RESOLUTION NO. 3571

A RESOLUTION ESTABLISHING CRITERIA AND GUIDELINES FOR NAMING PARKS AND RECREATIONAL FACILITIES AFTER PERSONS OR ORGANIZATIONS; RESCINDING RESOLUTION NO. 2799.

WHEREAS, the City of Overland Park, Kansas, owns and operates numerous parks areas and recreational facilities for public recreation and leisure service activities; and

WHEREAS, the City of Overland Park, Kansas, establishes and administers rules and regulations, and fees for use of said park areas and recreational facilities; and

WHEREAS, it is the desire of the City to develop criteria and guidelines for naming parks and facilities after persons or organizations.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS:

A. Parks and Recreation Facilities Except for the Arboretum and Botanical Gardens, Deanna Rose Children’s Farmstead, and Public Art.

1. That a parks or recreation facility could be named after any person, persons or organization who has made a significant contribution of land, service or financial resources to the City of Overland Park.

2. That the City should wait for such names to emerge and not go out seeking names.

3. That the City or any person may submit a proposal to name a park or recreational facility, in writing, to the Citizens' Advisory Council on Parks and Recreation. The proposal shall describe the facility to be named and shall state the name being proposed, and shall include a summary of the reasons and qualifications of such a person in having the park or facility named for him, her or it.

4. That the Citizen's Advisory Council on Parks and Recreation shall review any suggestions for naming parks or recreational facilities and ultimately make recommendations to the Community Development Committee for consideration. Recommendations from the Community Development Committee shall be submitted to the Governing Body for final approval.

5. That the naming of parks or recreational facilities should not be limited to new parks and facilities. Existing parks and facilities could be renamed.

B. Arboretum and Botanical Gardens, Deanna Rose Children’s Farmstead, and Public Art. 1. That a facility or public enhancement for the Arboretum and Botanical Gardens, Deanna Rose Children’s Farmstead and Public Art could be named after any person, persons or organization that has made a significant contribution of 51% or more of the funds, in-kind services or products required to complete a project.

2. That the Arts and Recreation Foundation of Overland Park will actively solicit these significant contributions to the Arboretum, Deanna Rose Farmstead and Public Art.

3. The Arts and Recreation Foundation of Overland Park may recognize other major contributions within a project according to a predetermined schedule recommended by the Foundation and approved by the Governing Body. That the naming of facilities or public projects should not be limited to new gardens, facilities or public projects but will allow for renaming of existing facilities, gardens or public projects where appropriate.

4. That the Gift Acceptance Policy of the Arts and Recreation Foundation of Overland Park is attached to this Resolution as Exhibit A and is hereby approved for use by the Foundation in solicitation and acceptance of gifts for programs, buildings, facilities, attractions and amenities at the Overland Park Arboretum and Botanical Gardens, the Deanna Rose Children’s Farmstead and for the Overland Park’s Master Plan for Public Art.

C. Renaming Policy

The naming of donated public property should ordinarily be with the intent for it to be perpetual recognition of the individual, family, corporation, foundation, association or other entity for which the donated facility has been named. The renaming of a donated facility is strongly discouraged. Rescinding the name of a donated facility shall occur only under extraordinary circumstances and after thorough study and the receipt of written recommendations from the Director of Parks and Recreation and the Overland Park Parks and Recreation Foundation and notice to the donor or his/her family. The Governing Body of the City of Overland Park, after appropriate notice and hearing, may rescind the naming of a facility donated after the effective date of this Resolution only under the following circumstances:

1. The individual, family, corporation, foundation, association or other entity for which the facility has been named has been convicted of a felony, a crime involving moral turpitude, or participated in any other illegal or disreputable behavior which would bring discredit to the City and do substantial harm to the reputation and mission of the City and the facility, or

2. The donor, or their legally authorized representative, has consented to such action by the City, or

2 3. The useful life of the facility has expired and the facility must be replaced or substantially renovated, or

4. A specific period of time for the retention of the name has been agreed to by the donor as part of the donation.

RESOLUTION NO. 2799 is hereby rescinded.
