Flexible Retirement Agreement
(Gaps to be completed by Manager / Human Resources and signed by employee and HCC Assistant Director, HR before release of pension. Copy to be saved on employee file and sent to the LPP with the Flexible Retirement Application Form).
This agreement is between X, X School and Hertfordshire County Council
You have expressed the wish to retire from X School in the near future.
It is the Governing Body’s view accepted by Council that due to the skills and experience you hold, it will be at a significant detriment should you leave the school at this time. The Governing Body and Council would wish to agree a transitional period of exit which would be used for you to complete the projects / tasks agreed and mentor others and impart knowledge and skills that would be invaluable to the school.
In light of this, the Governing Body and the Council are agreeing to allow you to take flexible retirement on an exceptional basis, as set out in the Councils Local Government Pension Scheme Discretion policy on the following basis:
- You will undertake work in the role of X for [x hours per week / at x grade – set out details of the flexible retirement] for a further period of [1 or 2] years, ending on [date]. Within this period you will not increase your hours or grade, subject to normal increment progression under PMDS.
- You will be able to access your Local Government Pension immediately upon the start date of your new role/ terms of employment and begin to draw your pension whilst continuing to be employed on the above terms
- During this period, you will relinquish some of your duties and responsibilities under you revised role / terms of employment and take the role of a mentor in relation to your skills and experience.
- At the end of the agreed period / at the agreed date as set out above you will resign from your role within the school.
- You accept that should you not resign from your role at the end of the agreed period / on the agreed date; the school will terminate your employment on the grounds of some other substantial reason.
- Before signing this document it is your responsibility to consider and fully understand the effect of this agreement on your Local Government Pension including relevant issues of abatement, you may wish to seek Independent Financial advice.
