3. Previous Minutes The minutes of the previous meeting were accepted.
4. Matters Arising None.
5. Scottish Developments and Reforms o PS reported that he and MCB went to Scotland and met Archie Rintoul, Brian Reeves and Stephen Jones. o AR/BR are inviting people to join an interim committee, to meet in February. o CPOs are topical and there is much enthusiasm for them in Scotland. o The circular has been published, and the Scottish Law Commission is due to review CPO law and Compensation this coming autumn. o RH produced a note summarising the current position with Scotland, set out below. The content of the note was agreed by the committee.
1. CPA in Scotland to be part of the CPA and a branch of the CPA, but otherwise an autonomous organisation. 2. CPA in Scotland would approve membership applications for applicants in Scotland. 3. CPT to provide central administration of membership and fees to CPA in Scotland. This would not involve physical presence in Scotland other than say a liaison meeting once or twice a year (time and travel funded out of CPA funds). 4. CPA national committee members would try to attend events in Scotland from time-to-time (as with other regional events) to show support. RH to be main point of contact for the CPA. 5. CPA in Scotland would organise and service its own committee meetings. 6. CPA to provide an annual grant to CPA in Scotland, based on membership. 7. CPT are free to provide assistance to CPA in Scotland for events, mailings and the like, to be funded by CPA in Scotland (from income from events or otherwise). 8. CPA in Scotland will be free to keep profits from events and raise money from other routes. 9. CPA website will have a section for Scotland and host material for the CPA in Scotland. 10. £500 has been allocated as “seed” funding to help the CPA in Scotland to become established and recruit members. 11. Given the additional costs to be incurred by Scotland whilst becoming established, over and above regional activity in England and Wales, it was agreed they should receive £30 per member per year to fund CPA activities, initially for the next 2 years (rather than £10 as others). 12. Whilst the money will be dealt with in the same way as regional funding, ie retained in the central kitty, this may change if CPA in Scotland wants to control its own funds.
o It was additionally agreed to invite Archie Rintoul and Brian Reeves as guests to the CPA dinner in March. o It was also agreed to ask the CPA in Scotland whether it wanted to establish itself as a body with its own constitution.
For clarity, the committee which is elected at the AGM will be known as the national committee, elected by the national AGM. Any member will be eligible to stand. Scotland will have its own committee and be called the Scottish Committee and their activities will be known as CPA in Scotland (or a different name if they wish). The

make-up of the Scottish committee is not prescribed by the CPA constitution, nor does it need to be. The Scots should be free to constitute the committee in whatever way they wish.

6. CPA Reforms o Localism Bill is now an Act o Localism Act secondary legislation and guidance o BDG, PA, ML and RH met Bob Segall in December 2011 to discuss transitional arrangements; a note of this meeting has been circulated. These are likely to come into force in April 2012 in part at least. o Bob Segall also invited input on the Land Compensation Development Order and revisions to Circular 06/04, and this matter is on-going. Input in relation to the Circular would also cover advance payments. RH has produced some text which is with PA for consideration. o The Tribunal is understood to be drafting amended rules to account for the transfer of jurisdiction for appeals in relation to certificates of appropriate alternative development. o MCB Chase Donald o HS2 o HS2 is acting as a spur for consideration of reform of blight and compensation generally. o Three question arose in discussion: 1. Should the CPA respond to the anticipated HS2 consultation? – Yes. 2. Should CPA work with RICS on this (as the Localism Bill)? – Yes. 3. Should CPA seek to take the lead in this area of possible reform to seek to promote what is in the best overall public interest? – Yes. o PA’s law reform group will take responsibility for this. o It was agreed that the HS2 compensation consultation could be part of the proposed two meetings (PA should liaise with Jade to sort dates and invitations). . Professional liaison meeting - involving NFU, CAAV, CLBA, IRRV, and RICS (Query whether other professional bodies be involved, such as Law Society, PEBA, RTPI for example, plus Local Government Association, Town and Country Planning Association, etc). . 7. Accounts, unpaid members and new fees o MCB reported the increased membership seems to have gone smoothly, with 120 members having paid by at the end of December. A clearer picture will emerge at the end of January and MCB will produce a report for the next meeting. Jade and Gill to do o 23 members announced their retirements; some as they have retired, some due to economic pressures, and some because they no longer do CPO work. More detail for next meeting o Unpaid members should be chased-up and a report made at the next meeting. Gill
8. Regions, regional activities, regional budgets and duties of convenors o MCB reported that he had not produced the allocation of the regional budgets, nor circulated them. He sought and received confirmation that he should use the final numbers as of December as the calculation of the budgets. Gill/Jade to sort summary and for MCB to circulate to convenors o Tony Lawton has been contacted and briefed in relation to the North West. o West Midlands (Michael Orlik) should be contacted by the Chairman to confirm that they now West and East Midlands; a list should be sent of the additional members. This will also mean an increase in their annual budget. Who to send? RH or or CS or KM? Me thinks CS o Richard Asher should be contacted by the Chairman and advised of this change in relation to the East Midlands. RH or or CS or KM? Me thinks CS o The Midlands spring meeting will be the 29 March 2012.
9. IRWA o The land assembly report and recommendations produced by PM were agreed. The report should be posted to the website. The December 2011 event was a good and valuable one. Thanks to CBRE and PM. o There appears to be little appetite from the marketplace to take up opportunities offered by IRWA. It was felt that NIPA would be a far more effective medium to promote such relations. To that end, KM and RH should seek to liaise with NIPA / RO. o It would be valuable to discover how IRWA’s meeting went with the RICS, as that is probably key to determining future developments in the UK.

o Our support and empathy for the IRWA is undiminished, but other than take an interest in the IRWA, and when funds and circumstances allow attend their annual conference, the committee could not see any prospect of further developments in the relationship. o The IRWA conference is in Seattle this year, 10-13 June 2012. The costs are high. The Treasurer and Chairman need to discuss what funds will be available for CPA participation, before seeing whether anyone from the committee would be prepared to represent the CPA at the IRWA conference. 10. Events o IPC Meeting – agreed that RG will progress and secure a meeting date, and circulate an invitation for other committee members to attend. RG to progress o Inter professional liaison and stakeholder meetings o See reform agenda o Dinner o Numbers circa 160. The max for the venue can now be confirmed as 190. o MCB is unhappy about any extra charge for a separate pre-dinner drinks room and will try to negotiate. o Conference o MCB sought guidance on the dates due to the bank holiday weeks and the Jubilee celebrations. Dates are proving elusive. o It was noted that there would be no Spring drinks reception this year, due to the anniversary celebrations.
11. AGM 2012 celebrations - Monday 15 October 2012 (if the room is free) Middle Temple Hall as the venue, using BDG as the member to secure a discounted rate KM to invite Sir Robert Carnwath Same sort of timings as last year, eg: 17.00 – Registration 17.30 - AGM Business 18.00 – Sir Robert Carnwath 18.30 - Champagne and cake reception 19.45 - Adjourn to a pub with a cash bar o Members only and free o Book in advance (as usual) o If we end up with more than 70, we shall end up standing. o If we find out nearer the time that numbers are higher than anticipated can we switch to a cheaper wine. o If the venue is too expensive, we should try other venues such as eg the House of Lords. o MCB to draft letter for KM to send

13. Membership Update No new members
14. Dates for future meetings These should be identified by the chairman and circulated by email, for 6 months ahead, as soon as reasonably possible. KM to advise on his suggested dates to MCB and CS to find up dates for MCB to circulate
15. AOB o Thanks were offered to PS and Turley Associates for providing the meeting facilities. o The desire to get a CPA place in NIPA remains. KM and RH to raise with NIPA when appropriate. o It was noted that with Sir Robert Carnwath’s elevation to the Supreme Court, a new Senior President of Tribunals was likely to be appointed. It was agreed that the CPA should seek to ensure that the important role of the Lands Chamber was appreciated by any successor, by seeking a meeting if necessary in due course.

o Work on the Penfold Review and a consultation on telecomms is underway, in which we may want to express an interest. RH to investigate.
