BACKGROUND Most debates about land policies in the Caribbean are driven by three overlapping and sometimes conflicting objectives: • The creation of a more vibrant land market, with the aim of increasing productivity and investment, through secure, documented and transparent title to land. • The elimination of poverty, through equitable access to land and other natural resources and the provision of security of tenure to poor households, allowing them to transform their land assets into sustainable livelihoods. • The conservation of the natural environment and improvement of the built environment, though land use planning and environmental regulations. The challenge for the Caribbean is to find the legal, institutional and policy measures to balance these three overlapping objectives. In the post-colonial State-led agrarian reform era of the 1960s and 1970s efforts were made to increase medium- and small-scale private holdings of agricultural land, mainly through State acquisition of large estates and the re-distribution of land to the peasant sector. These programmes have now largely been abandoned. In their wake an enormous amount of activity is occurring around tenure regularisation, land titling and property registry modernisation. Parallel efforts are under way to establish environmental zoning, promote eco-tourism, manage urban expansion, protect coastal zones and control deforestation. These efforts have often meshed poorly with the trend towards marketisation of individual rights. State ownership of land remains important in the Caribbean, as well as a variety of mechanisms for encouraging the private use of the land through leases and other arrangements. As land managers become more subject to private land market pressures and opportunities, but also increasingly responsible for planning, implementing, regulating and evaluating societal values in land, the institutions of land administration must also change. The institutional transformation of land management has been significant, through programs of Caribbean Network Report 1 privatisation, individualisation and (in some cases) internationalisation of land tenure. ORTH* For over a century, North Carolina property owners have been offered an alternative to the traditionaldeed and recordingsystem. Title to land may instead be entered in the Torrens system of registered titles. Under the Torrens system, the court determines the state of the title and issues a certificate, which is held in the registry with a copy given to the registered owner. The certificate provides conclusive evidence of ownership and of any liens or encumbrances on the property. Unlike titles evidenced by deeds, Torrens titles are not subject to loss by adverse possession, and transfer of a Torrens title is a simple process of changing the certificate in the registry and issuing a new certificate. A darling of Progressive law reformers in the late nineteenth and early twentieth centuries, nineteen states eventually adopted the Torrens system, although many later had second thoughts and abandonedthe system.

Comparison 2. A table setting out the features of the current deeds registration system and the title registration system proposed under the Land Titles Bill is at the Annex. Parallel Running 3. While there will be two pieces of legislation governing land registration after enactment of the Land Titles Bill, we plan to have only one single administrative system to handle all registrations. Submission of deeds under the Land Registration Ordinance and applications for registration - 2 - under the Land Titles Ordinance will both be made to the same customer service centre of the Land Registry. Each set of documents will then be handled by the Land Registry as required by the ordinance under which it is submitted. 4. There will be a single computerized information system handling all properties irrespective of which ordinance they are registered under. The system will be set up to show clearly which ordinance each particular property is registered under and to provide the supporting information and documents required by that ordinance. The system will serve both the Land Registry and external customers. Internally it will guide Land Registry staff through the correct registration procedures applicable to the property. Externally it will give searchers up to date information on the status of each property.

    Informational FILING A HOMESTEAD Brochure DECLARATION If you own a home, you should consider filing a homestead declaration with the County Recorder in your county. A homestead declaration protects your home from being seized and sold in the event that a money judgment is entered against you by a court. What kind of properties may be declared as a homestead? These types of property may be homesteaded: Land with a dwelling house on it plus appurtenances (fixtures and buildings). A mobile home, whether or not the mobile homeowner owns the land on which it sits. A condominium unit. Who can decide to declare a homestead? A single person or, in the case of a married couple, either or both spouses. If someone obtains a money judgment from a court against me, how will a homestead declaration protect my home? For most judgments against you, a homestead declaration protects the first $605,000 of equity you have in your home. If you have less than $605,000 equity in your home and the judgment is not of the type listed below, your home will not be sold to satisfy a judgment. If your equity exceeds $605,000, the property (or a portion of it, if a court determines it can be divided) may be sold, but you are entitled to keep the first $605,000. If allodial title has been established, the exemption extends to all equity in the land, dwelling and appurtenances. A homestead declaration will not prevent your home from being sold to pay a judgment for: Taxes. A mortgage, trust deed or other loan arrangement used to purchase or refinance your property or improvements to your property.

    The doctrine of tenure in Australia post-Mabo: Replacing the ‘feudal fiction’ with the ‘mere radical title fiction’ — Part 2 Dr Ulla Secher* Until the decision of the High Court in Mabo, the universal acceptance and application of the English doctrine of tenure in Australia led to the view that all titles, rights and interests in land had to be the direct consequence of some grant of the Crown. In Mabo, however, six justices of the High Court agreed that the common law, as it had been previously understood, should be changed to recognise native title rights to land; rights which do not derive from a Crown grant. The common law device adopted by the High Court to effect this change, and thereby reconcile the doctrine of tenure and native title when the Crown acquired sovereignty of Australia, was ‘radical title’. This two-part article examines how the Mabo High Court redefined the English doctrine of tenure, or, more accurately, defined the Australian doctrine of tenure, by developing the concept of radical title. It will be seen that in order to achieve this redefinition, the court had to clarify two interrelated aspects of the common law: the applicability of the English (feudal) doctrine of tenure in Australia and the legal effect of the classification of Australia as settled. Part 1 lays the foundation for this analysis by examining the genesis of the doctrine of tenure in pre-Conquest England and the pre-Mabo effect of the colonisation of Australia and the reception of English land. The question posed in Part 2 is twofold: first, how and why the Australian doctrine of tenure, with radical title as its postulate, diverges from the doctrine of tenure in English land law.

SECTION 1 Document type: Select the box next to the document type to indicate the type of document that you are registering. If you select OTHER, you MUST specify the document type. Document Date: This is the date of the execution or drafting of the document that is recorded on the document. If you do not have a document date then leave the field blank. Please Note: (i) When registering a Notice of Mortgage, you must attach a legible written description and affidavit of value, if applicable. You may attach supporting affidavits. • Do not attach the mortgage document, schedules, promissory notes or terms and conditions. (Note: Submitters other than law firms and pre‐authorized filers may be asked by the Registry to attach the full mortgage document.) (ii) When registering a Notice of Release of Mortgage please attach the Release of Mortgage document. (Note: Law firms and other pre‐authorized filers do not attach the Release of Mortgage document.) • Do not complete sections 4 and 5 of the registration application form. • You must complete section 7 which references the document being released.
