Town Council Minutes Public Hearing & Regular Town Council Meeting November 7, 2014

Council Members (C/M) present: V/M S. Moss, C/M B. Moss, C/M Davis, C/M Wallace, C/M Jones, and C/M K. Moss C/M absent: Mayor Paige Others present: Clerk, Peggy Johnson; Veronica Adams – pipeline; Todd Fortune, CRC; Karen & Ronnie Owen

The meeting was held at the Dillwyn Town Hall located at 1030 Main Street, Dillwyn, VA, on November 7, 2014, at 7:00 p.m.

Invocation by C/M B. Moss and the Pledge of Allegiance led by V/M S. Moss.

The V/M S. Moss opened the meeting and declared there was a quorum in attendance.

V/M S. Moss asked the council if there were any changes or corrections for the September 9, 2014 and the October 14, 2014 minutes. Motion was made by C/M K. Moss and seconded by C/M Davis to accept the minutes as submitted. Motion passed unanimously. Ayes: C/M B. Moss, C/M K. Moss, C/M Davis, C/M Wallace, and C/M Jones. Nays: none.

The V/M recognized the guest, Veronica Adams. Ms. Adams spoke on the pipeline: why not to have it in the county. There will be two (2) education events before Thanksgiving. Dominion VA Power to present in January to the Buckingham County Board of Supervisors.

Public Hearing: V/M S. Moss opened the floor for the public hearing to re-zone 16977 Oak Street from R1 to B1 by request of owner (Martin) and future owners (Owen) for the use as a consignment store/once a month flea-market. As there were no comments, the public hearing was closed. Motion was made by C/M K. Moss and seconded by C/M Jones to approve the re-zoning. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none.

Transportation Enhancement: Phase 4: Todd Fortune explained about the lights and no parking signs. Pay request from Keith Barber Construction in the amount of $24,188.05 was approved unanimously by motion from C/M K/ Moss and seconded by C/M B. Moss. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none Phase 4x/5: Todd Fortune explained the re-design of phase 4x at the corner of Main Street and Rosney Rd (Bank of America corner), will be doing only the crosswalk and some sidewalk down Rosney Rd towards the exit from the bank. With the new application for funding, a new resolution was approved for submission and signature and the payment of $1300.00 to CRC for grant writing services by motion from C/M K. Moss and seconded by C/M Wallace. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none

Housing: Todd Fortune reviewed the Program Management Plan and the RFP for the rehab specialist. It was advised to delay the construction application until 2016 due to all of the Page 1, November 7, 2014 paperwork needed to be completed for this application. RFP ad to run either in November or in December once approved by DHCD. Motion was made by C/M B. Moss and seconded by C/M K. Moss to do construction application in 2016. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none.

Revitalization Project: . Phase 2: pay requests from Bayard Construction for Fisher and ABC store; Triple L for Ford (996), and Keith Barber Construction (pocket park) was approved by motion by C/M K. Moss and seconded by C/M Jones. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none. . Pocket Park: Motion was made by C/M K. Moss and seconded by C/M Davis for a change order from Keith Barber Construction for the water connection ($500.00) and the closing of the second entrance to the park ($450.00). Motion was approved unanimously. Celebration for the opening of the Pocket Park will be December 20, 9:00 a.m. prior to the Christmas parade. . Friday Night events: on hold . The next meeting is scheduled for Tuesday, Dec. 9, 6:00 p.m.

Street Maintenance Committee: - Street lights: no report - Yards, etc.: no report - Town clean up: V/M S. Moss stated that the next section to be addressed will be at Dunkum Funeral and also Main Street towards Gilliam Motors.

Tourism Committee: Dec. 14, 4 – 8 p.m., Christmas house tour, $15.00 each

Christmas parade: Dec. 20, 10 a.m.

UNFINISHED BUSINESS:

Charter changes: still waiting on town attorney

Disposal, storage building (town hall) and street sweeper building: Jamerson Construction to start next week.

Accident (ABC): Clerk to call Pearson to replace sidewalk. Insurance company has paid for this.

NEW BUSINESS: Virginia Tourism: Mayor Paige has agreed to be the representative.

No Parking ordinance: Motion was made by C/M K. Moss and seconded by C/M Davis to approve the ordinance for no parking on the north side of US 15 from Conner Street to Rosney Road. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none.

Storage request for storing materials for the new sewer project upgrades for the contractor. Written agreement will be made to ensure property is left as found. Motion was made by C/M K. Moss and seconded by C/M Davis & Jones. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none.

Page 2, November 7, 2014 Donation to Habitat of $200.00 for food on the construction day was made per approval of survey of council members.

Comprehensive Plan needs to be reviewed. Needs to be done every five years. The Clerk advised that there are some areas of the plan that need to be updated: Transportation, ordinances.

Tax writeoffs: Total for 2008 is $175.42 (Personal Property) and 1994 is $2.10 (Real Estate). Motion was made by C/M B. Moss and seconded by C/M K. Moss. Motion was unanimously approved. Ayes: C/M K. Moss, C/M B. Moss, C/M Jones, C/M Davis, and C/M Wallace. Nays: none.

Bank of America refund of Franchise Tax: payment has been made.

OTHER ITEMS: . Computers: need to replace extra computer and new windows operating system for main computer and laptop

MEETINGS/WORKSHOPS/CONFERENCES: - Nov. 13, Richmond, VA Fair Housing workshop, Free. This was cancelled due to trainer personal issue.
