Minutes of a Regular Meeting of Council of the Corporation of the Township of Pelee held at the Royal Canadian Legion Hall on September 21, 2015

1.) Agenda

The agenda was presented for adoption, with the following addition under:

6. a.) Resolution for Tax Write Offs

2.) Minutes a.) The minutes for the Regular Meeting of Council for August 24, 2015 were presented and adopted, with a correction under 6.c.) Water Rates Report, clarifying that Deputy Mayor DeLellis did not think a $64 delivery charge was reasonable.

3.) Disclosure of Pecuniary Interest

Councillor Letkeman declared a conflict with Finnbilt payments under Disbursements.

4.) Petitions and Delegations

a.) Windsor Essex County Health Unit-Smoke Free By-Laws

Mr. Nadalin began the presentation along with Ms. McBeth; Mr. Nadalin went on to highlight areas of the Smoke Free Ontario Act and the new areas of legislation. Mr. Nadalin also highlighted restrictions on e-cigarettes. Mr. Nadalin stated that there are currently 139 municipal by-laws enforcing the Smoke Free Ontario act; as well as 6 local municipalities that have recently passed by-laws. He then gave examples of County by-laws and areas of restriction. Ms. McBeth stated that prohibitions and distances around buildings are legislated in the Smoke Free Ontario Act. Ms. McBeth stated that Pelee may want to look at municipal campgrounds, boat docks and marinas, as well as beaches, parks and recreation areas. Ms. McBeth also highlighted some products that are not municipally prohibited such as e-cigarettes and smokeless tobacco. Ms. McBeth spoke about integrating legislation and signage and gave examples of some possible infractions. She also commented on the role of WECHU such as surveillance for big evets and investigating complaints. Ms. McBeth then opened up the floor for questions. Councillor Letkeman asked why smoking cannot just be banned, Ms. McBeth stated it cannot be completely banned but it is a way to help denormalize tobacco use and better educate children. Ms. McBeth stated that this presentation was to make people aware of legislation and that a by-law would assist in providing clarity and additional protection. Mayor Masse stated that this was a provincial issue, not a municipal issue and that he did not believe that the community could monitor and enforce the legislation. Further discussion continued on by-law possibilities and enforcement on the Island.

Mayor Masse asked if any councillors wanted to support moving forward with the by-law. Councillor Malloch stated that at this time he didn’t believe that the Island currently had the resources to enforce this by-law. Mayor Masse thanked Mr. Nadalin and Ms. McBeth but stated at this time no one was in support of moving forward with a by-law.

5.) Old Business

a.) Marina Manager-Seasonal and Transient Dockage Rates

Charlene Malloch addressed a letter that was sent to the Marina asking if transient dockage rates could be capped at a seasonal rate because there was not a seasonal slip available to the customer. Mrs. Malloch stated that there were still people on the waiting list that had to be accommodated. She stated concerns that people may just leave their boat for the season knowing that a seasonal rate is available and using a slip that could be rented to someone else. Mayor Masse stated he did not agree with giving up transient slips. Councillor Letkeman asked how many were still on list. Mrs. Malloch responded that 15 boaters that want power were still on the list. Charlene Malloch stated 55 of the 105 docks were seasonal. Deputy Mayor DeLellis asked if there could be a quote for electrical on the east dock. Councillor Letkeman suggested offering Mr. Williams half the transient dockage rate after he reaches the seasonal cap. Discussion continued on electrical use and accommodating the waiting list with larger boats.

Councillor Letkeman suggested that for those who have slips and don’t use them consistently, their docks could be subletted to those that need it. Mrs. Malloch stated it is in their contract, that if they are not in for 48 hours, their slip can be rented out. Discussion continued on possible solutions. Councillor Malloch stated that people should be treated equally to avoid showing favoritism. Mayor Masse agreed that for now Mr. Williams should continue to pay the transient dockage rates. Deputy Mayor DeLellis suggested offering a non-power slip as a seasonal slip until a powered dock is available. Mayor Masse stated it could cause a problem if someone is higher on the waiting list. Mayor Masse asked administration to write a letter of response denying his request. Councillor Malloch supported directing administration to respond that the Marina cannot honour his request and to explain the reasoning behind the decision.

a.) Pelee Island Public School Hunt License Request

The following Resolution was passed:

“Be it Resolved that the Council of the Corporation of the Township of Pelee hereby agrees to donate three pheasant hunt licenses to the Pelee Island Public School for its annual raffle”.

8.) Disbursements

The Mayor presented disbursements to Council.

Deputy Mayor DeLellis inquired about payment 181 to Kal Tire and what the invoice included. The Deputy Clerk said she would forward the invoice to Council for review.

9.) Boards and Committees

(a) Economic Development Advisory Committee Meeting Minutes: August 13, 2015

Deputy Mayor DeLellis highlighted some of the efforts of the EDAC and commented on the surveys that were sent out, but that the response was lacking from the business side. He stated that they were planning for the CIP and determining what could be accomplished for presentation at the next Council meeting.

Carried. 10.) Councillor and Miscellaneous Reports

a.) Deputy Mayor DeLellis- Federal Conservative Party Member

Deputy Mayor DeLellis stated that Ken Van Kesteren, a Conservative federal MP candidate would be coming to the Island. Deputy Mayor DeLellis commented that he would be taking him around the Island and brining him up to speed on federal needs. Mayor Masse stated it was critically important to address the North Dock divestiture and that it should be offloaded up to standards or that there should be funds available to allow it to be brought up to standard. Mayor

Masse also stated that Blue Green Algae should be addressed and that the province is spending a lot of resources and the federal government should be contributing to a solution. Mayor Masse also suggested speaking on shoreline protection, as well as the difficulty in applying for federal grants because the requirements restrict Pelee from qualifying. Councillor Malloch brought up the leasing issue for the federal portion of the dock and discussion continued on what is happening with Transport Canada and the divestiture. The CAO stated that the Department of Fisheries and Oceans is trying to work with Transport Canad. Further discussion continued on the dock divestiture and ownership.

b.) Deputy Mayor DeLellis-PITSAC

Deputy Mayor DeLellis stated that MTO gave an update on the new boat, and that it seemed to be on track. Deputy Mayor DeLellis commented that MTO asked Kingsville, Leamington and Pelee to come together to plan and suggest what should be on the new boat. He further stated that the Islander was going to dry dock in 2017 and the Jiimaan in 2018, with new boat in spring of 2018 to

Deputy Mayor DeLellis highlighted some of the suggestions discussed at the meeting including, better communication with the ridership and an electronic sign at the terminals to warn of changed departures and cancelled boats. Deputy Mayor DeLellis also stated that MTO and OSTC wanted to come and talk to the Transportation Committee to discuss parameters to work within for scheduling going forward.

c.) Mayor Masse-Regional Director MNRF

Mayor Masse stated that the Regional Director from MNRF would be coming to Pelee next week to do a tour and hear about the challenges of completing projects on Pelee. He also stated that they were requesting a work program, especially on the canal system to work ahead for permits. The CAO responded that the Drainage Committee would come up with a work plan before the end of next year.

d.) Mayor-Regional Destination Marketing

Mayor Masse stated that the Southwestern Tourism Corporation and Tourism Windsor Essex Pelee Island representatives would be coming over this week for a discussion concerning how to work together, improve transportation and do a tri-community marketing plan.

(a) By-Law 2015-40; being a By-Law to Appoint a CEMC
