2016 Breeding Contract

This certifies ______, here referred to as Mare Owner/Agent, has engaged one service to the stallion THE WOW FACTOR, APHA #1,013,786, for the mare ______Reg #______for the 2016 breeding season , from February 1st - June 1st unless special arrangements are made in writing. The mare owner agrees to pay the introductory breeding fee of $1000, which includes a $500 non-refundable booking fee. Any deviation from these terms must be specified in writing and signed by Nicole Dalton. The balance of the entire breeding fee is due prior to the first shipment of semen. All payments must be made payable to Brassy Acres.

BOOKING - The mare owner must provide the following to Brassy Acres when making a booking:

1. Copy of both sides of the mares registration papers, with current owner listed or lease agreement must accompany contract. The owner recorded on the registration certificate will be recorded on the stallion breeding report. 2. Copy of signed breeding contract (Rebreeds must fill out a new contract for the current year).

FEES - The following fees are associated with this breeding (All fees must be paid in full and received by Brassy Acres prior to any semen shipments):

1. Booking Fee – A non-refundable booking fee of $500 US Dollars is due at the signing of this contract. This will assure you a slot in the booking schedule for the stallion. 2. Breeding Fee – A non-refundable balance of $500 US Dollars is due prior to the 1st shipment. This fee, along with the booking fee above, is for the stallion’s services. 3. Collection Fee – A fee of $250 US Dollars covers the collection and lab fees for each shipment of cooled semen. This amount is due prior to each shipment. 4. Shipping Cost - Actual shipping costs will apply for all shipments. 5. Each shipment will require a collection and shipping fee. 6. Semen will not be shipped to any mare unless a current credit card number and expiration date is on file with Brassy Acres or shipping prepaid with check, cash, Paypal or money order.

CONSIDERATIONS - World and Reserve World Champion mares breed for no breeding fee. Proven performers and producers are eligible for considerations. Please contact Nicole Dalton for current discounts. Collection and shipping fees still apply to every breeding.

Brassy Acres 7305 North 175th Avenue Waddell, Arizona 85355 602-702-0359 SHIPMENTS - Requests for semen shipments are on a first come, first served basis. Please call early to be put on the list.

1. Call Nicole at 602-702-0359 to request shipments. 2. Stallion is collected Monday, Wednesday, and Friday. 3. Semen will be sent via Fed-EX (next day arrival). Counter to counter airline shipments (same day arrival) are available. Availability of airline shipment depends on air cargo routes operated by Airlines contracted with Brassy Acres. 4. To guarantee shipping, mare owner, or agent, must give at least a 24 hour notice of possible semen shipment required to Brassy Acres and confirm shipment definitely required by 8am (MST) on collection days. 5. Brassy Acres shall not be responsible for the costs arising from shipments lost, damaged, or delayed in transit, or condition of cooled shipped semen upon delivery. We have no control of the shipment after it leaves our custody. 6. Customer must specify shipment method, Fed-Ex or Airline Counter to Counter service, when ordering semen. 7. Please remember that a signed contract does not guarantee semen will be available on a given day. 8. All fees must be paid in full before the mare will be put on a stallion breeding report.

RE-BREEDS – The mare will have the right to a re-breed under the following conditions

1. If a mare dies or is deemed unfit to breed during the breeding season, a substitute mare, approved by the stallion owner, may be bred without any additional breeding fee. 2. Live foal guarantee ~ A live foal is defined as one that stands and nurses without assistance. If foal is born dead, mare owner agrees to furnish the stallion owner within 7 days a veterinarian’s certificate describing the occurrence. If the mare aborts or fails to conceive, she may return during the current breeding season. If it becomes too late to re-breed a mare during the current season, she may be bred the following year, provided a re-breed fee of $250 and all relevant collection and shipping charges are paid. All parties agree that the stallion owner or their agents or assigns are not liable for death, sickness or accident, including consequential damages caused to the mare or foal. 3. Color guarantee ~ If the foal is born without the qualified markings to be registered in the American Paint Horse Association in the Regular Registry, the mare may be rebred, provided a re-breed fee of $250 and all relevant collection and shipping charges.

In the event that the stallion dies or becomes unfit for service, this agreement will immediately terminate. Stallion Owner shall have no liability to Mare Owner except notification of its occurrence.

The mare’s health and mortality are the full responsibility of the mare owner before, during and after this breeding.
