INTRODUCTION Tustin Ranch Sycamore Glen Condominium Association (the “Association”) is a California nonprofit mutual benefit corporation formed to administer, manage and operate the common interest development condominium project known as Tustin Ranch Sycamore Glen (the “Development”). The Association and the Development are subject to certain governing documents (collectively, the “Governing Documents”), including, but not limited to, the Association’s CC&Rs, Bylaws and Articles of Incorporation. These “Rules, Regulations and Restrictions” are also a Governing Document of the Association, and have been adopted pursuant to the Association’s Bylaws and CC&Rs and in accordance with Section 4340 et seq. of the California Civil Code. The Association, through the Association’s Board of Directors (the “Board” or “Board of Directors”), has adopted these Rules, Regulations and Restrictions to provide certain standards for behavior and conduct within the Development and to reiterate certain rights and responsibilities of owners, residents and their guests under the Governing Documents. These Rules, Regulations and Restrictions are intended to be consistent with both the Governing Documents and applicable state and federal laws. To the extent there is any conflict between these Rules, Regulations and Restrictions and the Governing Documents and/or the law, the Governing Documents and/or applicable law will control. Unless otherwise provided in these Rules, Regulations and Restrictions, all capitalized terms used herein have the same meanings as in the CC&Rs. The use and enjoyment of the Development by owners, residents and their guests shall be subject to the provisions of these Rules, Regulations and Restrictions and the Association’s other Governing Documents. Each person residing in or visiting the Development shall be required to comply with the provisions of these Rules, Regulations and Restrictions. An owner who violates these Rules, Regulations and Restrictions, or whose family members, cohabitants, tenants, guests, contractors or invitees violate these Rules, Regulations and Restrictions, shall be subject to enforcement action in the event of such violation. These Rules, Regulations and Restrictions do not address all use and other restrictions and obligations to which owners, residents and their guest are bound under the Governing Documents. The CC&Rs, Bylaws and other stand-alone rules/policies contain restrictions and guidelines relating to elections, collection of delinquent assessments, dispute resolution procedures, easement rights, architectural and design control, maintenance and repair responsibilities, liability for unit and common area damage, and insurance requirements, among other issues.

Installation or replacement of the following items and any other items required to be approved by the CC&Rs, must first be approved by the Architectural Review Committee: garage doors, windows, any street facing light fixture, front door and or screen/security doors. 1.2. From the date of adoption of these Rules, Regulations and Restrictions and at all times going forward, Owners, must, if so requested by the Board of Directors, be able to provide evidence of an approved Architectural Approval Request Form for all external alterations made to their Unit. Failure to provide an approved form will require the owner to rectify the issue at their own expense. This requirement shall not apply to architectural approvals and modifications made prior to the date of adoption of these Rules, Regulations and Restrictions. 1.3. Door knockers, name plates, additional street numbers etc., may not be attached to the front door or any part of the exterior of the building without the prior written approval of the Architectural Review Committee. 1.4. No furniture is permitted on porches without the prior written approval of the Architectural Review Committee. 1.5. All other items on a Unit's front porch are subject to the Association’s architectural guidelines and the prior written approval of the Architectural Review Committee. 1.6. Exterior lights bulbs are to be white only and no brighter than sixty (60) watts. 1.7. Door mats may be no larger than 24 x 36 inches. They must be bound (no ragged edge carpet remnants are allowed). They may not be attached to the concrete. Colors must conform to the Association’s current, existing color scheme. 1.8. The review and approval of an owner’s proposed plans and specifications for proposed improvements, alterations and additions will be subject to the architectural review provisions of Article IV of the Association’s CC&Rs, applicable provisions of Article VIII of the CC&Rs, and any other architectural control procedures adopted by the Association.

2. COMMON AREAS AND GENERAL RULES 2.1. No hoses, barbecues, toys, bicycles, personal property, etc. may be stored on common areas. This includes, without limitation, in or on the front porches and their walkways. 2.2. Skates, skateboards, roller blades, bicycles, tricycles, and other wheeled toys are prohibited in the pool/spa area and on lawns and landscaped areas. 2.3. Climbing is not permitted on the walls, buildings, fences and trees. 2.4. If a garage floor is painted any color other than gray, then the strip at the edge of the garage door is to be painted gray in order to conform with the surrounding Units. No paint of any color is to show when the garage door is closed. 2.5. No CB or radio antennas are permitted to be attached to the external/Common Area surface of any Unit.

Any air-conditioning unit that is situated on any Common Area or on the exterior surface of a Unit must be enclosed with an Association approved enclosure approved in writing by the Architectural Review Committee and, at the sole expense of the owner, must be kept in good structural condition at all times. 3. EXCLUSIVE USE COMMON AREA - BACKYARDS 3.1. It shall be the duty of each owner, at their sole expense, to keep their backyard free from debris and maintained in a good state of repair. 3.2. It shall be the duty of each owner, at their sole expense, to keep their backyard vegetation neat and tidy at all times. No backyard vegetation may be attached to any external surfaces of the Unit. 3.3. All vegetation must be well manicured, disease free and maintained in a manner that is not conducive to the breeding of any type of pests or organisms. 3.4. No clotheslines or hanging laundry, towels, etc. are permitted on any fence or wall. 3.5. No storage units or sheds of any kind are to be present in backyard areas which are visible from any Common Area. Backyards are not to be used for a workshop area. 3.6. No plants or pots may be placed on any part of a fence or wall, where watering or excess water drainage may damage any part of the fence or wall. 3.7. Any watering system must be maintained in a good working state, whereas not to cause damage to any part of the Unit, fence or external wall. Any damage caused by such systems will, after a properly noticed hearing before the Board, be repaired by the Association at the cost of the owner. 3.8. Nothing may be attached to the exterior of any building unless it wholly conforms with the architectural guidelines and has first been approved in writing by the Architectural Review Committee. 3.9. The Board of Directors, or a representative of the Association designated by the Board, has the right, upon reasonable notice and subject to any Governing Document requirements, to inspect any backyard area, and in its sole discretion shall determine an acceptable condition of maintenance in accordance with these Rules, Regulations and Restrictions and any other Governing Document.

4. HOLIDAY DECORATIONS 4.1. Holiday and seasonal decorations are permitted from Thanksgiving until January 10th as long as they are properly secured. All lights must be UL approved outdoor lights. 4.2. Decorations for other holidays are permitted for a period of thirty (30) days before and thirty (30) days after the holiday.

5. LANDSCAPING 5.1. No plants potted or otherwise, shall be placed in or on the common area landscape.

All plants which are on front porches and walkways may not be in original nursery containers. Dead plants and damaged containers must be removed promptly. 5.3. Notwithstanding any rules contained herein or any requirements of the CC&Rs, all owners shall be required to comply with any state or local law or regulation pertaining to water conservation or drought conditions.

All owners who lease or rent their Unit must provide the Association with (i) a completed Tenant Information Form and (ii) a completed Tenant Rules and Governing Document Acknowledgement Form. Copies of each form must be sent to the Association's Management Company within fifteen (15) days of the tenant taking occupancy of the Unit. Failure to comply with this provision will result in disciplinary action against the owner after a noticed hearing before the Board of Directors.

7. MOPEDS & MOTORCYCLES 7.1. No mopeds or motorcycles, or other like motorized vehicles, may be stored or parked on patios, entryways, or walkways. Mopeds and motorcycles are to be parked in an authorized parking area or within the resident's garage. 7.2. Mopeds or Motorcycles, or other like motorized vehicles, parked within the resident's garage does not waive a resident’s duty to comply with any requirements set forth in Article VIII, Section 8.02 of the CC&Rs, which governs parking requirements within the Development.

8. NON-EMERGENCY VEHICLES 8.1. Any non–emergency vehicle parked in a marked fire lane, adjacent to a red curb, within fifteen (15) feet of a fire hydrant or on a corner, or in a manner which interferes with any entrance or exit in the Association, is subject to immediate towing at the vehicle owner's expense in accordance with California Vehicle Code Section 22658.

9. NUISANCES 9.1. No owner shall permit anything to be done or kept within the owner's Unit and/or the owner's Exclusive Use Common Area that shall under fair and reasonable judgment by the Board of Directors be constituted as a nuisance. The following is a non-exhaustive list of nuisances: 9.2. Loud noises or noises of a repetitive nature including but not limited to horns, whistles, bells, noisy vehicles or motorcycles, power tools, appliances, entertainment systems, unreasonably loud or repetitive musical instruments, yelling and/or dog barking, that may unreasonably interfere with any owner's peaceful possession and quiet enjoyment of their Unit, Exclusive Use Common Area, or use of the Common Area generally. Owners will be expected to attempt to handle such disputes reasonably and peacefully prior to seeking any investigation by the Board. 9.3. Noxious or offensive odors, such as, for example only, smoke, garbage and/or animal waste/odors that can be smelled in or which can emanate to any portion of the Development. Owners will be expected to attempt to handle such disputes reasonably and peacefully prior to seeking any investigation by the Board.

Lighting placed or maintained in or on a Unit or any Exclusive Use Common Area that causes an unreasonable glare or illumination upon or into any other Unit, Exclusive Use Common Area, or to the Common Area 9.5. Except as otherwise permitted by law and/or for medical purposes, any activities involving the storage or use of chemicals, biohazard materials (e.g. blood, infectious agents, etc.) or other items that may be or become a health and safety concern for any resident in any Unit. 9.6. The use or presence of any items which may unreasonably interfere with television and/or radio reception in any Unit. 9.7. Any activity which may increase the rate of insurance on any Unit or the Common Area, and/or result in the reduction or cancellation of such insurance. 9.8. The violation of any local, state or federal governmental agency or governmental authority requirements with respect to the occupancy and use of a Unit, Exclusive Use Common Area or the Common Area. 9.9. The commission of criminal activity within any Unit or upon any portion of the Common Area or any Exclusive Use Common Area, such as, without limitation, illegal drug use, theft, vandalism or trespass.

10.PARKING 10.1. Parking is only permitted in full size driveways and authorized parking areas only. 10.2. Parking is permitted in front of garages that do not have full size driveways, for the sole purpose of active loading and unloading of the resident's vehicle. Any vehicle that remains in front of a garage for an extended period of time or overnight will be subject to towing at the vehicle owner's expense in accordance with the CC&Rs and the California Vehicle Code. 10.3. No resident shall park or store anywhere in the Development, or in an area that is visible other than when a garage door is open, any vehicle that is unregistered or not driven on a regular basis. 10.4. No resident with a full size driveway shall use any authorized parking area until the resident’s garage or driveway has first been fully utilized for parking. 10.5. Recreational vehicles may only be parked on a full size driveway by a guest of any Owner for a period not in excess of forty-eight (48) hours, and by the Owner for the sole and express purpose of loading or unloading, but not in excess of any six (6) hour period in any day. 10.6. All residents as required by Article VIII, Section 8.02 (Parking and Vehicular Restrictions) of the CC&R's must park one (1) vehicle in their garage. 10.7. Garage doors are to remain closed at all times when garage entrances are not actively being used.

11.PATIO COVERS

All patio covers, at the sole expense of the owner, must be kept in good structural condition at all times. 11.2. Patio covers may only be painted a color that matches the Association's existing color scheme. 11.3. Patio covers must remain free from obstruction and unenclosed at all times. 11.4. Any sunshade attached to a patio cover must be professionally made and be retracted when not in use.

12.PETS 12.1. All dogs and cats must wear appropriate identification at all times when outdoors. 12.2. Pet owners are required to pick up their pet's waste and dispose of it in a sanitary manner. 12.3. Pet owners will be held responsible for any damages or nuisances caused by their pets. 12.4. All pets are to be confined to the inside of the residence and patio area and are not permitted outside unless under restraint. No Owner of a pet shall permit, allow, or cause the pet to run, stray, or be uncontrolled in or upon the Common Area. 13.POOL AND SPA 13.1. The Pool/Spa areas will be open Sunday through Thursday from 6:00 a.m. to 10:00 p.m. and on Friday and Saturday from 6:00 a.m. to 12:00 a.m. No excessive noise is permitted, particularly before 8:00 a.m. and after 10:00 p.m., including loud talking or laughter or noise that would disturb and/or cause a nuisance to nearby residents. 13.2. Use of the Pool/Spa or any of the property appurtenant to the Pool/Spa outside the posted hours of operation will constitute trespassing, punishable by applicable law including, but not limited to, applicable provisions of the California Penal Code. 13.3. All persons using the Pool/Spa do so at their own risk. The Association assumes no responsibility for any accident or injury in connection with such use, or for any loss or damage personal property. 13.4. Children under fourteen (14) years of age must be accompanied by a responsible adult when in the Pool/Spa area. 13.5. Guests may only use the Pool/Spa upon invitation of a resident and must present a pool key or access card upon request when present in the Pool/Spa area without a resident. Residents must use good judgment in the number of guests using the Pool/Spa area at any time. Residents will be responsible for all conduct and behavior of their guests including, without limitation, nuisances caused by their guests. 13.6. The following are not allowed in the Pool/Spa area: Bicycles, skateboards/rollerblades, any other wheeled toys, rafts/floats (except those required for persons who require such rafts/floats in order to swim), kickboards, or hazardous toys, glass containers or other breakable or sharp objects. ALL GLASS AND/OR BREAKABLE ITEMS ARE STRICTLY PROHIBITED.

No climbing on gates, fences, etc. is permitted. 13.8. No pets are allowed in the Pool/Spa area at any time, other than service animals. 13.9. Association furniture and other fixtures may not be removed from the Pool/Spa area. 13.10. All stereos, radios, TV's and any other electronic equipment may be used with earphones only. 13.11. Residents using the Pool/Spa are responsible for depositing trash in the appropriate receptacles. Residents are also responsible for cleaning up any area they use. 13.12. No persons with an infectious disease or who have had active diarrhea within the prior fourteen (14) days may use the Pool/Spa. 13.13. Incontinent persons must wear water tight swimwear designed for incontinent persons at all times when in the Pool/Spa. 13.14. Bobby pins and hair pins, and any other sharp or small object which can be choked on, shall not be worn in the Pool/Spa. 13.15. All persons must shower before entering the Pool/Spa. 13.16. All Pool/Spa gates must remain locked at all times (special care should be taken to ensure compliance to this rule as it is for the safety of all residents). USE YOUR KEY OR ACCESS CARD. No climbing over fences. 13.17. The "Buddy System" is recommended to be used by all swimmers at all times. This simply means that for safety, no one should swim alone. 13.18. No nude sunbathing is permitted at any time in the Pool/Spa area and a swim suit must be worn at all times. 13.19. Any damage to equipment or furnishings in the Pool/Spa area should be promptly reported to the Management Company and may subject the responsible owner to discipline and/or a special assessment after a noticed hearing before the Board. 13.20. If you are pregnant, suffer from heart disease, diabetes, high or low blood pressure or other health problems, do not use the Spa without prior medical consultation and permission from your doctor. Children under the age of six (6) should not use the Spa. 13.21. Use of the Pool/Spa while under the influence of alcohol, narcotics, drugs or medicines may lead to serious consequences and is not permitted. 13.22. Long exposure in the Spa may result in nausea, dizziness or fainting and therefore do not use the Spa alone. 13.23. Because there is no lifeguard on duty, residents will be responsible for their own actions as well as the actions of their family, invitees and guests. 13.24. No Smoking is permitted in any Pool/Spa area. 13.24.1. Smoking of tobacco or any other products (including e-cigarettes and vapor pipes) in the vicinity of any Common Area Pool/Spa is not permitted at any time. For the purposes of this Rule, the vicinity of the Pool/Spa shall mean any area within any

P a g e | 11 Rules, Regulations and Restrictions – December 2014 TUSTIN RANCH SYCAMORE GLEN CONDOMINIUM ASSOCIATION Pool/Spa fences or within twenty (20) feet outside of such fences. 13.24.2. Association members are responsible for their compliance with this Rule, as well as the compliance as their co-residents, tenants, guests and invitees. 13.24.3. Any members reported to be in violation of this Rule shall be invited to a properly noticed hearing before the Board, following which disciplinary action may be taken, including but not limited to suspension of common area privileges, suspension of voting rights, and/or a monetary fine in accordance with the Association's fine policy.

14.POOL PARTIES: 14.1. The Pool Cabana area may be reserved for parties provided the following is observed: 1.a. A Pool Cabana reservation form is properly completed and a one hundred dollars ($100.00) deposit is submitted with the reservation form. 1.b. The number of guests does not exceed seventy-five (75) percent of the maximum allowable persons permitted in the Pool/Spa area; provided, however that the Association reserves the right to limit the number of guests further for health/safety purposes. 1.c. The host (responsible owner) is to provide additional tables and chairs as needed. 1.d. Only gas barbecues are permitted to be used, and must be clear of any structure. 1.e. All party trash must be removed from the Pool/Spa area at end of party. 1.f. A party may not exceed four (4) hours in length and must be finished before 8:00 P.M. 1.g. All existing Pool/Spa rules must be observed at all times. 15.RECREATIONAL USE OF THE STREETS 15.1. All persons who play in the streets do so at their own risk. The Association assumes no responsibility for any accident or injury in connection with such use, or for any loss or damage to personal property. 15.2. Any person is allowed to use a portable "Children at Play" or similar warning sign to make oncoming traffic aware that children or other persons are at play, provided no sign impedes the general traffic flow. 15.3. Persons residing in or visiting a Unit are permitted to draw on the street with chalk, provided the following requirements are complied with: 15.3.1. All drawings are washed away after finishing. 15.3.2. All drawings are located in front of the applicable owner’s own garage door. 15.3.3. The drawing area must not exceed the following dimensions: (i) no wider than the Unit's garage door and (ii) no deeper than half the width of the street.

16.SATELLITE DISH OR ANTENNA INSTALLATION 16.1. Satellite dish and antenna installations must comply with the Association's current Satellite

P a g e | 12 Rules, Regulations and Restrictions – December 2014 TUSTIN RANCH SYCAMORE GLEN CONDOMINIUM ASSOCIATION Dish and Antenna Installation Policy. Please read the Policy carefully to make sure your intended installation fulfills all requirements. 16.2. All satellite dish and antenna installations are subject to review by the Architectural Review Committee, and each owner, at their sole expense, will be required to rectify any installation issues as determined by the Architectural Review Committee.

17.SPEED LIMITS 17.1. The maximum speed limit on all Association streets is fifteen (15) miles per hour.

18.TENANTS 18.1. All actions of tenants who fail to abide by the Association's Rules, Regulations and Restrictions will be the responsibility of the owner/landlord. Where any violation of the Rules, Regulations and Restrictions results in a removal of privileges, such disciplinary action will be in effect against both the tenant and the landlord. For any violation of the Rules, Regulations and Restrictions that results in a financial penalty, such penalty will be taken solely against the landlord.

19.TRASH AREAS 19.1. All trash must be put inside the available bins and not in the enclosures. 19.2. All cardboard boxes must be broken down, regardless of size. 19.3. Residents may make separate arrangements directly with the refuse company for pickup of any large items, including but not limited to any type of indoor/outdoor furniture or appliance. 19.4. Do not place any item in front of trash enclosure doors. Residents must close trash enclosure doors after use. 19.5. During construction/re-modeling, contractors are responsible for removal of all construction waste. Association bins are not to be used for disposal of any building materials, including but not limited to wood, drywall, tile, concrete, dirt, appliances, toilets, flooring, windows and like items. 19.6. Items placed in the recycling bins must adhere to the Association's recycling policy. Items not specified by the recycling guidelines are not allowed to be placed in those bins designated for recycling. 19.7. The use of garbage/trash bags is required for any waste that has the potential to leak, cause odors, cause disease, or attract unwanted pests.

20.UNUSED/ABANDONED VEHICLES 20.1. Unless prior written approval is obtained from the Board of Directors, any vehicle that

P a g e | 13 Rules, Regulations and Restrictions – December 2014 TUSTIN RANCH SYCAMORE GLEN CONDOMINIUM ASSOCIATION remains parked/stored in a location other than an owner’s garage for an amount of time exceeding ninety-six (96) hours (or forty-eight (48) hours for a vehicle parked on a driveway), or any vehicle deemed to be a nuisance, or safety concern by the Board of Directors, is subject to immediate towing at the vehicle owner's expense in accordance with the Association’s CC&Rs and the California Vehicle Code.

21.USE OF UNITS 21.1. Units shall be used as a single family residence only. Commercial or business activity is limited to professional occupations carried out within a Unit, with no external evidence of such activities and such activates comply with applicable local, state and federal requirements, ordinances and statues. 21.2. No resident shall engage in any activity upon the property which is in violation of any law, code, ordinance, statute, rule or regulation of any city, county, state or federal body.

22.VIOLATION ENFORCEMENT PROCEDURES 22.1. Notice shall be sent to the owner advising the nature of the violation and time limit to rectify the violation, with the exception of a parking infraction which will be posted on the vehicle in question. 22.2. Failure to comply with the request to rectify the violation or respond to the Board of Directors or Management Company shall result in a second letter again requesting the issue to be rectified. 22.3. Failure to comply with the request to rectify the violation or respond to the Board of Directors or Management Company shall result in a Notice of Hearing. Such notice shall be sent at least fifteen (15) days prior to the Hearing requesting appearance on a specified date to be heard by the Board of Directors. 22.4. If the violation is sanctioned at the Hearing, the Board of Directors may take one or more of the following actions: 22.4.1. Levy or increase a special assessment as necessary. 22.4.2. Impose a monetary fine against an owner in an amount which will start at $250.00 depending upon the nature on the violation. 22.4.3. Suspend or condition the right of said Member to use any recreational facilities owned by the Association. 22.4.4. Suspend said Member's voting privileges as a Member. 22.5. The Board of Directors will again review continuing violations on a monthly basis. This review may lead to one or more of the following actions: 22.5.1. Levy or increase a special assessment as necessary. 22.5.2. Impose a monetary fine against an owner in an amount which will start at $250.00 depending upon the nature on the violation.

Suspend or condition the right of said Member to use any recreational facilities owned by the Association. 22.5.4. Suspend said Member's voting privileges as a Member. 22.6. The Board may also seek other remedies such as, without limitation, litigation and dispute resolution. All remedies which may be taken by the Board are cumulative and not exclusive, and the Board may pursue more than one (1) remedy simultaneously.

23.WINDOWS 23.1. Any addition, change or replacement to a Unit's windows must be submitted for review and receive prior written approval from the Architectural Review Committee prior to the commencement of any work. 23.2. All windows shall be covered by curtains, drapes, venetian blinds, shades or shutters. Window coverings seen from the outside must conform with the existing architecture color scheme. 23.3. No window shall be covered by paint, foil, tint, sheets or similar items. No reflective or metallic window covering of any kind will be allowed. 23.4. Satellite dishes and antennae designed to receive a broadcast signal/services via multi-channel multi- point distribution services (MMDS) may be installed subject to the following criteria:

1. Such dish or antennae is three (3) feet,(36 inches) or less in diameter.

2. The dish or antennae may only be installed on the lower section of the chimney in a position that is aesthetically pleasing in nature and preferably not visible from any common area or street.

3. All cables associated with the installation must be hidden under the eaves.

4. The installation must be performed by a professional installer/company.

5. The owner will be responsible for any damages during the installation, including but not limited to: roofing tiles, fascia, siding, landscaping etc.

6. Installation of a satellite dish or antennae requires the prior, written approval by the Architectural Review Committee, and each owner, at their sole expense, will be required to rectify any installation issues as determined by the Architectural Review Committee.

This Architectural/Landscape Approval Request Form, plans, sketches, scaled plot/site plan, description of work, brochures related to the project, specifications of materials and color schemes, and any other information pertaining to this project MUST be submitted to the property management company a minimum of three (3) weeks prior to the anticipated start of construction. Failure to comply with this procedure will result in a rejected approval request form and/or a request to correct any work performed prior to approval of this approval request form. All costs related to correction of work shall be the responsibility of the owner listed under this approval request form.

2. COMPLETELY and LEGIBLY fill out this Architectural/Landscape Approval Request Form. This form shall be accompanied by the following documents (Failure to submit the following documents will result in a rejected Approval Request Form): 2.1. Two (2) additional copies of this request form for a total of three (3) copies. (Property Management record copy, Architectural Committee record copy, and one copy that will be returned to the owner approved or rejected) 2.2. Three (3) copies of a fully dimensioned plot/site plan drawn to ¼" = 1'-0" scale. The plan shall CLEARLY show the entire building with the Unit relevant to the proposed work, building walls, garages, chimneys, patios, fences, gates, patio doors, windows, front door location, and landscaped areas. The drawing shall clearly reflect the existing conditions and clearly mark the newly proposed work, material colors, sizes, and/or any other items pertaining to the newly proposed work. 2.3. Three (3) copies of any brochures, specifications, and/or color schemes related to the newly proposed work.
