 Approve a Resolution to adopt the Bucks County 2016 Hazard Mitigation Plan as the official Hazard Mitigation Plan of Newtown Borough.  Public Meeting at the Chancellor Center to discuss parking kiosks on October 17, 2016 at 5:30 P.M.

Certificates of Appropriateness – Robert King

 Approve the recommendation of the Historic Architectural Review Board and direct President of Council to sign the following Certificates of Appropriateness, thereby approving the historical appropriateness of the application, with final approval by the Code Enforcement Officer.

COA 2016-038-H Applicants: Susan & Timothy Markey, 15 Liberty Street, residence

The applicant is seeking a Certificate of Appropriateness for the addition of a railing to the front porch steps of the home. HARB recommends approval of the application, as presented.

COA 2016-041-H Applicants: Bill & Linda Heinemann, 35 N. Chancellor Street, residence The applicant is seeking a Certificate of Appropriateness for the replacement of columns and the addition of railings to the front porch of the home. Homeowner Linda Heinemann was present. HARB recommends approval of the application, as presented.

COA 2016-042-H Applicant: Zaveta Custom Homes, 189 N. Chancellor Street, Hayden residence

The applicant is seeking a Certificate of Appropriateness for the installation of fences, one metal and one cedar, the construction of a pergola, and the installation of light fixtures for the garage door and front doors. HARB recommends approval of the application, as presented.

COA2016-037-H Applicants: Chris & Donna Gusty, 252 S. State Street, residence

Council Agenda October 11, 2016 Pg. #2 of #5 The applicant is seeking a Certificate of Appropriateness for the replacement of a roof on a commercial accessory structure. HARB recommends approval of the application, as presented, with the stipulation that the architectural shingles used will simulate the existing wood shingle roof.

COA 2016-039-H Applicant: Maryanne Bennett, 140 N. State Street, residence

The applicant is seeking a Certificate of Appropriateness for the replacement of storm windows and storm doors on the home. HARB recommends approval of the application, as presented, noting that the front door storm will be replaced in kind. Ms. Dinneen seconded the motion, which was unanimously approved by the Board.

COA 2016-040-H Applicants: Terrance & Philomena Carroll, 109 S. Chancellor Street, residence

The applicant is seeking a Certificate of Appropriateness for the replacement of a roof, siding and mansard on the home. The Board considered the application in relation to Ordinance No. 594 of the Borough of Newtown Code and The Secretary of the Interior’s Standards for the Treatment of Historic Properties, (1995), page 61. Ms. Ehrler said that the building was not an historic structure, constructed after the period of significance for the district. She noted that she had spoken with the applicant and indicated that vinyl siding, proposed for the home, has not been previously approved in the historic district. She informed the applicant that cement board siding had been approved for additions in the district but not vinyl. She said that two different roofing shingles were proposed, composite cedar shingle simulating cedar shingles for the mansard and asphalt shingles for the lower slope and gable; the shingles were different in texture. Mr. Hutchinson noted that vinyl siding and composite roofing shingles have not been previously approved in the historic district by HARB. Mrs. Carroll said that the house was constructed in the 70’s and that the existing siding is asbestos. Mr. Hutchinson said that Hardiboard siding, which has been approved, would be an acceptable replacement. Mrs. Carroll said that they had been quoted a price for cementitious siding that was twice the cost of vinyl siding. Ms. Brown said that cost is not necessarily considered in decisions by HARB. Mr. McAuliffe said that HARB needs to be consistent in their approvals relative to materials. Mrs. Carroll said that they wanted to use a different roofing material on the mansard; they felt that since the house set low to the street, it looked like “all roof”. Mr. Hutchinson suggested that the mansard be asphalt, which would be a replacement in kind, and recommended that the siding be Hardiplank or wood.

Council Agenda October 11, 2016 Pg. #3 of #5 Mrs. Carroll said that consideration should be given to the age of the house when reviewing acceptable materials, approving materials that were characteristic to the date at which the house had been built. She said that it was unfortunate when requirements for work on homes in the Borough contributed to the high cost of living in the Borough. Ms. Brown advised that the applicant could appeal the HARB finding to the Borough Council at their next meeting; date and time as noted by the Chair at the start of the meeting. Mr. Sauer made a motion to recommend denial of the application for vinyl siding and vinyl roofing, as presented, recommending that the existing asphalt roof be replaced in kind, which does not require further HARB consideration, and that the existing asbestos siding be replaced with smooth Hardiplank siding. Ms. Dinneen seconded the motion, which was unanimously approved by the Board. Rich Zaveta, a builder in the audience, suggested that there is a cementitious siding that is available, factory colored and with a 15-year warranty, at a price slightly higher than vinyl, that the applicant might investigate.
