RESOLVED: (1) THAT planning permission be granted subject to the conditions as detailed in the report now submitted, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement, under Section 106 of the Town and Country Planning Act 1990, to secure the payment of a commuted sum for, and implementation of, improvements to existing open space, such open space to be in close proximity to the development site, to the value of £191,967.

(4) THAT authority be given to refuse the application if the applicant fails to complete the Section 106 agreement within a reasonable period, on the grounds that the proposals would be contrary to Policies H8 and R2 of the City of Salford Adopted Unitary Development Plan.
69. HIGHWAYS ACT 1980, SECTION 129A, SALFORD CITY COUNCIL (CUMBERLAND AVENUE/DURHAM CLOSE, SALFORD) GATING ORDER 2007
The Strategic Director of Customer and Support Services and the Strategic Director of Housing and Planning submitted a joint report containing details of objections received in relation to the proposed gating order, together with the Strategic Director of Housing and Planning’s comments thereon.
RESOLVED: (1) THAT the Salford City Council (Cumberland Avenue/Durham Close, Salford) Gating Order 2007, be introduced as originally proposed.
(2) THAT an evaluation of the gating order be undertaken in two years, to assess its impact on the area.
70. HIGHWAYS ACT 1980, SECTION 129A, SALFORD CITY COUNCIL (MATHER ROAD/ CHADWICK ROAD/BRIGHT ROAD, ECCLES) GATING ORDER 2007
The Strategic Director of Customer and Support Services and the Strategic Director of Housing and Planning submitted a joint report containing details of objections received in relation to the proposed gating order, together with the Strategic Director of Housing and Planning’s comments thereon.
RESOLVED: (1) THAT the Salford City Council (Mather Road/Chadwick Road/Bright Road, Eccles) Gating Order 2007, be introduced as originally proposed.
(2) THAT an evaluation of the gating order be undertaken in two years, to assess its impact on the area.
(3) THAT it be noted that Councillor Norbert Potter had declared a non- prejudicial interest, and left the room during consideration of the item, as he knew the local residents supporting the proposed order and the objector.
