A. Statement and Background 1. This matter comes before the Colorado Public Utilities Commission

(Commission) for consideration of a Petition for Declaratory Order filed by LogistiCare

Solutions, LLC (“LogistiCare” or “Petitioner”). Petitioner seeks an order declaring that the

Commission may change PUC permits of Non-Emergency Medical Transportation (NEMT) transportation providers administratively and without reapplication to “Current Medicaid NEMT

Broker.”

2. Petitioner was awarded a contact by the State of Colorado to be the Medicaid

NEMT broker for Colorado’s eight Front Range counties. Arapahoe County previously served as the NEMT broker for these counties. The change of NEMT brokers requires that numerous transportation providers now amend their PUC permits and enter into the reapplication process even though there has been no change to their scope of services. 3. NEMT brokers can potentially change annually. In order to avoid the current and future risk of interruptions of service to the state’s Medicaid NEMT population, Petitioner states that it is in the best interest of the State of Colorado, its Medicaid clients and the NEMT program if the Commission issue a Declaratory Order to change the PUC permits of NEMT transportation providers administratively and without reapplication to “Current Medicaid NEMT Broker,” instead of having to enter the reapplication process even though there is and will be no change to their scope of services.

4. Because the broker providing the services may change annually but the scope of services will not change, we find that the Petitioners suggested language will avoid the risk of interruption of service to the state’s Medicaid NEMT population. Therefore, PUC permits of

NEMT transportation providers will be changed to include the language as stated above.

II. ORDER

A. The Commission Orders That: 1. The Petition for Declaratory Order filed by filed by Logisticare Solutions, LLC is granted consistent with the discussion above.

2. The 20-day time period provided by § 40-6-114(1), C.R.S., to file an application for rehearing, reargument, or reconsideration shall begin on the first day after the effective date of this Order.

3. This Order is effective upon its Mailed Date.
