Section 1 Introduction & Administrative Information
1.1 Purpose The purpose of this Request for Proposal is to solicit bids from qualified providers to provide the goods and/or services identified on the RFP cover sheet and in the attached specification and delivery instructions. Any contract(s) resulting from the RFP shall not be an exclusive contract.
1.2 Instructions to Bidder For further clarifications and directions in responding to this Request for Proposal refer to the RFP Clarifications Document posted at the Iowa State (Prison) Industries website www.iaprisonind.com under Purchasing, Bids & Proposals. Click on the above referenced RFP number. Some items described in the RFP Clarifications Document may or may not be required at the time of submission by Bidder and may be required by Iowa State (Prison) Industries at a later date. All submission requirements for this Request for Proposal will be identified within this Request for Proposal Submission Document.
1.3 Procurement Timetable The dates provided in the procurement timetable on the RFP cover sheet are provided for informational and planning purposes; however, Iowa State (Prison) Industries reserves the right to change the dates. If Iowa State (Prison) Industries changes any of the deadlines for Vendor submissions, Iowa State (Prison) Industries will issue Addenda to the RFP. Bidders are advised to check the IPI website for such addenda postings.
1.4 Submission of Bid Proposals Iowa State (Prison) Industries must receive the Bid Proposal at the Purchasing Agent’s and Supervisor’s addresses identified on the RFP Cover Sheet before or on the bid proposal due date listed on the RFP cover sheet. This is a mandatory requirement and will not be waived by Iowa State (Prison) Industries. Electronic mail and faxed Bid Proposals will not be accepted.
Contractors must furnish all information necessary to evaluate the Bid Proposal. Bid proposals that fail to meet the mandatory requirements of the RFP may be disqualified. Verbal information provided by the Contractor shall not be considered part of the Contractor's Bid Proposal unless it is reduced to writing.
If a Contractor proposes more than one method of meeting these requirements, each shall be labeled and submitted separately. Each will be evaluated separately.
The costs of preparation and delivery of the Bid are solely the responsibility of the contractor.
All bids shall become the property of ISI and shall not be returned.
1.5 Bid Proposal Opening Iowa State (Prison) Industries will open Bid Proposals after the deadline for submission of Bid Proposals has passed. The Bid Proposals will remain confidential until the Evaluation Committee has reviewed all of the Bid Proposals submitted in response to this RFP and Iowa State (Prison) Industries has announced a notice of intent to award a contract. See Iowa Code Section 72.3. The names of Contractors who submitted timely Bid Proposals will be publicly available after the Bid Proposal opening. The announcement of Contractors who timely submitted Bid Proposals

does not mean that an individual Bid Proposal has been deemed technically compliant or accepted for evaluation.
1.6 Rejection of Bid Proposals Iowa State (Prison) Industries reserves the right to reject any or all Bid Proposals, in whole and in part, received in response to this RFP at any time prior to the execution of a written contract. Issuance of this RFP in no way constitutes a commitment by Iowa State (Prison) Industries to award a contract.
1.7 Acceptance of Terms and Conditions The Contractor shall specifically agree that the Bid Proposal is predicated upon the acceptance of all terms and conditions stated in the RFP. If the Contractor objects to any term or condition, the Contractor must specifically refer to the RFP page, and section. Objections or responses that materially alter the RFP may be deemed non-responsive and disqualify the Contractor.
1.8 Certification Letter The Contractor shall sign and submit with the Bid Proposal the document included as Attachment #1 (Certification Letter) in which the Contractor shall make the certifications included in Attachment #1.
1.9 Authorization to Release Information The Contractor shall sign and submit with the Bid Proposal the document included as Attachment #2 (Authorization to Release Information Letter) in which the Contractor authorizes the release of information to Iowa State (Prison) Industries.
1.10 Firm Bid Proposal Terms By submitting a response to this RFP the Contractor guarantees the availability of the goods and/or services offered and that all Bid Proposal terms, including price, will remain firm a minimum of 120 days following the deadline for submitting Bid Proposals.
SECTION 2 SPECIFICATIONS AND TECHNICAL REQUIREMENTS
2.1 Purpose The purpose of this Request for Proposal is to secure competitive bids for the furnishing of Green Seal Certified concentrates for cleaning chemicals to Iowa State Industries Housekeeping/Chemical Division, 300 Elm Avenue SW, Mitchellville, IA 50169.
2.2 Scope This bid covers the requirements for concentrated cleaning chemicals for Iowa State Industries for a period of one year subject to renewal for four one-year periods upon mutual agreement. New products and equipment may be added as they become available upon mutual agreement and will be considered to be a part of this contract. Samples of the proposed new products shall be available to Iowa State Industries for testing at no charge.
2.3 General All bidders must provide: 2.3.1 Directions for the manufacture of the concentrates to finished products. 2.3.2 Products names and specifications for concentrates and the finished products.

2.3.3 Product use sheet, recommended dilution rates with exact quantities to be realized and instructions on how to use, etc. for the products listed. 2.3.4 Original SDS sheets for all items. 2.3.5 Master SDS sheets with NFPA coding for the finished products for which the contractor supplies concentrates. 2.3.6 Literature and/or label copy for the finished products for which contractor supplies concentrates. These copies shall serve as a template for Iowa State Industries to use in printing their own 2.3.7 literature and/or labels. 2.3.7 IPI is requesting the option to private label products using the Iowa Prison Industries logo and labeling. IPI is requesting bidder propose in writing their recommendation and program for private labeling of products under the IPI logo. 2.3.8 Documentation in writing of what type of support can be provided by vendor. Such as in person onsite, website, flyers, samples and what kind of support dispensing products is required. 2.3.9 Documentation of their company organization detailing subsidiaries which may be responsible for supplying product and/or equipment to Iowa State Industries. 2.3.10 List of equipment available for dispensing or proportioning each of the products included in this bid. Must include part number, description, product with which it would be used, and cost. If product being bid is NOT compatible with the existing equipment, must be willing to furnish replacement equipment at no charge in all facilities.
2.4 Specifications/Products See attached SDS for each product listed. The specifications furnished with this invitation to bid referencing brand names are not intended to be restrictive but for the purpose of describing and establishing general quality levels. Bids will be considered for any brand, which meets or exceeds the quality of the specifications. All brands bid must be listed with specifications and descriptive literature provided.
2.5 Quantities Contract is to cover actual requirements of Iowa State Industries for the life of the contract whether the total of such requirements is more or less than the quantities shown. Purchase orders will be issued on an "as needed" basis.
See attached price sheet showing estimated annual usage requirements. Iowa State Industries does not obligate itself to purchase the full quantities listed. The requirements may be less or may exceed the quantities shown and the successful bidder shall be required to furnish all requirements as shown on purchase orders throughout the contract period.
2.6 Pricing/Minimum Shipments The price quoted shall be for each item individually in the unit specified. This price shall be firm for the initial contract period. Bidders are asked to quote FOB Delivered.
Please specify minimum order requirements, if any. Preferences may be given to vendors with lower minimum quantities.
2.7 Delivery All merchandise shall be delivered within 10 working days or less after contractor’s receipt of order. Deliveries shall be made to: Iowa State Prison Industries Housekeeping/Chemical Division 406 N High Street

Receiving Hours: 7:00 a.m. – 2:30 p.m. Trucks must be unloaded before 2:30 p.m. Monday through Friday, except holidays 2.8 Samples/Testing Samples shall be made available for testing purposes at no charge to Iowa State Industries upon request. These samples shall be available to ship within 48 hours of request by the ISI Office of Purchasing. Vendor may be required to pay for such testing if product does not meet specifications.
2.9 Safety Data Sheets/Labels/Product Data Sheets Original material safety data sheets for both concentrated and finished products will be furnished complete with NFPA coding. NFPA coding information is only required for finished product items. When those products are determined, a company representative will need to make the correct information available. Bidder shall include a label and original product data sheet for each product with the bid. Successful bidder will be required to develop finished product material safety data sheets on the standard IPI form for all products that are formulated using their raw materials. Original material safety data sheets and original product data sheets will be supplied at no charge. Spanish version may be requested as need arises. These are necessary to use for marketing purposes.
2.10 Qualification of Bidder Bids will not be considered unless the firm submitting the bid can meet the following: A. That it has in operation a factory adequate for and devoted to the manufacture of the commodity it proposes to supply. In the event a bid is submitted by other than the manufacturer, a certificate executed by the manufacturer may be required stating that the bidder is an authorized agent of the manufacturer and that the product offered is completely in compliance with the conditions specified herein. B. That it regularly employs technically trained service personnel to provide adequate coverage of all State operations. C. That it has sufficient inventory capacity to meet the delivery requirements herein. D. Each product and dispensing system shall have been nationally marketed and sold successfully for a minimum of one year prior to bid opening. Proof of this may be required of the successful bidder. E. Bidder shall certify that all products are thoroughly tested to assure that they meet all applicable Federal Standards of performance, health, safety and formulation.
2.11 Vendor Responsibilities A. The successful bidder shall provide product and equipment training for Iowa State Industries’ personnel as required in the area of product knowledge, sales presentations and product demonstrations. Contractor shall have sales representatives available throughout the state to assist in joint calls on potential customers, in addition to service as detailed below. Bidders shall supply list of Iowa service representatives and their respective territories.
B. The successful bidder shall provide adequate certified staff and a fully equipped technical service laboratory capable of performing needed tests and providing both telephone and on- site assistance as needed. Batch testing will be provided with test results to be faxed to Iowa State Industries within two (2) working days after receipt of sample. Contractor shall have personnel available to train production personnel in the areas of product knowledge, product processes and quality controls requirements as determined by Iowa State Industries.

C. Successful bidder will be expected to provide Iowa State Industries with samples upon request for use as promotional handouts at various trade shows.
D. If product is EPA approved, vendor shall provide Iowa State Industries with authorization to distribute product within Federal guidelines and assistance to complete necessary forms.
E. Vendor shall not compete against Iowa State Industries in customer’s marketplace. Said marketplace is tax supported and non-profit agencies. Evidence of competition may be considered breach of contract and be cause for cancellation of same. Vendor must submit listing of their current customers and contact persons in the state of Iowa who meet this criteria. Include name, address, and telephone and fax numbers.
F. Successful vendor must have personnel available and trained to install and service equipment in adult correctional facilities.
G. Vendor will be responsible to assign one person to receive all purchase orders and handle customer service calls from Iowa State Industries.
H. Vendor must notify ISI 90 days in advance of any changes to existing contract to include but not limited to packaging variations and dilution ratios, discontinued products or substitutions.
I. Vendor shall advise manufacturer of product being bid.
J. Product shall have been nationally marketed and sold successfully for a minimum of two years prior to bid opening. Proof of this may be required of the successful bidder.
K. Iowa State Industries may be allowed to link to the contractor’s web site for additional support to end users as determined by Iowa State Industries and contractor.
2.12 Preparation for Delivery A. Packaging –All packing shall be adequate to protect contents from damage.
B. Container Size – Products shall be available in gallons, pails, drums, totes and bulk as noted on product listing. State container sizes available for each product, if different from sizes stated on product listing.
C. Marking - Shipping containers shall be marked to show contents, name of vendor, and precautionary labeling requirements.
2.13 Reservations/Method of Award All products must meet specifications listed on this bid. Non-compliance to these terms may be cause for termination.
Iowa State Industries reserves the prerogative to issue a separate Request for Proposal for cleaning chemicals differing from those specified herein during the contract period when it is discerned to be to the advantage of Iowa State Industries.
Iowa State Industries will evaluate all bid responses in the product groupings identified in Paragraph 2.2 Scope.

Iowa State Industries reserves the right to waive minor technicalities, irregularities, accept or reject any or all bids and to accept the bid which Iowa State Industries deems to be in the best interest of the State.
Award will be based on: 1. Price 2. Specifications 3. Availability of all products/equipment 4. Ability to meet all criteria detailed in this Invitation for Bid. 5. Minimal amount of disruption to current customers (state facilities). 6. Minimum order quantity.
Iowa State Industries reserves the right to issue this contract solely to one vendor, to split the contract or to issue multiple contracts whichever is in the best interest of Iowa State Industries.
It may be required that Iowa State Industries will issue more than one contract for a one year transition period to allow for testing and research of products to assure equality to all current products being used. At the conclusion of the one year period if it has been determined that the products do not meet the specifications detailed in this bid, Iowa State Industries has the right to cancel such contract and to re-evaluate the bids originally submitted herewith.
2.14 CANCELLATION/LIQUIDATED DAMAGES Failure to comply with all requirements, inclusions and terms and conditions of this bid may result in rejection of such bids. In the event a vendor fails to perform in good faith, or in accordance with the terms of this contract, and cannot furnish good and sufficient cause for this failure to perform, their contract shall be terminated and Iowa State Industries will take the necessary action to recover any damage to the State from the defaulting vendor. Vendor may also be subject to payment of liquidated damages for failure to comply with the terms and conditions of this contract. Written notice shall be given to the vendor stating complete cause for termination action. Circumstances such as strikes and/or fire over which the vendor has no control will not be considered sufficient cause for termination.
2.15 Overview The successful Contractor shall provide the goods and/or services to Iowa State (Prison) Industries and to Buyers issuing Purchase Instruments against the Resulting Contract in accordance with the technical specifications defined on the specification/technical data sheet or on the RFP Price Sheet included in this bid package. Bid Proposals must identify any deviations from the requirements of this RFP or requirements the Contractor cannot satisfy. Any deviations from the requirements of Section 2 or any requirement of other Sections that the Contractor cannot satisfy may disqualify the Contractor.
There are two types of requirements addressed in these specifications: . Mandatory Requirements: A successful Contractor must be able to satisfy all these requirements to be deemed a Responsible Contractor. . Scored Technical Requirements: Proposals which pass the Mandatory Requirements review will be reviewed by the evaluation committee and scored in accordance with the evaluation criteria. Compliance with the Scored Technical Requirements is also mandatory. The successful Contractor shall be obligated to provide all goods and/or services specified in this Section.

2.16 Mandatory Requirements: 1. RFP must be sealed and received on or before the due date stated. 2. Price Sheet(s) must be fully completed and signed. 3. Certification Letter (Attachment #1) must be completed and signed. 4. Authorization to Release Information Letter (Attachment #2) must be completed and signed. 3. Compliance with Scored Technical Requirements.
2.17 Scored Technical Requirements All items listed below are mandatory Scored Technical Requirements. They will be evaluated and scored by the evaluation committee. 3. Unless otherwise required by law, the information found in the Bid Proposal has not been knowingly disclosed and will not be knowingly disclosed prior to the award of the contract, directly or indirectly, to any other Contractor.

Certification Regarding Registration, Collection, and Remission of Sales and Use Tax
7. Pursuant to Iowa Code sections 423.2(10) & 423.5(8) (2005 Code Supp.) a retailer in Iowa or a retailer maintaining a business in Iowa that enters into a contract with a state agency must register, collect, and remit Iowa sales tax and Iowa use tax levied under Iowa Code chapter 423 on all sales of tangible personal property and enumerated services. The Act also requires Contractors to certify their compliance with sales tax registration, collection, and remission requirements and provides potential consequences if the certification is false or fraudulent.
By submitting a Bid Proposal in response to Iowa State (Prison) Industries Request for Proposal # 105 for Green Seal Certified concentrates for cleaning chemicals, the undersigned certifies the following: (check the applicable box)

Dear Ms. Reck:
______hereby authorizes Iowa State (Prison) Industries or a member of the Evaluation Committee to obtain information regarding its performance on other contracts, agreements or other business arrangements, its business reputation, and any other matter pertinent to evaluation and the selection of a successful Contractor in response to Request for Proposal #105.
The Contractor acknowledges that it may not agree with the information and opinions given by such person or entity in response to a reference request. The Contractor acknowledges that the information and opinions given by such person or entity may hurt its chances to receive contract awards from Iowa State (Prison) Industries or may otherwise hurt its reputation or operations. The Contractor is willing to take that risk.
The Contractor hereby releases, acquits and forever discharges the State of Iowa, Iowa State (Prison) Industries, their officers, directors, employees and agents from any and all liability whatsoever, including all claims, demands and causes of action of every nature and kind affecting the undersigned that it may have or ever claim to have relating to information, data, opinions, and references obtained by Iowa State (Prison) Industries or the Evaluation Committee in the evaluation and selection of a successful Contractor in response to Request for Proposal #105.
The Contractor authorizes representatives of Iowa State (Prison) Industries or the Evaluation Committee to contact any and all of the persons, entities, and references which are, directly or indirectly, listed, submitted, or referenced in the undersigned's Bid Proposal submitted in response to Request for Proposal #105.
The Contractor further authorizes any and all persons, entities to provide information, data, and opinions with regard to the undersigned's performance under any contract, agreement, or other business arrangement, the undersigned's ability to perform, the undersigned’s business reputation, and any other matter pertinent to the evaluation of the undersigned. The undersigned hereby releases, acquits and forever discharges any such person or entity and their officers, directors, employees and agents from any and all liability whatsoever, including all claims, demands and causes of action of every nature and kind affecting the undersigned that it may have or ever claim to have relating to information, data, opinions, and references supplied to Iowa State (Prison) Industries or the Evaluation Committee in the evaluation and selection of a successful Contractor in response to Request for Proposal #105.
A photocopy or facsimile of this signed Authorization is as valid as an original.
