4 ORDINANCE 2007-802-E 5 AN ORDINANCE CONCERNING THE RIVER CITY MARKETPLACE 6 DEVELOPMENT OF REGIONAL IMPACT (DRI), (FORMERLY KNOWN AS 7 THE DUVAL NORTH COMMERCE CENTER DRI AND THE FIRST COAST 8 CENTER DRI) AS ORIGINALLY ADOPTED BY ORDINANCE 88-355- 9 327, AND AMENDED BY ORDINANCE 88-1174-570, RESOLUTIONS 10 90-1104-559, 93-127-41, 94-1142-355, 96-1008-319 AND 11 2003-1534-A, AND ORDINANCES 2007-42-E AND 2007-479-E, 12 LOCATED EAST OF INTERSTATE 95, SOUTH OF DUVAL ROAD, AND 13 WEST OF U.S. HIGHWAY 17; ADOPTING PROPOSED CHANGES 14 PURSUANT TO THE NOTIFICATION OF A PROPOSED CHANGE TO A 15 PREVIOUSLY APPROVED DEVELOPMENT OF REGIONAL IMPACT (NOPC) 16 FILED BY RAMCO-GERSHENSON, INC., ORIGINALLY DATED JULY 9, 17 2007, AND REVISED AUGUST 10, 2007, WHICH CHANGES ARE 18 GENERALLY DESCRIBED AS AMENDING THE USE CONVERSION TABLE 19 TO PERMIT CONVERSION OF COMMERCIAL USES TO ADDITIONAL 20 HOTEL ROOMS WITHIN THE DRI; FINDING THAT THESE CHANGES DO 21 NOT CONSTITUTE A SUBSTANTIAL DEVIATION FROM THE 22 ORIGINALLY APPROVED DRI; DIRECTING THE LEGISLATIVE 23 SERVICES DIVISION TO FORWARD CERTIFIED COPIES OF ENACTED 24 ORDINANCE TO PARTIES LISTED HEREIN; AND PROVIDING AN 25 EFFECTIVE DATE. 26

27 WHEREAS, the Council adopted the River City Marketplace DRI 28and subsequently amended the DRI Development Order as described in 29the title above; and 30 WHEREAS, Ramco-Gershenson, Inc., submitted an NOPC dated July 319, 2007, and revised August 10, 2007, to the City requesting 2 -1- 1 Amended 8/28/07

1certain changes to the adopted DRI Development Order; and 2 WHEREAS, the NOPC was submitted to the appropriate state, 3regional, and local land planning agencies and has been reviewed by

4the City’s Planning and Development Department; and 5 WHEREAS, the Planning and Development Department submitted 6recommendations concerning said proposed changes to the adopted DRI

7Development Order; and

8 WHEREAS, the Land Use and Zoning Committee reviewed the NOPC and

9made its recommendation to Council; and

10 WHEREAS, the Northeast Florida Regional Council found that the

11proposed changes do not result in any additional adverse regional

12impacts and do not constitute a substantial deviation from the

13originally approved DRI; and 14 WHEREAS, a public hearing was properly noticed and held by the

15Council pursuant to Section 380.06, Florida Statutes; and 16 WHEREAS, after such public hearing and in consideration of the 17recommendations made and submitted to the Council, the Council has 18made certain findings and determinations; now, therefore 19 BE IT ORDAINED by the Council of the City of Jacksonville: 20 Section 1. The Development Order for the River City 21Marketplace DRI is hereby amended to incorporate the proposed 22changes and modifications contained in the NOPC dated July 9, 2007,

23and revised August 10, 2007, and on file in the City Council

24Legislative Services Division.

25 Section 2. The Council hereby finds and determines that 26the changes and modifications set forth in the above referenced 27NOPC dated July 9, 2007, and revised August 10, 2007, do not 28constitute a substantial deviation, as such term is defined in 29Section 380.06(19), Florida Statutes. 30 Section 3. The Legislative Services Division is hereby 31directed to forward a certified copy of this ordinance to the 2 - 2 - 1 Amended 8/28/07

1following, immediately upon its effective date: Mr. Bill Pable, 2Northeast Team Regional Review Administrator, Department of 3Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee, Florida 432399-2100; Mr. Edward Lehman, Growth Management Director, 5Northeast Florida Regional Council, 6850 Belfort Oaks Place, 6Jacksonville, Florida 32216; and Mr. Thomas O. Ingram, Esq., Agent 7for the River City Marketplace DRI, 245 Riverside Avenue, Suite 8400, Jacksonville, Florida, 32202. 9 Section 4. Effective Date. This ordinance shall 10become effective upon signature by the Mayor or upon becoming 11effective without the Mayor's signature. 12
