Breezy Point City Council Tuesday, January 3, 2017 - 7:00 p.m. Regular Meeting Minutes

The regular meeting of the Breezy Point City Council was called to order by Mayor Tom Lillehei at 7:00 p.m. All present stood for the pledge of allegiance.

Administrator Rudberg gave the Oath of Office to newly elected Tom Lillehei, Mayor and Councilmembers Rebecca Ball and Gary Mitchell.

Present at tonight’s meeting are Tom Lillehei, Michael Moroni, Gary Bakken, Rebecca Ball and Gary Mitchell. Staff present included Administrator Clerk Joe Rudberg, Chief Kevin Merschman, Public Works Supervisor Joe Zierden, Deputy Clerk Kathy Millard and Finance Specialist Kari Jacobson. Justin Schulz, WSN, was also present.

Consent Calendar A. Council Minutes December 5, 2016 B. Approval of Claims totaling $47,616.44 (1702E-1704E, 1718E-1720E & cks#133183, 133185-133244) MOTION MORONI/MITCHELL TO APPROVE THE CONSENT CALENDAR AS PRESENTED, MOTION CARRIED.

Open Forum - Opened and closed with no comment.

Mayor & City Council Reports A. Mayor Mayor Lillehei announced there were two donations received for the cemetery and asked for motions to receive them. MOTION BAKKEN/MORONI TO ACCEPT THE DONATION FROM THE FLETCHER FAMILY FOUNDATION IN THE AMOUNT OF $10,000 FOR THE CEMETERY FUND, MOTION CARRIED. MOTION BAKKEN/MORONI TO ACCEPT THE DONATION FROM JASON BACA OF GRASSMASTERS IN THE AMOUNT OF $1,073.63 FOR THE CEMETERY FUND, MOTION CARRIED.

1) Organizational Resolution - Resolution 17-01 Mayor Lillehei reviewed Resolution 17-01 that makes the annual designations and appointments. This resolution also lists the council liaison appointment for the departments and commissions/committees. MOTION BAKKEN/MORONI TO ACCEPT RESOLUTION 17-01 MAKING ANNUAL APPOINTMENTS AND DESIGNATIONS FOR THE ORGANIZATION STRUCTURE FOR THE CITY OF BREEZY POINT FOR THE YEAR 2017, MOTION CARRIED.

Council members Bakken, previous and current liaison for Pelican Woods Cemetery, commented on the generous donations from the Fletcher Family Foundation and Jason Baca of Grassmasters, both longtime supporters of the cemetery. He commends these parties for their substantial support for Pelican Woods Cemetery going forward.

Engineers Report A. Plans and Specifications – Whitebirch 6th Addition - Resolution 17-02 Justin Schulz, WSN, gave an overview of the project. The proposed roads in the 2017 Road Improvement include Navaho Trail, Zuni Circle, Pima Circle, Aztec Circle and Pawnee Circle. There are not many drainage concerns with these roads. Pawnee Circle has a 10-12% grade to the Dove Street approach which has been a safety and maintenance concern for city staff. Pawnee Circle will be changed to an 8% maximum grade and add concrete curb and gutter to save washouts on shoulders.

Mitchell asked what MN Statute Chapter 429 is. Schulz explained that Chapter 429 gives cities the authority to make improvements and assess those costs to the benefited properties. Chapter 429 has a schedule of steps that need to be done for the project and was included with the report. Mitchell will be on the Road Committee and asked questions on the typical road section diagram that was also included in the report. Schulz explained that in this road project with existing gravel road they add base material to the desired 2% crown and roll and pave on top of that. Existing roads might not have an existing crown so they need to add the correct amount of base to build it up.

MOTION MORONI/BAKKEN TO ACCEPT RESOLUTION 17-02 APPROVING PLANS AND SPECIFICATIONS AND ORDERING THE ADVERTISEMENT OF BIDS FOR PAVING IMPROVEMENTS FOR WHITEBIRCH SIX. Discussion: Moroni tells the new council members that this step does not commit the city to this project and if the bids are not favorable they can cancel the project. MOTION CARRIED.

Committee Reports A. Road Committee 1) 2017 Seal Coating The proposed streets to be seal coated included Humming Bear Lane, Bittersweet Circle, Autumn Lane, Harvest Court, Harvest Road, Green Scene Drive, Snowman Circle and a portion of Summer Drive for a cost of $61,500. Additional roads were added to complete the neighborhood; Four Seasons Place, paved portion of Raccoon Lane and the other portion of Summer Drive. The additional roads added an estimated $17,300 to the project for a total of approximately $78,800. MOTION MORONI/BAKKEN TO APPROVE THE ORIGINAL 2017 SEAL COATING AS PRESENTED WITH THE ADDITIONAL ROADS INCLUDED IN THE PROJECT.

Breezy Point City Council January 3, 2017 Page 2 Discussion: Several roads were clarified as gravel and would not be considered for seal coating. MOTION CARRIED.

Administrator and Staff Reports A. Hunting Ordinance Revision - Ordinance 17-01 Chief Merschman has requested the Archery and Birdshot ordinances be updated to require permission from the landowner to be on their property. The Shooting Ordinance addressed this issue by requiring landowner permission to fire a rifle but this phrase was missed in the Archery and Birdshot section of the ordinances. MOTION MORONI/BALL TO APPROVE ORDINANCE 17-01 REGARDING HUNTING AND THE NEED TO GAIN PROPERTY OWNER PERMISSION. Discussion: Moroni clarified that verbal permission from a property owner was okay. Mitchell wanted crossbow added to the language for the use of bow and arrow but Chief Merschman wants to keep the verbiage generic so it covers all new equipment. MOTION CARRIED.

B. Pay Equity Report Pay equity reporting is done every three years. Job points are rated using the Modified Princeton System. The pay plan that was adopted in 2012 has kept things in check along with consistent wage increases across all job categories.

There are several tests that have to be met; statistical analysis test, t-test and salary range test. Exceptional service pay for the city is longevity pay. This year there is one female job class and two male job classes with longevity pay. This represents compensation paid above the maximum due to longevity. Longevity pay could be a problem in future years because pay equity thinks longevity pay should be applied equally between males and females regardless of years of service.

Administrator Rudberg believes the city is in compliance at this time. MOTION MITCHELL/MORONI TO APPROVE THE PAY EQUITY REPORT AS SUBMITTED. Discussion: Ball asks if Pay Equity is a pass/fail scenario or don’t we know until the report is submitted? Bakken asks if this should be a concern for the Personnel Committee. Administrator Rudberg said this could be a problem within 3 years when retirements take place. MOTION CARRIED.

C. Sale of 2001 Ford Chassis 350 The 2001 Ford F-350 Cab and Chassis was put up for sealed bids with a minimum bid of $3,000. Six sealed bids were received and opened on December 27, 2016 at 3 p.m. These ranged from $3,600 to $5,020. MOTION MORONI/MITCHELL TO SELL THE VEHICLE TO THE HIGH BID OF $5,020 FROM MARC BUDKE AND IN THE CASE THAT MARC BUDKE DOES NOT PURCHASE THE

D. Purchase 2017 Squad Car Chief Merschman reported their department has budgeted $43,720 to purchase a new squad and outfit it with needed equipment. The new squad will be used by Officer Rieber because it has a larger cargo area and the ability to go off-road. This would be a benefit to the Paramedic program. The Police Department planned to retain the old squad as a backup and to allow part-time officers to utilize one vehicle. This required purchasing a camera and radio for an additional cost of $8,870. MOTION BAKKEN/BALL TO APPROVE THE PURCHASE OF THE 2017 FORD SUV FOR THE PRICE OF $43,720 AND TO RETAIN THE OLDER SQUAD FOR A BACKUP, MOTION CARRIED.
