1 [3915] 1 1 THE BRANCH OF SERVICE FROM WHICH THE MEMBER IS 2 RETIRED. 3 4 Be it enacted by the General Assembly of the State of South 5 Carolina: 6 7 SECTION 1. Section 56-3-1750 of the 1976 Code, as last 8 amended by Act 459 of 1996, is further amended to read: 9 10 “Section 56-3-1750. The department may issue a special motor 11 vehicle license plate to active members of the United States Air 12 Force Reserve, United States Army Reserve, United States Coast 13 Guard Reserve, United States Marine Corps Reserve, or United 14 States Navy Reserve who are residents of the State for a private 15 passenger motor vehicle registered in their respective names. The 16 biennial fee for the special license plate is the regular motor 17 vehicle registration fee plus the personalized license plate fee 18 provided by Section 56-3-2020. Only one One plate may be issued 19 to a person. an active reservist for each private passenger motor 20 vehicle registered in his name in this State, provided the total 21 number of reservist plates issued to one person shall not exceed 22 three.” 23 24 SECTION 2. Section 56-3-1760 of the 1976 Code, as added by 25 Act 164 of 1993, is amended to read: 26 27 “Section 56-3-1760. The special license plate must be of the 28 same size and general design as regular motor vehicle license 29 plates. The department shall imprint the special license plates with 30 the words “United States Military Reserve” or an abbreviation 31 selected by the department, with numbers the department may 32 determine. The plate shall bear the insignia of the branch of 33 service of which the reservist is a member. Below the branch 34 insignia the department shall imprint the name of the reservist’s 35 branch of service, to wit: ‘U.S. Army Reserve’, ‘U.S. Air Force 36 Reserve’, ‘U.S. Navy Reserve’, ‘U.S. Marine Corps Reserve’, or 37 ‘U.S. Coast Guard Reserve’. The license plate must be for a 38 biennial period which expires twenty-four months from the month 39 it is issued.” 40 41 SECTION 3. Section 56-3-1815 of the 1976 Code, as last 42 amended by Act 63 of 1999, is further amended to read: 43

1 [3915] 2 1 “Section 56-3-1815. The department may must issue a special 2 motor vehicle license plate to a retired member of the South 3 Carolina National Guard and may must issue a special motor 4 vehicle license plate to a member of the South Carolina State 5 Guard who is a resident of the State for a private passenger motor 6 vehicle owned or leased by a member or a retiree only after the 7 current stock of South Carolina Guard, National Guard, and South 8 Carolina National Guard Retired license plates is exhausted upon 9 request.” 10 11 SECTION 4. Section 56-3-1820 of the 1976 Code, as last 12 amended by Act 63 of 1999, is further amended to read: 13 14 “Section 56-3-1820. The special license plates must be of the 15 same size and general design of regular motor vehicle license 16 plates upon which must be imprinted the figure of the ‘Minute 17 Man”’ with numbers, or letters, or both, as determined by the 18 department. The license plate must provide a space on the top of 19 the plate to affix a decal indicating ‘National Guard”’, ‘Retired 20 National Guard”’, ‘Air National Guard”’, or ‘State Guard”’. This 21 license plate must be issued only after the current stock of South 22 Carolina State Guard, National Guard, and South Carolina 23 National Guard Retired license plates is exhausted. The biennial 24 fee for the special license plate is the regular motor vehicle 25 registration fee prescribed by Article 5 of this chapter. The plates 26 must be issued for biennial periods November first to October 27 thirty-first.” 28 29 SECTION 5. Section 56-3-4310 of the 1976 Code, as last 30 amended by Act 459 of 1996, is further amended to read: 31 32 “Section 56-3-4310. (A) The department shall issue a special 33 motor vehicle license plate for use on a private passenger motor 34 vehicle owned by any retired member of the United States Armed 35 Forces who is a resident of this State in accordance with the 36 provisions of this section. 37 (B) The annual fee for the special license plate is the regular 38 motor vehicle registration fee plus the personalized license plate 39 fee provided by Section 56-3-2020, and only one plate may be 40 issued to any person for each vehicle owned by that person, up to a 41 maximum of two vehicles. The revenue from the issuance of 42 plates under this article must be deposited in the manner provided 43 under Section 56-3-2020. The department shall issue the license

1 [3915] 3 1 plate or the revalidation sticker upon receipt of an application 2 made under oath and in the form required by the department. 3 (C) Any person is authorized to use the special license plates 4 provided by this section article if he provides evidence that he is a 5 retired member of one of the branches of the United States Armed 6 Forces designated in Section 56 - 3 - 4320.” 7 8 SECTION 6. Section 56-3-4320 of the 1976 code, as added by 9 Act 96 of 1991, is amended to read: 10 11 “Section 56-3-4320. The special license plate must be of the 12 same size and general design as regular motor vehicle license 13 plates. The department shall imprint the special license plates with 14 the words “U.S. Armed Forces, Retired”. The plate shall bear the 15 insignia of the branch of service from which the individual retired. 16 Below the branch insignia the department shall imprint the name 17 of the retired member’s branch of service followed by a comma 18 and the word ‘Retired’, to wit: ‘U.S. Army, Retired’, ‘U.S. Air 19 Force, Retired’, ‘U.S. Navy, Retired’, ‘U.S. Marine Corps, 20 Retired’, or ‘U.S. Coast Guard, Retired’.” 21 22 SECTION 7. This act takes effect upon approval by the 23 Governor. 24 ----XX----
