1 Ocean Beach Shores Club 2 By-Laws 3 4 Toms River Township, P.O. Box 292, Lavallette, NJ 08735 5 www.obscnj.org 6 7ARTICLE 1 8SECTION 1 – MEMBERSHIP 9 10 Property owners or lot lessee at Ocean Beach Shores shall be members of this Club. 11 12 Any person or persons holding title or lease without applying for and being accepted 13by the Club may not use the Club’s facilities. Any person who has taken title or 14leasehold by inheritance, sale, assignment or otherwise, must will file an application with 15the Membership Committee. 16 17 Every prospective lot owner must will apply for membership in the Ocean Beach 18Shores Club and shall be subject to the provisions of these By-Laws and any rules and 19regulations promulgated by the Board. 20 21 When an applicant is accepted into this Club he or she shall agree to abide by the 22provisions of the Certificate of Incorporation of the Club, these By-Laws and any 23subsequent regulations imposed by this Club in addition to the Deed restrictions on his or 24her lot. 25 26There shall be two (2) types of members: 27 28 1. Regular member is an owner or long term lessee with voting rights. 29 2. Associate member is one who occupies a regular member residence for usually 30 less than one (1) year, does not have the right to vote, but enjoys all the facilities 31 of the Club (Renters). 32 33 The distinction should be noted between the regular member and the associate 34member. Whenever the terms member or membership are used the reference is to the 35regular member. 36 37 Applications for membership in Ocean Beach Shores Club shall apply only to lots in 38Ocean Beach Shores which are used for dwelling purposes. Members in good standing 39shall be entitled to enjoy all rights and privileges of membership, including the use of the 40beachfront and other facilities of this Club, subject to the provisions of the Certificate of 41Incorporation of this Club, these By-Laws and the rules and regulations approved by this 42Club.

1 1 2 43SECTION 2 – ADMISSION 44 45 (a) A person or group of persons becomes a member of Ocean Beach Shores Club as 46 of the date of approval of his or their application for granting a membership. 47 (b) Applications for membership ion Ocean Beach Shores Club shall be approved or 48 disapproved in writing by the Membership Committee of the Ocean Beach Shores 49 Club. 50 51SECTION 3 – TERMINATION OF MEMBERSHIP 52 53 Membership in this Club shall automatically terminate when the member no longer 54owns, leases, or has any record interest in any parcel of property at Ocean Beach Shores. 55 56ARTICLE 2 57 58SECTION 1 – OFFICERS 59 60 The officers of this Club shall consist of a president, a vice-president, a treasurer and a 61secretary, all of whom shall be members in good standing of the Board of Trustees. 62 63 Trustees are to be awarded an honorium honorarium each year as established at the 64fall meeting. 65 66ARTICLE 3 – DUTIES OF OFFICERS 67 68SECTION 1 – PRESIDENT 69 70 The president shall be the chief executive officer and it shall be his or her duty to 71preside at all meetings of the members and of the Board of Trustees; call special meetings 72of the Board of Trustees when necessary; appoint all committee chairmen, except the 73Nominating Committee chairmen, provided for by the Certificate of Incorporation or by 74these By-Laws and any other committees deemed necessary. The president shall have the 75right to establish ad hoc committees. The President shall, with the treasurer, sign all 76checks, drafts, notes and other negotiable instruments in the name and under the seal of 77the Club, when so authorized by the Board of Trustees. The president shall be an ex- 78officio member of all committees except the nominating committee. 79 80SECTION 2 – VICE-PRESIDENT 81 82 The vice-president shall be vested with all the powers and shall perform all the duties 83of the president in the latter’s absence and shall also perform such other duties as may 84from time to time be designated by the president or to by the Board of Trustees. He or 85she shall be in charge of one of the major standing committees, preferably the 86membership committee.

3 2 4 87SECTION 3 – TREASURER 88 89 The treasurer shall keep full and accurate records of receipts and expenditures of the 90funds of the Club in books belonging to the Club and shall deposit all monies and other 91valuables of the Club in the name of and to the credit of the Club in such depositories as 92may be designated by the Board of Trustees. 93 94 All books and records of the treasurer shall be available and open at all times for 95examination by the Board of Trustees. The treasurer shall collect all dues and special 96assessments and issue receipts only for cash payments. 97 98 Yearly dues and special assessments shall be collected by the treasurer from the owner 99or lessee of each lot. The first payment paid by a lot owner or lot lessee on each lot shall 100be considered initiation fee and cover the period up to December 31 of that year. Regular 101dues on each lot shall begin on January 1. The initiation fees shall be equal to the full 102yearly dues and special assessment. 103 104 Membership dues and special assessments on a lot are not transferable. Each lot 105transfer shall require the new owner or lot lessee to apply for membership and to pay the 106full initiation fee on each lot transferred to him or her regardless of the portion of the 107remaining year. No dues or initiation fees of any kind shall be assessable on any lot or 108plot not originally sold or leased by the Developers, Bay Beach Corp., Fred A.C. Pearl, 109Robert A. McDonough, Edward J. Patnaude, their heirs, successors or assigns. 110 111 The treasurer shall, with the president or vice-president, execute all checks, drafts, 112notes or other negotiable paper in the name of and under the seal of the Club. At the 113Board’s discretion and at the expense of the Club, the treasurer shall supply the Club with 114a proper surety bond written by a responsible surety company in the amount of $50,000, 115or an amount otherwise determined by the Board. 116 117 The treasurer shall be the Chairman of the Budget Committee and shall prepare the 118preliminary budget with input from various committee chairmen and present it at the 119August meeting of the Board of Trustees. The Board shall adopt a budget for the 120following year and present to the membership at the September meeting. 121 122SECTION 4 – SECRETARY 123 124 It shall be the duty of the secretary to keep a record of the minutes of all meetings and 125to transcribe such records into a minutes book to constitute a permanent record. Among 126other things the secretary shall also be required to: 127 128 (a) Present copies of the minutes of the board of trustee meetings for approval by the 129 board of trustees at each following trustee meeting. 130 (b) Certify Resolutions and furnish same when so requested by the Trustees.

5 3 6 131 (c) Attest signatures of the president or vice-president or other authorized officer 132 when so directed by the Trustees, in execution of any and all legal instruments 133 affecting the Club in accordance with corporate law. 134 (d) Notify all members of meetings, regular or special. He or she shall be responsible 135 for all legal communications to the members of the Club 136 (e) Include a list of candidates for the Trustees that have been presented by the 137 Nominating Committee with the notification of the annual meeting. 138 (f) Shall write letters to all vendors to request the annual contribution set by the 139 Trustees for the right to solicit business on the Club’s private property. The 140 secretary shall advise the Club of any vendor applications. 141 142ARTICLE 4 – TRUSTEES 143 144 There shall be seven members of the Board of Trustees and each shall be elected for a 145two-year term; four members at one annual meeting and three members of the succeeding 146annual meeting. The number of trustees constituting the Board of Trustees may be 147increased or decreased by amendment of this provision of the By-Laws. 148 149 Absence of any member of the Board of Trustees for more than three consecutive 150meetings without reasonable cause will terminate his or her membership on such Board 151and the Board of Trustees may thereupon on majority vote, fill such vacancy from the 152membership of the Club until the next annual meeting of the membership. 153 154 Any member in good standing may fill a vacancy on the Board of Trustees caused by 155death, written resignation, suspension of membership, loss of membership for any reason, 156expulsion or impeachment. He or she must receive a majority vote by the Board of 157Trustees. His or her term of office runs until the next annual meeting of the membership, 158at which time the membership shall vote to fill the vacancy. 159 160 An individual Trustee or the Board of Trustees as a whole shall not be liable to any 161member or any third party for any act or failure to act unless the act or a failure to act can 162be characterized as a willful disregard of duty on the part of the individual trustee or the 163Board of Trustees. 164 165 The Trustees are empowered by these By-Laws to enter into a long term lease in 166behalf of this Club, with the owners of the bathing beaches, boat basin and parking lots in 167accordance with the deed restrictions. 168 169 The control and complete management of the Club shall be entrusted to the duly 170elected Trustees who shall make any and all rules and regulations consistent with their 171understanding of the needs and desires of the majority of the membership, and enforce 172compliance therewith, as well as with these By-Laws and the Deed restrictions. 173 174 Committee Chairmen may spend all money authorized in the budget without the 175approval of the Trustees. 176

7 4 8 177ARTICLE 5 COMMITTEES 178 179SECTION 1 MEMBERSHIP COMMITTEE 180 181 The Membership Committee shall consist of a minimum of three persons at least one 182of whom shall be a Trustee and shall not act upon any membership in Ocean Beach 183Shores until a signed application fully completed has been submitted to it. 184 185 All applicants for regular membership must be interviewed in person by the 186membership committee. Purchasers or lot lessees must appear and fill out an application. 187 188 When accepting a single or unmarried person for membership, the membership letter 189of acceptance will state that application of both husband and wife will be required upon 190any change in marital status. 191 192 Any person or persons inheriting or otherwise acquiring property or leasehold in 193Ocean Beach Shores, shall for Club purposes be treated as an entirely new applicant and 194shall will appear and fill out a Club application together with his or her spouse. as 195outlined above. 196 197 No club, association, fraternity or society, corporation or company shall be eligible for 198membership. regardless of how or under what conditions they might acquire Ocean 199Beach Shores property or leasehold. This does shall not apply to family established trusts 200to closely held corporations, partnerships, LLC’s, or trusts. An individual representative 201of any entity will apply for membership. 202 203**The membership committee shall vote on the acceptance or non-acceptance of new 204members and shall notify applicants in writing of this status. Applications not accepted 205for membership may be reviewed by the Membershiop Commmittee at any time after 206ninety (90) days.** 207 208 The Chairman of the Membership Committee shall supply new members with copies 209of the Club By-Laws, certificate of Incorporation and any rules and regulations and shall 210receive a signed receipt for same. 211 212Suspension of membership: A member shall, upon a majority vote of the Membership 213Committee, and with the approval of the Board of Trustees, be suspended for such 214violations of the rules, By-Laws, regulations or restrictions as the Committee shall 215decide. The Club dues and other assessments as approved by the membership are 216payable on or before March 15. Any member, whose financial obligations to the Club 217have not been met on Club dues are unpaid on or before May 1, shall be automatically 218suspended on May 2. Similarly, any member whose financial obligations to the Club 219arising from other membership approved assessments which remain unpaid 60 days 220beyond the assessment due date, shall be automatically suspended. A 1.5% interest per 221month will be charged for each month after the 60 day period that the dues or 222assessments remain unpaid. Such member, in either case, shall be notified in writing of

9 5 10 223this suspension, and all occupants of his or her cottage or cottages prevented from use of 224the beach and/or other Club facilities until such time as the suspended member is 225reinstated by a majority vote of the Membership Committee. 226 227 Providing that all other qualifications have been met, acceptance of any new applicant 228shall be withheld until all past dues and special assessments have been paid and all 229violations on the premises cleared to the satisfaction of the Club’s Trustees. This shall be 230based on the fact that inasmuch as the Trustees, in order to properly provide services and 231maintain the private club’s facilities, are obliged to expect that each residential lot will 232provide and bear its equal share of the Club’s yearly cost of operation. 233 234 Therefore any and all lots on which financial obligations are unpaid, as set forth 235above, shall have charged against it or them on the Club books an amount equal to the 236year’s unpaid financial obligation plus a penalty of $100.00 until paid by: 237 238 (a) a present member paying his membership dues and special assessment (in order to 239 avoid suspension) 240 (b) a suspended member (in order to be reinstated) 241 (c) a new applicant for membership (in order to be accepted) 242 243 All members are liable for their dues and/or assessments whether or not 244their membership is suspended. 245 246 No purchaser or lessee with violations on his present premises will be accepted on any 247new membership until all existing violations have been cleared by the Board of Trustees; 248upon the recommendation of the Membership Committee, shall take any legal action to 249enforce these By-Laws. 250 251 Nothing contained in these By-Laws shall limit, restrict or prevent any member or 252group of members at any time from presenting grievances or complaints in writing to the 253Club or to the Board of Trustees. 254 255 Any member deeming himself or herself aggrieved by a decision of the Membership 256Committee concerning suspension of membership shall have a right of appeal to a 257committee consisting of seven members; three members of the Club to be chosen by the 258aggrieved member, three Club members to be chosen by the Chairman of the 259Membership Committee. The seventh member shall be the president of the Club, who 260shall vote only in the case of a tie. Any decision of the Membership Committee 261pertaining to suspension of the membership may be reversed by a majority of the Appeals 262Committee hereby created. 263 264 All applications for associate membership use of rental property must be in the hands of 265the membership chairman not less than seven (7) days prior to the actual term of 266occupancy. Only those applicants who have not been approved will be notified in 267writing. 268

11 6 12 269 Any owner giving up a cottage for longer than 72 hours (3 days) to anyone other than 270members of his or her immediate family must submit an associate member application to 271the Membership Committee for identification and to facilitate locating anyone in case of 272emergency. 273 274SECTION 2 – SOCIAL COMMITTEE 275 276 The Social Committee shall stimulate interest in community planning, sociability and 277good fellowship by organizing and operating all membership social affairs. This 278Committee may raise funds for any and all entertainment or other functions as sponsored 279by it. All such funds shall be paid to the treasurer of the Club and earmarked only for use 280by the Social Committee. The board of trustees, at their discretion, may offer financial 281assistance from club funds for club sponsored events. 282 283SECTION 3 – NOMINATING COMMITTEE 284 285 The Nominating Committee shall consist of a minimum of three members in good 286standing; it shall be the duty of the Nominating Committee to recommend nominations 287for Trustees for election at the annual meeting in the Fall. Nominations from the floor 288shall be called for by the president. 289 290SECTION 4 – BUILDING AND GROUNDS COMMITTEE 291 292 The Building and Grounds Committee shall consist of a minimum of three members in 293good standing. The Committee is responsible for shall oversee the maintenance and 294improvements of all Club properties. 295 296 It shall be the duty of the Building and Grounds Committee to see that all properties in 297the community are kept neat, well-painted, and in good repair. 298 299 The Building and Grounds Committee will pass on all approve or disapprove all 300building alterations. Construction of any building, alteration, addition, dock or bulkhead 301must be approved in writing by the Building and Grounds Committee. The Building and 302Grounds Committee may seek input from the Developer. Necessary Federal, State, and 303Township permits may also be required. The Building and Grounds Committee shall see 304that all items such as fences, storage boxes sheds and shower screens shall be constructed 305and located in accordance with the rules that are outlined in Deed restrictions and enacted 306from time to time. 307 308Any owner whose vacant lot or yard is in a condition deemed detrimental by the Building 309and Grounds Committee shall first be requested to clear the violation. If the violation is 310not cleared in fourteen (14) days, the Building and Grounds Committee shall notify the 311Board of Trustees which shall give written notice to the lot owner of its intention to have 312the work done, charging the cost of same to the lot owner.’s account. 313

13 7 14 314 All garbage will be placed at the curb in appropriate metal or hard plastic containers. 315Plastic bags are not acceptable. 316 317SECTION 5 – BEACH COMMITTEE 318 319 The Beach Committee shall consist of a minimum of three members in good standing. 320 321 It shall be the duty of the Beach Committee to take complete charge of the beach. 322This Committee shall be responsible for the maintenance of ropes and other safety 323devices, employment of lifeguards, the maintenance and cleanliness of the beach, and all 324other matters incidental to the proper operation and control of the beach. 325 326 Any and all persons who, by their actions, disregard warnings by the Beach 327Committee or lifeguards or other persons in charge of bathing beaches, shall be 328considered disorderly and subject to suspension of membership and/or police action. 329 330 The Beach Committee or any Trustee in the Chairman’s absence shall, when such 331action is required, make and sign a Toms River Township Police complaint against any 332and all persons, who by their actions violate safety, health and/or general welfare of 333either themselves or others. Intoxication, use of illegal drugs, rowdiness, disorderliness, 334loud, profane and/or indecent language or actions deemed as such by the Beach 335Chairman, shall be considered grounds for police action and/or suspension of 336membership 337 338 Upon determination of the Trustees, buttons, badges or other similar identification 339shall be worn on the person displayed when using any of the beaches or bathing facilities. 340However, no person or persons shall be permitted the use of the above-mentioned 341facilities unless he or she is a member, associate member, or the guest of a member 342thereof. Provisions have been made for people who would like to use our beach who are 343not members or associate members. No automobiles or other vehicles shall be parked in 344or on any of our private roads, streets, or ways of Ocean Beach Shores by any user of the 345beaches or boat basin. Strict enforcement of these rules shall be maintained. 346 347 The primary responsibility of the lifeguards is to provide a safe environment for the 348members, associate members and guests of the Ocean Beach Shores Club. They are to 349enforce the rules imposed by the Beach Committee. 350 351 The lifeguard in attendance shall prevent bathing, swimming or fishing in beach areas 352not designated for such use. 353 354 Since glass, plastic and similar objects are potential safety hazards, only Styrofoam, 355paper containers and aluminum cans will be allowed at the Ocean or bay beaches. 356 357 No glass containers are permitted at any time on the ocean or bay beaches. 358 359 No fires are allowed on either the bay or ocean beaches.

15 8 16 360 361 Removal of sand from any of the Club’s beaches shall not be permitted. Sand 362which has, due to wind or storms, been deposited on lots shall be returned to the beach 363and not removed from the development. 364 365 The walkway to the beach is to be properly delineated. Everyone is advised to use the 366walkway at all times for access to the ocean beach and not to walk to or from the beach 367between beachfront houses. 368 369SECTION 6 – MARINA COMMITTEE 370 371 The Marina Committee shall consist of at least three (3) members in good standing. 372 373 It shall be the duty of the Marina Committee to take complete charge of the Marina. 374The Marina consists of land parcel #6 of the lease dated February 25, 1967, and amended 375May 25, 1968. The Marina Committee shall be responsible for the maintenance, care and 376operation of said grounds. 377 378 The Marina Committee with the approval of the Board of Trustees will determine the 379marina rental fees and any identification that may be deemed necessary. The slips in the 380Marina shall be primarily for the use of members of the Ocean Beach Shores Club. 381 382 Non-members will be permitted only after slips have been offered to the members. 383Length of craft (LOC) shall not exceed 20 feet. Boats with toilet facilities on board shall 384not be permitted to use the Marina at any time. Overnight sleeping on board will not be 385permitted. 386 387 Parking at the Marina is prohibited, except for express use of the renters of the boat 388slips in good standing. Overnight parking is prohibited unless the result of the overnight 389boating event for the assigned slip renter 390 391ARTICLE 6 – VOTING 392 393SECTION 1 394 395 Only regular members of the Club in good standing, or their designee, shall be eligible 396to vote at a regular or special meeting of the Club. A member shall not be considered in 397good standing unless all past dues and special assessments have been paid. The 398eligibility of any member shall be passed on by the president of the Club. Members 399suspended for violations are not permitted to vote until reinstated. 400 401SECTION 2 402 403 (a) Members of the Board of Trustees shall be elected by a plurality of the votes cast 404 by the members of the Club at the annual meeting and such election shall be held 405 by secret ballot. Provision shall be made for voting for members of the Board of

17 9 18 406 Trustees by absentee ballots which will be mailed at least fourteen (14) days in 407 advance and posted on the following website: (www.obscnj.org). Ballots will be 408 sent out only to members who request them at least 15 days prior to the annual 409 meeting. 410 411 (b) Officers of the Board of Trustees shall be elected from among the members of the 412 Board at the first meeting following the annual meeting of the Club. If requested, 413 such meetings shall take place immediately following the annual meeting. 414 415 (c) Trustees and officers shall take office immediately after election and shall serve 416 until their successors are elected. 417 418SECTION 3 419 , 420The regular member voting power shall be as follows: 421 422 (a) To nominate and vote for election of trustees each year. 423 424 (b) To vote for approval of the annual budget after such budget presentation to the 425 Board of Trustees. 426 427 (c) The general membership, when called upon by the Chair, may make 428 recommendations and vote on any matter, provided such voting is not in violation 429 of parliamentary procedure or of these By-Laws. 430 431 (d) The membership may petition or complain to the Trustees 432 433SECTION 4 434 435 No electioneering will be permitted at the polls; however, an oral statement may be 436made by each nominee. 437 438. 439 440ARTICLE 7 – GENERAL MEMBERSHIP MEETINGS 441 442 (a) All meetings of the members shall be held at Ocean Beach Shores or at a nearby 443 easily accessible meeting place arranged for by the Board of Trustees. 444 (b) The meetings of the Ocean Beach Shores Club will be in the Spring and Fall. 445 (c) A quorum for any special meeting or regular meeting of the Club shall consist of 446 15 25 members who are eligible to vote. Husband and wife, or any other joint 447 membership will be considered as one voting member. There will be only one 448 vote per property. Owners or lessees of more than one lot shall have one vote for 449 each such lot owned or leased.

19 10 20 450 (d) Notice of any annual or special meeting of the members of the Club shall be given 451 to the members at his or her address, as the same appears on the records of the 452 Club, at least fourteen (14) days prior to the date of the meeting. 453 (e) Special meetings of the members of the Club may will be called by the president 454 upon the written request of 15 members; upon the request of the Board of 455 Trustees, or by the president at his or her discretion. 456 (f) Membership meetings are mainly for reports to general members by the Trustees 457 and each Committee. Any proposal to the membership shall be made by the 458 elected Trustees after they have approved a given Committee’s report. 459 460 461ARTICLE 8 – BOARD OF TRUSTEES MEETING AND SPECIAL MEETINGS 462 463SECTION 1 464 465 The Board of Trustees shall hold a regular meeting of the Board once each month 466during the months of April to September, inclusive, and at such other times during the 467year as may be deemed necessary by the president. 468 469SECTION 2 470 471 Four members of the Board of Trustees shall constitute a quorum for any regular or 472special Trustees meeting. 473 474ARTICLE 9 – FINANCES 475 476SECTION 1 477 478 Notice of all dues and special assessments as determined by the budget shall be mailed 479to each member annually. 480 481SECTION 2 482 483 The regular membership shall be notified in writing at least fourteen (14) days in 484advance of any regular or special meeting in which membership approval would be 485requested for a special assessment. Such notice shall indicate the amount of dollars the 486special assessment will require for each lot owner or lessee and the purpose for which the 487special assessment would be used. 488 489SECTION 3 490 491 All payments of dues and special assessments shall be made payable to Ocean Beach 492Shores Club and sent to the treasurer.

21 11 22 493SECTION 4 494 495 The Trustees will submit the budget to the membership at the annual Fall meeting. 496The budget must be submitted to the membership at least fourteen (14) days in advance 497of the annual meeting. The bank balance of the Club in any account will not exceed the 498amount recommended by the Board of Trustees and approved by the voting members at a 499regular meeting. 500 501SECTION 5 502 503 Except for the contingency fund, any unbudgeted expenditure in excess of $500.00 to 504be made by the Board of Trustees shall first be voted on and approved by a majority vote 505at a special or regular meeting of the members of the Club. An exception is the fixed 506beach lease obligations which shall be paid according to the terms of the lease and not 507subject to a majority membership vote. 508 509SECTION 6 510 511 The purpose of the Contingency fund is to develop a reserve for the repair of Club 512roads and Club leased property. Any unbudgeted and extraordinary expenditure will be 513limited to $250.00 except in a catastrophic situation such as a road collapse, or ocean 514break-through, when the limit does not apply. Estimates will be requested by registered 515mail, return receipt from two or more contractors when time permits. 516 517SECTION 7 518 519 The dues and special assessments made by the Board of Trustees and collected from 520members of the Club shall not be used for any social activities of the community or the 521Club. 522 523SECTION 8 7 524 525 Associate members will be required to pay a special fee for the use of the Club 526facilities, the amount will be determined at the Fall meeting of the Club. Owners are 527responsible for any fees not paid by associate members (renters). 528 529ARTICLE 10 – AUDIT AND FISCAL YEAR FINANCIAL REVIEW 530 531SECTION 1 532 533 The Board of Trustees shall annually appoint may retain an accountant to audit review 534the books of this Club annually. Upon request a copy of the review will be made 535available to members.

23 12 24 536SECTION 2 537 538 The fiscal year of the Club shall be January 1 to December 31. 539 540ARTICLE 11 – RULES AND REGULATIONS 541 542SECTION 1 543 544 Failure to file for Ocean Beach Shores Club approval of plans for building alterations, 545additions or installation of storage boxes or sheds will result in penalties of up to 546$1,000.00 for each year that such infractions may exist. Failure to pay the fine will result 547in having a lien placed on the property. 548 549SECTION 2 550 551 The roadways, Ocean Road and Ocean Bay Boulevard, shall be used as private roads. 552 553 All parking of automobiles, other than temporary parking by trucks and other vehicles 554while making deliveries and/or repairs shall be prohibited in these roadways. 555 556 Limited parking under the control of the Ocean Beach Shores Club at the bay bathing 557beach and at the northbound state highway location, designated by the Developers, shall 558however, be permitted as long as Club issued parking permits are displayed in the front 559windshield. 560 561SECTION 3 562 563 Only solicitors approved by the Board of Trustees shall be permitted. 564 565SECTION 4 566 567 No excessive noise is permitted at any time. 568 569 Major construction work or alteration work is permitted between Labor Day and June 57015 between the hours of 8:00 a.m. – 8:00 p.m. Painting, plumbing or other work, when 571not noxious or noisy, may be exempt from this rule, but under no circumstances shall any 572work be done after 11:00 p.m. of any day. 573 574SECTION 5 575 576 (a) Pets are not permitted on the beach during normal beach hours. from May 15th 577 through September 15th. 578 (b) Pets are not permitted to run loose anywhere in Ocean Beach Shores and are to be 579 leashed at all times. 580 (c) Where possible pets are to be walked and curbed on the member’s property. 581 When a member walks his pet on Club property the pet must be leashed and the

25 13 26 582 member must carry, and use an appropriate “pooper scooper”. Toms River 583 Township Ordinance 4 #3.76 requires all dogs to be on a leash except when dog is 584 on an owner‘s property. ($500.00 Fine) 585 (d) Associate members are not permitted pets, unless given special permission from 586 the homeowner. 587 588SECTION 6 589 590 Unauthorized ball playing on beaches is prohibited during normal beach hours. 591 592SECTION 7 593 594 Mopeds, motorbikes, minibikes, scooters, ATV’s and unregistered vehicles are 595prohibited from Club roads, and parking areas, or beach unless special written permission 596has been granted by the Trustees. 597 598 No motorized boats or motorized personal water vehicles can shall be launched from 599Ocean Beach Shores Club beaches. 600 601SECTION 8 602 603 Nothing in the By-Laws, rules, and regulations is intended to violate local, New Jersey 604or Federal laws and anything therein contained contrary shall be disregarded. 605 606SECTION 9 607 608 Approved and recognized standard manuals on practice and procedure shall be the 609authority on all questions of parliamentary law and proceedings.
