Issue: The Nelson County Board of Supervisors has, pursuant to § 33.2-908 of the Code of Virginia, requested that the Commonwealth Transportation Board discontinue two segments of Route 641 (Dutch Creek Lane) to include the following: Segment A which is from 2.72 miles northwest of Route 640 to 3.57 miles north of Route 640, a distance of 0.85 of a mile and Segment B which is from 5.05 miles northwest of Route 640 to Route 641 (Eades Lane), a distance of 0.07 of a mile (as depicted in Attachment A).

Facts:Pursuant to § 33.2-908, the Commonwealth Transportation Board may discontinue VDOT services and jurisdiction over roadways, public landings, or crossings comprising the secondary system of state highways that no longer provide sufficient public convenience to warrant maintenance at public expense.

In accordance § 33.2-908 of the Code of Virginia, the Nelson County Board of Supervisors in concert with the Virginia Department of Transportation (VDOT) published a Notice of Intent to Discontinue the segments (Attachment B) on April 30 and May 7, 2015 in the Daily Progress and News Virginian local newspapers and notified the abutting landowners by registered mail.

No public hearing was requested.

The Nelson County Board of Supervisors passed a resolution on July 14, 2015, (Attachment C) requesting the discontinuance of the two segments of Route 641 (Dutch Creek Lane) described above.

Recommendations: VDOT recommends the Board approve the discontinuance of two segments of Route 641 (Dutch Creek Lane) to include Segment A which is from 2.72 miles northwest of Route 640 to 3.57 miles north of Route 640, a distance of 0.85 of a mile and Segment B which is from 5.05 miles northwest of Route 640 to Route 641 (Eades Lane), a distance of 0.07 of a mile as depicted in Attachment A.

Action Required by CTB: The Code of Virginia requires a majority of the Board’s members to approve the discontinuance. A resolution will be provided for the Board’s consideration.

Result if Approved: The Virginia Department of Transportation will suspend maintenance of the above referenced segment of Route 641 (Dutch Creek Lane) in Nelson County.

Options: Approve, Deny or Defer
