ADMINISTRATIVE MEMORANDUM CIV 13-A

IN RE: SUBMISSION OF SERVICE LISTS IN RESIDENTIAL MORTGAGE FORECLOSURE CASES

In accordance with the provisions of Administrative Memorandum 12-D, plaintiffs in residential mortgage foreclosure cases were required to submit updated service lists and envelopes in pending cases filed in 2011 and in prior years. Due to less than full compliance with this requirement, the Court has chosen to revise these procedures.

NOW, THEREFORE, pursuant to the authority vested in me as Administrative Judge of the Circuit Civil Division in the Eleventh Judicial Circuit of Florida, under Rule 2.215, Florida Rules of Judicial Administration, the following requirements are implemented to effectively manage the backlog of residential mortgage foreclosure cases:

1. Plaintiff shall identify all open foreclosure cases in which the firm acts as Plaintiff’s counsel of record and provide the following: (a) A cover letter identifying the case number and style; (b) A current, accurate service list, including Plaintiff’s counsel (mailing and e-mail, addresses, as applicable; (c) Pre-addressed, postage paid mailing envelopes for the entire service list, with the case number referenced on the face of the envelope.

2. Plaintiff shall provide the items in Section 1 above as follows: (a) The deadline for submission for Cases filed in 2010 and earlier is 2/15/13; (b) The deadline for submission for Cases filed in 2011 and 2012 is 2/25/13.

3. Plaintiff shall deliver the required items in Section 1 to Room 900 of the Miami Dade County Courthouse located at 73 West Flagler Street, Miami, Florida 33130. (a) Please deliver these items within the applicable time frames; (b) Early submissions are encouraged and will be accepted. Please do not hold these items until the deadline to deliver your entire set; deliver these items as soon as they are ready.

1 4. In addition to the foregoing, Plaintiff shall file with the Clerk of the Courts its updated Notice of Filing Updated Service List.

5. This is the Second Order requiring stamped envelopes and service lists. There was some noncompliance with the initial order. Any plaintiff/firm which elects not to comply risks a determination that it has abandoned its cause of action and, as a consequence, sanctions which may include dismissal of its case. Compliance is not optional.

6. Failure to comply with the foregoing requirements will result in the imposition of sanctions, including a contempt hearing before the Administrative Judge.

7. The time deadlines imposed by this Administrative Memorandum supersede those proscribed by Administrative Memorandum 12-D to the extent that they conflict. All other provisions of Administrative Memorandum 12-D remain in full force and effect.

This Administrative Memorandum shall take effect immediately and shall remain in effect until further order of the Court.
