CHANGE OF EMPLOYMENT STATUS

RESOLUTIONS Resolution in support of application by the City of Charleston for a Justice Assistance Grant (Funding for City of Charleston Police and Kanawha County Sheriff’s Department) Jennifer Herrald, Grant Coordinator/Executive Assistant to the County Manager Ms. Herrald stated that this grant would be a 2-year grant for $35,000 to each the Charleston Police Department and the Kanawha County Sheriff’s Department with no match required. Commissioner Shores moved approval. Commissioner Hardy seconded. Motion carried.

FIDUCIARY Update discussion regarding the Estate of William Jack King Objections and Exceptions, Estate of William Jack King Order Confirming and Ratifying Supervisor’s Report of Claims and Settlement Reports, Estate of William Jack King Ray Keener, Fiduciary Supervisor Marc Slotnick, County Attorney The Estate of William Jack King was represented in the discussion by Robert R. Rodecker, attorney for the Estate of William Jack King and Suzanne King as power of attorney for Eddie King. Motion was made by Commissioner Carper to hold a special meeting prior to the end of March if the parties involved cannot agree to terms through meditation with a binding agreement by next week with the proviso that the special meeting would be set at the convenience of the other two Commissioners in addition to a requirement that Mr. Rodecker be in town. Commissioner Hardy seconded. Motion carried.

ORDERS Order appointing David W. AGENDA ITEMS Update regarding London fire hydrants to include, but not be limited to, level of commitment from the West Virginia American Water Company Commissioner Hardy Susan Blake, Planning Director Mark Sankoff of West Virginia American Water stated that they can not justify a $250,000 project contribution for approximately 5 fire hydrants in the London area at this time. The Commission unanimously agreed.

ORDERS  Order authorizing the Clerk of the County Commission to issue a check in the amount of Twenty Thousand Dollars ($20,000.00) from Line Item #002-439.00-800-5-68.00 (Coal Severance) to the Loudendale Civic Improvement Group David Fontalbert, Deputy County Manager/Comptroller A representative from the Loudondale Civic Improvement Group stated $20,000.00 was needed to complete the building. The group has committed to allowing the County Clerk to use the building as a handicapped accessible polling place. Commissioner Hardy made the motion. Commission Shores seconded. Motion carried.

MINUTES FOR MEETING MARCH 2, 2006 4/5/2018 1:30 下午 Page 4 of 16 AGENDA ITEMS Presentation of Year End Report for all Divisions of the Sheriff’s Department Commissioner Carper The Honorable Mike Rutherford, Sheriff Sheriff Mike Rutherford gave a lengthy report on his 2005 Annual Department Overview a copy of which is hereto attached.

Budget and Funding Presentation – Kanawha Dental Health Council Commissioner Carper Representative(s) of Dental Health Council Commissioner Carper inquired as to how much money the Board of Education contributed to the group. Lisa Moore, Executive Director Kanawha Dental Health Council stated that the Board of Education contributes $30,000 cash plus the in kind contribution of office space and utilities. Ms. Moore further stated that her group was a private non-profit group that provides services to the children of Kanawha County whether they are in a county school, home school or private school. The Dental Health Council buses children to the seven clinics with Board of Education buses and drivers. The four school Dental Health Educators, Board Chairman, Steve Weber, and Dr. Gateley, Kanawha-Charleston Health Department attended the meeting in support of the continued funding. Commissioner Hardy suggested that Ms. Moore prorate how much of time that is spent in Coal Severance eligible areas to allow the commission to use those funds to support the program or possibly merge with the Kanawha-Charleston Health Department. Ms. Moore stated that she would be happy to exhaust all potential funding possibilities. The Commission agreed that this was a wonderful program and that they would put it down as one of the budget items and take a hard look at it; however the school board is going to have to come forward with additional financial support.

Discussion regarding 2006 Court Security Grant Application with a deadline of March 24, 2006 Commissioner Carper Jennifer Herrald, Grant Coordinator/Executive Assistant to the County Manager Ms. Herrald stated that the application for the $162,263 grant would be with the State from the Court Security Fund with no match required. The grant application is solely for new equipment. Commissioner Carper made a motion to apply for the grant. Commissioner Shores seconded. Motion Carried.

Discussion of accounting reconciliations and timeliness of responses provided to independent outside auditors and Commission staff from the County Clerk’s Accounting Department Commissioner Hardy Brent Pauley, County Manager David Fontalbert, Deputy County Manager/Comptroller The Honorable Vera McCormick, Clerk of the County Commission Commissioner Hardy addressed Mrs. McCormick with concerns he had due to conversations he had with Mr. Adams of Gibbons and Kawash during the audit interview process. The auditors had concerns with the disconnect between the Commission and County Clerk’s accounting financial teams. Commissioner Carper and Mrs. McCormick both stated that this issue was not brought up in their respective interviews. The auditors were requested to be at the meeting tonight however they were too busy to attend. Mrs. McCormick did place a call to Mr. Adams when she could not reach Commissioner Hardy upon seeing this issue on the agenda for this evening in an attempt to gain additional information as to the issues at hand. Mr. Adams stated that he does not remember making any such reference indicating an issue. Commissioner Hardy and Mrs. McCormick agreed that everyone in both groups are working for the taxpayers of Kanawha County and each team has been instructed to have a positive attitude and work together. Mrs. McCormick and Commissioner Hardy agreed that each would contact Mr. Adams and ask if the audit is clean and if we have any issues regarding information or cooperation. In the event Mr. Adams indicates no further issues that will be the end of the matter. Commissioner Carper requested that any tension between the offices be worked out and move forward creating a better work relationship and starting anew.

Discussion regarding the West Virginia Supreme Court’s denial of the Clifford appeal Commissioner Carper Marc Slotnick, County Attorney Commissioner Carper stated that the Clifford appeal was denied by the West Virginia State Supreme Court and our attorney will be submitting our final bill for that by the next meeting.

MINUTES FOR MEETING MARCH 2, 2006 4/5/2018 1:30 下午 Page 5 of 16 Discussion regarding statutorily required budget meeting for April 18, 2006, 8:30 a.m., to be scheduled for the purpose of receiving comments and/or objections regarding the 2006-2007 Budget Commissioner Carper Marc Slotnick, County Attorney Commissioner Carper acknowledges that this item was placed on the agenda as a requirement which the Commission is fully aware.

Budget Presentation and Discussion – Clerk of the Kanawha County Commission Commissioner Carper The Honorable Vera McCormick, Clerk of the County Commission The County Clerk waived a formal presentation in lieu of submitting written documentation for review by the Commissioners. David Dodd added that the only thing that may be a little off target is the election as this will be the first election with all new equipment and the transportation issues. Commissioner Carper confirmed that the money was moved from the Circuit Clerk’s budget to the County Clerk’s budget as the new laws dictate the responsibilities. Mrs. McCormick stated that she had one vacancy in the current salary line item. Commissioner Carper suggested that she take a hard look at filling that position.

Budget Presentation and Discussion – Kanawha County Prosecutor Commissioner Carper The Honorable William Charnock, Prosecuting Attorney Mr. Charnock respectively requested the same amount of money in FY 2007 as in FY 2006.

Budget Presentation and Discussion – Kanawha County Sheriff Commissioner Carper The Honorable Mike Rutherford, Sheriff Sheriff Rutherford referred to Chief Tax Deputy Allen Bleigh to answer questions regarding the 2007 proposed budget Mr. Bleigh stated that the total budget for all the Sheriff’s departments is 3 million dollars and that they were asking for a total of a 7.46% increase ($650,000) exclusive of vehicles of which 15 are requested in the capitol budget. However, the Sheriff did not request a salary rate increase. Mr. Bleigh submitted written documentation for review. The Commissioners indicated to Sheriff Rutherford that he needed to trim the request as much as possible indicating that they do understand that publication cost, postage and gasoline increases cannot be controlled.

MINUTES FOR MEETING MARCH 2, 2006 4/5/2018 1:30 下午 Page 6 of 16 Budget and Funding Presentation – Kanawha County Parks and Recreation Commissioner Carper Commissioner Shores Commissioner Hardy Representative(s) of Parks and Recreation Jeff Hutchinson, Kanawha County Parks and Recreation Director stated that the current budget is 3.3 million with the County Commission contributing 1.275 million and they respectively requested the same amount for the 2007 year. Mr. Hutchinson stated that the Park and Recreation board will be making a decision on the course of action for the Sandy Brae Golf Course at the March 15, 2006 meeting. Further reporting that the board has had two serious inquiries regarding the property to date. Mr. Hutchinson also reported that the Shawnee Pool has been closed by a unanimous vote of the Park Commission in February.

Designation of Gary W. Morris as Deputy Director of Emergency Services Commissioner Carper Both Dale Petry Director of Emergency Services and Fire Coordinator PJ Johnson agree with Gary W. Morris being named as Deputy Director of Emergency Services. Commissioner Hardy made the motion. Commissioner Shores seconded. Motion carried. Commissioner Carper requested that we send a letter to Mutual Aid in support of Mr. Johnson being named as Kanawha County Fire Coordinator. Commissioner Hardy made the motion to send the letter. Commissioner Shores seconded. Motion carried.

NEW BUSINESS Commissioner Hardy requested that the Commission send a second letter expressing continued support for the Metro Government bill in the legislature. Commissioner Carper seconded. Motion carried.

Update regarding the Kelly’s Creek Communities Association Brownfield Grant Commissioner Carper Commissioner Shores Commissioner Hardy Representative(s) from the Kelly’s Creek Association Commissioner Carper stated that the Kelly’s Creek group did not want to stay for the meeting. However, they were asking for the Commission to support an extension of their grant. There is no downside for the Commission except the caveat being that the group could not say that due to the Commission’s advice they did or did not get the extension. Commissioner Carper moved to authorize the writing of a letter in support of the extension. Commissioner Shores seconded the motion. Motion carried.

Discussion regarding the personal use of county telephones and the use of personal cell phones during working hours Commissioner Carper Brent Pauley, County Manager Commissioner Carper posed the question as to whether the County has a policy on the use of private cell phones during business hours. Mr. Pauley stated that currently we do not have a policy in place. Commissioner asked that Mr. Pauley look at the issue and see if we need a policy and if so report back with a recommendation or state that he does not feel we need a policy at this time.

Discussion regarding the implementation of the new Optical Scan/AutoMark voting system to include, but not be limited to, discussion and update regarding public education plan Commissioner Carper Commissioner Shores Commissioner Hardy The Honorable Vera McCormick, Clerk of the County Commission Brent Pauley, County Manager Mrs. McCormick introduced a prototype of the cage that will hold the new equipment to the Commissioners.

MINUTES FOR MEETING MARCH 2, 2006 4/5/2018 1:30 下午 Page 7 of 16 Discussion regarding the Small Cities Block Grant Demolition and Asbestos Abatement Projects to include an increase in the projected base square footage price due to the use of 2006 Prevailing Wage Rates (Astar $2.34/sq.ft. to $2.49/sq.ft. and Pepper Electric $6.85/sq.ft. to $7.05/sq.ft.) Commissioner Carper Terry Sayre, Deputy Planning Director Jerie Whitehead, Purchasing Director Jennifer Herrald, Grant Coordinator/Executive Assistant to the County Manager Mr. Sayre reported that the grant was bid in 2005 and due to the process, the prevailing wage has increased prior to the award therefore the Commission would need vote to accept the increase. Commissioner Shores moved to accept. Commissioner Carper seconded. Motion carried.

Commissioner Hardy suggested taking a look at the scheduled July 6, 2006 meeting due to it being a holiday week. Commissioner Carper suggested that it be looked at again and voted on at the March 16, 2006 meeting.

Update on County Wellness Program Commissioner Hardy Brent Pauley, County Manager Mr. Pauley gave a quick update on the Program at the request of Commissioner Hardy. Mr. Pauley has asked Susan Dunn, as the program coordinator to expand it to more of a committee by getting representation from each of the elected offices to work with her on it. Mr. Pauley stated that he is looking at several different programs and has scheduled a meeting March 15 with Mountain State Blue Cross/Blue Shield, Be Better Health. Be Better Health has pitched a nutrition class and Brent is also looking at a walk program. Two Yoga classes have been scheduled with a total enrollment of 30 to 32 people enrolled. Commissioner Carper expressed concerns that $1,400.00 of taxpayers money was spent for 15 people when the commission already participates in discounted memberships with the South Charleston Recreation Center and Nautilus which both provide Yoga classes and that the issue was not brought before the commission for a vote.

PUBLIC COMMENT

COUNTY MANAGER’S REPORT Mr. Pauley made an out of state travel request for a educational seminar 2006 Law Enforcement Grant Summit at a cost of roughly $2,500 - $2,800 for Dale Petry, Emergency Operations Supervisor, and Jennifer Herrald, Grant Coordinator/Executive Assistant to the County Manager to attend. Mr. Pauley also suggested inviting the Sheriff to send a representative out of his budget. The Seminar is in Arlington, Virginia. Commissioner Carper confirmed with Mr. Pauley that the money was in the budget.

NAME OLD SALARY PROPOSED SALARY Commissioner Carper requested that the Department Pay Raises items be permanently removed from the standard Agenda.

NEW BUSINESS State of West Virginia Regional Jail & Correction, Commission, $728,809.00 (October and November, 2005) After discussion, motion was made by Commissioner Hardy that only the October portion of this bill be paid. Seconded by Commissioner Shores. Motion carried. The supplemental voucher for the State of West Virginia Regional Jail & Correction in the amount of $728,809.00 was not processed. The County Manager was directed to process an emergency check on Friday, March 3, 2006, for the October portion of the jail costs only.  Loudendale Civic Improvement Group, Commission, $20,000.00 (Coal Severance)  L.L.E.B.G. Federal Grant Fund, Commission, $5,176.00 (from General Fund to cover an overdraft condition occurring when a receipt was deposited to the General Fund in error) Commissioner Hardy moved for approval of the remaining two supplemental vouchers. Commissioner Shores seconded. Motion carried.

AGENDA ITEMS Discussion regarding 2006-2007 Budget to include, but not be limited to, rising fuel and utility costs, current cash projects, projected income for 2006/2007, jail costs, and health care costs Commissioner Carper Commissioner Shores Commissioner Hardy Brent Pauley, County Manager David Fontalbert, Deputy County Manager/Comptroller Mr. Fontalbert stated that we currently have a zero balance currently in the budget for jail fees for this year. Mr. Pauley stated that we are budgeting $4.7 million. Commissioner Carper confirmed that we are now prepared to pay the October and November 2005 approximately $742 thousand dollars asking the other two Commissioners how they wanted to manage it. Commissioner Carper stated three reasons why we are currently over budget (1) delay of arrest to conviction (2) delay in getting paperwork completed (3) increase in number of people being placed in jail. Commissioner Hardy made the motion to pay the October bill only. Commissioner Carper seconded. Motion carried.
