings save in the circumstances of absence by the appointed Chairman. Cllr. Revd. Davis was proposed by: Cllr. Kersey and seconded by: Cllr. Ms. Saunders and agreed.

236 DECLARATIONS OF INTEREST Cllr. Kersey: RSPB. Cllr. Revd. Davis: Y09/0305/SH. Cllr. McKay: Y09/0358/SH. Cllr. Ms. Saunders: RSPB, Neighbourhood watch, SSG and Y09/0358/SH (prejudicial interest).

238 CORRESPONDENCE KCC: Denge Pit, notice of Planning application meeting 26/05/09. KCC: Electronic communication of Public Path orders and Rights of way modifications. EDF Energy: New Nuclear new build newsletter EDF Energy: Notice of possible sale of nuclear new build site. Shepway D.C.: Public consultation – core strategy – Guildhall 16/06/09. DHA Planning: Offer of training for Councillors in planning matters. The correspondence was received and noted. Proposed by: Cllr. Ms. Saunders and seconded by Cllr. McKay and agreed.

239 MINUTES Minutes of the meeting on 20th April, 2009 were agreed and signed as a true record Proposed by: Cllr. Kersey and seconded by Cllr. Watts and agreed.

240 TOWN CLERK’S REPORT Town Clerks report (set out in Appendix A) was received and a letter of thanks to be sent Mr. I. Prebble was requested in respect of new information on Denge Marsh Road and Galloways Road. Proposed by: Cllr. Kersey and seconded by Cllr. Watts and agreed.

241 Y09/0305/SH – LAND ADJACENT TO 46, STATION ROAD, LYDD Erection of one detached dwelling and one pair of semi detached dwellings (Resubmission of Y08/0972/SH). Submitted by: Mr. D. May. RESOLVED: Supported: 6 for, 0 against. Proposed by: Cllr. Ms. Saunders and seconded by Cllr. Watts.

242 Y09/0312/SH – 9, HIGH STREET, LYDD Listed building consent for removal and replacement flooring, ceilings, beams, partitions, staircase and removal of original conservatory at rear. Submitted by: Mr. D. Buggins The contents of the letter sent to the planning case officer on 13/05/09 were upheld as the evidence to support a retrospective planning application had been removed. Proposed by: Cllr. Kersey and seconded by: Cllr. Watts. RESOLVED: Objection 6, 0 against.

243 SH/09/TEMP/0011 Land at former goods yard, Station Road, Lydd. Continued temporary use, weekend only, of the site to provide an area for the stationing of one refuse freighter and one open back collection vehicle for the purpose of receiving bulky household waste. The positioning of recycling containers outside the operational site boundary for collection and service to be provided by Shepway District Council. Submitted by: Kent County Council. Proposed by: Cllr. Ms. Saunders and seconded by Cllr. Kersey. RESOLVED: Supported 6 for, 0against.

244 Y09/0333/SH – 137, COAST DRIVE, LYDD-ON-SEA Erection of rear conservatory. Submitted by: Mr. Skilton. Proposed by: Cllr. Revd. Davis and seconded by Cllr. Mrs. Davis. RESOLVED: Support: 5 for,1 Abstained (Cllr. Ms. Saunders who could note vote or speak, but wished to record her abstention afterwards)

245 Y09/0358/SH – 29, BALDWIN ROAD, GREATSTONE. Erection of two storey dwelling with associated front forecourt parking. Submitted by: Mr. P. Carter-Leay. Proposed by: Cllr. Ms.Saunders and seconded by Cllr. Mrs. Davis. RESOLVE D: Object: 5, 0 for, Abstention 1. Not in keeping with existing street scene.

Information: This is a brief resume of progress on matters considered by the Planning and Environment Committee at its meeting held on the 20th April, 2009.

 Appeal on B.O.A.T.s designation Denge Marsh Road and Galloways Road Further documents have been submitted to NATROW in respect of the appeal against the decision of the KCC Rights of Way Department. A further set of documents is about to be sent to NATROW, which may well prove to be decisive in meeting the test of ‘on the balance of probabilities’ necessary to win the appeal. I would like to thank Mr. Ian Prebble who has provided numerous valuable documents and assistance during the making of this appeal.

 Banks Sports and Social Club The exemption application was successful for infilling the Cricket pitch outfield and the work will be carried out by G.H Bromley Ltd, in due course. KCC has also made an application for funding to upgrade the Derings Lane bridle way, to make this path part of a network facilitating a route to Camber in E. Sussex, forming a new part of the ‘Ride Kent and Cycle Kent’ initiatives.

Recommendation:  Accept the report.
