FISHING RULES

I. GENERAL PROVISIONS
1. These Rules shall regulate catching of fish, river lampery, crayfish and other aquatic invertebrates (hereinafter referred to as fishing) in inland bodies of water, inland and territorial seas and in economic zones in so much as not otherwise provided for by the Economic Zone Act (RT 1993, 7, 105), and collection of agar in the sea and shall be binding to all persons engaged in fishing and collection of agar.
2. Fishing and collection of agar in national parks, nature protection reserves and in any other protected areas shall be performed pursuant to these Rules and in accordance with the current procedure in the concrete protected area.
3. These Rules shall not regulate fishing in fishing farms.
4. Terms and conditions of fishing and collection of aquatic plants for special and scientific purposes may differ from those provided for by these Rules. Such terms and conditions shall be determined by the issuer of permit and shall be noted in the permit.
II. LIST AND DESCRIPTION OF FISHING GEAR
5. Fishing gear permitted to be used by any person is a hand fishing pole (hand line) consisting of rod, fishing line of the length up to 1.5 of the rod length, single hook, and in fishing with which natural bait is used and which may be furnished with a weight and a float. (28.08.1998)
6. Fishing gear allowed for recreational fishing on the basis of the fishing card:
1) spinning reel - consisting of rod with collars, spool, fishing line and spoonbait or device, may be furnished with connecting cable, additional weight and the so-called luring pulling device; spoon - a lure made of wood, metal or some other material, imitating natural food of the fish; catching device - an aid to enable to use dead fish as bait;
11) hand fishing pole (hand line) consisting of fishing rod, fishing line and up to three hooks or flies attached by traces; may be furnished with rod collars, weight, float or nodder and spool or reel for winding the fishing line;

2) trolling line - a fishing gear drawn behind the boat, consisting of fishing line, spoon bait or catching device; may be furnished with connecting cable and an additional weight;
3) pulling device - a fishing gear consisting of fishing rod, spool or reel, fishing line and pulling device or fly; may be furnished with connecting cable; pulling device - spoon bait or catching device with up to three hooks, whereas the gap between the arms may not exceed 30 mm; fly - a single hook with a weight or a plastic lure attached to the shank; nodder - a shaft made of elastic material fixed to the top of the fishing rod to discover if the fish has taken the bait; reel - a device for winding the fishing line;

4) fly hook - a fishing gear consisting of fishing rod, spool, fishing line and hook. In catching fish, natural bait floating on the surface of water or artificial lure is used;
5) hook - a fishing gear consisting of fishing rod, fishing line, weight and up to three single hooks fixed to the line, with gap between the point and the shank not exceeding 15 mm;
6) bottom long line - consisting of the line of the length of up to 60 meters, weight and up to three hooks. The weight and baited hooks are cast into the water manually or by means of a fishing rod;
7) krunda - consisting of a fishing rod of the length of up to 2 meters, fishing line of up to 40 meters, weight, trace, hook and float. The latter serves to give a signal - it is hanging between the top of the fishing rod and the surface of the water;
8) unanchored trimmer - a fishing gear consisting of fishing line, one treble hook and float to which fishing line is wound; it may be furnished with connecting cable and additional weight. The fishing gear is not attached to the bottom, shore, boat or elsewhere;
9) underwater fishing gear:
- harpoon gun - a mechanical or pneumatic device to harpoon fish;
- harpoon - a piercing device, whether barbed or not, with up to three prongs, fired from the harpoon gun or thrust into the fish. The harpoon without the harpoon gun may be used for fishing flounder and turbot.

7. Fishing gear allowed for professional fishing:

1) hooks and lines - fishing gear the catching principle of which is to attract the fish by the bait fixed to the hook, and grasping the bait the fish gets hooked; long line - fishing gear consisting of fishing line and hooks attached to it by means of traces; bottom long line - a long line placed to the bottom of a water body; drifting long line - a floating unanchored long line drifting by force of the stream or wind; anchored long line - long line the hooks of which are lifted higher from the bottom by means of floats or by a floating fishing line;
2) gill nets and entangling nets - fishing gear the catching principle of which is entrapping or entangling of the fish in the netting or to trap fish in net meshes; gill net or net - a rectangular wall of net meshwork hung to lines; in calculating catch effort, maximum number of nets and fishing right fee, the net of the length of 70 meters and of the height of up to 2.5 meters when folded up shall be considered the size of accounting net (except as provided for in subsections 40 and 41 of the Fishing Rules); trammel - a gill net to one or both sides of which a net with large mesh has been fixed;
(21.01.1999) fixed net - anchored gill net; drift net - floating unanchored gill net moving (drifting) by force of the stream or wind and it may be fixed to a fishing vessel;
(21.01.1999) frame net - a gill net with horizontal and vertical towlines driven through meshes; row of nets - two or more gill nets joined one behind the other; special net - a gill net with the mesh size of over 80 mm, anchored at one end and dragged at the other end;
3) traps - fishing gear the catching principle of which is to attract fish into the trap or its part where it is easy to enter but difficult to find a way out; trap - a fish trap with a leader, wings (which form an enclosure), with one or several funnels, with the belly or bellies closed on the top; fyke net - a trap with the square not higher than 3 meters; open-sea trap - a trap with the square higher than 3 meters; pound net or fixed net - a fish trap with leader, enclosure, funnel(s) and one or two pots open on the top;
(21.01.1999) non-leader fyke net - a fish trap with the belly made from mesh with a funnel or funnels, or wickers or some other material and wings or without them, lacking the leader; lamprey pot - a conic fish trap with a mouth diameter of up to 30 meters, without wings; eel-pot - a fish trap without wings (as a rule, placed in a long line) with the mouth height of up to 0.5 meters, whereas its two bellies furnished with funnel(s) are placed at either end of one leader; lamprey trap - a fish trap made from wickers, wire or some other material, with the mouth height of up to 0.5 meter, lacking the leader;

4) seine nets - fishing gear the catching principle of which is enclosing a part of the water body and getting the fish therein by dragging the net together;
Danish seine - a net consisting of draw ropes of equal length, wings and cod end, whereas the draw ropes serve to scare the fish off; towing net - fishing gear consisting of towropes, wings, belly and cod end, by means of which - when being pulled together - the whole water layer of the enclosed area is strained; beach seine - a dragnet by means of which the catch is dragged to the shore; cast net - a dragnet by means of which the catch is dragged to a floating means or to the ice; hoop net - a seine net consisting of a rigid frame and a cod end hung to it; drag net - a seine net consisting of a rigid articulate frame and mesh hung to it; lift net - a net horizontally placed in the water consisting of a frame and a net bag and which may be lifted up; it may be furnished with a boom and a hand winch;
5) trawls - fishing gear by which fish is caught to a net bag drawn behind a boat (boats); trawl net - a trawl fixed to a flexible frame and the horizontal openness of which is attained by trawl boards or some other structures or by drawing with two boats (two-boat trawl); bottom trawl - a trawl furnished with a ground rope (with weights attached to the separate end under the bottom line); pelagic trawl - a trawl lacking the ground rope; dredge net - a trawl fixed to a rigid frame for collection of agar.
8. Allowed crayfish catching gear:
1) crayfish lift net - a baited lift net with diameter of up to 50 meters for catching crayfish;
2) crayfish fyke net - a small trap with funnels lacking leader and wings.
9. Implements to lift the fish caught out of the water:
- landing net - a small lift net with diameter of up to 70 cm; it may be hung to a shaft;
- gaff or landing hook - a hook of the length of up to 1 meter which is hooked into the body of the fish.
III. CLOSE SEASONS AND FORBIDDEN AREAS OF FISHING
10. In all bodies of water it is forbidden to catch the following fish species:
- sturgeon;
- grayling;
- Aspius aspius; - sheatfish.
11. In inland and territorial seas it is forbidden to:
1) catch fish in the area closer than 1000 meters to the mouth of the rivers Kunda, Selja, Loobu, Valgejôe, Jägala, Pirita, Keila, Vasalemma, Punapea and of the streams Õngu and Pidula - all the year round;
2) catch fish in the area closer than 500 meters to the mouth of the rivers and streams listed in Annex 1 of these Rules - from 15 August to 31 December;

3) catch fish in the area closer than 200 meters to the mouth of the fluvial water bodies listed in Annex 2 of these Rules (except catching with a hand line) - from 1 March to 31 May;
4) catch fish in the area closer than 200 meters to the mouth of the fluvial water bodies listed in Annex 3 of these Rules - from 1 September to 30 November;
5) catch fish in the sea area located to the west from the right mole of the River Pärnu in the range of 500 meters from the mole;
6) catch fish in the Bay of Pärnu in the area limited by the mole of the river of Pärnu, the coastline and the line being the abstract extension of Side street and the line crossing the latter and passing the end of the mole - from the breaking of the ice coat until the formation of the ice coat (during the period free of ice) but not more shortly than from 1 May to 30 November;
7) catch fish in the Bay of Pärnu in the region of Madalmurru in the shoal of Uulu in the marked area - from 15 April to 15 July;
8) catch fish in the Bays of Kihelkonna, Kuusnômme and Atla in the area located between the coastline and the stretches passing the steep rocky coast of Elda, the lighthouse of Vilsandi and the harbour of Jaagarahu - from 1 October to 30 November;

9) catch fish in the Bay of Mullutu-Suurlahe - from 1 April to 20 May;
10) catch fish in the Bay of Hullo in the area north of the stretch passing 58°57'5" north latitude, 23°13'1" east longitude and 58°57'5" north latitude, 23°13'1" east longitude - from 25 October until the formation of ice coat (in the case of lacking the ice coat - until 31 December);
11) catch fish in the eastern part of the Bay of Sviby in the area located between the stretches connecting the cape of Upholm with the northern tip of Hobulaiu and further the southern lighthouse of Hobulaiu with the harbour of Sviby - from 25 October until the formation of ice coat (in the case of lacking the ice coat - until 31 December);
12) catch fish in the Bay of Tagalahe of Haapsalu in the area east of the line Uuemôisa - Tahuküla to the full extent - from the breaking of ice coat (in case the ice coat is lacking - from 15 March) to 15 May;
13) catch fish with professional fishing gear in the area between the islands of Suur-Pakri and Väike-Pakri, which is limited in the south by the stretch connecting the tip of the peninsula of Selgrund with the tip of the cape of Kappelskotten and in the north by the stretch drawn parallel to the norther coast of the cape Vatnesi of Väike-Pakri up to Suur-Pakri;

14) catch fish in the bay of Koolimäe in the area located closer than 500 meters to the Koolimäe stream mouth - from the breaking of ice coat (in case the ice coat is lacking - from 15 March) to 15 May;
15) catch fish in the bays of Jôeranna and Paope up to the connecting line between the cape of Paope and Ninaotsa - from 10 October to 20 November;

16) catch fish in the bay of Soonlepa in the area located between the coastline and the stretches connecting Talilaiu, the northern tip of the islet of Saarnaki and the fish receiving center of Salinômme - from 10 October to 20 November;

17) catch fish in the area between Tähvanina and Säärenina, which is limited from the sea by the stretches connecting Säärenina, Kadakalaiu and Tähvanina - from 10 October to 20 November;

18) catch fish in the bay of Kirikulahe - all the year round;
19) catch flounder and turbot: in subdevisions 28 and 29 determined by the ICES:
- from 15 February to 15 June;
- in subdevision 32:
- in the inland sea from 15 February to 15 June; in other places from 1 February to 30 June;

20) catch pike from the breaking of ice coat (in case the ice coat is lacking - from 1 March) to 30 April;
21) catch powan in the surroundings of the island Ruhnu up to 20 meters isobath from 25 October to 1 December.
12. In Lake Peipsi (Peipus), Lake Lämmi and Lake Pihkva (Pskov) it is forbidden to:
1) catch fish in the bay of Värska south to the stretch connecting the village of Berezje and the north tip of the island of Kolpino (except fishing with a hand line) - from 15 May to 15 June;
2) catch fish in Lake Peipsi in the area limited in the north by the stretch connecting the southern tip of the village of Ostrovtsy and the schoolhouse of the village of Pedaspää, in the south by the stretch connecting the capes of Uhtinina and Sigovits (except fishing with hand line, spinning reel and pulling device) - from 15 May to 1 August;
3) catch fish in Lake Peipsi in the area located to the west from the stretch connecting the mouth of the main canal of Varnya polder and the schoolhouse of Meerapalu - from 1 May to 15 June, except catching smelt with a trap the mesh of which is less than 12 mm, in the area between the schoolhouse of Pedaspää and the northern tip of the Pedaspää peninsula - from 1 May to 15 June;

4) catch lake whitefish (Coregonus albula) from the breaking of ice coat (in case the ice coat is lacking - from 1 May) to 20 June and from 1 November to 30 December;
5) catch Peipus powan from 20 October to 20 November;
6) catch pike from 1 April to 15 May;

7) catch bream (except fishing with a hand line) from 15 May to 15 June;
8) catch tench (except fishing with a hand line) from 20 June to 20 July;
9) catch pike-perch from 15 May to 15 June;
10) catch burbot from 15 January to 5 February;
13. In other bodies of water it is forbidden to: 1) catch fish all the year round in the rivers of Vainupea, Riguldi, Punapea, Tirtsi, Vanajôe, Lemmejôe, Rannametsa (incl. Timmkanal) and in the streams of Mägara, Kongla, Rihula, Karepa, Koolimäe, Kurdla, Kuusalu, Kaberla, Treppoja, Kolga, Männiku, Priivitsa, Loode, Poama, Õngu, Pidula and Jämaja, and in the main ditch of Kiruma - to the full extent, except lamprey fishing with a lamprey pot and non- leader fyke net and except fishing with a hand line in the rivers of Lemmejôe and Rannametsa and in the streams of Kolga, Männiku, Priivitsa, Loode from 15 April to 15 May;
2) catch fish all the year round in the rivers downstream of waterfalls, dams (dikes) in the following range:
- in the river of Pärnu - 500 meters from the dam of Sindi;
- in the river of Narva - from the dam of the hydroelectric power station to the first viaduct;
- in the river of Kunda - from the dam of the power station to the mouth, except lamprey fishing with a lamprey pot and a lamprey trap downstream of the Lontova bridge;

- in the river of Vasalemma - 500 meters from the dam of Vanaveski;
- in other rivers - 100 m;
In the river of Kunda, from the Lontova bridge to the river mouth, fishing to a limited extent with a spinning reel furnished with spoon bait or catching device, may be permitted by the Minister of Environment on the basis of the supplementary sheet of the fishing card;
3) catch fish all the year round in the rivers downstream of waterfalls, dams (dikes) and bridges in the following range, except lamprey fishing with a lamprey pot and a lamprey trap further than 100 meters from the dam or dyke:
- in the river of Pada - from the dam of Bökman to the mouth;
- in the river of Toolse - from the viaduct of the Roads Selja and Kunda to the river mouth;
- in the river of Selja - from the dam of Varangu to the river mouth;
- in the river of Mustoja - from the dam of Vihula to the river mouth;
- in the river of Altja - from the dam of Oandu to the river mouth;
- in the river of Vôsu - from the dam of Laviku to the river mouth; - in the river of Loobu - from the dam of Joaveski to the river mouth;
- in the river of Valgejôe - from the dam of Kotka to the river mouth;
- in the river of Pudisoo - from the viaduct of Tallinn - Narva Road to the river mouth;
- in the river of Loo - from the dam of Loo to the river mouth;
- in the river of Keila - from the stream to the mouth;
The Minister of Environment may permit fishing to a limited extent, on the basis of the supplementary sheet of the fishing card, with a spinning reel furnished with spoon bait or catching device in the areas named in subsection 3 of this section, except 100 meters downstream of the dam;
4) catch fish all the year round in the following rivers:
- the river of Piusa - from the influx at Kivioja to the Estonian- Russian border;
- the river of Vaidava - from the dam of Vastse-Roosa to the mouth;
- the river of Peetri - from the Estonian-Latvian border to the bridge of Tiitse;
5) catch fish all the year round on fish ladders and not nearer than 50 meters upstream from them;
6) catch fish all the year round in the river of Suur Emajôgi from its source up to the viaduct of Jôesuu Road;
7) catch fish all the year round in Lake Vôrtsjärv between the moles of the Suur Emajôgi and 200 meters in their neighbourhood and to the south from the stretch connecting the mouth of the stream of Pühaste (Küünra) and the north tip of Ainsaare up to the northern end line of the Pikasilla stadion;
8) catch fish in the river of Väike Emajôgi upstream of the mouth up to the Jôgeveste bridge (except fishing with a hand line) - from 1 April to 15 June;
9) catch fish in the old riverbeds of the Suur Emajôgi from the mouth of the river Pedja to the viaduct of Kärevere - from 1 April to 30 June;
10) catch fish in the river of Narva upstream of the Narva reservoir (except fishing with a hand line) - from the breaking of ice coat (in case the ice coat is lacking - from 15 March) until 15 May; the governor of Ida-Viru County may permit fishing in this period with a fixed net in Karoli basin up to the end of the village of Karoli; 11) catch fish in the part of the main ditch of Naelavere (the river of Lahe), which connects Lake Lahepera with Lake Peipsi, in the rivers of Koosa, Kargaja, Agali, Kalli and Kaevandu, in the canal connecting Lake Leegu and the river of Kalli, in Lakes Ähijärve, Vôngjärve, Lahepera, Koosa, Kalli, Keeri and Leegu - from 1 May to 25 May;
12) catch fish from 15 September to 31 December in the following rivers:
- Pärlijôgi - to the full extent;
- the river of Vôhandu - from the bridge of Kurvitse to Sômerpalu;
- the river of Peeli - from the influx of the stream of Kolga to the mouth;
13) catch river lamprey in the rivers from 1 March to 30 June;
14) catch salmon and sea trout:
- in the rivers of Narva, Kunda, Selja, Loobu, Valgejôe, Jägala, Pirita, Keila, Vasalemma and Pärnu - from 1 September to 30 November. The Minister of Environment may permit fishing with a spinning reel to a limited extent, on the basis of the supplementary sheet of the fishing card, during the named period in the rivers of Narva, Selja, Loobu, Valgejôe, Jägala, Pirita, and Pärnu, excepte in the areas named in subsection 2 of this section;

- in other rivers and streams - from 1 September to 31 October;
15) catch river trout from 15 September to 31 December;
16) catch sea powan in the river of Pärnu from 15 October to 15 November;
17) catch Peipus powan from 20 October to 20 November;
18) catch Coregonus albula from the breaking of ice coat (in case the ice coat is lacking - from 1 May) to 1 July and from 10 November to 30 December;
19) catch pike from 15 March to 10 May;
20) catch bream (except in Lake Vôrtsjärv and except fishing with a hand line) from 1 May to 20 June;
21) catch tench (except with a hand line) from 20 June to 20 July;
22) catch chub from 15 May to 15 June; 23) catch Vimba bream in the rivers of Kunda, Selja, Loobu, Valgejôe, Jägala, Pirita, Vääna, Keila, Vasalemma, Vihterpalu, Kasari (with tributaries), Paadremaa, Audru, Pärnu, Sauga and Reiu - from 10 May to 20 June. The Minister of Environment may permit fishing of Vimba bream with a hand line to a limited extent, on the basis of the supplementary sheet of the fishing card, in the above- named bodies of water and during the named period;
24) catch pike-perch:
- in the Väike Emajôgi from the viaduct of Pikasilla to the mouth and in Lake Vôrtsjärv - from 1 May to 15 June;
- in other inland bodies of water - from the breaking of ice coat (in case the ice coat is lacking - from 1 May) to 1 June;
25) catch crayfish from 25 September to 25 July;
14. The Minister of Environment may, in case the fish resources are endangered, on the proposal from fish protection and research institutions, change the beginning and terminating dates of temporary fishing restrictions set forth in subsection 20 of section 11, subsections from 4 to 10 of section 12, and subsections from 13 to 25 of section 13 of these Rules.
IV. MINIMUM STANDARD MEASURES OF FISH
AND BYCATCH CONDITIONS
15. The following minimum standard measures of fish shall be valid:

The restrictions named in this section do not apply to fishing of Baltic herring, sprat, smelt, cod, turbot, flounder and halibut with a hand line. l - the length of fish from the tip of nose (the mouth closed) to the beginning of the middle rays of caudal fin;
L - the length of fish from the tip of nose (the mouth closed) to the end of the caudal fin.
The fish is deemed as of standard size if at least one of the given measures (l or L) is equal to the minimum measure or exceeds it.
The length of crayfish is measured from the tip of rostrum to the end of telson (not including hairs).
In the first half-year of 1999 the minimum standard measure of pike- perch in Lakes Peipsi (Peipus), Pihkva (Pskov) and Lämmi shall be 38 cm.

16. The fish in the catch by legal fishing, catching of which is forbidden during that time, place or with that gear, undersized fish and the fish, catching of which is not allowed on the basis of the given permit, shall be considered as bycatch.
17. Bycatch is allowed as follows:
1) undersized fish:
- Baltic herring and sprat - for either species up to 15 per cent of the numerical catch of that species.
If the portion of sprat or Baltic herring in the total catch forms 10 per cent or less, this restriction shall apply only to the species the portion of which in the catch is 90 per cent or more;
- cod - up to 5 per cent of the weight of cod catch;
- Coregonus albula - up to 10 per cent of the numerical catch of Coregonus albula;
- eel in fishing with hooks and lines - up to 10 per cent of the numerical eel catch;
- flounder, halibut and turbut - up to 5 per cent of the total numerical catch of these species;
- powan, Vimba bream, bream, pike, ide, pike-perch, burbot, tench, perch - up to 5 per cent, by net fishing - up to 8 per cent of the numerical catch of these fish species;

2) standard fish catching of which at that time, place or with that gear is forbidden or not allowed by the fishing permit: - flounder, halibut and turbot in trawl fishing of cod - 10 per cent of the weight of cod catch;
- cod in trawl fishing of flounder - 5 per cent of the catch weight;
- cod in fishing of Baltic herring and sprat - 10 per cent from the catch weight;
- smelt in trawl fishing of Baltic herring and sprat - in unlimited quantity;
- Baltic herring in sprat fishing - 50 per cent of the catch weight;
- in fishing of flounder by fixed net, net and trap - 10 per cent of the catch weight;
- salmon and sea trout in the sea and powan, Vimba bream, bream, pike, ide, pike-perch, burbot, tench - up to 8 per cent in net fishing, up to 5 per cent in fishing by other gear - numerically from the total catch of these species.
18. Bycatch of salmon, sea trout and river trout in the rivers is forbidden.
19. If the fishing of a fish species is restricted in quantity, its bycatch shall be considered as cover of the quota of the given species.
20. In case the bycatch exceeds the rate allowed in section 17 of these Rules, fishing in the given place and/or with the given gear shall be stopped.
21. Fishing with traps and seine nets shall be deemed as stopped, when:
- in fishing with traps, fixed nets and other fish traps, the part collecting fish thereof is either open or the access thereto for fish is closed;
- in fishing in the sea with trawls or seine nets, before placing the gear into the water again, the fishing ground has been changed at least by 5 nautical miles.
22. If the quantity of undersized fish or fish catching of which is forbidden at that time and place, in the catch by trawl fishing exceeds the rates set out in section 17 of these Rules, the fisher shall not be considered as having breached these Rules, if he/she/it fulfills the following conditions:
- promptly makes a respective entry in the fishing diary and notifies the Marine Inspectorate by radio or (if it is lacking) upon arrival at the port or the shore; - stops fishing at the given place and (or) with the given gear and does not resume fishing before the Marine Inspectorate has given permission for that.
V. RESTRICTIONS AND REQUIREMENTS FOR FISHING GEAR
AND FISHING METHODS IN ALL BODIES OF WATER
23. In all bodies of water it is forbidden to:
1) catch fish by scaring fish into nets with splashing with a pole, by using electricity, poisonous or narcotic substances, piercing implements (except in recreational underwater fishing), hooking implements, fire guns, explosives, by using live fish as bait in ice fishing in inland bodies of water;
2) close with fishing gear more than 1/3 of the width of a fluvial water body and/or a strait. The deepest part of the cross section of the strait or fluvial water body shall be kept free. For catching the introduced migrating eel, the county governor may give the permission to hinder the movement of the fish, at the outlet of the water body, to the full width of the riverbed;

3) use fixed and drift nets, which are not duly designated and marked. The fixed net is unmovable in respect of the bottom, the drift net is drifting by force of wind and/or the stream;
4) placing of fixed gear (except lamprey pot, non-leader fyke-net, crayfish lift net and hooked lines) nearer than 50 meters to the fixed fishing gear already placed for fishing;
5) attach to fishing nets structures which can reduce the mesh size of the collecting part of the net below the standard prescribed by these Rules, except in cases set forth in section 32 of these Rules;
6) catch fish with a gill net the part of which hung to the headrope is longer than 70 meters. In determining the catch effort, a gill net shorter than 35 meters shall be considered as half a net, a gill net higher than 2 meters, irrespective of the length, shall be considered as two nets;
7) use during recreational fishing more than three fishing gears of the same or different types (except in catching crayfish);
8) use in underwater fishing autonomous breathing device and artificial lighting.
24. The frequency of contolling the fishing gear during fishing shall avoid spoiling of the catch in the gear.
25. In placing the fishing gear for fishing, the following requirements shall be complied with: - fixed gear and their long lines and the rows of artificial spawning places in the sea, in the river and reservoir of Narva, in Lakes Peipsi and Pihkva, in the Suur Emajôgi and Lake Vôrtsjärv shall be designated at the end towards the open waters by two flags fixed to one pole above each other, and by one flag at the other end. The dimensions of the flag shall be at least 30x30 cm and their height from the surface of the water shall be at least 1 meter. In other bodies of water the manner of designation shall be determined by the issuer of the permit or it shall be provided for in the lease agreement of the fishing region;
- the designation of the fixed gear shall indicate the direction of its position, for which purpose additional signs shall be used if necessary;
- the designation of fishing gear shall enable to establish the holder of the permit on the spot (on the body of water) or at the permit issuer's place.
26. The mesh size (inner) of fishing nets is measured by a 2 mm thick measuring gauge made from wearproof material, which has inclination of 1 meter per length of 8 meters on either edge and which is furnished with a measuring scale. The measuring gauge is pressed into the mesh of the wet netting. 20 meshes in one row are meshed lengthwise the net not nearer than 10 meshes or 50 meters to the side seam (to the towline, ropes) and the arithmetic average of the measuring results shall be considered as the mesh size.
In determining the mesh size of a gill net, the distance between 11 successive knot rows of the folded-up meshwork may be measured. The mesh size shall be determined by dividing the measuring result by 5.
27. The use of fishing gear not described in these Rules or principally new fishing gear or fishing methods may be allowed by the permission of the Minister of Environment.
VI. RESTRICTIONS AND REQUIREMENTS FOR FISHING GEAR
AND FISHING METHODS IN INLAND AND TERRITORIAL SEAS
AND IN ECONOMIC ZONE
Trawl fishing
28. All the year round it is forbidden to:

1) catch with a trawl below the 20 meter isobath, except the collection of agar with a dredge in the area fixed by the Minister of Environment;
2) catch with a trawl in the Strait of Irbe in the area limited in the west by the stretch between the lighthouse of Ovishi (57°34'10"N; 21°42'90"E) and the lighthouse of Loode (57°58'34"N; 21°58'03"E) and in the east by the stretch between the Cape of Kolka (57°45'60"N; 22°36'40"E) and the lighthouse of Kaavinina (57°58'95"N; 22°11'77"E);
3) catch fish in the Bay of Livonia (Bay of Riga) with a bottom trawl and use in trawl fishing vessels with engines of capacities over 300 h.p.
29. It is forbidden to use during specified periods:
1) the bottom trawl - in the Gulf of Finland west to the east longitude 26°00' - from 1 February to 30 June;
2) the pelagic trawl in the Bay of Livonia (Bay of Riga) - during 30 days from 1 April to 31 May. The beginning of the close season shall be fixed each year by the Minister of Environment;

30. In trawl fishing, the size of a mesh, in no part of the trawl net (except in the funnel if its fixing place is at least three times of the funnel length from the end of the trawl's fish bag) shall be less than:
1) in Baltic herring fishing in subdivisions 28 (except the Bay of Livonia) and 29 south to the north latitude of 59°30' - 28 mm;
2) in Baltic herring fishing in subdivision 29 north to the north latitude of 59°30' and in the Bay of Livonia and the Gulf of Riga - 16 mm;
3) in sprat fishing - 16 mm;
4) in cod fishing:
- the trawl net, the cod end of which is furnished with a special structure that will ensure at least 50 per cent selectiveness of the fish in the length group of L 38 cm - 105 mm;
- the trawl net with a usual cod end - 120 mm;
5) in flounder fishing:
- in subdivision 28, the trawl net - 110 mm;
- in subdivisions 32 and 29, south to the north latitude of 59°30', the trawl net with a usual cod end - 110 mm; - the trawl net with a special selective structure at the cod end - 105 mm.
31. In fishing with a trawl net it is allowed to:
1) hang under the lower part of the cod end sailcloth, meshwork, leather or other materials;
2) use in cod and flounder fishing, to cover the cod end of the bottom trawl, cod end outer body made from coarse thread (cord), which is made of the same fibre as the meshwork of cod end and whose length does not exceed 3/4 of the length of the cylindrical part of the cod end. The mesh size of the cod end outer body shall be twice the size of the mesh of the cod end of the trawl and it may be fixed to the cod end only along the front, side and rear edge;
3) in Baltic herring and sprat fishing, use a cod end outer body made from coarse mesh trawl, the mesh size of which is larger than that of the cod end of the trawl.
32. The trawl net at sea is not considered ready for fishing, if:
- the trawl boards are rigidly fixed to the board of the vessel or to the trawl gallow;
- warps are not connected with trawl boards and cables not connected with ground ropes;
- the roll of trawl net is covered and lashed;
Fishing with traps and pound-nets
33. It is forbidden to use in the sea:
1) fish traps and pound nets (fixed nets) with mesh size less than:
- in Baltic herring and smelt fishing - 24 mm;
- fyke net with leader - in cod end 24 mm;
- in stickleback fishing with a trap - 12 mm;
- in the Bay of Pärnu north to the straight between Liu and Pikknina, in an open water trap - in the cod end 24 mm and in other parts of the trap - 80 mm;
2) in the Bay of Pärnu north to the straight between Liu and Pikknina, open water traps with two and more cod ends.
34. In placing traps and pound-nets (fixed nets) for fishing, the following requirements shall be observed with respect to placement density: - distance between open water traps shall be at least 300 meters in side direction and 50 meters in other directions;
- distance between fyke nets shall be at least 100 meters in side direction and 50 meters in other directions; The conditions of trap line apply to the placement of leader fyke nets longer than 100 meters:
- for open water traps and fyke nets placed in a line, the total line length is confined to 400 meters, whereas the distance between the lines, or the distance between the line and the nearest single trap shall be at least 300 meters in side direction and 50 meters in other directions;
- the distance between pound nets (fixed nets) shall be at least 600 meters in side direction and 300 meters in other directions; the allowable length of the pound net leader may be up to 600 meters.
Net fishing (excluding trawl and fixed net fishing)
35. Fishing grounds where net fishing in a definite body of water is allowed shall be determined by the county governor.
36. In the sea it is forbidden to use nets (excluding trawl and fixed nets) with mesh size less than:
1) in Baltic herring and smelt fishing - 24 mm;
2) in catching other fish - 48 mm;
3) in cod fishing:
- Danish seine the cod net of which is furnished with a special structure ensuring at least 50 per cent of fish selectiveness in the length group of L 38 cm - 105 mm;
- Danish seine with a usual cod net - 120 mm;
4) in flounder fishing:
- Deinish seine in subdivision 28 - 110 mm;
- in subdivisions 32 and 29 south to 59°30' north latitude:
Danish seine with usual cod net - 110 mm;
Danish seine with a special selective structure in the cod net - 105 mm.
Net and hook fishing
37. It is forbidden to use: 1) in the Bay of Pärnu north to the straight between Liu and Pikknina:
- a gill net higher than 2 meters - all the year round;
- a gill net with mesh size below 96 mm (knot to knot 48 mm) and a hooked line - all the year round;

- a gill net - from 1 May to 30 June;
2) salmon drift and fixed hooked lines:
- in the Gulf of Finland from 1 July to 15 September;
- in other places, farther than 4 nautical miles from the border line of the territorial sea in the direction of the open sea - from 1 April to 15 November;
3) salmon drift and fixed net lines farther than 4 nautical miles from the border line of the territorial sea in the direction of the open sea:
- in subdivision 29 north to 59°30' north latitude - from 1 June to 15 September;
- in other places - from 15 June to 30 September;
4) gill nets with smaller mesh size than:
- in Baltic herring fishing - 28 mm;
- in sprat fishing - 20 mm;
- in smelt fishing - 24 mm;
- in salmon fishing: netting made from synthetic fibre - 157 mm; netting made of natural fibre - 165 mm;
- in cod fishing - 105 mm;
- in flounder fishing: in subdivision 28 - 110 mm*; in subdivisions 32 and 29 south to 59°30' north latitude - 110 mm*;
- in catching other fish - 76 mm. * flounder gill nets with mesh size of 90 mm are allowed to be used in the coastal zone up to the depth of 20 meters until 1 January 1997;
5) in salmon fishing a fish-hook with gap between the point and the hook shank below 19 mm;
6) gill nets with mesh size other than:
- in Baltic herring fishing - 28 - 40 mm;
- in sprat fishing - 20 - 40 mm;
- in smelt fishing - 24 - 40 mm;

38. The distance between fixed nets and their long lines shall be at least 100 meters. The maximum allowable length of the fixed net long line in the sea at the depth of less than 20 meters shall not exceed 700 meters.

39. The rows of nets and long lines for salmon and cod fishing shall be designated with spar buoys visible at the distance of 2 nautical miles and which are furnished with lamp, location reflector and flag.
40. In salmon and sea trout fishing it is allowed to:
- for one vessel to place for fishing up to 600 drift nets whereas the length of the upper headrope of one drift net may be up to 35 meters;
- for one vessel to place for fishing up to 2000 drift lines;
- on the vessel fishing salmon and sea trout, keep in reserve up to 100 drift nets and up to 200 fish-hooks besides the quantity allowed to be cast for fishing at a time.
41. It is allowed to catch cod and flounder in the sea deeper than 20 meters with a gill net of the length up to 35 meters.

41. At sea, nets and long lines shall not be considered ready for fishing if:
- the nets are covered and lashed;
- fishing lines and hooks are lashed in boxes. 43. The reserve fishing gear referred to in section 40 of these Rules, shall be kept separately from the fishing gear in operation.
VII. RESTRICTIONS AND REQUIREMENTS FOR FISHING GEAR
AND FISHING METHODS IN INLAND BODIES OF WATER
44. In Lakes Peipsi (Peipus), Lämmi and Pihkva (Pskov) it is forbidden to:
1) trawl fish - all the year round;
2) catch fish with Danish seine south to the straight connecting the villages of Praaga and Raskopel - all the year round;
3) catch fish with fixed nets in Lake Lämmi and in the surroundings of the islands of Piirissaare and Kolpino in the area of 300 metres to the full extent of the designated fairway - all the year round;
4) catch fish with Danish seine in Lake Peipsi - from 1 January to 1 April (except ice fishing) and from 1 May to 1 September;

- the length of the row of fixed nets shall not exceed 700 meters, the distance between the rows shall be no less than 100 meters.

PROCEDURE FOR ISSUING FISHING LICENCES
I. DOCUMENTS CERTIFYING THE PROFESSIONAL FISHING RIGHT
1. The lease agreement of a fishing area providing fishing conditions.
2. The fishing licence, which can have three forms pursuant to fishing conditions:
1) fishing licence (Annex 1) B of a fishing vessel entitles the undertaker who is registered pursuant to the procedure provided for in the Commercial Code and whose one of the areas of activity is fishing, to catch fish with an Estonian fishing vessel holding the Estonian flag certificate in the Baltic Sea from 20 meters isobath to the outer border of the economic zone, and in economic zones of other countries where fishing is carried out pursuant to international agreements;
2) fisherman's fishing licence (Annex 2) B entitles a natural person to catch fish with professional fishing gear listed in the Fishing Rules in the sea up to 20 meters isobath and in inland bodies of water open for public use. The form of fisherman's fishing licence may be used as the lessee's authorization for fishing in the leased fishing area unless the fisher is himself the lessee.
3) coastal dweller's fishing licence (Annex 3) B entitles a permanent resident of a coastal village to catch fish with a limited number of professional fishing gear in the sea and in Lakes Peipsi (Peipus), Lämmi and Pihkva (Pskov).
3. The fishing licence shall always be carried along while fishing.
II. ISSUING OF FISHING LICENCES
4. The fishing licence of a fishing vessel shall be issued by the Ministry of Environment. 1) To obtain the first licence (and the first one of the current year), an application shall be submitted, containing the following details:
- applicant's name;
- address, phone, fax;
- extract from the company or commercial register which certifies that fishing is the licence applicant's one of the areas of activity;
- vessel's board index and name;
- gross register tonnage;
- general length;
- number and capacity of head engines;
- call sign and frequency;
- home harbour;
- certificate on registration of the vessel in compliance with the ship's flag right and ship registers act;

- validity period of the temporary flag certificate;
- shipowner's or lessee's name and address, phone and fax;

- captain's name;
- period for which the fishing right is applied for;
- name(s) of fishing gear;
- fish species and volume being applied for in case of limited catch capacities;
- fishing area(s) being applied for;
- guarantee letter about the transfer of the fishing right fee or a copy of the respective payment order.
2) on applying for next fishing licences during the same year, the following details shall be presented:
- applicant's name and address; - vessel's board index and name;
- number and validity period of the former fishing licence;
- captain's name;
- period for which the fishing right is applied for;
- name(s) of fishing gear;
- fish species and volume being applied for in case of limited catch capacities;
- fishing area(s) being applied for;
- guarantee letter about the transfer of the fishing right fee or a copy of the respective payment order.
Upon expiry of licence validity and to obtain a new licence, the previous licence shall be returned to its issuer.

3) One fishing licence may be issued for a pair of two small trawlers which always work in pairs, indicating the board index and the master's name of both small trawlers.
4) The user of the licence shall fill in the column "Substitute master's name" in case if during the validity period of the licence it is necessary to substitute the master.
5) The issuer of the licence shall fill in the column "Volume allowed" in case it is necessary to restrict the catch of some fish species listed.
6) Further requirements to the holder of the licence shall be set out in the column "Observations" by the issuer of the fishing licence, confirming them by seal and signature.
7) The fishing licence shall be valid from the date following its issue date unless the issuer of the licence sets a later date.

8) The fishing licence shall be valid for the period specified on the licence. The fishing licence shall expire ahead of time upon catching out the volume of fish specified on the licence. Upon receiving a new fishing licence, the previous one shall be returned to its issuer.
(31.01.1999) 5. The fisherman's fishing licence shall be issued by the Ministry of Environment, county governor, local municipality or lessee of a fishing area.
An applicant for a fisherman's fishing licence shall submit a respective application containing the following details:
- applicant's name;
- address, phone, fax;
- extract from the company or commercial register which certifies that fishing is the licence applicant's one of the areas of activity.
- name(s) and number of fishing gear;
- marking of the fishing gear;
- period for which the fishing right is applied for;
- fishing area(s) being applied for;
- guarantee letter about the transfer of the fishing right fee or a copy of the respective payment order.
6. The coastal dweller's fishing licence shall be issued by the local municipality or the county governor. The applicant for the coastal dweller's fishing licence shall submit to the licence issuer an application, containing the following details:

- name(s) and number of fishing gear;
- marking of the fishing gear;
- period for which the fishing right is applied for;
- fishing area(s) being applied for;
- guarantee letter about the transfer of the fishing right fee or a copy of the respective payment order.

PROCEDURE FOR PRESENTING THE DATA
RELATED TO FISHING
I. PRESENTING OF DATA ON FISHING
PERFORMED PURSUANT TO THE FISHING CARD
1. The holder of the fishing card shall present the issuer of the fishing card the fishing data within 10 days from the expiry of the fishing card in the form of a report set out in Annex 1 of this Procedure.
2. The issuer of the fishing card shall consolidate the fishing data for the annual report in the form of a report set out in Annex 1 of this Procedure, which shall be submitted to the Fishery Board not later than by 1 March of the year following the accounting year, indicating in the report the name of institution or organization having issued the fishing card and the name and signature of the person who has prepared the report.

III. PRESENTING OF DATA ON FISHING PERFORMED PURSUANT TO THE FISHERMAN'S AND THE COASTAL VILLAGE PERMANENT RESIDENT'S FISHING LICENCE
6. The person performing fishing pursuant to the fisherman's and the coastal village permanent resident's fishing licence shall present the fishing data on the sheet of the coastal fishing logbook (Annex 4).

7. The person performing fishing pursuant to the fisherman's and the coastal village permanent resident's fishing licence shall present the issuer of the fishing licence the completed sheet taken out of the coastal fishing logbook for each month not later than by the fifth day of the month following the accounting month. The sheet from the logbook shall be presented for the whole licence validity period regardless of the fact whether any catch was caught or not while fishing during the accounting month.

8. The issuer of the fishing licence shall compile the fishing data of the accounting month presented to him/her into the consolidated statistic report, which he/she shall submit to: - the county governor in case the fishing licence is issued by the local municipality;
- the Fishery Board in case the fishing licence is issued by the county governor.
IV. PRESENTING OF DATA ON FISHING PERFORMED PURSUANT TO THE FISHING LICENCE OF A FISHING VESSEL AND IN WATERS OUTSIDE THE JURISDICTION OF THE REPUBLIC OF ESTONIA

9. The captain of the fishing vessel fishing pursuant to the fishing licence of a fishing vessel and in waters outside the jurisdiction of the Republic of Estonia shall present the fishing data on the sheet of the fishing vessel's logbook (Annex 5).

102. The sheet of the logbook shall be presented also in case no fishing was performed during the accounting month. In such a case the captain of the vessel shall make a respective note on the logbook sheet, specifying the reason why no fishing was performed. The logbook sheet need not be presented in case no fishing licence had been issued to the fishing vessel for the accounting month.

V. PRESENTING OF DATA ON FISHING PERFORMED PURSUANT TO THE LEASE AGREEMENT OF THE FISHING AREA 12. The person fishing in the sea and on Lakes Peipsi (Peipus), Lämmi, Pihkva (Pskov) and Vôrtsjärv pursuant to the lease agreement shall present fishing data on the sheet of the coastal fishing logbook.
13. The person fishing in the sea and on Lakes Peipsi (Peipus), Lämmi, Pihkva (Pskov) and Vôrtsjärv pursuant to the lease agreement shall present the county governor the completed sheet taken out of the coastal fishing logbook for each month not later than by the fifth day of the month following the accounting month.
14. The person fishing in the bodies of water not named in subsection 13 of this Chapter shall present the county governor a report every month on fish caught in the fishing area leased out to him not later than by the fifth day of the month following the accounting month. The report shall set out the following data:
- fish species caught;
- volume of fish caught in kilograms, by species, in case of salmon also the number of individuals;
- number of gill nets required (discharged);
- number of fish traps required;
- number of fishhooks required;
- number of mammals and birds perished in the fishing gear, by species.
VI. PRESENTING OF DATA BY COLLECTOR OF AQUATIC PLANTS
15. The collector of aquatic plants shall present the Fishery Board each month the data on the volume of collected aquatic plants and indicating the collecting area not later than by the tenth day of the month following the accounting month.

VII. PRESENTING OF DATA BY THE PRIMARY FISH PURCHASER
16. The primary fish purchaser shall present the Marine Inspectorate the completed receipt of primary fish purchase as set out in Annex 3 of this Procedure, within 48 hours from the moment of performing the purchase.
VIII. PRESENTING OF CONSOLIDATED FISHING DATA
17. The county governor shall present the Fishery Board consolidated data for each month not later than by the fifteenth day of the month following the accounting month. 18. The Marine Inspectorate shall present the Fishery Board the received consolidated data not later than by the twentieth day of the month following the accounting month.

Instructions for filling in the coastal fishing logbook
1. All persons fishing pursuant to the fisherman's fishing licence and lease agreement of the fishing area in the sea and on Lakes Peipsi (Peipus), Lämmi, Pihkva (Pskov) and Vôrtsjärv are obliged to keep the coastal fishing logbook (the form of logbook's sheet is enclosed).
2. The front cover of the logbook shall be filled in by the issuer of the fishing licence.
3. Blanks 1, 2 and 4 of the logbook sheet shall be filled in before demanding the fishing gear, the rest of the blanks before unloading, reloading, storing, dispossessing of fish.
4. The upper part of the logbook's sheets shall be filled in according to the front cover of the logbook.
5. Entries on fishing gear demanded (emptied) on the given day shall be made in columns from 1 to 16 of the logbook; the code of fishing gear shall be indicated in column 2 as follows:
1 - pound net;
2 - open-sea trap with the mouth height 3 meters and higher;
3 - fyke net with the mouth height from 1 to 3 meters;
4 - fyke net with the mouth height up to 1 meter;
5 - non-leader fyke net (trap);
6 - line of traps;
7 - lamprey pot;
8 - gill nets: 8-1 - mesh size under 48 mm
8-2 - mesh size 48 - 72 mm
8-3 - mesh size 73 - 120 mm
8-4 - mesh size more than 120 mm
9 - beach seine;
10 - Danish seine (flounder net);
11 - other towing net;
12 - hooked line (number of hooks shall be entered in blank 3)
13 - mail (number of hooks shall be entered in blank 3)
14 - other fishing gear.
6. The fishing place (column 4 - fishing square) is indicated as a small square with side length of 10 minutes depicted in the scheme set out on the cardboard interleaf.
7. The catch of fish shall be indicated in kilograms by species and by types of fishing gear, in case of salmon and sea trout the number of individuals caught shall also be specified.
8. The sheets of the logbook are printed on self-copying paper, therefore, while filling in the logbook, the cardboard interleaf shall be placed between the sheets before the next white sheet.
9. At the end of the month a white sheet (sheets) shall be torn out of the logbook and forwarded to the issuer of the fishing licence within five days.

Instructions of Filling in
the Fishing Vessel's Logbook
1. The sheets of the fishing vessel's logbook (the form of the logbook's sheet is enclosed) are printed on self-copying paper, therefore, while filling in the logbook, the cardboard interleaf shall be placed between the sheets before the next white sheet.
2. At the end of the calendar month a white sheet (sheets) shall be carefully torn out of the logbook and presented to the Marine Inspectorate (Kopli 76, 10416 Tallinn, phone 490 710). The coloured sheets will remain in the fishing journal.
3. Page number (1-24), fishing licence number, year and month shall be indicated in respective blanks of the sheet.
4. The date of fishing is the date when the fishing gear is taken out of the water.
5. The average fishing square in the Baltic Sea is the fishing square with side length of 10, where most of the daily catch is caught.
6. The name of a respective country in Estonian is written in the column "Economic zone, name of the country".
7. Indicators of catch effort: a) in trawl net fishing the total amount of trawling hours per 24 hours shall be indicated in the respective blank; amount of trawling hours - time in hours from the end of casting the trawl net until the commencement of drawing it out; b) in gill net fishing the number of nets used in fishing shall be indicated in the respective blank, if several fishing operations were performed during 24 hours, the number of fishing operations shall also be shown in brackets; c) in hooked line fishing the number of hooks cast into the water shall be indicated in the respective blank.
8. In trawl net and gill net fishing the minimum inner mesh size (mm) shall be indicated, in fishing with a hooked line the size of the smallest hook (mm).
9. The catch is shown by fish species and draughts. Each draught shall be entered on a separate line in kilograms, in case of salmon and trout, the number of individuals caught shall also be specified.
10. In fishing with a two-boat trawl, only those fish quantities shall be indicated in the vessel's logbook which are loaded aboard that boat.
11. In the column "Number of days at sea" the number of calendar days spent fishing during the month shall be entered, including the days of departure from and arrival in the harbour unless they fall on the same calendar day. In the column "Number of trips" there shall be entered all the trips during which fishing was performed. 12. The data concerning fishing shall be entered in the logbook immediately after unloading the trawl.
13. In the column "Observations" notes are taken about the reasons why the vessel had stopped.
