3 ORDINANCE 2016-333 4AgreementExh1.tif AN ORDINANCE APPROVING, AND AUTHORIZING THE 5 MAYOR, OR HIS DESIGNEE, AND CORPORATION 6 SECRETARY TO EXECUTE AND DELIVER IN ACCORDANCE AgreementExh2.tif 7 WITH SECTION 122.421(b), ORDINANCE CODE, A 8 NON-EXCLUSIVE GRANT OF EASEMENT CONVEYING TO 9 JEA A UTILITY EASEMENT, IN, OVER, AND UNDER 10 PORTIONS OF EVERBANK FIELD PARKING AREA, IN 11 COUNCIL DISTRICT 7 AND NEEDED TO SUPPORT THE 12 JEA WASTEWATER FORCE MAIN RIVER CROSSING, 13 TOGETHER WITH ALL DOCUMENTATION NECESSARY TO 14 CONVEY SUCH EASEMENT; PROVIDING AN EFFECTIVE 15 DATE. 16

17 BE IT ORDAINED by the Council of the City of Jacksonville: 18 Section 1. Utility Easement. There is hereby approved, 19and the Mayor, or his designee, and the Corporation Secretary are 20hereby authorized to execute and deliver in accordance with Section 21122.421(b), Ordinance Code, a Non-Exclusive Grant of Easement, in 22substantially the same form as is attached hereto as Exhibit 1, and 23incorporated herein by this reference, conveying to JEA a sewer 24utility easement along portions of the old Franklin Street 25abandoned right-of-way which is now part of the Everbank Field 26parking area (“Utility Easement”). The Utility Easement will be 27used in connection with the JEA South Shores Force Main River 28Crossing Project (“Force Main Project”) for the purposes of 29installing and maintaining a wastewater force main that is being 30placed approximately 100 feet under the St. Johns River and emerges 2 1on the South Bank. The new sewer line will be placed into service 2upon completion of construction and the old line will remain in 3place as a backup and environmental safeguard. 4 Section 2. Purpose of Additional Easement. This Utility 5Easement is in addition to and consistent with easements that have 6already been approved by Council. The Council has granted two 7other easements in connection with this Force Main Project pursuant 8to Ordinance 2015-313-E. Copies of the Non-Exclusive Grant of 9Easement Agreement and the JEA Temporary Construction Easement are 10attached hereto as Exhibit 2. The purpose of this additional 11Utility Easement is to move the point of connection for the new 12force main to an existing 12-year-old 48 inch force main located at 13the intersection of Franklin Street and Duval Street, rather than 14connection to the existing 45-year-old force main located 15approximately 200 feet south of Adams Street. This opportunity 16and proposed change in the project was only discovered after 17construction was started. This new point of connection will provide 18increased redundancy of critical infrastructure for conveying up to 1910 MGD of wastewater at peak flow; provide an alternative flow 20path; reduce the risk of system failure by utilizing a newer force 21main as the primary flow path; and minimize the risk of damaging an 22existing in service, 45-year-old pipe, during construction. 23 Section 3. Construction. All construction for the Force 24Main Project will still be conducted within the existing JEA 25Temporary Construction Easement. To connect to the revised point 26of connection, all construction within this Utility Easement will 27be underground with the exception of some surface disturbance for 28an open cut section to make the connection point and avoid other 29existing utilities. Any surface disturbance will be restored by 30JEA within the time frames established in the JEA Temporary 31Construction Easement. 1 -2- 2 1 Section 4. Effective Date.
