[4250-2] 1 2 3 4 5 6 7 8 9 A JOINT RESOLUTION 10 11 TO APPROVE REGULATIONS OF THE COMMISSION ON 12 HIGHER EDUCATION, RELATING TO DETERMINATION 13 OF RATES OF TUITION AND FEES, DESIGNATED AS 14 REGULATION DOCUMENT NUMBER 4729, PURSUANT TO 15 THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF 16 THE 1976 CODE. 17 18 Be it enacted by the General Assembly of the State of South 19 Carolina: 20 21 SECTION 1. The regulations of the Commission on Higher 22 Education, relating to Determination of Rates of Tuition and Fees, 23 designated as Regulation Document Number 4729, and submitted 24 to the General Assembly pursuant to the provisions of Article 1, 25 Chapter 23, Title 1 of the 1976 Code, are approved. 26 27 SECTION 2. This joint resolution takes effect upon approval by 28 the Governor. 29 XXX 30 31 SUMMARY AS SUBMITTED 32 BY PROMULGATING AGENCY. 33 R.62600 through 62612 of Chapter 62 is being amended. 34 Revisions to the existing regulation for the SC Residency 35 Regulation are being considered to clarify the policies and 36 procedures for administering the program. In the proposed 37 amendment, the definition of an independent is clarified to provide 38 flexibility for the student and institution in determining if a student 39 meets the definition. In addition, clarification is being given to the 40 list of items that serve as indicia of intent for South Carolina 41 Residency. There are also additional clarifications being proposed, 42 such as correctly identifying the Federal Agency which issues

[4250] 3 1 permanent residency cards to new residents of the United States. 2 The revisions seek to promote consistency among the State 3 institutions and their residency classification processes. 4 5 A Notice of Drafting for the proposed regulation was published in 6 the South Carolina State Register on July 22, 2016. 7 XX 8
