The 2004 Re-Organizational Meeting of the Earl Township Board of Supervisors, Held on Monday

The Earl Township Board of Supervisors meeting, held on Monday March 6, 2017 was called to order by Chairman Rick Kochel, at 7 p.m. The following were present: Rick Kochel, Ray Martin, and Lee Zimmerman, Road Master and Solicitor Cassidy. Supervisor Thomas Plitt arrived later.

Ray made a motion to approve the February 6th and the February 16, 2017 minutes, Rick seconded and all voted yes.

Public Comment: Kathy Ashcroft, 133 Maple Drive, inquired if the Township Ordinance allow one and one half (1 ½) animals per acres and if that means a property of two acres would be allowed three (3) animals. Rick confirmed that is the Ordinance and has been the language.

Robert Winegardner, 254 Orchid Court, submitted a letter formally requesting that the Township conduct an immediate feasibility study of forming a regional police force and presented at a public meeting. Mr. Winegardner stated now is a prime time to conduct a study and believes that a significant savings could be gained. Mr. Winegardner requested a formal reply from the Board of Supervisors. Rick confirmed a written response would be provided.

Police Report: Chief Bowers presented the February 2017 police report. The Ragner Relay Pa 2017 Run on June 2 & 3, 2017 was reviewed.

Martindale Fire Co. Report: Chief Groff presented the February 2017 fire report.

Garden Spot Fire Rescue: The February 1, 2017 (GSFR) meeting minutes were reviewed and will be filed in the Township office.

Elanco Library: The January 2017 update flyer was reviewed.

Subdivision and Land Development Plans: Alan Love, Site Design Services, was presenting the Mark and Jane Leid, 214 Sensenig Road, Ephrata, Major Storm Water Management Plan and is requesting the following: a. Conditional approval of the Storm Water Management Plan. Rick made a motion to grant conditional approval of the Storm Water Management Plan, contingent upon the review comments of the Township’s Engineer. Ray seconded and all voted yes. b. Tom made a motion to approve the Improvement Guarantee in the amount of Twenty One Thousand and Six Hundred Dollars ($21,600.00), Ray seconded and all voted yes. c. Ray made a motion to approve signing the Storm Water Management Agreement and Declaration of Easement, Tom seconded and all voted yes.

Ray made a motion to approve signing the King Court Properties 125 King Court, Storm Water Management Agreement and Declaration of Easement, Tom seconded and all voted yes.

Tom made a motion to approve signing the Lamar L and Jane Zimmerman, 225 Conestoga Avenue, Storm Water Management Agreement and Declaration of Easement, Ray seconded and all voted yes.

Ray made a motion to approve signing the Garden Spot Village, Cooperative Living, 303 Ranck Road, Storm Water Management Agreement and Declaration of Easement, Tom seconded and all voted yes. Tom made a motion to approve granting SOCO Enterprises, southside of Airport Road, Subdivision and Land Development Plan, a time extension until June 5, 2017, to meet the conditions to record their Land Development Plan. Ray seconded the motion and all voted yes.

Ray made a motion to partially release the Zimmerman Steel, 213 Gristmill Road, New Holland, Preliminary/Final Land Development Plan, Improvement Guarantee funds, in the amount of Thirty Six Thousand Seven Hundred Sixty One Dollars and Three Cents ($36,761.03). Tom seconded the motion and all voted yes. The balance remaining to complete this project, shall be in the amount of Two Thousand Three Hundred Forty Five Dollars and Seventy Cents ($2,345.70), per ELA Group Inc. letter dated March 6, 2017.

Road Master’s Report: Lee reported that the Premier Custom Cabinetry, 110 Short Street, Storm water system is in need of repair and maintenance. A letter was mailed and the owner G Marlin Horst indicated the repairs will be completed and coordinated with the soon to be installed sanitary sewer extension.

Rick made a motion to approve selling the 2001 International truck, plow, spreader and conveyor on the Municibid auction, and the conveyor may be sold under another approved method. Ray seconded the motion and all voted yes.

Lee presented creating As-Built Plans and Right of Way Easement to record the Storm water Management facilities installed on the 136 Redwell Road property at an estimated cost of One Thousand Seven Hundred and Fifty Dollars ($1,750.00). After some discussion Rick made a motion to proceed with creating the As-Built Plans and Right of Way Easement to record the Storm water Management facilities on the 136 Redwell Road property, at a cost not to exceed One Thousand Eight Hundred Dollars ($1,800.00). Tom seconded the motion and all voted yes.

Lee reported the 2017/2018 Low Volume Road Grant from the Lancaster County Conservation District was awarded in the amount of Twenty Thousand Dollars ($20,000.00) to help fund finishing the Snyder Road project.

Zoning Officer’s Report: The January 1st – January 22, 2017, written zoning report was submitted and will be filed in the office.

Sewage Enforcement Officer’s Report: The Supervisors reviewed the Sewage Enforcement Officer’s February 2017 report.

Solicitor’s Report: Solicitor Cassidy reported that he is waiting to hear back from Cohen Law Services regarding reviewing and renewing cable, wireless and broadband franchise agreements. Robert Winegardner inquired about establishing franchise agreements and/or permitting dishes, to fairly charge those customers as well.

Solicitor Cassidy will provide a document approving the event and an Indemnification Agreement for execution by the New Holland Summer Arts, who is proposing to hold a July 4th fireworks display on the Grace Family Church property located at 415 South Kinzer Avenue in Earl Township.

The Supervisors acknowledged the Burkholder Quarry Operation, PA NPDES Permit correction and renewal application.

The Supervisors acknowledged the L.C.P.C. schedule/comments on the following neighboring Municipalities Zoning Ordinance amendments: West Earl Township – Zoning Ordinance amendment Leacock Township – Official Map adoption Leacock Township – Zoning Ordinance amendment East Earl Township – Zoning Ordinance update

The Supervisors acknowledged the LCCD earthmoving inspection report and other reporting for the following properties: Fieldcrest Properties, 260 Jalyn Drive King Court, 125 King Court Lavern Shirk, 851 Gristmill Road Summary of Activities for the Chapter 102/105 and NPDES Programs

The Supervisors acknowledged ELA Group earthmoving inspection report on Samuel Blank, 695 South Custer Avenue.

Receipts received in February were $31,248.78 in the General Fund and $2,597.21 in the Waste.

Tom made a motion to pay the expenses in the General and the Payroll Funds (Checks #1842 – 1888 and #7968 - 7987) in the amount of $140,716.34, and the payroll taxes electronically transferred in the amount of $9,978.47. The Street Light (Check #411) in the amount of $1,114.18, the Waste and Recycling (Checks #229 - 230) in the amount of $12,960.03 and the Liquid Fuels (Check #378 - 379) in the amount of $96,171.00. Ray seconded the motion and all voted yes.
